EXTENSION OF PERSONAL SERVICES AGREEMENT WEED, RUBBISH and THISTLE ABATEMENT This extension agreement is entered into this L_V_d�y f September, 2006, by and between the City of San Juan Capistrano ("City") and E. Stewart and Associates, Inc. ("Consultant'). WHEREAS, City and Consultant have entered into a weed abatement agreement as of October 2002 which is due to expire by October 31, 2006, and WHEREAS, City desires to retain consultant beyond the expiration date until such time that a final determination can be made regarding future weed abatement services, NOW THEREFORE, City and Consultant mutually agree as follows: Section 1. The existing weed abatement contract dated October 15, 2002, is hereby extended for up to a period of 60 days under the same terms and conditions as provided for in the agreement. Section 2. City reserves the right to terminate this extension agreement by giving Consultant at least 10 days advance written notice of termination. Edwin Stewart PERSONAL SERVICES AGREEMENT ,� THIS AGREEMENT is made and entered into this 6aENay of 03 0 2002, by and between the City of San Juan Capistrano (hereinafter referred to as the "City") and Stewart and Associates (hereinafter referred to as "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to provide Weed, Rubbish, and Thistle Abatement; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by Consultant shall consist of those tasks as set forth in the Specifications and Contract Documents for Weed, Rubbish, and Thistle Abatement dated August 2002 (Exhibit "A") attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and services required hereunder shall be completed by no later than October 31, 2006. Section 3. Compensation. 3.1 Amount. Total compensation for the scope of services for this Project shall not exceed those unit prices, as set forth in Stewart and Associates proposal dated September 24, 2002 (Exhibit "B"), attached and incorporated herein by reference. 1 SD 3.2 Rate Schedule. The services shall be billed to the City at the hourly rate set forth in Exhibit "B," attached and incorporated herein by reference. Included within the compensation are all the Consultant's ordinary office and overhead expenses incurred by it, its agents and employees, including meetings with the City representatives and incidental costs to perform the stipulated services. Submittals shall be in accordance with Consultant's proposal. 3.3 Method of Payment. Consultant shall submit monthly invoices based on total services which have been satisfactorily completed and specifying a percentage of projected completion for approval by the City. The City will pay monthly progress payments based on approved invoices in accordance with this Section. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. 3.4 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to City. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. 2 Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed construction site, including the location of all utilities, and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. All services to be rendered hereunder shall be subject to the direction and approval of the City. 3 Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agentg, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non-owned vehicles in the following minimum amounts: 4 $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit the insurance certificates, including the deductible or self-retention amount, and an additional insured endorsement to the Consultant's general liability and umbrella liability policies to the City Clerk's office for certification that the insurance requirements of this Agreement have been satisfied. 14.5 Not Applicable 14.6 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions have been satisfied. 5 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City and Consultant shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to the other party In addition, this Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. Attorneys' Fees. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other relief to which he may be entitled. Section 18. Dispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). 6 Section 19. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. SITUATION The City of San Juan Capistrano, per City Ordinance #348, provides for the annual abatement of weeds and the removal of garbage, refuse, and dirt throughout the City. Abating these nuisances aides in the reduction of risks associated with fire and health hazards and makes our community a safer, more beautiful place in which to live. Weed abatement is also required in City High Fire Hazard Severity Zones, per Assembly Bill 337 (Attachment 1) and as directed by the Orange County Fire Authority and designated City representatives. Firebreaks, by means of weed abatement, are required on the northeasterly and southeasterly boundaries of the City. Thistle abatement is required on approximately 1200 acres of City Open Space (Attachment 2). Comprehensive thistle abatement conducted during 2001-2002 achieved approximately 90-95% killing of thistle on site. Abatement on an as needed basis will be required annually to provide complete and continued eradication of thistle. It is anticipated that thistle will steadily decline with continued annual treatment, and staff will evaluate its progress annually. Property to be abated shall include