WITNESSETH: THAT WHEREAS, CITY is desirous of contracting with COUNTY for the perform- ance of the hereinafter described services within CITY'S boundaries by COUNTY through COUNTY'S Health Officer thereof; and WHEREAS, COUNTY is agreeable to rendering such services on terms and conditions hereinafter set forth; NOW THEREFORE, IT IS AGREED as follows: 1. COUNTY agrees, through the Health Officer of COUNTY to provide animal and rabies control services within the corporate limits of CITY, to the extent and in the manner hereinafter set forth. Such services shall only encompass duties and functions of the type coming within the jurisdiction of and customarily rendered by the Animal Shel- ter of COUNTY under the laws of said COUNTY and the statutes of the State of California. The level of service shall be that same basic level of service that is, and shall be hereafter during the term of this agreement, provided for unincor- porated areas of COUNTY by said Health Officer. The rendition of such services, the standard of performance and other matters incidental to the performance of such services, and the control of personnel so employed, shall remain in COUNTY. In event of dispute between the parties as to the extent of the duties and functions to be rendered hereunder, or the level and manner of performance of such service, the determination thereof made by the Health Officer of COUNTY shall be final and conclusive as between the parties hereto. Such service shall include the enforcement of State statutes and such municipal code ordinances relating to animals as CITY may adopt, as hereinafter provided for. 2. To facilitate the performance of said functions, it is hereby agreed that COUNTY shall have full cooperation and assistance from CITY, its officers, agents, and employees. 3. For the purpose of performing said functions, COUNTY shall furnish and supply all necessary labor, supervision, equipment, and supplies necessary to maintain the level of service to be rendered hereunder. Notwithstanding anything herein contained, it is agreed that in all instances wherein special supplies, stationery, notices, forms, and the like must be issued in the name of said CITY, the same shall be supplied by said CITY at its own cost and expense. 4. All persons employed in the performance of such services and func- tions for said CITY shall be COUNTY employees and no CITY employee as such shall be taken over by said COUNTY, and no person employed hereunder shall have any CITY pension, civil service, or any status or right. For the purpose of performing such services and functions, and for the purpose of giving official status to the performance thereof where neces- sary, every COUNTY officer and employee engaged in the performance of any service hereunder shall be deemed to be an officer or employee of said CITY while performing services for said CITY, which services are within the scope of this agreement and are purely municipal functions. 5. CITY shall not be called upon to assume any liability for the direct payment of any salaries, wages, or other compensation to any COUNTY personnel performing services hereunder for said COUNTY, or any liability other than provided .for in this agreement. Except as herein otherwise specified, CITY shall not be liable for compensation or indemnity to any COUNTY employee for injury or sickness arising out of his employment. 6. COUNTY, its officers and employees, shall not be deemed to assume any liability for intentional or negligent acts of said CITY or of any officer or employee thereof. 7. Unless sooner terminated as provided for herein or upon at least three (3) months written notice by either party, this agreement shall be effective July 1, 1978, and shall run for a period of one (1) year thereafter. At the option of the City Council of said CITY, with the consent of the Board of Supervisors of said COUNTY, this agreement shall be renewable for secccasive periods of not exceeding one (1) year each. In event CITY desires to renew this agreement for any succeeding one- year period, said City Council, not later than one hundred and twenty (120) days before the expiration date of this agreement, shall notify the Board of Super- -2- visors of COUNTY that it wishes to renew the same, whereupon said Board of Supervisors, sixty (60) days after said notification, shall notify said CITY in writing of its willingness to accept such renewal for an additional one- year period or such other term as it deems advisable, otherwise such agree- ment shall finally terminate at the end of one-year period. Notwithstanding the provisions of this paragraph hereinbefore set forth, either party may terminate this agreement on the first day of July of any year, upon notice in writing to the other party of not less than two (2) calendar months prior to the say of said termination. j 8. Notwithstanding anything to the contrary herein contained, this contract shall be sooner terminated at any time that CITY fails to enact and to maintain in full force and effect, including the amount of fees provided, an ordinance similar to the provisions of Arti.cles 1 through 10, Division 1, Title 4, and Divisions 1, 2, and 3, Title 5, of the Codified Ordinances of the County of Orange, and other regulations which may be adopted by the Orange County Board of Supervisors. This contract shall also