' IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS: ' FIRST. CONTRACT DOCUMENTS. The contract documents shall be considered to include the Notice Inviting Bids, the Instructions ' to Bidders, the Proposal, the Bid Bond, the Non -Collusion Affi- davit, the Designation of Sub -Contractors, the Contract which is prepared for execution by the City and the Contractor, plans, ' specifications and special provisions, contract bonds, resolu- tions adopted by the City Council pertaining to the work, in- surance policies and certificates, and any supplemental written agreements amending or extending the scope of the work originally ' contemplated that may be required to complete the work in a substantial and acceptable manner. SECOND. THE WORK. CONTRACTOR agrees to furnish all tools, ' labor, material, equipment, transportation, and supplies neces- sary to perform and complete in good and workmanlike manner the construction of modifications of the existing City Old Fire Station buildings and site in strict confor- mity with the Plans, Specifications and all other contract docu- ments, which documents are on file at the Office of the City Clerk, City Hall, 32400 Paseo Adelanto, San Juan Capistrano, ' California.. THIRD. PAYMENT. City agrees to pay, and CONTRACTOR agrees to accept, the lump sum adjusted for variations of quantities, at the prices designated in bid proposal at the time and in the manner set forth in the Specifications. -16- ' FOURTH. COMMENCEMENT AND COMPLETION OF THE WORK. CONTRACTOR agrees to begin and complete the work within the time specified in the Notice Inviting Bids. It is agreed that it would be im- practicable and extremely difficult to fix the actual amount of damages, and loss sustained by City, should CONTRACTOR fail to ' complete the work in the specified time; therefore, CONTRACTOR shall pay City, as liquidated damages, not in the nature of a ' penalty, one hundred dollars ($100) a day for each day delayed; provided that extensions of time with waiver of liquidated damages, may be granted as provided in the Specifications. ' FIFTH. PERFOF24ANCE BOND AND LABOR. AND MATERIAL BOND. Contractor agrees to furnish bonds guaranteeing the performance of this con- tract and guaranteeing payment of all labor and material used ' under this contract, as reauired by the laws of the State of Cali- fornia, on forms approved by City. The Performance Bond shall ' be for an amount of one hundred percent (100%) of the amount of this contract and shall be conditioned on full and complete per- formance of the contract, guaranteeing the work against faulty workmanship and materials for a period of one (1) year after com- pletion and acceptance. The Labor and Material Bond shall be for an amount of one hundred percent (1008) of the amount of this contract and shall be conditioned upon full payment of all Labor and Material entering into or incidential to the work covered by this contract. CONTRACTOR agrees to furnish the bonds on the forms found within the Specifications. SIXTH. GENERAL PREVAILING RATE OF PER DIEM WAGES. Pursuant to the Labor Code of the State of California, copies of the pre- vailing rate of per diem wages, as determined by the Director of the State Department of Industrial Relations, are on file in the office of the City Clerk, 32400 Paseo Adelanto, San Juan Capistrano, California, and are hereby incorporated and made a j -17- part hereof. CONTRACTOR agrees that he, or any SUB -CONTRACTOR under him, shall pay not less than the foregoing specified pre- vailing rates of wages to all workmen employed in the execution of the contract. ' SEVENTH. INSURANCE. CONTRACTOR agrees to carry Public Liability, Property Damage, and Workmen's Compensation Insurance in amounts ' as required by the Specifications. ' EIGHTH. COMPLIANCE WITH OTHER PROVISIONS OF LAW RELATIVE TO PUBLIC CONTRACTS. City is subject to the provisions of the Government Code and the Labor Code of the State of California. It is stipulated and agreed that all provisions of law applicable ' to public contracts are a part of this contract to the same ex- tent as though set forth herein and shall be complied with by CONTRACTOR. These include, but are not limited to, the stipula- tion that eight (8) hours labor constitute a legal day's work and CONTRACTOR shall, as a penalty to City, forfeit twenty-five dollars ($25) for each workman employed in the execution of the Contract by CONTRACTOR, or by any SUB -CONTRACTOR, for each calen- dar day during which such workman is required or permitted to work more than eight (8) hours in violation of the provisions of Article Three, Chapter One, Part Seven, Division 2, of the California Labor