ST ,i� Superor C A e,By 40F}FtiQl-'lOti AGREEME:;T 2 3 THIS AGREE<"IENT entered into this 7th day of January 1976 , 4 by and between the County of Orange, hereafter "COUNTY" and the City of San Juan 5 Capistrano hereafter "CITY". 6 WHEREAS, Title I of the Housing and Community Development Act of 1974, here - 7 after "ACT", makes available to cities under 50,000 population and the unincorpor- $ ated area of the County of Orange certain sums to be used for a broad range of housing 9 and community development activities; and WHEREAS, said ACT authorizes such cities to enter into cooperation agreements 11 with COUNTY for the purpose of undertaking or assisting in the undertaking cf essential 12 j community development and housing assistance activities; 13;1 NOW, THEREFORE, the parties agree as follows: 14 1. This Agreement shall constitute a cooperation agreement between the parties 15 within the meaning of Section 102(a)(6) of the ACT. The parties agree to cooperate 16 in the undertaking, or assisting in undertaking, essential community development and 171 housing assistance activities, especially urban renewal and publicly assisted housing. 18 1 2. COUNTY shall be responsible for the preparation, adoption, and submission 1911 of an Urban County Application to the Department of Housing and Urban Development, 20ij hereinafter "HUD". In the preparation of said application, COUNTY shall give due 21 i consideration to CITY`s analysis of community development needs and proposed activities. 22 I 3. CITY shall comply with the community development plan and program and the 23 housing assistance plan which are developed pursuant to said application, and all laws, 24 regulations and policies applicable to said grant. 25 4. In the event COUNTY's Urban County application is approved by HUD, COUNTY 26 shall forward to CITY any such grant funds received from HUD which are attributable 27 to activities conducted by CITY, unless another form of distribution is required by 2311 the ACT - 29 5. Continuation of Model Cities Activities 6. CITY shall be responsible for carrying out all approved projects located in CITY, including all necessary record keeping. 7. The term of this Cooperation Agreement shall be for one year commencing with the approval by HUD of COUNTY's application. 8. (a) CITY shall indemnify, hold harmless and defend COUNTY, its officers, agents and employees against all liability, claims, losses, demands and actions for injury to or death of persons or damage to property arising out of or alleged to arise out or in consequence of this Agreement, provided such liability, claims, demands, losses or actions are claimed to be due to the acts or omissions of CITY, its officers, agents or employees in the performance of this Agreement, including any activities conducted by CITY. (b) In addition, City shall indemnify and hold harmless COUNTY against any liability, claims, losses, demands, and actions incurred by COUNTY as a result of a determination by HUD that activities undertaken by CITY failed to comply with any laws, regulations, or policies applicable thereto or that any funds forwarded to CITY under this Agreement were improperly expended. (c) The provisions of paragraphs 1, 3, 4, 5, 6, and 7 of Section 2778 of the California Civil Code, as said section exists on the effective date of this Agree- ment, shall be applicable to the above indemnification provisions. Smith, Director of Planning ITEM: Cooperation Agreement For HCDA and Housing Assistance Plan SITUATION Previously the City Council has directed Staff to prepare the necessary forms for second year funding of $50,000 to be set aside for the implementation of projects in the Los Rios Area. Attached is the Cooperation Agreement for participation in the Second Year Urban County Block Grant Program, 1976-77, and the City's proposed Housing Assistance Plan. Both documents are similar to those which were adopted last year. The Housing Assistance Plan has been prepared by County Housing Planners in cooperation with City staff and representatives of SCAG. Because of the constant flux of demographic characteristics in San Juan Capistrano, the update is at best, a best guess. The results of the Special Census to be conducted later in January will give us a yardstick for measuring our estimate. In order to implement the Housing Assistance Plan, the City has joined the Orange County Housing Authority in order to make Section S housing available within San Juan Capistrano. To this date no units have been leased under that program. FINANCIAL IMPLICATIONS The addition of a $50,000 grant to be utilized in the Los Rios Area. This, combined with the $12,500 from last year, provides a total of $62,500. By continuing in the Program, it also puts the City in a good competitive position for additional funds if the implementation of the Los Rios Precise Plan calls for such funds. ALTERNATE ACTIONS 1. Decline to participate in the program. 2. Modify the program. 