by and between the County of Orange, hereafter "COUNTY" and the City of San
Juan Capistrano hereafter "CITY".
G 1,11iEREAS, Title I of the Housing and Community Development Act of 1974, here—
after "ACT" , makes available to cities under ' 50,000 population and the u4incorpor—
S ated area of the County of Orange certain suns to be used for a broad range of housing
and community development activities; and
0 ,-,iEREAS, said ACT. authorizes such cities to enter into cooperation agreements
j with COUSTY for the purpose of undertaking or assisting in the undertaking of essential
co-x3unity development and housing assistance activities;
YOW THEREFORE, the parties agree as follows:
1. This Agreement shall constitute a cooperation agreement between the parties
within the meaning of Section 102 (a) (6) of the ACT. The parties agree to cooperate
in the undertaking, or assisting in undertaking, essential community development and
7 hoau:ing assistance activities, especially urban renewal and publicly assisted housing.
,g 2. COUNTY shall be responsible for the preparation, adoption, and submission
19 of an Urban County Application to the department of N-,using and Urban Development.

21 consideration to CITY's analysis of Community development needs and proposed activitie

2i 4. In the event COUNTY' s Urban County application is approved by HUD, COUNTY
shall forward to CITY any such grant funds received from HUD which are attributable
37 to activities cone-icted by CITY, unless another form of distribution is required by

4. RECREATION GAMEMOBILE - AWARD BID
(62) Council received copies of report dated November 17, 1976,
from the Administrative rvices Officer forwarding a compila-
tion of bids received November 4, 1976, for a van for the
City 's proposed Btobi Recreation Program.
It was moved by uncilman Heckscher, seconded by Councilman
Sweeney and un imously carried to approve the award of one
Gamemobile to the low qualifying bidder, Hal Green Chevrolet,
in the amou t of $4, 639. 49 and to reject all other bids
received.
The L' ns Club approved the donation of funds for the cost of
the amemobile at their meeting of November 9. Council directed
th staff extend the City 's appreciation to the Lions Club
f r their offer.
PUBLIC HEARINGS
1. HOUSING AND COMMUNITY DEVELOPMENT ACT -
THIRD YEAR FUNDING APPLICATION
(89) Council received copies of a report dated November 17, 1976,
from the Director of Planning forwarding the recommendation
made a the Planning Commission meeting of October 26, 1976,
that the City participate in the Third Year Urban County Grant
Application for HCDA fluids in the amount of $35, 000 which may
be utilized for a rehabilitation program for the Los Rios Area.
Forwarded along with the application were a Housing Assistance
i
Plan which identifies community needs as they relate to low
and moderate income families; an Assurances agreement certify-
ing compliance with Federal rules, regulations, and existing
legislation; and a County/City Cooperation Agreement for
allocation of block grant funds.
Notice hav zg '_ -on given as required by law, Mayor Nash
declared the Pubi • -aring open on the application for third
year funding under the - n sing and Community Development Act
and inquired if anyone in audience wished to address the
Council . There being no rospun„ , . Mayor Nash closed the Public

SUBJECT: Housing and Community Development Act (HCDA) - Third Year Program
SITUATION
The Planning Commission, at its meeting of October 26, 1976, has forwarded a recom-
mendation to the City Council for participation in the Third Year Urban County Grant
Application. The desired funding level for this year's program is recommended at
$35,000. Currently the City has a reserve fund from first and second year allocations
of $42,500. This reserve, per the previous year applications, has been designated
for the Los Rios Area. It should be noted that the funding for the Los Rios Precise
Plan has not encumbered any HCDA funds.
The primary purpose for considering the application is to provide an opportunity
for public input regarding issues and needs related to the HCDA program. Included
as Attachment A is a description of the possible scope of the program upon comple-
tion of the Los Rios Precise Plan.
Concurrent with this process, a Housing Assistance Plan has been prepared which identifies
community needs as they relate to low and moderate income families based upon a regional
fair share allocation. The specific goals as related to the City are included as
Attachment B. It should be noted that the allocation represents approximately 0.045%
of the current housing supply. Of the 89 units identified for low and moderate income
families, approximately 92% would be targeted for Section 8, lease housing administered
by Orange County Housing Authority. The remaining 8% could be incorporated into
a proposed rehabilitation program for the Los Rios Area.
The County of Orange and the City are required to assure that a number of associated
Federal rules, regulations, and related existing legislation be adhered to in the
development and implementation of the HCDA program. An assurance agreement is enclosed
as Attachment C. Said agreement must be executed by the City as a part of the grant
application (no change from second year format) .
In addition, the City is required to enter into a cooperation agreement which permits
both the City and County to jointly participate in the HCDA program. The County,
however, is recognized as the official applicant by the U.S. Department of Housing
and Urban Development. A proposed agreement is enclosed as Attachment D. This agreement
outlines the relationship which must exist between the County and City before block
grant funds can be allocated (no change from second year format) .
FINANCIAL CONSIDERATIONS
The addition of a $35,000 grant to be utilized in the Los Rios Area. This, combined
with the $42,500 from the previous years, provides a total of $77,500 which may be
used as part of the implementation program for the Los Rios Precise Plan.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, FOR PAR-
TICIPATION IN THE THIRD YEAR URBAN COUNTY
BLOCK GRANT PROGRAM 1977-79.
WHEREAS, the City of San Juan Capistrano has joined i
with the County of Orange for participation for an Urban County
Block Grant entitlement under the Housing and Community Develop-
.. ment Act of 1974; and
WHEREAS, the City has held Public Hearings to determine
the extent of involvement for the third year program; and
WHEREAS, the City's Environmental Review Board has
determined that the setting aside of funds is categorically
exempt from the provisions of the California Environmental
Quality Act and has otherwise fulfilled the requirements for
environmental assessment.
NOW, THEREFORE, BE IT RESOLVED, that the City of San
Juan Capistrano applies for participation in the Third Year
Urban Bounty Block Grant Program with the County of Orange in
order to set aside a sum of $35,000 to be applied to projects
in the "Los Rios Precise Plan Area";
BE IT FURTHER RESOLVED, that in order to participate
in the program, the City Council authorizes the Mayor to execute
the Assurance Agreement and Cooperation Agreement between the
County of Orange and the City of San Juan Capistrano.
BE IT FURTHER RESOLVED, that the City of San Juan
Capistrano adopts the Housing Assistance Plan for the Third
Year Program as detailed in Tables I through IV per attachment.

