REGULAR MEETING TELEPHONIC/VIDEO CONFERENCE MEETING ORGANIZATION:
Chair Taylor called the Regular and Telephonic Conference Meeting of May 11, 2021, of
the Planning Commission of the City of San Juan Capistrano to order at 6:35 p.m.
ROLL CALL:
PLANNING COMMISSIONERS PRESENT: Commissioners Stan Braden, Darren Fancher, Matt Gaffney, Harrison Taylor, and Tami Wilhelm.
COMMISSIONER ABSENT: None.
STAFF PRESENT: Joel Rojas, Development Services Director

D1. Consideration of Whether to Change the Date and Start Time of Regularly Scheduled Planning Commission Meetings (Planning Commission). Commission Action: Moved by Commissioner Wilhelm, seconded by Commissioner Braden, to direct staff to bring amended Planning Commission
Bylaws to the May 25, 2021 meeting, to change Planning Commission meetings
to the second and fourth Wednesday with a 5:00 p.m. start time for regular meetings, and such amendments to take effect beginning on the second meeting in June. The motion passed by a 5-0 vote.

None. PUBLIC HEARINGS: F1. Continued Consideration of Code Amendment No. 20-002, Los Rios Specific Plan Amendment: A request to amend the Los Rios Specific Plan (SP78-01), which is generally bounded by Los Rios Street, Del Obispo Street, Paseo Adelanto and Mission Street, has a General Plan Land Use Designation of
Specific Plan/Precise Plan and Zoning of Los Rios Specific Plan/SP 78-01, to
allow expanded and new alcoholic beverage sales within the Historic Residential (HR) district via an accessory use permit (AUP)(Applicant: Phillip Schwartze, PRS Group)(Project Manager: Sergio Klotz, Assistant Director).
Sergio Klotz, Assistant Director, provided the staff presentation and responded to
questions. Phillip Schwartz, applicant, provided a presentation and responded to Commissioner questions.
Chair Taylor opened the public hearing, and David Hutchins, John Taylor, Steven Rios, Damian Orozco, Chuck Krolikowski, Julianna Danson, and Monica Mukai provided public testimony.
Commission Action: COMMISSIONER Wilhelm made a motion, seconded by
COMMISSIONER Gaffney, to recommend that the City Council adopt Code Amendment 20-002 as presented by staff with the following restrictions:

• Allow no more than two AUPs to be approved and establish alcohol service hours that vary by the day of the week and the time of year.
• Restrict alcohol service to the following hours:
o Summer Season (June to September)
Weekends (Friday and Saturday): 9 a.m. to 9 p.m.
Weekdays (Sunday to Thursday): 8 a.m. to 7 p.m. o Non-summer Season (October to May)
Weekends (Friday and Saturday): 9 a.m. to 7 p.m.
Weekdays (Sunday to Thursday): 8 a.m. to 5 p.m.
• Clarify that short-term rentals are prohibited in the Historic Residential District. The motion passed by a 5-0 vote.