Code, except as permitted by law. Acceptance of Work: The following Resolution was adopted: RESOLUTION NO. 83-9-20-1, COMPLETION OF CONSTRUCTION MODIFICATIONS OF THE EXISTING CITY OLD FIRE STATION BUILDINGS AND SITE GABRIEL - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING WORK TO BE COMPLETED AS TO PLANS AND SPECIFICATIONS FOR THE CONSTRUCTION MODIFICATIONS OF THE EXISTING CITY OLD FIRE STATION BUILDINGS AND SITE (GABRIEL) The Resolution accepts the project as complete -and directs the City Clerk to forward the Notice of Completion to the County Recorder within 10 days. SITUATION• The modification and renovation work on the four buildings and site of the Old Fire Station for conversion to Recreation Department uses has been completed by the contractor, Gabriel Construction Company. This work is ready for acceptance by the City Council and recordation of a Notice of Completion with the County Recorder. COMMISSION/BOARD REVIEW RECOMMENDATION: Not applicable FINANCIAL CONSIDERATIONS: The work was completed for the original contract price of $124,990. There were no change orders. Twelve bids were received; the five lowest were as follows: Gabriel Construction $124,990 Hewett Developers $126,197 Freeman Construction $129,411 PME Construction $129,906 Flintstone Construction $134,480 After a through review by Staff of each proposal, all have been determined as complete and the contractors as satisfactory. Coordination with the County has indicated their approval of the proposed work. With the award of this contract, work is scheduled to commence in April and be completed by July. FINANCIAL CONSIDERATIONS Financial considerations for this project have been reduced due to other capital priorities. To accommodate this project moving forward, a reallocation utilizing several budgeted but presently inactive project funds will be necessitated. Coordina- tion with local organizations as well as the appropriate City Commissions has been an integral part of this ongoing process. Orange County General Services Agency (GSA) officials have been contacted and supplied with plans for their review. No substantive exterior changes are proposed. Major interior modifications to better utilize building space and provide for community programs will be undertaken. The original schedule anticipates project completion in June. To accommodate this time frame the contract should be awarded in March with construction to commence soon afterward. Staff intends to present the final plans to the Cultural Heritage Commission for their second review on February 24th. County approval is anticipated to be forthcoming soon. Following Council authorization the advertising for bids will commence. Plans and specifications are available for perusal in the office of the Director of Public Works. Construction activity and hours, roadway access, and street maintenance are detailed in the specifications to mitigate and assure limited interruptions of local residential routines. This recreation complex houses many recreation classes, senior citizen activities, the senior nutrition program, and the administrative offices of the Recreation Department. At the ceremonies, appreciation will be given to the County of Orange for leasing these facilities to the City and to Father Martin for the use of the Old Mission facilities for the nutrition meals program prior to their moving to the fire station. Appreciation will also be extended to the retired volunteer fire chiefs and their families who the buildings were named after. The following activities will be included in the celebration: 1:00-1:30 P.M. Lunch, provided by the Seniors Nutrition Program, will be served to dignitaries such as Orange County Supervisor Thomas Riley, the Mayor and City Council, and the Parks and Recreation Commission. 1:30-2:00 Ceremonies will be conducted in the parking lot area including: 1. Baker TLB:na 0 0 March 3, 1983 ADDENDUM TO SPECIFICATIONS OLD FIRE STATION RECREATION COMPLEX At the pre -job meeting of March 2, 1983, several comments arose concerning the project. Those comments are outlined below. SITE IMPROVEMENTS: The sawcutting and removal of concrete and asphalt and exterior demolition and removal, including the removal of the restroom building, will be done by the City. City forces will also remove the gas pumps and underground tanks, and will fill and compact the tank area to existing grade. Finish grade will be done by the Contractor as well as the removal of the iron fence and top courses of brick retaining wall at the driveway access ramp to E1 Horno Street. The Contractor shall also deliver and compact sand backfill for the ramp and remove soil wherever new concrete