PC Minutes-2021-11-10 MINUTES November 10, 2021 SAN JUAN CAPISTRANO PLANNING COMMISSION REGULAR MEETING TELEPHONIC/VIDEO CONFERENCE MEETING Assembly Bill 361 allows for this meeting to be conducted by teleconference ORGANIZATION: Chair Taylor called the Regular and Telephonic Conference Meeting of November 10, 2021, of the Planning Commission of the City of San Juan Capistrano to order at 5:01 p.m. ROLL CALL: PLANNING COMMISSIONERS PRESENT: Commissioners Stan Braden, Darren Fancher, Harrison Taylor, and Tami Wilhelm. COMMISSIONER ABSENT: None. STAFF PRESENT: Sergio Klotz, Assistant Development Services Director Laura Stokes, Housing Supervisor/Associate Planner STAFF ATTENDING BY TELEPHONE: Joel Rojas, Development Services Director Jane Abzug, Deputy City Attorney Agenda items are presented in the originally agendized format for the benefit of the minutes’ reader but were not necessarily heard in that order. CONSENT CALENDAR: Commission Action: Moved by Commissioner Wilhelm, seconded by Commissioner Braden, to approve consent calendar items C1 and C2 by a 4-0 vote (Commissioner Gaffney abstained from Item C2). C1. Motion Finding that Conducting Telephonic/Virtual Meetings for the Regular Open Session Meetings as Allowed Per Assembly Bill 361, Promotes Social Distancing During the COVID-19 Pandemic. Conditional Use Permit (CUP) 20-001, Architectural Control (AC) 21-022, and Grading Plan Modification (GPM) 21-023, San Juan Capistrano Montessori & STEAM; A request to allow for the establishment of a private educational use within an existing building, an accessory playground within the existing rear parking lot, modification to an existing retaining wall to establish an outdoor area at the front of the property, and minor modifications to the building paint, windows, and doors for property located at 31442 El Horno Street (Applicant: Stacey & Ray Constantian)(Project Manager: Laura Stokes). Laura Stokes, provided the staff presentation and responded to questions. Stacey and Ray Constantian, applicant, provided a presentation and responded to questions. Chair Harrison opened the public meeting and Susan Grover provided public testimony. Commission Action: COMMISSIONER Wilhelm made a motion, seconded by COMMISSIONER Braden, to adopt a resolution conditionally approving the proposed preschool use and modifications to the existing building and site through Conditional Use Permit (CUP) 20-001 and Architectural Control (AC) 21-022. NOES: COMMISSIONER: None RECUSED: COMMISSIONER: None ABSTAINED: COMMISSIONER: None Planning Commission Action Minutes 3 November 10, 2021 Commission Action: COMMISSIONER Wilhelm made a motion, seconded by COMMISSIONER Braden to adopt a resolution conditionally approving the proposed preschool use, modifications to the existing retaining wall through Grading Plan Modification (GPM) 21-023 with the following additional condition: K. Applicant shall consult with City Staff and the Orange County Fire Authority to determine if the proposed stairway from El Horno Street to the patio can be eliminated and replaced with a low semi-circular patio wall.