be sooner terminated if CITY does not enact the same amendments to their municipal code as those adopted by COUNTY'S Board of Supervisors within one hundred and twenty (120) days after request to do so by COUNTY. The COUNTY Health Officer, acting on behalf of the COUNTY, may use discretion and need not request CITY to adopt amendments which do not apply to CITY. 9. For and in consideration of the rendition of the foregoing services by the COUNTY, CITY agrees that COUNTY may 'keep and retain any and all licenses and fees provided for by said Municipal Code Ordinance and collected by the COUNTY pursuant hereto. It is agreed that in connection therewith, COUNTY shall have all powers of CITY and shall receive all cooperation possible there- from to enable efficient enforcement of such Municipal Code Ordinance and to effectuate collections called for thereunder. 10. COUNTY shall retain all fees and revenue derived from the enforcement of the CITY Ordinance pertaining to animal and rabies control by COUNTY. 11. COUNTY agrees to maintain its animal shelter in a humane manner and keep said premises in a sanitary condition at all times, and that all services furnished by it hereunder shall be in accordance with the laws of the State of California, and that it will give the prescribed notices and use humane meth- ods of care and destruction of any animal coming under its jurisdict:i.wu. 12. COUNTY agrees to keep such books and records in such form i::.d -canner -3- as the Auditor-Controller of COUNTY shall specify. Said books shall be open for examination by said CITY at all reasonable times. 13. All records created or received by COUNTY in accordance with this Agreement shall be COUNTY records. Mocalis , City Manager FROM: Pamela Hallan, Administrative Assistant SUBJECT: Renewal of Veterinary Public Health Service Contract SITUATION: The current contract with the County of Orange for veterinary public health services is due to expire June 30, 1981. There are some minor changes in the new contract, but they are not significant for San Juan Capistrano. The changes include the following: 1. Instead of year-to-year, the contract will continue indefinitely until terminated by either party. 2. It is contemplated that fees will increase in the near future, but not until a study is done by the County. The study has not yet been ordered. 3. Billing procedures may change for some cities who currently employ their own impound people. 4 . The County will no longer house animals which are evidence in criminal cases unless the case involves direct violation of a City animal control ordinance. If a City police officer requests that an animal be held, the County' s usual charges will be assessed. FINANCIAL CONSIDERATIONS: The City is not charged for this service. ALTERNATE ACTIONS : 1. Approve the contract and authorize the Mayor to execute the agree- ment on behalf of the City. 2. Request further information. The following information on the hours of operation and level of patrol is provided for Council information : Animal Shelter 10 : 00 a.m. - S : 00 p .m. Mon. thru Sat . (City of Orange) Field Services 7 : 30 a.m. - 10 : 30 p .m. Mon, thru Sat . (two shifts) 7 days per week (emergency calls only after 10 : 30 p .m. ) Service Requests 8 : 00 a.m. - 5 : 00 p.m. Mon. thru Sun . (after S : 00 p .m. recording advises caller to contact Sheriff' s Department ; Sheriff screens calls and will dispatch emergency calls to shelter, i . e . , biting dog , injured dog, rattlesnakes , etc . ) Two units are on patrol and on call in South Orange County from 7 : 30 a.m. to 10 : 30 p.m. daily covering San Juan Capistrano , San Clemente, E1 Toro, Mission Viejo , Dana Point , and Capistrano Beach. (The second unit was added just this year. ) Special patrols may be sent into an area for a period of time to alleviate a problem area if service requests are high. According to the Director, coverage is not as high in South Orange County as it is in more populated areas of the County , but on a per capita basis , coverage would be about equal . Seventeen cities in Orange County contract for animal control services with the County. The level of service provided to the cities is the same basic level of service that is provided in the unincorporated areas of the County. Three cities contract for a specific level of service , i . e . , Huntington Beach collects its own licensing fees , and pays approxi- mately $140 ,000 per year directly to the County for animal control services . FOR CITY COUNCIL AGENDA .... .. •Agenda Item - Animal Control -2 - March 5 , 1980 The provisions concerning renewal and cancellation of the Animal Control Agreement are as follows : - If the City wishes to renew the agreement , not later than 120 days before the expiration date the City shall notify the County of its intent to renew. - Either party may terminate the agreement on July 1 of any year, upon written notice to the other party not less than two (2) months prior to the day of termination. FINANCIAL CONSIDERATIONS: Revenues collected by the County from dog licensing in the City of San Juan Capistrano equalled approximately $12 , 900 this year. This amount of money would not be enough to consider the City providing animal control service at this time, nor is it enough to finance a higher level of animal control service . Consideration to providing this service by the City could be given when population growth warrants a feasibility study at some future time. There are no direct costs to the City for the extension of the animal control agreement . The agreement provides that the County may retain any and all revenue for licenses and fees collected for the services provided. ALTERNATE ACTIONS : 1 . Approve the extension of the agreement with the County for animal control services for the period of July 1 , 1980 to June 30 , 1981 . 