work is required. The Contractor shall also remove the existing exterior light standard (shown on Page 2 of the plans), at the southeast corner of the Activity/Hobby room.and deliver to the storage yard behind City Hall. On Sheet 3 of the plans, new curb along La Matanza shall be Orange County Standard Plan #201, Type D (include gutter). Interior curb shall remain 201-B1. Also, install a driveway apron per Orange County Standard Plan #210 (W-24 foot) at the entrance to the employee parking lot. The directory shown adjacent to the Meadows Building shall be supplied and installed by the City. The sign located at the new E1 Horno entrance shall be equivalent to those supplied to the City park sites by Imagineer- ing, Inc. of Capistrano Beach, California (493-9733). All landscape and irrigation work will be supplied by the City of San Juan Capistrano. The Contractor will coordinate with the City for smooth and efficient completion of the work. LACOUAGUE BUILDING: Existing tile flooring in dining room, kitchen, men's room, office and hall shall be removed and replaced as per the specifications on Page 30, H 1. In the kitchen, paint the entire wall receiving the new doorway; painting the entire kitchen is not necessary. Paint, carpet, and levlor colors were all selected per Merrell Paint, San Clemente, (714) 498-0900. Women's restroom floor shall also be per Specifications on Page 30. Wherever new tile is installed, remove existing baseboards and install comparable new baseboards. 0 0 ADDENDUM TO SPECIFICATIONS March 3, 1983 Page 2 Utility sinks in the Activity/Hobby room will be drained by a new 4 inch lateral connected to the sewer in La Matanza. Any cuts in the existing slab shall be repaired and finished as smooth as possible as the floor will remain uncovered concrete. Water lines to the utility sinks may be left exposed rather than recessed into the walls. MEADOWS BUILDING: Some doubt has arisen as to whether the interior can be sandblasted to remove the varnish and leave a suitable interior finish. The City will allow other refinishing methods, such as liquid sandpaper, etc. Please include a note in your bid as to the type of refinishing proposed. NYDEGGER BUILDING: Due to the cost of removing space heaters from City Hall, it may be cost efficient to supply new heaters in lieu of the used heaters. Should you decide to supply new units, please indicate this in your bid. In addition, the heater roof vents at City Hall may remain, eliminating any roof patching. In lieu of the ten gallon gas water heater, install a ten gallon electric heater. EXTERIOR LIGHTING: It will be necessary to bore under the curbed planters in front (east) of the Lacouague Building. The person submitting such a re- quest shall be responsible for its prompt delivery. In the event that the Engineer receives such a request and it should be found that certain essential information is not clearly and fully set forth, or if the Engineer discovers errors, CIM ' omissions, or points requiring clarification in the drawings or documents, a written addendum will be mailed to each person to ' whom a set of contract documents has been delivered. The City will not be responsible for any instructions, explanations or interpretations of the documents presented to bidders in any ' manner other than written addendum. ' Addenda or Bulletins The effect of all addenda to the contract documents shall be considered in the bid and said addenda shall be made a part of the contract documents and shall be returned with them. SCOPE OF WORK TO BE DONE The work to be done consists of construction modifications of ' the existing City Old Fire Station buildings and site and other appurtenant work as shown and designated on the plans and defined in the specifications. ' 2. STANDARD SPECIFICATIONS ' The Contractor shall perform his work in accordance with the following: a) The Uniform Building Code, 1979 edition, as modified and ' adopted by the City of San Juan Capistrano, hereinafter referred to as the Building Code. ' b) The Standard Specifications for Public Works Construction, 1982 Edition, hereinafter referred to as the Standard Specifications. ' c) The Standard Plans, Orange County Environmental Management Agency, 1982 Edition, hereinafter referred to as the Standard Plans. The contractor shall maintain a copy of these books on the job ' site at all times. Unless otherwise specified, errata and supplements to the Standard Specifications, Standard Plans and Building Code shall be part of these specifications. Such payment shall be full compensation for the items of work and all work appurtenant thereto. The Contractor shall submit with his bid a detailed ' schedule