those areas of City Open Space as determined and directed by the Director of Public Works or designee. Additionally, the City has ten water facility sites (approximately 210,000 SF) requiring annual, year-round weed control (Attachment 3). The City controls approximately 6.5 miles of riverian environment along San Juan, Trabuco, and Oso Creeks. National Pollutant Discharge Elimination System (NPDES) requirements state that biannual removals of waste and trash are mandatory. Recent years' cleanings have produced an estimated 40 Tons of trash and rubbish. Trash and rubbish pickup shall be carried out by hand methods, and the contractor shall recognize the fragile nature of the riverian environment. Volunteer trash removals such as the recent First Intercoastal and Watershed Cleanup Day, help to reduce the volume of contract removals, as well as costs. On September 4, 2002, the City sent out requests for proposals to seven contractors to provide weed, rubbish, and thistle abatement throughout the City. The Public Works department received one bid for this work on September 24, 2002, (Attachment 4). Stewart and Associates has provided weed and thistle abatement in the City of San Juan Capistrano for the past fifteen years. Their work has always been of the finest quality and their costs low. This firm responds immediately for emergency and extra work, oftentimes not charging the City additional fees. Other weed abatement contractors contacted have stated that they cannot compete with the pricing that Stewart and Associates provides, and thus were reluctant to submit on this request for proposal. Stewart and Associates has provided a bid cost, which is unchanged from their previous four-year agreement with the City of San Juan Capistrano. This represents a very real and large cost savings over what other cities are being charged for the same type of work. Stewart and Associates has consistently provided the City of San Juan Capistrano fair dealings and hard work. A person, firm or corporation who has submitted a sub-proposal to a contractor, or who has quoted prices on materials to a contractor, is not hereby disqualified from submitting a proposal in his own behalf. 3 Proposals 40 9 Proposals to receive consideration shall be in accordance with the following instructions: A. Each contractor shall submit a statement of experience and list of equipment. G. Proposals shall be delivered to the Public Works Department on or before the day and hour set for receipt of proposals. H. The Contractor must submit a copy of their Safety and Injury and Illness Prevention Programs with their proposal. I. The Contractor shall have a minimum of 5 years of comparable experience to the field of weed abatement. Licensing of Contractor Contractor is required to possess a current City Business License prior to commencement of work. Evidence of certain State permits approving application of chemicals used in the abatement of Thistle is required. Recent years cleanings have produced an estimated 40Tons of trash and rubbish. Trash and rubbish pickup shall be carried out by hand methods and the contractor shall recognize the fragile nature of the riverian environment. Signature Company 13 • GENERAL PROVISIONS 0 REQUIREMENTS, PERSONNEL, EQUIPMENT, MATERIALS, AND SUPERVISION REQUIREMENTS (a) Work will ordinarily be performed between the hours of 7:00 AM and 6:00 PM, Monday through Friday. During emergencies, work may be required at other than normal hours. The hourly rates requested in the bid proposal address both routine and emergency work. (b) Contractor shall maintain an adequate crew of at least two experienced employees to perform the service required. (c) Contractor shall provide the City with the name of a contact person and a telephone number where he/she can be reached twenty-four(24) hours a day. This person must be available for emergency work scheduling at all times. Contractor shall be able to respond to emergency work requests within one hour of notification by City. (d) Contractor will be required to supply a list of equipment owned and available for work. (e) Contractor will be required to supply a list of references for similar work performed. (f) Contractor may be required to supply additional experience references if requested by City. (g) Contractor shall provide City with required proof of liability insurance, workman's compensation insurance, vehicle insurance, and City business license as noted in the contract. (h) Hourly rates and unit prices quoted shall include all labor, equipment, transportation, cleanup, disposal, insurance, taxes and any other costs. (i) Hourly rates and unit prices quoted shall include all safety equipment required. Traffic control may be required on some sites, and shall be included in quoted prices. Q) Hourly rates for emergency work shall be for actual time spent on the job site. No travel time will be paid. (k) The bid will be awarded based on an analysis of: Bid Prices; Statement of Experience, Statement of Equipment, and all provisions noted in the Instructions to Bidders and General Provisions and Specifications Sections of the Specification Package. (1) At any time prior to bid date, Contractor may inspect City property for further information, if desired. City representatives will be available if desired to answer questions. (m) Contractor shall protect any and all private property adjacent to work areas. Any damage to private property resulting directly or indirectly from Contractors actions shall be the responsibility of the Contractor. 