1990-0312_BENTZ, DAVID P_Employment Agreement0 i EMPLOYMENT AGREEMENT THIS EMPLOYMENT AGREEMENT is made by and between THE CITY OF SAN JUAN CAPISTRANO, hereafter referred to as "City", and DAVID P. BENTZ, hereafter referred to as "Employee". Whereas, City has offered Employee the position of Director of Administrative Services for the City of San Juan Capistrano; and Whereas, Employees desires to accept said position, NOW, THEREFORE, BE IT MUTUALLY RESOLVED between City and Employee as follows: 1. City hereby offers the position of Director of Administrative Services to Employee and Employee hereby accepts said position. The initial starting salary shall be $5,250.00 per month for the first six months, and thereafter increased in the seventh month to $5,432.00 per month (the 5th step of the existing salary range for this position). 2. City shall pay to employee an automobile allowance of $226.00 per month. 3. Employee agrees to relocate his residence to the City of San Juan Capistrano between the sixth and eighth months of employment. Upon relocation, City will pay to Employee relocation assistance consisting of: (a) Actual moving expenses of up to a maximum of $6,000. (b) Closing costs of a home purchase, that is, normal escrow costs paid by buyer and loan points, up to a maximum limit of $10,000. 4. Employee shall receive 30 days per year of annual comprehensive leave for each year of employment. Employee shall not have the right to cash out any of the accumulated annual leave unless Employee retires from City employment by filing a formal retirement application with the retirement system. The comprehensive annual leave provided herein is intended to substitute for the normal vacation, sick leave, and executive leave which are identified in the City's personnel rules and regulations for classified employees. 5. Employee will serve as an at will employee, that is, Employee may be terminated without cause. At any time after Employee's sixth month of service, and Employee has relocated his residence to San Juan Capistrano, City will provide Employee a severance benefit equal to three (3) full months of Employee's salary. 6. City will make the full contribution, that is, both the employer and employee shares, to the Orange County Employees Retirement System. 0 0 7. Employee will be allowed to continue as an independent contractor and with his personal resources and equipment, provided that such work does not interfere in any fashion with his duties performed on behalf of the City. On a monthly basis, Employee will provide the City with the names of his clients. 8. City will provide comprehensive family health care coverage including medical, vision, and dental coverages which City provides to its other employees. City will provide life insurance with a policy value of two times the annual salary paid to Employee by City. City will further provide long term disability to Employee in the same manner offered to other City employees. 9. This Agreement contains the enticement agreement between City and Employee. There are no other representations, agreements, arrangements, or understandings, oral or written, between City and Employee hereto relating to the subject matter contained in this Agreement which have not been fully expressed herein.
