Julian, City Manager FROM: Ronald C. Sievers, Director Public Lands and Facilities SUBJECT: 1991 Weed Abatement Program - Resolution, Notice of Completion and Final Report SITUATION The City of San Juan Capistrano annually conducts a Weed Abatement Program in accordance with City Ordinance No. 348. This ordinance requires that all properties not in compliance with the ordinance be cleared of noxious and hazardous weeds, debris and refuse by a City Contractor. The 1991 Weed Abatement Program has been completed and is ready for acceptance by the City Council and recordation of a Notice of Completion. Thirty days following this action, the 10% retention monies will be released. NOTIFICATION Ed Stewart Custom Weed Abatement 2157 Calle Ole Var-de San Clemente, CA 92672 COMMISSION/BOARD REVIEW, RECOMMENDATIONS Not applicable. FINANCIAL CONSIDERATIONS The contract was awarded to Ed Stewart Custom Weed Abatement for $31,411.55 and has been completed for $10,905.30. A total of 36 properties were abated this year (19 private, 13 City, 4 City CRA), compared to 88 properties in 1990. Efforts by staff, through an early notification process and increased overhead charges, have played a key role in reducing the number of properties requiring abatement by the City Contractor this year. City Council approval will result in the release of the 10% retention to the City Contractor in the amount of $1,090.53. ALTERNATE ACTIONS 1. Accept the completion of the 1991 Weed Abatement Program and authorize recording of the Notice of Completion. 2. Do not accept completion of the 1991 Weed Abatement Program. 3. Refer to staff for additional information. FOR CITY COUNCIL AGEND s AGENDA ITEM September 17, 199 Page Two RECOMMENDATION By resolution, determine that the work for the 1991 Weed Abatement Program has been completed and authorize staff to release the l0% retention, in the amount of $1,090.53, thirty days after the recording of the Notice of Completion. The bids received (which are good through April 5, 1991) were as follows: Ed Stewart Custom Weed Abatement $ 31,411.55 Landscape Systems $ 43,451.17 Edwin Webber, Inc. $ 75,119.69 Lambaren Contractors, Inc. $171,908.80 Proposals received were bid on a unit price basis for discing, mowing, handwork and trash clean-up. The final contractual estimate (as shown above) is based on the unit price bid by the contractor applied to the final quantities of the prior year's weed abatement program. Ed Stewart C.W.A. will be able to begin the abatement process in accordance with our proposed schedule. The 1991 Weed Abatement Program is anticipated to commence May 15, 1991, and will be completed by July, 1991. Julian, City Manager FROM: Ronald C. Sievers, Director Public Lands & Facilities SUBJECT: Review of Specifications and Authorization to Call for Bids - 1991 Weed and Rubbish Abatement Program SITUATION City Ordinance No. 348 provides for the annual abatement of weeds, garbage and refuse throughout the City. During April, inspections of all properties of the City are conducted. If a property appears to have a potential weed/debris problem, the owners are notified by letter. The owners are advised to clean their properties within 30 days. If the property is not cleared of weeds, etc., a private contractor, who is awarded the contract by the City Council, will clear the property under the direction of the City Enforcement Officer. Prior to the actual start of work, a list of all properties identified will be reviewed by the City Manager's Office and/or the Community Redevelopment Agency for any possible conflict with historical or archaeological concerns. Any properties identified which do have historical or archaeological conflicts will be abated under the direction or supervision of a representative of the archaeological consultants retained by the City. Discing, mowing and handwork charges are assessed by the acre and the square foot. These charges, along with an administrative charge, are added to the owner's property tax bill. The administrative charge covers the cost for the inspector's time, computer time, printing, mailing costs and all other expenditures associated with the Weed Abatement Program. The total dollar amount for the 1990 Weed Abatement Assessments was $26,945.27. Now is the time to solicit new proposals for this service. Every year, the physical characteristics of the City change somewhat, as does the type of work needed to abate weeds. Areas once disced by tractor may now have to be mowed, edged or handworked. Each year, the City solicits new proposals that reflect these changes. This insures that the City obtains the best and most economical contract for its citizens. To implement a new agreement before the 1991 program commences, it is necessary at this time to review the specifications so that advertising for new bids may begin. FOR CITY COUNCIL AGEND A) / 0 AGENDA ITEM November 20, 1990 Page 2 N/A COMMISSION/BOARD REVIEW. RECOMMENDATIONS Not Applicable FINANCIAL CONSIDERATIONS i All costs associated with private property abatements will be assessed the individual landowners, including an administrative charge. The 1990 Weed Abatement Program assessed 71 properties, for a total of $26,945.27. These assessments were submitted to the Orange County Auditor -Controller for inclusion on the property tax roll. ALTERNATE ACTIONS 1. Approve the specifications for the 1991 Weed and Rubbish Abatement Program and authorize advertising for bids. 2. Do not authorize the advertising for bids. 3. Request