14 (n) All employees of Wractor shall wear a uniform or shifthat clearly identifies the company. (o) All employees of Contractor shall wear an orange safety vest whenever working in City streets, or within 10 feet of City streets. (p) Contractor must be able to provide a list of employee's names, dates worked, and hours worked on each date if requested by the City. PERSONNEL The contractor shall use and furnish all labor necessary for the satisfactory performance for the work set forth in this contract. (a) Contractor's Laborers The Contractor agrees to require his laborers to present a neat appearance at all times while engaged in the performance of their duties and maintain good bearing and deportment toward the public. Should for any reason an employee be unsatisfactory in the opinion of the City, the Contractor, when notified in writing, shall cause that employee to be removed from the job and replaced by a satisfactory laborer. (b) Laborer Attire The Contractor shall require each of his employees to adhere to basic standards of working attire. These are basically uniforms, with the Contractor's company name or insignia clearly visible, proper shoes and other gear required by State Safety Regulations, and proper wearing of clothing. Shirts shall be worn at all times, buttoned and tucked in. (c ) Typical Tasks Contractor shall supply laborers with the skills to perform various semi-skilled duties in connection with custodial maintenance; cleaning rubbish and debris; operating a variety of hand and power tools; painting and maintaining of public facilities, and operating light equipment. (d) Experience Supervisors and foremen shall have a minimum of three years experience in weed abatement. (e) Licenses Laborers will be required to possess a valid and current California Drivers License. (f) Knowledge and Abilities The Contractors representatives shall have a general knowledge of the weed abatement maintenance industry including suitable experience in the field to perform the required work in a safe and thoughtful manner. 15 (g) Additional Labor Additional laborers will be supplied by the Contractor if so requested by the Director of Public Works. Any additional laborers will be paid at a rate equal to the prevailing wage rate and mark up as shown on the form titled "Contractor's Hourly Rate". EQUIPMENT The contractor shall use and furnish all equipment necessary for the satisfactory performance of the work set forth in this contract. (a) Vehicles Contractor shall display the name of his firm on any vehicles used by the Contractor's employees to carry supplies and equipment. The firm name shall be in letters large enough to be easily legible from a distance of fifty (50) feet. (b) Maintenance All equipment used by the Contractor shall be kept in a neat and clean appearance, maintained in top mechanical condition and property adjusted, from an operational standpoint and from a safety standpoint. (c) Storage of Equipment The Contractor shall provide for the storage of equipment necessary to perform the work set forth in the contract. The City, may, upon special approval, provide a limited amount of space for occasional storage of the Contractor's equipment that is used in the City. The space and restrictions concerning length of time and hours of storage shall be designated by the Director of Public Works or his/her authorized representative. The Contractor shall be limited to the space so designated. The City shall not be responsible for anything stolen, vandalized or damaged otherwise. MATERIALS The contractor shall furnish all material, including but not limited to equipment etc. necessary for the performance of the work set forth in this contract. (a) Storage of Materials The Contractor shall provide for the storage of materials necessary to perform the work set forth in the contract. The City, may, upon special approval, provide a limited amount of space for occasional storage of the Contractor's materials that is used in the City. The space and restrictions concerning length of time and hours of storage shall be designated by the Director of Public Works or his/her authorized representative. The Contractor shall be limited to the space so designated. The City shall not be responsible for anything stolen, vandalized or damaged otherwise. SUPERVISION The Contractor shall provide such adequate supervision as to furnish continuous surveillance of workmanship and adherence to schedules by the laborers performing the work under contract. The field supervisor or his representative shall check with the Department of Public 16 Works weekly as to (1) Aule of work; (2) complaints; and (^equacy of performance. The Contractor shall submit such reports as the City may require to insure compliance with scheduled worts. The Supervisor shall be in the City at least 20% of the time while work is in progress. The Contractor shall be penalized One Hundred Dollars ($100) per week for failing to be in the City at least 5 hours per week. TELEPHONE SERVICE AND EMERGENCY NUMBERS The Contractor shall provide the City at all times throughout the duration of this contract emergency telephone numbers of at least two (2) qualified persons who can be called for emergency conditions at anytime that Contractor's representatives are not immediately available