PROJECT DESCRIPTION
The Los Rios Precise Plan encompassed an approximate 40-acre parcel
bounded by the Santa Fe Railroad right of way on the east , Del Obispo
Street (south) , Trabuco Creek Channel (west) , and Tract 7196, Mission
Village (north) . Upon completion of the "Los Rios Precise Plan" study
scheduled for March, 1977, the following programs may be considered
as a part of the implementation program for which HCDA funding may be
used:
1. Create a rehabilitation program of loans and/or grants to
assist in repairing, upgrading, and restoring existing
structures and other exterior improvements.
2. Provide necessary hard surfacing and drainage provisions for
Mission Street which is currently an unimproved road serving
existing residents.
3. Make improvements in the project area to correct storm drainage
and other functional problems relating to municipal services
while protecting existing structures.
4. Provide adequate public sanitary facilities for all structures
within the project area.

future residential units from the intermediate regional flood.

NOTICE IS HEREBY GIVEN, that a Public Hearing will
be held by the City Council of San Juan Capistrano
on the 17th day of November , at 7 : 00 P.M.
in the City Council Chamber, 32400 Paseo Adelanto,
relative to the following:
Housing and Community Development Act - Third Year Program
City application to receive third year funding under the County
Housing and Community Development Grant Application. The desig-
nated area for expenditure of said funds received is that area
commonly known as the Los Rios/Little Hollywood area.More spec-
ifically , the area is bounded by Trabuco Creek on the west , Del
Obispo Street on the south, Santa Fe Railroad right-of-way on the
east , and Tract 9186 on the north.
This project has been reviewed and processed in accordance with
the California Environmental Quality Act . The City 's Environmental
Review Board has determined that the project will not have a
significant impact on the environment based upon the finding that
the application is a request for funds and does not identify any
specific project . The Board recognizes. that a full EIR will be
required for any program developed for expenditure of HCDA funds.

SUBJECT: Housing and Community Development Act '(11CDA) - Third Year Program
SMATIOA -
The Planning Commission, at its meeting of October 26, 1976, has foriaarded a recom- i
mendation to the City Council for participation in the Third Year Urban County Grant
Application. The desired funding level for this year's program is recom,zcnded at
$55,000. Currently the City has a reserve fund from first and second year allocations
of $42,500. This reserve, per the previous year applications , has been designated
for the Los Rios Area. It should be noted that the funding for the Los Rios Precise
Plan has not encumbered any IICDA funds.
The primary purpose for considering the application is to p:o•, ide an opportunity
for public input regarding issues and needs related to the 11CDA program. Included
as Attachment A is a description of the possible scope of the program upon comple-
tion of the Los Rios Precise Plan.
Concurrent with this process, a Housing Assistance Plan has been prepared which identifies
community needs as they relate to low and moderate income families based upon a regional
. fair share allocation. The specific goals as related to the City are included as
Attachment B. It should be noted that the allocation represents approximately 0.045a
of the current housing supply. Of the S9 units identified for lora and moderate income
families, approximately 92% would be targeted for Section S, lease housing administered
by Orange County Housing Authority. The remaining S% could be incorporated into
a proposed rehabilitation program for the Los Rios Area. a;

The County of Orange and the City are required to assure that a number of associated
Federal rules, regulations, and related existing lenislation be adhered to in the
development and implementation of the HCDA program. An assurance agreement is enclosed
as Attachment C. Said agreement must be executed by the City as a part of the grant
application (no change from second year format).

In addition, the City is required to enter. into a cooperation agreement which permits
both the City and County to jointly participate in the I1CM program. The County,
however, is recognized as the official applicant by the U.S. Department of Housing
and Urban Development. A proposed agreement is enclosed as Attachment D. This acreement
outlines the relationship which must exist between the County and City before block
grant funds can be allocated (no change from second year format). "
FINANCIAL COXSIDBRATIOSS
The addition of a $55,000 brant to be utilized in the Los Rios Area. This, combined.
with the ;412,500 from the previous years, provides a total of $77,500 which nay be

Ar. Merrell reviewed participation in the funding prograrrt by the City during the
last two years. . He noted that the staff was recommending participation for third
year funding in the amount of $35,000. He then discussed the use of the funds
for the Los Rios Area and the work to date by the consultant and the Steering
Committee. _ - -
Vice-Chairman Davies opened the public hearing.
11r. Al Serrato, -representing the Environmental"Management Agency of-Orange' County,
questioned staff -on the composition of the Steering Committee and their next meeting
date.
There being no one else wishing to be heard, the public hearing was closed.
Commissioner Riley questioned what other types of projects could be funded by '{
HCDA monies. Mr. Merrell responded that projects such as public improvements,
parks, and any other project to improve housing conditions would be eligible.
Vice-Chairnan Davies asked if this included subsidization of lora income housing. �
Mr. Merrell stated that it did, but that the City was already participating in
such subsidation through the Orange County Housing Authority. r
Commissioner Riley offered Resolution 76-10-26-4 recommending to the City Council
