CHC Minutes-2022-02-22 MINUTES FEBRUARY 22, 2022 SAN JUAN CAPISTRANO CULTURAL HERITAGE COMMISSION REGULAR AND TELEPHONIC CONFERENCE MEETING ORGANIZATION: Chair Siegel called the Adjourned Regular and Telephonic Conference Meeting of February 22, 2022, of the Cultural Heritage Commission of the City of San Juan Capistrano to order at 4:30 p.m. ROLL CALL: CULTURAL HERITAGE COMMISSIONERS PRESENT: Commissioners Jan Siegel, Ann Ronan, Anna Dickinson, and Lorie Porter. COMMISSIONER ABSENT: Paul Lopez. STAFF PRESENT: Sergio Klotz, Assistant Development Services Director Agenda items are presented in the originally agendized format for the benefit of the minutes reader but were not necessarily heard in that order. PLEDGE OF ALLEGIANCE: Commissioner Siegel led the Pledge of Allegiance. ORAL COMMUNICATIONS: None. CONSENT CALENDAR: Commission Action: Moved by Commissioner Dickinson, seconded by Commissioner Ronan, to approve the consent calendar Items C1 & C2 by a 4-0 vote. C1. MOTION FINDING THAT CONDUCTING TELEPHONIC/VIRTUAL MEETINGS FOR THE REGULAR OPEN SESSION MEETING AS ALLOWED PER ASSEMBLY BILL 361, PROMOTES SOCIAL DISTANCING DURING THE COVID-19 PANDEMIC. C2. Accessory Use Permit (AUP) 21-001, The Tea House on Los Rios; A request to allow an existing eating establishment (The Tea House) to serve distilled spirits, in addition to the current service of beer and wine, with food service (a Type 47 Alcoholic Beverage Control license) until 10:00 pm seven days a week located at 31731 Los Rios Street (APN 121-143-15 & 16) (Applicant: Phillip Schwartze, PRS Group) (Project Manager: Sergio Klotz). Sergio Klotz provided the staff presentation and responded to questions. Phillip Schwartze, applicant, provided presentation and responded to questions. Chair Siegel opened the public hearing and David Hutchins, Iraj Douraghi, Steven Rios provided public testimony. Commission Action: COMMISSIONER Dickinson Commission made a motion, to adopt a resolution recommending that the City Council approve Accessory Use Permit (AUP) 21-001, to allow the service of distilled spirits and the expansion of the Applicant’s current alcohol service hours until 10:00 p.m. There was no second and the motion failed. Commission Action: COMMISSIONER Ronan made a motion, seconded by COMMISSIONER Porter, to adopt a resolution recommending that the City Council approve Accessory Use Permit (AUP) 21-001, to allow the service of distilled spirits but with no expansion of the Applicant’s current alcohol service hours. Commission Action: COMMISSIONER Ronan made a motion, seconded by COMMISSIONER Porter, t o adopt a resolution recommending that the City Council deny Accessory Use Permit (AUP) 21-002, to allow the expansion of the Applicant’s current alcohol service hours. Consideration to Recognize May 2022 as National Historic Preservation Month (Project Manager: Sergio Klotz). Commission Action: COMMISSIONER Dickinson made a motion, seconded by COMMISSIONER Ronan, t o adopt a resolution recommending that the City Council issue proclamation recognizing May 2022 as National Historic Preservation Month. The motion passed by a 4-0 vote. ROLL CALL: AYES: COMMISSIONER: Siegel, Ronan, Dickinson, and Porter. NOES: COMMISSIONER: None RECUSED: COMMISSIONER: None ABSTAINED: COMMISSIONER: None UNFINISHED BUSINESS: 1. Continued verbal discussion to consider related programs during preservation month in 2022 and to consider forming an Ad Hoc Committee. Cultural Heritage Commissioners provided comments and feedback regarding preservation month, activities/events, fundraising and outreach. It was agreed to continue the discussion to the next regularly scheduled meeting.