3. Approve the Cooperation Agreement, Housing Assistance Plan, and Second Year Application. Smith, Director of Planning SUBJECT: Housing and Community Development Act - Second Year Program SITUATION This item has appeared on the Council agenda previously and direction was given to Staff to initiate steps to secure second year funding. Attached is the Staff Report which was given to the Planning Commission for their hearing. During their meeting of December 9, 1975, they adopted Staff's recommendation. Following positive action by the City Council, Staff will then begin to prepare the appli- cation forms which will be brought again before the Council for final action. The purpose of this hearing is to gain any further input to the program or process. FINANCIAL IMPLICATIONS Monies gained through the Housing and Community Development Act will be applied specifically to the Los Rios Area after a plan and implementation program are adopted. It is anticipated that once the Los Rios plan is adopted, the City will be in a very favorable position to obtain additional funding through the Third Year Program of HCDA. ALTERNATE ACTIONS 1. Decline to participate in the Housing and Community Development Act. 2. Follow the Planning Commission recommendation. 3. Give new direction. Smith, Director of Planning SUBJECT: Housing and Community Development Act (HCDA) - Second Year Program APPLICANT City of San Juan Capistrano REASON FOR APPLICATION To fulfill administrative requirements and to indicate the amount and disposition of funds which the City desires in conjunction with the Housing and Community Development Act. SITUATION Attached are two memorandum which give background pertaining to HCDA. At their November 5, 1975 meeting, the City Council reviewed this material and directed Staff to take steps necessary to obtain an allocation for the second year program. This item should be considered at a Public Hearing so that members of the community have an opportunity to address the Planning Commission. Since the amount of funds which the City is requesting is relatively small, significant community participation is not anticipated. Since the City is apparently embarking on the Los Rios Precise Plan, Staff feels that we could request an allocation to be earmarked for the Study and future implementation programs. An amount of $50,000 is suggested. It is felt that this amount will not be significant in regard to the overall costs which will eventually be incurred in the Los Rios Area and will be readily absorbed. After it is determined how much and where the funding should be directed, Staff will then prepare the application. The application primarily relates to the goals and objectives of the City and to our budget. As a part of the application, there is also the Housing Assistance Program (HAP). Last year the City had a target of fifteen low -to -moderate income units. To meet this objective, the City participates with the Orange County Housing.Authority in the Section 8 Program. We anticipate to have the same number of target units in the second year application. 0 Agenda Item - HCDA -2- December 2, 1975 ALTERNATE ACTIONS 1.. For the second year program a change of format has been prepared. All monies will not be a direct entitlement (past-thru) but shall be allocated on a proicct basis. 'thus individual cities will be competing for the total County grant. It doesn't seem that any city will be in jeopardy since the County share may not be able to be spent on a project. Since San*Juan Capistrano does not have a proicct in the mill at this time, we will probably submit a request for $24,000 to be earmarked for future San Juan Capistrano use. This amount is equivalent to that which was "promised" to us when the City threw itself in with the County in order for them to get an entitlement grant. Also as part of the second yesr program, extensive citizen participation was anticipated. However, since the City may get only $24,000, and.since this money is not earmarked for a special project which is imminent, Staff suggested that the County not send mailers to the target area in San Juan Capistrano, and that such activity would only cause further consternation and frustration in that the City has not yet developed a viable project. If this is the City's position, it will probably be necessary for us to require a few public hearings. An HCPA representative is scheduled to appoar before the City Council on November 5 in order to discuss/explain the second year program. After that meeting, a HCDA application for the second year should be reviewed by the Planning Commission at a public hearing and then at a City Council public hearing. These should wrap up by December, and the City should submit its proposal and cost estimates to the County. After this action there is probably nothing :more to be done with the exception of approving a cooperative agreement which may be placed on a Council agenda in March or April. Once the City develops a downtown project relating to cultural preservation, historic preservation, housing, or public improvements, we will be in a position to have a project upon which we can spend the accumulated HCDA funds and attempt to compete with other communities for additional funding. I have met with members of his staff to discuss the City's participation in the second year program. Notes of that meeting are attached in my memorandum dated October 21. Also attached is a September 29, 1975 letter from the EMA which describes their involve- ment in a second year program. FINANCIAL