in triplicate, to be used as basis for determining progress payments and as a basis for determining payment affected by change orders. This schedule shall equal in total the lump sum bid and shall be in such form and sufficiently detailed as to satisfy the Engineer that it correctly represents a reasonable apportionment of the lump SUM. TERMS DEFINED Whenever in the said standard specification the following terms are used, it is hereby provided that the following City departments or persons shall be intended: AGENCY shall mean City of San Juan Capistrano, wherever appropriate BOARD shall mean the City Council of the City of San Juan Capistrano ENGINEER shall mean City Engineer or other person(s) designated by same. 4. FLOW AND ACCEPTANCE OF WATER It is anticipated that storm, surface and ground or other waters may be encountered at various times and locations during the work herein contemplated. The Contractor, by submitting a bid, acknowledges that he has investigated the risk rising from such waters and has prepared his bid accordingly. It shall be the sole responsibility of the Contractor to protect his work from danger due to any waters encountered. Should any damage to the work due to surface or other water occur prior to acceptance of the work by the City, the Contractor shall repair such damage at his expense. -24- 5. INSURANCE AND OVERHEAD COSTS The Contractor shall receive no direct compensation for insurance and overhead (move -in costs for example) costs. ' Accordingly, these costs should be prorated to the appropriate bid items. 6. PROTECTION OF EXISTING UTILITIES 1 The Engineer has endeavored to show all existing utilities. The Contractor must, however, take all due precautionary measures to protect all of the existing utilities. 7. PROTECTION OF PRIVATE PROPERTY ' The Contractor must remain within the construction zone to the best of his ability. The Contractor must protect all existing private property. 8. HOURS OF WORK Hours of construction will be from 8:00 a.m. to 5:00 p.m. weekdays. VEHICULAR ACCESS AND PARKING ' Construction vehicles shall only utilize access to and from the job site by means of E1 Horno Street. Construction parking will be restricted to E1 Horno Street directly adjacent to the ' site and directly on the site. Additionally, the early construction of an access ramp (as designated in the plans and specifications) from E1 Horno Street to the site will be required. ' Prior to construction of the access ramp, access and on-site parking of construction vehicles via the existing La Matanza ' entrance will be permitted. Access, however, will not be permitted via Acjachema/La Matanza, and no parking will be allowed on La Matanza. 1 1 -25- • • ' LABOR AND MATERIAL SPECIFICATIONS ' A. Hours of Work ' All work shall be completed between the hours of 8:00 a.m. and 5:00 p.m. weekdays, subject to the holiday restrictions of the Municipal Code. If necessary, the Building Official ' may authorize some interior work on Saturdays. 3. Demolition ' All items indicated on the plans for removal shall be disposed of, salvaged or relocated as per approved plans. Items not relocated shall be removed from the job site. 4. Intention ' The intention of these documents is to include all labor, material, equipment and transportation necessary for complete and proper execution of the work. ' S. Changes The owner may order extra work or make changes by altering, adding to, or deducting from the work; the contract sum may be adjusted accordingly. ' 6. Clean-up All trades shall, at all times, keep the premises free from accumulation of work material or rubbish caused by their work. ' Final clean-up includes all cleaning, ready for occupancy. 8. General Notes ' These notes shall be used in conjunction with the plans, and any discrepancies shall be brought to the attention of the City Design Engineer. The contractor must check all dimensions ' and site conditions before starting work. Contractor is not responsible for work indicated on drawings as being performed by others, or not part of this contract. ■ -26- B. CONCRETE ' Furnish and place concrete as indicated on the on-site improvement plans. ' 1. Concrete shall be to the requirements of Section 201 of the standard specifications for Public Works construction. 2. Reinforcing steel shall be per ASTM -A-615 and shall be sized as shown on the drawings. 