COMMENCEMENT AND COMPL_E_TION OF THE WORK. CONTRACTOR agrees to begin and complete the work within the time specified in the Notice Inviting Bids. It is agreed that it would be im- practicable and extremely difficult to fix the actual amount of damages, and loss sustained by City, should CONTRACTOR fail to complete the work in the specified time; therefore, CONTRACTOR shall pay City, as liquidated damages, not in the nature of a penalty, one hundred dollars ($100) a day for each day delayed; provided that extensions of time with waiver of liquidated damages, may be granted as provided in the Specifications. FIFTH. PERFORMANCE BOND AND LABOR, AND MATERIAL BOND. Contractor agrees to furnish bonds guaranteeing the performance of this con- tract and guaranteeina payment of all labor and material used under this contract, as required by the laws of the State of Cali- fornia, on forms approved by City. The Performance Bond shall be for an amount of one hundred percent (100%) of the amount of this contract and shall be conditioned on full and complete per- formance of the contract, guaranteeing the work against faulty workmanship and materials for a period of one (1) year after com- pletion and acceptance. The Labor and Material Bond shall be for an amount of one hundred percent (100%) of the amount of this contract and shall be conditioned upon full payment of all Labor and Material entering into or incidential to the work covered by this contract. CONTRACTOR agrees to furnish the bonds on the forms found within the Specifications. SIXTY. GENERAL PREVAILING RATC OF PER DIEM WALES. It is stipulated and agreed that all provisions of law applicable to public contracts are a part of this contract to the same ex- tent as though set forth herein and shall be complied with by CONTRACTOR. Murphy, Director of Public Works SUBJECT: Resolution, Notice of Completion and Final Report - Construction of Vehicle Storage Building and Modifications of Existing Building (Olsen) SITUATION On May 5, 1981, the City Council awarded a construction contract to Roland Olsen, General Contractor, calling for construction of a new vehicle storage building and exterior and floor modifications to an existing vehicle storage building located in the City Hall yard area. Work was started on May 21, 1981; a period of 120 days was allowed for completion of the specified work. FINANCIAL CONSIDERATIONS The original contract price of $129,990.00 has been increased by Change Orders 1 through 4 to a final amount of $139,895.54. Funds are available in the Capital Improvements Budget. ALTERNATE ACTIONS 1. Accept the specified work as complete and authorize payment of the retained funds in accordance with City policy. 2. Do not accept the work as complete. 3. Request further information from staff. Both of the bids received are responsive to the Plans and Specifications, and both bidders enclosed the required and proper Bid Bond. Mocalis, City Manager 1] Murphy, Director of Public Works SUBJECT: Award of Contract -Public Works Vehicle Storage Building and Modification of Existing Vehicle Building SITUATION On April 7, 1981, the City Council approved the Plans and Specifica- tions and authorized staff to call for bids for construction of new vehicle storage shed facilities on City Hall property and to provide certain modifications to a portion of the existing storage shed area and buildings. Pursuant to this action by City Council a request for bids was ad- vertised and several sets of plans and specifications were purchased by potential bidders. A pre-bid meeting was held at the job site on April 23, 1981. Public bid opening is scheduled for 2PM on May 5, 1981 at City Hall. Results of that bid opening, together with staff recommendation, will be reported by a supplement agenda item, and will be available prior to opening of the City Council meeting. FINANCIAL CONSIDERATIONS The fiscal year 1980-81 budget contains $200,000 to cover the work described in the subject plans and specifications, together with supporting interior modifications and area rework. It is estimated that the new storage facilities will cost approximately $80,000, with the remainder ($120,000) being used for rework and modification of existing building and yard areas. ALTERNATE ACTIONS Approve staff recommendation and authorize the Mayor and City Clerk to execute the agreement with the recommended bidder cover- ing the work detailed in the Plans and Specifications. Award the contract to a bidder not recommended by staff. Request further information from staff. ' Examination of Plans, Specifications and Site of Work The bidder is required to examine the site of work, the ' proposal, the plans and the specifications very carefully. He shall satisfy himself as to the character, quality and quantities ' of the work to be performed, the materials to be furnished and the reauiroments of the Contract Documents. 