IMPLICATIONS The receipt of additional funds which should be at least $24,000, but may be greater if a project is pursued. ALTERNATE ACTIONS 1. Receive and file. 2. Once the City develops a downtown project relating to cultural preservation, historic preservation, housing, or public improvements, we will be in a position to have a project upon which we can spend the accumulated HCDA funds and attempt to compete with other communities for additional funding. In order to minimize the pitfalls and problems associated with last year's application effort, the County has already begun to develop a second year program. It is hoped, therefore, that this letter will serve not only as notice, but as an impetus for City staff to begin "gearing up." This second year entails a rather different approach to the program than occurred last year. Based upon continued communications with HUD, the County understands that all the Urban County applications will be required to emphasize an areawide approach in the second year application. The program will not be put together on a piecemeal, city by city basis. Rather, each City's proposal will be weighed and judged in relation to its applicability to areawide priorities. More specifically, HUD requires that there be no formula based allocation to participating cities. It is intended that an individual City will submit proposals and cost estimates to the County for consideration. These proposals must be fully documented and justified as to need and priority in the City and or area. This documentation must include the implementation of a viable citizen participation plan. The County, in turn, will judge the particular proposals as it relates to areawide needs, goals and priorities. This approach will produce a much more effective and coherent Housing and Community Development Program which will comply more fully with the intent of the Act. Cooperation Agreements It will be necessary to execute Cooperation Agreements between each City and the County for the Second Year Program. Based upon recent discussions with HUD, no changes are expected to occur in the content of last year's final, adopted agreement. This subject will be more fully addressed at the City Council presentations scheduled for the first part of October. Execution of these agreements by Cities wishing to participate will hopefully occur between November 1 and January 1. City Council Presentations and City/County Staff Meetings Presentations before City Councils are now being scheduled. The purpose of this presentation is to inform your City of the changes in approach and emphasis in the Second Year Program. This will give City Councils an opportunity to determine how the second year will affect each City's program and effort. More than one City Council presentation by County staff is not foreseen this second year. The County expects that Cities should now be familiar with H/CD procedures based upon the first year's experience. Hopefully, major questions can be identified and answered during or prior to the meetings with your City Council. Meetings between City staff and County H/CD staff will be scheduled prior to City Council presentations. These meetings are intended to determine: (1) where Cities are in terms of documentation of effort and citizen participation; (2) what is anticipated for the second year program; and (3) the status of updating Housing Assistance Plans (HAPs). Citizen Participation The County is presently developing a citizen participation plan which is required by the Housing and Community Development Act. Hopefully, this plan will be available for public review by the middle of October. This plan is intended to cover the entire entitlement application. Each City, though, is encouraged to develop and implement its own citizen participating effort and plan to aid in the development of proposals. Documen- tation of need will be a direct objective of this citizen participation effort. Consideration by the County of City proposals will be based on this documentation and/or support given by the citizen participation effort. Further discussions of this topic will occur during the preliminary staff meetings. It should be pointed out that the citizen participation process does not require the concurrence of any person or groups involved in the citizen participation process in final determinations concerning the findings and contents of the application. The sole responsibility and authority to make such final determi- nations rests exclusively with the applicant. The County, however, is looking to a more concerted citizen participation effort this second year in both the unincorporated area and the incorporated cities. Final adoption, public hearing before Board of Supervisors on application. This schedule is tentative at best. It does, however, represent a desire by the County to avoid last year's critical time deadlines and associated problems. If all goes according to schedule, the County hopes to complete the major portion of the Second Year effort by mid-January. This would enable us to continue with first year implementation and monitoring. Further discussion and expansion of the considerations raised in this letter will occur during the staff meetings early in October.