3. Concrete cost shall be included in the on-site improvement bid section, except for the air conditioner pad and water heater closet base, which shall be pre -fabricated concrete slabs. C. ROUGH AND FINISH CARPENTRY ' 1. Scope Building of the rough frame interior partitions, furnishing and installing all rough hardware, bolts, screws, nails, straps, anchors, etc., and furnish finish hardware as indicated on approved drawings. ' Install interior doors and trim, shelving, boarding, patching, removed and relocated areas and all building specialties, furnishing all material per drawings and code requirements of the UBC, Chapter 25, 1979 Edition, and the San Juan Capistrano Municipal Code. 2. Framing Materials (a) Sill plates shall be pressure -treated Douglas fir. ' (b) Horizontal framing, beams and headers (over 41 0") shall be construction grade Douglas fir No. 2. ' (c) Vertical framing shall be Douglas fir No. 2. (d) Joists shall be construction grade Douglas fir. ' (e) Metal connectors shall be Simpson strong ties. (f) Nails shall comply with Table 25-P of the UBC, 1979 Edition. (g) Glu -lam shall be Douglas fir 5-1/8" x 17-1/2" as per ' treating standard for structural timber framing AITC 109. Finish Materials (a) Workmanship ' All joints shall be tight, true and securely fastened. Corners shall be neatly mitered, butted and accurately scribed to fit adjoinging surfaces, with nails set, and shall be free to tool marks on finished surfaces. ' (b) Frames and Trims Frames shall be set true and plumb, rigidly secured, and protected during construction. Special care shall be ' taken in removing doors and trim for relocation as indicated on approved plans. ' (c) Interior Doors, Frames and Trim Material shall be kiln -dried. See Door Schedule on plans ' for type, size, material and finish. (d) Fitting and Hanging Doors Each door shall be accurately cut, trimmed, and fitted to its frame and hardware. Clearance from stiles, heads and locks shall not exceed 1/8 inch. Clearance at the bottom ' shall be adjusted for the finish floor schedule. Doors shall operate freely, with hardware properly adjusted. (e) Weather-stripping All exterior doors shall be weather-stripped with 3 -inch mortise type as manufactured by Zero Weather-stripping ' or equal, with aluminum thresholds. (f) Cabinets ' Furnish all cabinets and hardware as indicated on drawings. Finish cabinets shall meet the requirements of Southern ' California Association of Cabinet Manufacturers. Standard paint -grade cabinets, with formed Mar -lite tops as per drawing schedule. ' D. INSULATION 1. Scope ' Furnish all material and labor to install thermal insulation batts as per approved drawing locations. ' (a) Ceiling Use 5-1/2 inch R-19 batts with vapor barrier. (b) Walls Use 3-1/2 inch R-11 batts with vapor barrier. -28- (c) Sound Insulation Use 3-1/2 inch R-11 batts, between men's and women's bath ' in Lacouague Building. ' 2. Material Use Ownes Corning fiberglass batts or equal. ' E. DRYWALL 1. Scope ' Furnish all labor and material required to complete the work indicated on the approved plans. ' 2. Material All walls shall be 1/2 -inch thick regular wallboard. Toilet ' room requires 5/8 -inch thick green board wainscot four feet high. 3. Workmanship ' Nail and joint treatment shall be in accordance with the American Standard specification for gypsum wall board ' installations and finishes ASA No. A97. All joints in finished surface shall be taped, reinforced corners and finished with joint cement. ' 4. Finish Surfaces (a) Walls on new construction in Lacouague Building to be - smooth, all other shall be finished to match existing texture and finish. (b). Ceiling in Lacouague Lounge shall be finished with a simulated acoustic finish with integral color (white) as indicated on the drawings. ' F. ROOFING 1. Scope ' Provide all labor and materials to patch roofing and provide water -proofing as indicated on the approved drawings where vents, etc., are to be removed to match the existing roofing ' material and color coordinate to blend to a uniform patch. G. WOOD DOORS 1. Scope Furnish all labor and materials for all new doors as indicated ' on the approved drawings. All doors to be relocated shall be covered and protected, and natural finish preserved, sanded ' and re -varnished and fitted to prior specifications. -29- ' H. RESILIENT FLOORS 1. Scope ' Furnish all labor and material to install floor covering. New floor covering (marked on plans as linoleum) shall be Kentile ' "antique marble", K-44, solid vinyl tile, 12" x 12" x 1/8". I. PAINTING ' 1. Scope Provide painting and preparation of the surface with all labor ' and material as indicated on approved drawings. 