'he plans for the ' work show conditions as they are believed to exist, but it is not to be inferred that ail the conditions as shown thereon are actually existent, nor shall the City or any of its officers or ' agents be liable for any loss sustained by the Contractor as a result of any variance between conditions shown on the plans and actual conditions revealed during examination or progress of the work. The submission of a proposal shall be prima facie evidence ' that the bidder has made such an examination. Interpretation of Drawings and Documents If any bidder should find discrepancies in, or omission from, the, dra:ain�,s, specifications or other proposed contract ' documents, or is he should be in doubt as to the true meaning of any part thereof, he shall at once make a written request to the ' Engineer for correction, clarification or interpretation of the point or points in question. The person submitting such a re- quest shall be responsible for its prompt delivery. In the event that the Engineer receives such a request and it should be found that certain essential information is not clearly and fully set forth, or if the Engineer discovers errors, 1 -10- ' omissions, or points requiring clarification in the drawings or documents, a written addendum will be mailed to each person to ' whom a set of contract documents has been delivered. The City will not be responsible for any instructions, explanations or interpretations of the documents presented to bidders in any ' manner other than written addendum. Addenda or Bulletins The effect of all addenda to the contract documents shall ' be considered in the bid and said addenda shall be made a part of the contract documents and shall be returned with them. Be- fore submitting his bid, each bidder shall inform himself as to whether or not any such addenda have been issued, and failure to cover in his bid any such addenda issued may render his bid invalid _and result in its rejection. ' Disqualification of Bidders No person, firm or corporation shall be allowed to make, ' file or be interested in more than one bid for the same work unless alternate bids are called for. Licensing of Contractor All persons, firms, partnerships or corporations shall be licensed in accordance with the Business and Professions Code of the State of California and the applicable ordinances of the City and County before doing any work of any kind. 'Witherawl of Bids Any bidder may withdraw his bid in person or by written request at any time prior to the scheduled closing time for re- ceipt of bids. Openina of Bid Pronosals The City will, in open session, publicly open, examine and declare the bids at the time set forth in the "Notice Inviting Bids". Bidders or their authorized representatives are invited to be present. Award of Contract or Reiection of Bids No bidder may withdraw his bid for a period of forty-five (45) days after the date set for the opening of bids. The con- tract for the work will either be awarded or the bids rejected within the forty-five (45) days from the date set for the opening of bids. The contract for the work will be awarded to the lowest ' responsible bidder complying with these instructions and with the "Notice Inviting Bids". A corpora- tion to which an award is made shall furnish evidence of its cor- porate existence and evidence -that the officer signing the con- tract and bonds for the corporation is duly authorized to do so. TO BE DONE The work to be done consists of construction of a new vehicle storage shed and the rework of an existing storage shed and other appurtenant work as shown on the plans and ' defined in the specifications. 2. STANDARD SPECIFICATIONS ' The Contractor shall perform his work in accordance with the Standard Specifications for Public Works Construction, 1979 edition, hereinafter referred to as the Standard Specifications. The Uniform Building Code, 1979 edition, as modified and adopted by the City of San Juan Capistrano, hereinafter referred to as the Building Code, and the specifications of Varco-Pruden Metal Building Systems, dated May, 1980. Also, the latest set of standard plans of the State of California Department of Transportation (Caltrans.) The contractor shall maintain a copy of these books on ' the job site at all times. The provisions of the Standard Specifications shall be modified as indicated below: Change 1: "Section 2-4 - Contract Bonds" ' The "Payment Bond" (Material and Labor Bond) shall be in the amount of 100 percent of the contract price. Other agencies with which the contractor may be involved in the accomplishment of the work, may require greater amounts. -23- The City willot recognize any claim foldditional compensation because of the