at the job site. An alternate emergency number shall be provided in case no answer is received at the first number. The emergency number shall be used to contact the representative of the Contractor who can take the necessary action required to alleviate an emergency condition which threatens to cause damage to any City property. In addition, the Contractor shall employ person(s) to answer telephone complaints, requests for service, etc. (an answering service will not be considered sufficient for this purpose) during normal City working hours. Normal City working hours are 8.00 A.M. to 5:00 P.M., Monday to Friday. Contractor is required to maintain an office within a 60-mile radius of the City. Contractor is further required to provide City with a 24-hour emergency number for contact outside normal working hours. The response to an emergency call-out by the Contractor shall not be more than three (3) hours and shall by considered part of the normal contract except when delayed by problems caused by vehicle accidents or Acts of God. EMERGENCY MEDICAL FACILITY (a) The bidder is required to designate a twenty-four (24) hour emergency medical facility to provide emergency medical treatment/care in the event of injury to any of the contractor's employees. It will be the responsibility of the contractor's crew supervisor/leadworker to transport or make arrangements for the transportation of any injured employee to and from the designated emergency medical facility or any similar medical facility. (b) The successful bidder must provide the City with one (1) copy of the " Emergency Medical Facility Designation and Procedure Sheet" before a contract is awarded. NPDES REQUIREMENTS The San Diego Regional Water Quality Control Board has issued a permit which governs storm water and non-storm water discharges resulting from municipal activities performed within Orange County. The RWQCP Permit is National Pollution Discharge System (NPDES) Permit No. CAS108740. A copy of the RWQCB Permit is available for review from the City of San Juan Capistrano. The County of Orange has developed a Drainage Area Management Plan(DAMP) to be compliant with Permit requirements. Evaluation of the activities subject to DAMP requirements performed under this contract will be conducted by the City to verify compliance with DAMP requirements, and will be required through contractor self-evaluation as determined by the City. 17 SPECIAL PROVISIONS WEED AND RUBBISH ABATEMENT SCOPE OF WORK 1. Work to be Done - Work to be done consists of furnishing all labor, supervision, methods of processes, implements, tools, machinery, safety equipment, traffic control, materials and proper licensing required to identify, list and clean those areas designated by the City representative, and to leave the grounds in a neat condition. If the City representative determines that the contractor has not satisfactorily cleaned any designated areas, he shall cause the payment for the cleaning of such areas to be withheld until such areas are properly cleaned. The contractor shall furnish and maintain maps designating exact locations and areas of lots and parcels cleaned. He shall submit to the City reports of completion of work identifying each parcel by O.C. Assessor's Code Number, Book Number, Page Number, and Parcel Number and Site Address, together with the costs for each parcel according to the unit cost schedules of this agreement. Such reports shall be signed and sworn to by the contractor. All work for which a progress payment is made shall be reported on and certified according to the foregoing procedure, and in addition thereto, the City representative shall certify that the work has been inspected and was completed to the satisfaction of the City prior to payment by the City. The contractor shall also furnish administrative needs pertaining to the proper property owner notification, mailing, handling of property owner questions and complaints, notification of assessments, processing of assessments to the County Tax Assessors office and other needs as arises for the processing of private weed abatement per Title 6 Chapter 7 of the City of San Juan Capistrano Municipal Code. Copies of the municipal code section are available at the Office of the City Clerk or online at www.sanjuancapistrano.org. There are approximately 500 privately owned parcels in the City of San Juan Capistrano which require weed abatement noticing. 2. Authorization of Work - Work will not be performed without prior approval and only as authorized by the City representative. 3. Before and After Photographs - In order to provide proper back-up related to work required and work performed, Contractor shall photograph and log by parcel number all parcels he is directed to perform work on prior to beginning and upon completion of said work. 4. Progress of Work - Cleaning shall proceed in an orderly manner. Wherever possible, lots shall be completely finished prior to workmen proceeding to the next parcel. Any exceptions shall be approved by the City representative. 5. Authority to Enter Private Premises to Abate Nuisances Reference is made to Section 39572 of the California Government Code which makes the following provisions: "The City Engineer (or any other office of the City) may enter upon private property to abate the nuisance." 