2 . Direct staff to notify the County that the City will terminate the animal control agreement with the County commencing July 1 , 1980 , and investigate alternative means of providing animal control services . 3 . Request further information from staff. If Council is desireous of continuing to contract for these services, the attached agreement must be executed at this time. In the past this agreement has been renewable for successive periods of five years each. However the County presently has a policy of limiting these agreements to a maximum of one year duration. Therefore the agreement, if accepted by Council, will commence on July 1, and automatically terminate on June 30 the following year unless arrangements for continued service are made at such time. Other than the above revision to the contract period, a comparison of the current and the proposed agreements reveals no significant difference in either the terms or the conditions of the agreements. FINANCIAL CONSIDERATIONS Other than minor costs which may arise from time to time for special supplies, stationery, forms, notices and the like, there is no direct cost to the City for receiving such services. It is assumed, however, that the City is desirous of continuing to contract for these services. This letter will outline the changes which will be incorporated into the contract extension, contemplated fee increases, and the required procedures in order to execute an extension. CONTRACT PERIOD Effective July 1, 1981, many contracts between cities and the County for most Animal Control services will be on an indefinite basis. The extensions will commence on July 1, 1981 and continue until terminated or sooner modified by you City or the County as provided in the contract. FEE INCREASES In reviewing the County Fees Inventory, the County Auditor-Controller took notice that the Animal Control Fees had not been revised in recent years. The County Revenue Policy, adopted by Board Resolution 79-1451, states that "all cost recovery revenue sources should be updated at least once a year to reflect current costs". Pursuant to this policy, the Auditor-Controller has confirmed to us that a cost study will be performed in the near future. It is contemplated that there will be an increase in most fees charged by the Shelter. BILLING PERIOD At the present time, we are invoicing some cities for specified services, e.g. , shelter services, etc. two weeks in arrears. The problem is that this does not allow us sufficient time to resolve the disposition of many animals • March 20, 1981 Page two impounded by a City animal regulation department. We proposed in a previous communication to invoice those cities one (1) full month in arrears. The advantage of this change is that it will allow us more time for disposition of all animals before preparation of the invoice begins. In addition, it will facilitate an efficient billing process. This change is incorporated into the contract by its inclusion in the extension. SHELTERING OF ANIMALS HELD AS EVIDENCE From past experience, there appears to be something of a misunderstanding regarding the use of Animal Shelter for the holding of animals as evidence. The County Counsel has concluded that unless criminal cases involve violation of the City Animal Control ordinance, the agreement does not require the County to house animals which are evidence in criminal cases. In order to further clarify our role, we have inserted a clause in the renewal specifying this limitation and conditions under which the Shelter will house these animals. Where a city police department desires to have the Animal Shelter house animals seized in non-animal control criminal cases for the purposes of preserving evidence, the City will be required to pay the Animal Shelter's usual and customary charges for such housing. However, if such housing would interfere with the normal operation of the Shelter, or would require facilities which do not exist at the Shelter, the Shelter has no obligation to assume the duty of caring for the animals. RENEWAL EXTENSION If the renewal is acceptable to your City, please execute it as to all required City signatures and attestations. Return all seven (7) City executed copies to me at the above address by May 16. The renewal will then be placed upon the Board of Supervisor's agenda for ratification along with the other cities. Upon their approval, a copy of the fully executed contract will be returned to you with a copy of the Board's action. PERIODIC CONFERENCES The County endeavors to provide the City with the highest level of veterinary public health services. However, it is recognized that problems and complaints do arise from time to time. Periodic meetings between County staff and City representatives are encouraged to discuss citizen complaints and methods of improving the services provided.