requirement for greater amounts of insurance, as an element to be considered by the Contractor in determining his bid. 3. TERMS DEFINED Whenever in the said standard specification the following terms are used, it is hereby provided that the following City departments or persons shall be intended: AGENCY shall mean City of San Juan Capistrano, ' wherever appropriate BOARD shall mean the City Council of the City of San Juan Capistrano ENGINEER shall mean City Engineer or other person(s) designated by same. ' 4. FLOW AND ACCEPTANCE OF WATER ' It is anticipated that storm, surface and ground or other waters may be encountered at various times and locations during the work herein contemplated. The Contractor, by submitting a bid, acknowledges that he has investigated the risk rising from ' such waters and has prepared his bid accordingly. It shall be the sole responsibility of the Contractor to protect his work from danger due to any waters encountered. Should any damage ' to the work due to surface or other water occur prior to acceptance of the work by the City, the Contractor shall repair such damage at his expense. ' 5. INSURANCE AND OVERHEAD COSTS The Contractor shall receive no direct compensation for insurance and overhead (move -in costs for example) costs. Accordingly, these costs should be prorated to the appropriate bid items. ' 6. PROTECTION OF EXISTING UTILITIES The Engineer has endeavored to show all existing utilities. The Contractor must, however, take all due precautionary measures to protect all of the existing utilities. ' 7. PROTECTION OF PRIVATE PROPERTY The Contractor must remain within the construction zone to ' the best of his ability. The Contractor must protect all existing private property. -24- SSIAL PROVISIONS OF ITEMS CO WORK AND METHOD OF PAYMENT A. BID ITEMS ' BID ITEM 1 - Clear Grub and Grade The workmanship and materials included in the work prescribed ' for Bid Item 1 shall conform to Section 300 of the Standard Specifications. The work for this bid item shall include the clearing of all unsuitable material as determined by ' the Engineer and the existing drainage conduits. The grading portion of this bid item includes approximately 850 cubic yards of over excavation, removal and disposal, replacement ' with new material, and recompaction. Contractor shall grade to finish grade shown on plan. All materials within the building line and within a minimum of five feet outside of the building line, shall be compacted to 90 percent relative com- paction as specified by the UBC Standard 70-2. Payment ' The lump sum bid shall include all labor, materials, tools, and equipment for the removal of all unsuitable material, ' and the placement and the compaction of all new fill, and no additional compensation shall be made. BID ITEM 2 - Furnish and Install 24" Reinforced Concrete ' Pipe, 1750 D The workmanship and materials included in the work prescribed ' for Bid Item 4 shall conform to Sections 207 and 306 of the Standard Specifications. The work for this bid item shall include all trenching required and backfilling of the trench as shown on the improvement plans for the installation of the ' 24" reinforced concrete pipe with a D load of 1750 or greater. Payment ' The unit price bid per lineal foot shall include all labor, materials, tools and equipment necessary for the installation ' of the R.C.P. as specified, and no additional compensation shall be made. BID ITEMS 3 and 4 - Furnish and Install Concrete Foundations ' And Floor Slab for Buildings The foundation shall be constructed per Section 303 of the ' Standard Specifications and Chapter 29 of the Building Code. Concrete shall be Class 560-C-3250 per Section 201-1.1.2 of the Standard Specifications. The steel reinforcement shall ' be per Section 201-2 of the Standard Specifications. The Contractor shall provide column anchor bolts for the inclusion in the slab and shall be responsible for proper placement. ' NOTE: Foundation details, etc. shown on Page 3 of plans is for information only. Contractor is to provide design and working drawings prepared by a licensed civil or structural engineer. -25- i • • Payment The lump sums bid for each bid item shall include all labor, materials, tools and equipment for the construction of the ' footings, foundations and floor slabs and no additional com- pensation shall be made. ' BID ITEM 5 - Furnish and Install 1 Varco-Pruden or equal Metal Building 40' wide X 80' long with 8 skylights and 1 Varco-Pruden or equal Metal Building 20' wide X 100' long. Based on criterial requirements contained herein, the metal buildings shall be designed and manufactured by Varco-Pruden per their specifications of metal building systems dated May, 1980, or equal as approved by the engineer. The erection of the metal buildings shall conform to