18 Any contractor with whom a contract has been entered into by the City hereunder, and his assistants, deputies, employees, and agents, are hereby expressly authorized to enter upon private property for the purpose of abating the nuisance for which the contract was awarded, unless otherwise noted and/or directed by City representative. 6. Alterations - The City reserves the right to increase or decrease the quantity of any Rem or portion of the work or to omit portions of the work as may be deemed necessary or advisable by the City. The City representative may make such alterations or deviations, additions to, or omissions from these specifications, as may be detem-dned during the progress of the work to be necessary and advisable for the proper completion thereof. Such alterations or deviations, additions or omissions shall in no way affect or make void the contract. Upon written order of the City representative, contractor shall proceed with the work as increased, decreased or altered. 7. Acceptance of Work Done - The City representative will make inspections and determine that the work has been completed in all respects in accordance with these specifications. 8. Billing Form - Contractor shall use the approved billing form and progress payment form given to him by the City. METHOD OF WORK 1. Discing - Lots and parkways shall be disced with an approved double throw disc at a sufficient depth to place weeds under the finished soil surface. Discing shall be performed so as to completely eliminate all standing weeds and shall be to the satisfaction of the City representative. 2. Mowing - When, in the opinion of the City representative, discing is impractical or proves unsatisfactory, weeds shall be cut to within two (2) inches of the finished soil surface with an approved mechanical mower. 3. Hand Work- Lots cleaned by discing, edging and/or mowing or a combination of the above, shall be hand cleaned along the edges, slopes, parkway, and/or other areas where machine cleaning is not practical oniv as directed by the City representative. Lots so located as to be unsuitable for machine cleaning will be hand cleaned only as directed by the City representative. The price for such cleaning will be paid for as hand labor per square foot with a 100 foot minimum. 4. Rubbish and Tumbleweed Removal - Removal of rubbish and tumbleweeds shall be performed in a workmanlike manner, satisfactory to the City representative. Rubbish to be removed shall be loaded by approved mechanical means. Where, in the opinion of the City representative, mechanical loading is impractical or proves unsatisfactory, the contractor shall load such rubbish manually. The contractor shall remove only such materials designated for removal by the City representative on the job. If the contractor removes undesignated materials, he shall return such materials to the site from which they were removed, and no additional compensation will be made therefore. 19 Rubbish shall be Dosed of at approved locations. Th*urrent disposal charge at the Prima Deshecha Landfill is $27.00 per ton for standard debris. After removal operations have been completed, the grounds shall be left in a neat and presentable condition, satisfactory to the City representative. EQUIPMENT 1. The contractor shall provide adequate and suitable equipment to meet contract requirements and, when ordered by the City representative, shall remove unsuitable equipment from the work. 2. Minimum Equipment List: a. One track-type tractor (Caterpillar size D-4 or equal, and being less than ten years old) equipped with the following: 1) A minimum 7'6"wide disc of pull-type off-set with blades of 26" or larger. 2) Minimum weight of disc shall be two ton. b. One rubber-tired tractor with the following equipment available: 1) A skip-load bucket not less that 1/4 cubic yard capacity. 2) A disc. 3) One flail mower with minimum 50 HP. C. One rubbish truck with loading capacity of 20 yards or greater. d. One chain saw. e. One hand-operated mower. f. Transport trailers capable of jack-knifing all public curbs and sidewalks in order to avoid damage to same. (Note: Damage to public property will be paid for by Contractor.) g. Weed eaters and other hand tools. All equipment must have suitable transport and be equipped with an approved spark arrestor, fire extinguisher, and wheel chocks where applicable. All equipment shall be available for inspection within ten (10) days after bidders have been contacted. Unsatisfactory equipment will be rejected. All equipment shall be maintained in a reasonable mechanical condition and replacement equipment shall be approved by City representative. If such equipment is not replaced, contractor is subject to having his contract annulled and shall be responsible for any difference in fees over and beyond for replacement of his contract. In the event bidder wishes to substitute other equipment for any item specified, such substitution shall be justified to the satisfaction of the City representative. ADMINISTRATION The contractor shall furnish administrative needs pertaining to the proper property owner notification, mailing, handling of property owner questions and complaints, notification of assessments, processing of assessments to the County Tax Assessors 20 Office and other As as arises for the processing of date weed abatement per Title 6 Chapter 7 of the City of San Juan Capistrano Municipal Code. Copies of the municipal code section are available at the Office of the City Clerk or online at www.sanjuancapistrano.org. There are approximately 500 privately owned parcels in the City of San Juan Capistrano which require weed abatement noticing. The City requires that a preliminary notice be sent out in February and final notices be sent out in late March. Private weed abatements are due by May le of each year. Non- compliant properties are to be abated by June 15"'. Assessments for these properties are due to the county assessors office no later than August 1&. 