2. Material and Colors ' All rooms shown to be painted, use Merrill's Paint "Kid Proof", #720, Nutria color or equal, at approval of design engineer. ' 3. Preparation of Surfaces All surfaces shall be clean, dry and in suitable condition for finishes as specified on drawings. (a) Cracks, holes, voids, etc., shall be filled and sanded smooth, or.textured to match existing surfaces. (b) Patched areas are to be sealed prior to paint applications. ' (c) Nydegger and Meadows Buildings may be sandblasted lightly to remove scaly, chipped and weathered existing paint finish. Special care must be taken when sandblasting the ' adobe brick, so as not to damage brick by deep penetration. Sandblast interior of Meadows Building to remove existing finish and provide for even refinishing. 4. Workmanship and Finish Paint finishes shall be cut sharply to line, uniformly applied, ' free of lap marks and protected from adjacent finishes. Mix and apply paint and other finish material in accordance with the manufacturers instructions. ' S. Interior and Exterior Paint Material ' (a) Exterior (1) First coat shall be a latex primer and sealer on new work and Meadows Building. Adobe brick will require ' a clear water seal prior to primer coat. (2) Second coat wall surfaces shall be an exterior grade ' alkyd -latex paint. Wood trim shall be a semi -gloss exterior enamel. (b) Interior (1) walls and ceiling shall be one coat latex primer and final coat as noted on plans. ■ -30- 0 (2) Toilet room finish coat shall be a semi -gloss enamel. ' (3) All paint grade, cabinets and trim shall be one coat primer and one coat semi -gloss. (4) Natural finish wood shall be stained, and varnished ' or spray -lacquered two coats. J. LATH AND PLASTER 1. Scope Exterior stucco lath and plaster only, shall comply to the applicable requirements of the UBC Chapter 47, 1979 Edition. Contractor shall supply all labor and material to complete the work indicated on the approved drawings. Plaster shall be ' applied with three coats (scratch, brown and finish color coat) to match the existing building. ' K. BUILDER'S SPECIALTIES 1. Toilet Compartments and Urinal Screen ' (a) Scope Install three toilet compartment stalls and a two -foot by t four -foot urinal screen as indicated on the approved drawings. The urinal screen shall match the existing men's toilet compartment partition. The women's toilet compart- ment color to be selected by the City. (b) Material ' Toilet compartments shall be the overhead braced, flush metal, baked enamel finish, manufactured by a firm regularly engaged in the fabrication of such units, constructed to the dimensions given on the approved drawings. ' The compartment partitions and pilasters shall be made of not lighter than 20 gauge furniture steel; the doors shall not be made of lighter than 22 gauge furniture steel. The partitions, pilasters and doors shall be made of two face plates, formed edges, sound -deadening insulated cores and bound with die -drawn moldings interlocking under tension. The compartment doors shall be hung on concealed gravity hinges with the upper hinge mounted in a recess in the edge ' of the door. Each door shall be fitted with standard chromium -plated hardware, including door latches. 2. Toilet Room Accessories ' Provide the labor and material to install the following items: ' (a) Three -toilet tissue dispensers, manufactured by Bobrick, Model No. B-6857 or equal. -31- ' (b) Three seat cover dispensers manufactured by Bobrick, Model No. B-221 or equal. ' (c) Three soap dispensers manufactured by Bobrick Model No. B-25 or equal. ' (d) Three mirrors, 24 inch x 36 inch, manufactured by Bobrick, Model No. B-292 or equal. (e) Three sanitary disposal containers to be provided and ' installed in each woman's compartment, manufactured by Bobrick, Model No, to be approved by the City. ' (f) Equip one stall in each bath for handicapped as per drawing and Title 24 regulations. ' 3. Laminated Wall Covering Wainscot (a) Scope Provide labor and material to install a four -foot high laminated wainscot in the women's toilet rooms and splices to the altered men's room existing laminated wall covering, ' matching the existing color as close as possible. (b) Material ' Laminated wall cover shall be pressure -laminated plastic (melamine) which meets or exceeds performance standards set by the National Electrical Manufacturers Association, ' NEMA LO 3-1975 for class I high pressure laminates as to resistance to wear, burns, stains and water, as well as ' dimensional changes, Material may be Textalite No. 1689 or equal installed in accordance with the manufacturers recommendations. ' L. PLUMBING 1. Scope Provide all labor and material to install the plumbing work as indicated and specified on the approved drawings in complete ' working order for all plumbing systems, hot and cold water, waste lines, trenching, excavation, concrete cutting and back- fill. Setting all fixtures new, and relocating fixtures shall be per drawings, with