additional information from Staff. ------------------------------------------------------------------ ------------------------------------------------------------------ By motion, approve the specifications for the 1991 Weed and Rubbish Abatement Program and authorize the advertising for bids. Actual Notices to,2Abate will ''be mailed in mid-April`. Contractor bids have been received and an,award of contract will be made at the City Council•"meeting of March 5, 1991. Mr. Sievers indicated that 950 letters had been mailed in January to residentswho may have a potential weed abatement problem. These letters were sent in an effort to give, citizens early notification of the program, suchithat they will.haVe ample time to plan ahead. ;Citizens have theioption of performing their own abatement, hiring an outside contractor, or notifying the City that they wish totb&V`e the work done byxthe City Contractor. As costs for work performed by the City Contractor, as well as City administrative charges, are expected to increase this year, citizens are encouraged to perform their own abatement or to hire an outside contractor. A list of contractors who perform weed abatement (neither endorsed nor recommended by the City) is available for citizen convenience. Questions regarding the upcoming Weed Abatement Program may be directed to the Department of Public Lands and Facilities, Monday thru Friday, 8:00-5:00 p.m., at 714/493-1171, Ext 295. 32400 Paseo Adelanto San Juan Capistrano CA 92675 0 E NOTE TO FILE - WEED ABATEMENT FOR INCLUSION IN 1992 WEED ABATEMENT PROGRAM On Wednesday, 2/6/91, Masood Aimaq of Artistic Landscaping (14700 E. ' I explained that, as noted in the advertising, the Pre -Bid Conference was mandatory and he would not be able to bid this year. ';ct. .. ...... .. nb 0 0 NOTE TO FILE - 1991 WEED ABATEMENT 2/5/91 (Tuesday), 4:30 pm Sherry, of H & M Excavating (496-9255), came to City to purchase bid package. I explained to her that they would not be able to bid on the Weed Abatement Project since they had not attended the 2/4/91 Mandatory Pre -Bid Conference. I told her that I had spoken with Gwen mid-January specifical- ly regarding the mandatory bid (who indicated she would share this information with Pete). In addition, I had mailed a letter to that effect on January 29 and had spoken on January 29 to Dorie (Pete Is wife), again reiterating the mandatory pre-bid. She understood and suggested I speak with Dorie on Wednesday. On Wednesday, 2/6/91, 8:50 am, I contacted 'Doris at H & M Excavating and explained to her. She indicated that her brother-in-law had open heart surgery and that the family had been requested to come to the hospital suddenly. I explained that if they had perhaps contacted us that there was an emergency, we could have made it known at the pre-bid that there would be one more bidder, but unable to attend due to emergency. She said she understood and just couldn't help the situation. Said she would explain it to Pete. Didn't seem too terribly upset about missing out on the bid. Didn't make attempts to appeal or request special consideration. Based on final figures, for last year's abatement, the approximate percentages were 30% handwork and 70% machine work. To clarify a second question asked during the meeting, I have reviewed the license requirements with the City Attorney. I have been advised that due to the fact that no license is required by the State for weed abatement, and the fact that the City has no precise requirement for licensing for this work, no contractor license will be required by the bidders for the weed abatement contract. If the City feels that a license would be beneficial, that will be taken into account when our decision is made to award the contract. If you have any questions on these issues, please contact us. Very truly yours, Ronald C. Sievers, Director Public Lands and Facilities RCS:nb January 25, 1991 xx Dear Property Owner of Parcel No. xx RE: 1991 WEED ABATEMENT PROGRAM IMPORTANT . . THIS LETTER IS FOR INFORMATION ONLY - WEED ABATEMENT IS NOT REQUIRED AT THIS TIME. SUBSEQUENT NOTICES WILL BE MAILED AT TIME ABATEMENT IS REQUIRED. Last year, you were notified regarding the City's Annual Weed Abatement Program. If abatement was needed, you were faced with the decision of doing the work yourself, contracting out, or having the work done by the City contractor. We are writing in an effort to encourage homeowners to plan early for the 1991 Weed Abatement Program. It is important to note that administrative overhead costs are expected to increase due to increased staff time required, as well as anticipated increases in contractor costs. We want to encourage homeowners to explore the possibility of performing their own weed abatement when the time comes or to contract with an outside firm (see attached list). This could result in lower costs to you, the homeowner. IF YOU ARE NOT THE CURRENT OWNER OF THIS PARCEL, OR ANTICIPATE THE SALE OF THIS PROPERTY, IT IS IMPERATIVE THAT YOU NOTIFY OUR OFFICE SO THAT THE CURRENT OWNER MAY BE NOTIFIED. Our ability to best serve the community is dependent upon your assistance in notifying the correct property owner. Please carefully review the enclosed weed and rubbish abatement specifications. We appreciate your interest in helping us to make our community a safer placer to live by reducing the risks associated with fire, health and welfare hazards. Please feel free to contact our office if you have questions regarding the program. Very truly yours, Ronald C.