Chapters 22, 23 and 27 of i the Building Code. The shop drawings shall be submitted by the Contractor and approved by the Engineer prior to ordering materials. The 40' wide X 80' long section shall include eight skylights per plan, with the building designer to specify and recommend suitable ' installation for the Engineer's approval. Payment ' The lump sum bid shall include all labor, materials, tools and equipment for the design, construction and erection of the metal ' buildings and no additional compensation shall be made. The lump sum price shall include all painting of the roof and outside walls in colors to be designated by the Engineer. Installation of electric circuitry and fixtures is not a part of this contract, and iis specifically excluded. BID ITEM 6 - Metal Work for Existing Building ' The work for this bid item includes the enclosing of approximately 60 feet of the existing building with siding and color to match ' existing siding on the building. Furnish and install 5 doors 3' wide X 6'8" high. Furnish and install 7 aluminum sliding windows 3' high X 4' wide. Furnish and install overhead doors on 3'h bays of the existing building. At the Contractor's option and the Engineer's approval, the overhead doors may be full width or half width of the openings, as dictated by optimum cost and design factors. All work, must be located as shown on the plans. Payment ' The lump sum bid shall include all labor, materials, tools and equipment for the re -work of the existing building and no add- itional compensation shall be made. D 1 -26- 1 B. 1 1 1 0 E BID ITEM 7 - Furnish and Install 10 -inch Schedule 80 PVC Pipe The work for this bid item shall include all trenching and back- filling as required for the installation of approximately 25 feet of 10 -inch schedule 80 PVC, as shown on the plans. This shall tee into 24 inch RCP pipe as described in Bid Item 2. Payment The lump sum price bid shall include all labor, materials, tools and equipment necessary for the installation of the 10 -inch PVC pipe and junction to 24 -inch RCP, and no additional compensation shall be made. SURVEYING Surveying, corner location, finished slab elevations and similar surveying and engineering work will be provided by the Engineer as requested by the Contractor. -26 -a - • DETAIL SPECIFICATION • ' PREFABRICATED METAL BUILDING ' 5-01. Description. This section covers the design, fabrication and erection of the metal building, and the re -working of the existing building. ' 5-02. General Requirements - The buildings shall be a clear span rigid frame. The 40 foot wide, 80 foot long metal building shall have an eave height of 16'/1718", with a roof pitch of 1:12. The 20 foot wide, 100 foot long metal building shall have an eave height of 12'4"/14', with a roof pitch of 1:12. The rigid frames will be spaced on 20 foot centers. End walls to be ' of full frame construction. The building as specified herein shall consist of all columns, roof beams, end posts, anchor bolts, girts, purline, covering, bracing, connectors, etc. or as specified. All material shall be new, unused and free from defects. All eave ' heights and roof pitches shall match existing buildings eave heights and roof pitches. 5-03. Structural Design. The steel building shall be a standard prefabricated type and shall be designed in accordance with the Uniform Building Code, modified by the following ' provisions. The building shall be designed for a wind load of 20 pounds per square foot assumed to act horizontally to the vertical ' projected area of the side walls and roof. All structural mill sections and welded plate sections shall ' conform to ASTM Specification A36 and be designed in accordance with the latest edition of the American Institute of Steel Construction "Specifications for the Design and Fabrication of Structural Steel for Buildings." All cold formed steel structural ' members shall confirm to ASTM Specification A570 or A611 and be designed in accordance with the American Iron and Steel Institute "Specifications for the Design of Light Gauge Cold - Formed Steel Structural Members." All welding shall conform to regulations set forth by the American welding Society. 5-04. Fabrication. All rigid frame members shall be shop fabricated to provide holes for the attachment of secondary structural members and bracing. Flanges and webs of built-up welded members shall be joined by a continuous automatic submerged arc welding process. All other shop welding shall be by operators qualified as prescribed in the "Standard Qualification Procedure of the American welding Society." ' All building parts shall carry an identifying mark for easy field identification. 