all the necessary trim. All work shall comply with the UPC, 1979 Edition. ' 2. Material (a) Water lines shall be rolled copper Type L below slab grade, Type M above grade - all new hot water lines shall be ' insulated in unheated areas. ' (b) Waste and vents shall be cast iron with no -hub fittings. (c) Gas piping shall be black iron piping and properly wrapped in imbedded areas. L -32- . • • ' 3. New Fixtures ' (a) Water closets shall be floor mounted tank type, manufactured by American Standard, complete with chromium trim - total of three fixtures. ' (c) Salvage sink from existing bath in Lacouague Building and reinstall in new woman's restroom; match two new sinks as close as possible. Provide all faucet and drain tail pieces, chromium plated. (d) Relocate urinals as per plan layout, complete with bell ' trim. 4. Workmanship ' Workmanship shall be of the best quality and competent mechanics skilled in their trade, shall be employed. -33- Rough -in shall be completed, tested and approved before closing ' in other work, and shall provide the necessary backing for securing fixtures. ' Provide cleanouts at the ends of all waste lines and where required by the UPC, 1979 Edition. ' Provide shut-off valves at each fixture and isolate all water piping from the framing members. ' M. HEATING 1. Scope ' Furnish all labor and material, equipment, transportation and services required to install completely and put in operation all new and relocated heating and cooling units as shown on ' the approved drawings. All work shall comply with the applicable local, state, and federal code requirements. 2. Guaranties Provide a one-year parts and labor warranty on the new heating and air conditioning unit in the Meadows Building. 3. Materials (a) Relocate two 80,000 BTU space heaters and Honeywell ' thermostats from City Hall and install with proper gas lines in the Nydegger Building. -33- (b) Meadows Building - install a 60,000 BTU Horizontal heater mounted in attic, Day & Night or equal coil and core ' Model 506-B030, condensate pan, condensate lines with Honeywell T8082 (or equal) night set back thermostat. Install one Day and Night condensing unit Model No. 569CJX03000 or equal on a precast concrete pad per drawings. ' Install all ducts, return air supply, room outlets, condensate lines, etc., as reauired for full standard installation. (c) Lacouague Building - Provide heat outlet with diffuser to new women's toilet room as shown on the approved drawings. N. ELECTRICAL t1. Scope Provide all labor, material, equipment and transportation to ' complete in proper working order, all electrical work as shown on all the approved drawings. 2. Material ' (a) General ' All material shall comply with the applicable codes, National Electrical Code, 1981 edition and adopted City ordinances. (b) Grounding All existing non -grounded convenience outlets shall be ' replaced with a grounded duplex outlet plug. Ground through existing conduit system. ' (c) wiring Methods All wiring for the project shall be run in metal raceways, ' supported and anchored in place in an approved manner. All wiring shall be concealed wherever possible. Exposed wiring shall be run in electrical metallic tubing or rigid conduit at right angles or parallel to the building construction, and shall be coordinated and approved by the City Inspector. Any failure to indicate the name and address of the con- struction lender on such application, however, shall not relieve any person from the obligation to give to the construction lender the notice required by this section. (J) Designation of mortgage, deed of trust or other Instrpment securing loan. A mortgage, deed of trust, or other instrument securing a loan, any of the proceeds of which may be used for the purpose of constructing Improve- ments on real property, shall bear the designation "Construction Trust Deed" prominently on its face and shall state all of the following: (1) the name and address of the lender, and the name and address of the owner of the real property described in the instrument, and (2) a legal description of the real property which secures the loan and, it known, the street address of the property. The failure to be so designated or to state any of the information required by this subdivision shall not affect the validity of any such mortgage, deed of trust, or other instrument. Failure to provide such information on such an instrument when recorded shall not relieve persons required to give preliminary notice under this section from such duty. The county recorder of the county in which such instrument is recorded shall indicate in the general index of the official records of the county