1. The Contractor shall meet with representatives of the City and Orange County Fire Authority in November of each year to review the previous years abatement and to make note of areas which require correction or modification for the following years abatement. 2. The Contractor shall print a list of properties from the previous year for his field representative to review to establish the property owners to be notified this year. 3. The Contractor shall prepare and print Preliminary Notices; prepare mailing labels; and mail out the Preliminary Notices. The Contractor is responsible for mailing charges. (By February of each year.) 4. The Contractor is responsible for answering property owner questions in regards to the Preliminary Notice mailing. (The contractors number shall be the contact number shown on the notice.) 5. The Contractors field staff shall make inspections of the properties throughout the City and revise list accordingly. 6. The Contractor shall prepare and print Official Notice to Abate; prepare mailing labels; and mail out the Official Notices. (By April 1 st of each year.) The Contractor is responsible for mailing charges. The Notice shall include the Public Meeting Date and Deadline Date. 7. The Contractor shall attend a Public Meeting to answer property owner questions in regards to weed abatement. (Held the 2nd Thursday in May). 8. The Contractor shall after the deadline date of May 15'" of each year compile a list of private properties which have not met the abatement requirements. This requires field staff survey of all noticed properties. 9. The Contractor shall post all non-compliant properties within fifteen days of the deadline date with a notice stating that the property owner has not complied with the city's weed abatement ordinance and that the City will have the property abated in ten days if not addressed and the costs assessed to the property owners property tax bill. 10. The Contractor shall also attempt to contact non-compliant property owners by all means available. (Phone E-mail, letter) 11. The Contractor shall prepare the paperwork necessary and mail out assessment letters to those properties still non-compliant. (By June 16"'of each year.) 21 12. The Contractoioall prepare and deliver a basis for Assment, list of assessed properties and final weed abatement report to the City for preparation of the Ctiy Council approval of assessments. 13. The Contractor shall attend the Public Hearing in regards to weed abatement. 14. The Contractor shall prepare the deliminited Dos Disks with the City Council approved assessment information to the County Assessors Office within two days of the City Council approval of assessments. 22 SPECIAL PROVISIONS THISTLE ABATEMENT - CITY OPEN SPACE SCOPE OF WORK 1. Work to be Done - Work to be done consists of furnishing all labor, supervision, methods of processes, implements, tools, machinery, safety equipment, traffic control, materials and proper licensing required to abate thistle from City--s approximate 1200 acres of City Open Space. For the protection of nearby communities and residences, aerial spraying will not be permitted. Note: Comprehensive thistle abatement conducted during 1996-1997 achieved approximate 90-95% kill of thistle on site. Continued abatement on an as needed basis will be required annually to provide complete and continued eradication of thistle. It is anticipated that thistle will steadily decline with continued annual treatment. Progress will be evaluated annually. Property to be abated shall include those areas of City Open Space as determined and directed by the Director of Public Works or City representative. 2. REPORTS If awarded the contract, Contractor shall be responsible for providing City with an Advisory Report, prepared by a Licensed Pest Control Advisor and approved by the Orange County Agriculture Commission, which provides specific method and chemical recommendations for abatement of thistle. Upon approval by the County Agriculture Commission, Contractor shall be responsible for providing licensed qualified applicators to perform the work. Comprehensive thistle abatement conducted during 2001- 2002 achieved approximate 90-95% kill of thistle on site. Continued abatement on an as needed basis will be required annually to provide complete and continued eradication of thistle. It is anticipated that thistle will steadily decline with continued annual treatment. Progress will be evaluated annually. RUBBISH REMOVAL—City Streambed Areas The City controls approximately miles (approximately 70,000 L.F. of riverbank) of riverian environment which per recent National Pollutant Discharge Elimination System (NPDES) requirements requires biannual removals of waste and trash. Recent years cleanings have produced an estimated 40Tons of trash and rubbish. Trash and rubbish pickup shall be carried out by hand methods and the contractor shall recognize the fragile nature of the riverian environment.