5-05. Primary Framing. Rigid Frames will consist of solid or open web columns and roof beams complete with necessary splice members and plates for field assembly. ' -27- (a) Welding will be done in accordance with the American ' Welding Society Code for Building Construction. Certification of welder qualification will be supplied when required and specified. ' (b) All base plates, cap plates, ridge plates, splice plates and stiffener plates as required will be shop fabricated in proper sizes with bolt connection holes shop fabricated. ' (c) Stiffeners will be shop welded into place. (d) Columns and roof beams will be shop fabricated complete ' with proper holes in webs and flanges for the attachment of secon- dary structural members and bracing in proper locations. ' All bolts for field assembly of primary frame members will be of the required strength and of proper sizes complete with washers as indicated on erection drawings. Anchor bolts will be as specified on the building manufacturer's anchor bolt layout ' drawings. Endwall Frames for the building will be cold formed members designed and fabricated in accordance with latest AISI specifica- tions. Endwall frames will consist of endwall columns, endwall roof beams and endwall posts as required by design criteria. ' (a) All base plates, cap plates, ridge plates and stiffeners as required will be shop fabricated in proper sizes with bolt connection holes shop fabricated. ' (b) Stiffeners will be shop welded into place. (c) Columns, beams and posts will be shop fabricated complete with proper holes for the attachment of secondary structural members in proper locations. ' Rigid frames may be substituted for endwall frames as shown on the drawings. Necessary endwall posts and holes for connection to the rigid frame used in the endwall will be shop fabricated. ' 5-06. Secondary Members. Purlins, braces and girts shall be precision roll -formed sections of 16 gauge minimum high strength ' steel with a minimum yield of 50,000 psi. Lateral bracing to provide lengthwise rigidity against wind and seismic forces shall be furnished, e.g. by rods with adjusting bolts on ends. 5-07. Painting of Structural Members. Unless otherwise specified, all structural steel members and parts shall be thoroughly cleaned of all loose mill scale, oil, dirt and other ' foreign matter and given one shop coat of Primer in Accordance with Federal Specification TT -P -636D. Primer shall be applied in such a manner to fill all joints and exposed edges. _28- ' 5-08. Roof and Wall Covering. All roof and wall covering shall be made from prime, hot -dip galvanized steel not less ' than 26 gauge, having a minimum yield strength of 36,000 psi and a minimum of 1.25 o zinc per square foot; roll -formed into ribbed panels of required length to minimize end laps. Flat areas shall not exceed 12 inches between any two ribs. To insure rigidity of the panels and provide joints that stay snug and weather -tight under load, the average deflection of the center of panels between ribs shall not exceed 1/8 inch with twenty pounds per square foot load on the roof span. The junction of the roof and wall panels to be weather sealed. ' Ridge flashing shall be in accordance with the manufacturer's specifications. 5-09. Connections. Panel connections shall be waterproof and fasteners shall be corrosion proof and with a position action. Fasteners shall allow easy panel replacement. Fasteners shall match color of building. All holes in purlins, eave struts, base angles and gable angles shall be fabricated in such a manner as to provide a field assembly method which will automatically produce positive panel alignment. 5-10. Color Coating of Panels. Color coating shall be factory ' applied baked enamel finish. The interior surface of all roof and wall panels shall be ' ivory or White enamel. The exterior surface of all roof and wall panels will be selected by the Engineer from available standard colors. 5-11. Outside Paint. The outside of the completed construction (including roofs) shall be painted to match existing construction as approved by the Engineer. 5-12. Trim and Closures. All metal trim shall be 28 gauge minimum galvanized steel. Trim is to be formed and lapped to pro- vide a complete weathertight installation. The intersection of roof panel and the eave trim shall be sealed by a preformed neoprene closure strip. Rake or cornice trim shall be sealed by a continuous bead of 1/4 inch extruded sealer or tape mastic between the trim and the roof panel and held together by sheet metal screws 12 -inches on center. Corner and ridge trim closures shall be preformed closure pieces to provide a neat transition at points of directional change of eave and (gable) trim. -29- r • • r 5-13. Gutters and Downspouts. Approved roof gutters, ' with downspouts at each end shall be installed on the front (open) side of gable roofs for both the new and existing buildings. 5-14. Clean-up.