that such instrument secures a construction loan. (k) Trust fund and lender; supplementary fringe benefits. Every contractor and subcontractor who is required pursuant to a collective-bargaining agree- ment to pay supplementary fringe benefits into an express trust fund described in Section 3111, and who has failed to do so shall cause to be given to such fund and to the construction lender, it any, or to the reputed construction lender, if any, not later than the date such payment due to such fund became delinquent, a written notice containing: (1) The name of the owner and the contractor. (2) A description of the jobsite sufficient for identification. (3) The identify and address of the express trust fund. (4) The total number of straight time and overtime hours on each such job, payment for which the contractor or subcontractor is delinquent to the express trust: (5) The amount then past due and owing. Failure to give such notice shall constitute grounds for disciplinary action by the Registrar of Contractors. (1) Contract; name and address of owner; Information to person seeking to serve notice. Every written contract entered into between a property owner and an original contractor shall provide space for the owner to enter his name and address of residence; and place of business if any. The original contrac- tor shall make available the name and address of residence of the owner to any person seeking to serve notice required by this section. §3097.1 Proof of service of preliminary 211 -day notice, proof of service afll- davit; receipt. Proof that the preliminary 20 -day notice required by Section 3097 was served in accordance with subdivision (f) of Section 3097 shall be made as follows: (a) If served by mail, by the proof of service affidavit described in subdivi- sion (c) of this section accompanied either by the return receipt of certified or registered mail, or by a photocopy of the record of delivery and receipt main- tained by the post office, showing the date of delivery and to whom delivered, or, in the event of nondelivery, by the returned envelope itself, (b) If served by personally delivering the notice to the person to be notified, or by leaving it at his address or place of business with some person in charge, by the proof of service affidavit described in subdivision (c). (c) A''proof of service affidavit'' is an affidavit of the person making the service, showing the time, place andmannerof service and facts showing that such service was made in accordance with Section 3097, Such affidavit shall show the name and address of the person upon whom a copy of the pre- liminary 20 -day notice was served, and, if appropriate, the title or capacity in which he was served. §3098. Preliminary 20 -day notice (public work), stop notice; service; dis- ciplinary action; exemption for express trust fund. "Preliminary 20 -day notice (public work), stop notice'' means a written notice from a claimant that was given prior to the filing of a stop notice on public work, and is required to be given under the following circumstances. (a) In any casein which the law of this state affords a right Ida person fur- nishing labor or materials for a public work who has not been paid therefor to file a stop notice with the public agency concerned, and thereby cause the withholding of payment from the contractor for the public work, any such person having no direct contractual relationship with the contractor, other than a person who performed actual labor for wages or an express trust fund described in Section 3111, may file such a notice, but no payment shall be withheld from any such contractor, pursuant to any such notice, unless such person has caused written notice to be given to such contractor, and the public agency concerned, not later than 20 days after the claimant has first furnished labor, services, equipment, or materials to the jobsite, stating with substantial accuracy a general description of labor, service, equipment, or materials furnished or to be furnished, and the name of the party to whom the same was furnished. Such notice shall be served by mailing the same by first-class mail, registered mail, or certified mail, postage prepaid, in an envelope addressed to the contractor at any place he maintains an office or conducts his business, or his residence, or by personal service. In case of any public works constructed by the Department of Public Works or the Department of General Services of the state, such notice shall be served by mailing in the same manner as above, addressed to the office of the disburs- ing officer of the department constructing the work, or by personal service upon such officer.
