The purpose of our materials testing services will be to sample and test concrete placed on the project to evaluate conformance with the project specifications. If requested, we will also provide deputy inspection services to evalu- ate structural steel reinforcement for caissons, grade beams and tie -back anchors. We understand that the project will include construction of 24 drilled cast -in-place caissons. The caissons will be approximately 24 inches in diameter and approximately 60 feet deep. The cais- sons will be connected to a grade beam and tie -back anchors. The purpose of the caissons is to provide stability to the reservoir from nearby landslide conditions. Our services will not include geotechnical observation or testing services, which is being provided by others. Detailed plans, specifications, and construction scheduling have not been provided. Based on our experience we anticipate that approximately four caissons may be constructed per day for a total of approximately six days of caisson construction. We also estimate that one set of four concrete cylinders will be collected for testing each day. We estimate that grade beam and tie- back installation will take approximately six days. These estimates are for planning purposes and should be reviewed by project team members. Depending on actual construction duration our costs may vary. SCOPE OF SERVICES Our services will include sampling and testing of concrete cylinders on an as -needed basis dur- ing construction. A separate scope of services is also presented to provide deputy inspection of structural steel reinforcement and installation of tie -back anchors. Based on our understanding of the proposed construction and our experience with similar projects, we propose to provide the following scope of services. Coordination and Quality Control Attachment 1 —Page 1 of EA Krum Reservoir Improvements San Juan Capistrano, California August 2, 2005 Proposal No. P-12727 • Project coordination, technical support and management, including review of the pro- ject plans and specifications, distribution of test reports, and work scheduling. • Attendance at pre -construction meetings and as -needed field meetings. Materials Testing Services • Field technician services sampling of concrete including preparation of concrete cylin- ders, measurement of slump and temperature, labeling, documentation, and transporting samples to our laboratory. • Preparation of daily reports and cylinder test data sheets. • Laboratory testing to evaluate compressive strength of concrete, mortar, concrete and grout specimens sampled in the field. • Preparation and submittal of laboratory test reports. Deputy Inspection Services • Deputy inspection services during caisson, grade beam and tie -back construction. In- spection services include evaluation of caisson reinforcing steel and cage placement, placement of caisson concrete, grade beam steel reinforcement and tie -back anchors and installation. • Preparation of progress reports and field memoranda to document the items inspected. • If work performed is not in compliance with the project plans and specifications, the contractor will be notified, verbally. When corrected, the corrective action taken will be recorded. If not corrected, the work will be rejected and the contractor and project in- spector will be notified verbally and in writing of the rejection item. • Issuance of final inspection reports. ASSUMPTIONS Based on our experience with similar projects, the following assumptions have been made in the preparation of our scope of services: • We assume that materials testing services will be provided based on 4 -hour per day field work for each day of construction as estimated herein. • We assume that deputy inspection services will be provided based on 8 -hour per day field work for each day of construction as estimated herein. If deputy inspection services are in- cluded in our scope of work, the deputy inspector will also prepare and collect concrete samples. • Our services do not include geotechnical observation or testing services. • Our services do not include monitoring of tie -back anchor load testing. • We assume our services are subject to prevailing wage requirements. • Our estimated fee is based on the scope of services and assumptions outlined above and do not include stand-by time or costs associated with retesting or reinspecting materials that were found not to be in compliance with the project plans or specifications. Our services will depend on the construction schedule and the contractor's operations. Hours spent that ex- ceed those in the attached tables will be billed on a time -and -materials basis. ESTIMATED FEES We propose to provide materials testing and inspection services on a time -and -materials basis in accordance with the attached Schedule of Fees and Schedule of Fees for Laboratory Testing. Our estimated fee for the materials testing scope of services described herein is approximately $8,800 (eight thousand eight hundred dollars). If our scope of services is to include deputy in- Attachmc t I —Page 2 of 5 E Krum Reservoir Improvements San Juan Capistrano, California 0 August 2, 2005 Proposal No. P-12727 spection services we estimate that our additional fee will be approximately $5,000 (five thou- sand dollars). The total estimated fee for materials and deputy inspection services is approximately $13,800 (thirteen thousand eight hundred dollars). Ninyo & Moore appreciates the opportunity to submit this proposal and looks forward to working with you. Conceptual engineering studies for the protection of existing pipeline have been completed by RBF Consulting, Inc. (RBF). RBF recommends a protection system which includes the installation of drilled caissons, tie -back anchors and a continuous grade beam. Staff along with its geotechnical consultant, Lawson and Associates Geotechnical Consulting, concurs with RBF's recommendation and recommends that the protection system be implemented. Final engineering plans, structural inspection, and construction management services are required for this work. Given their extensive involvement with this project and their experience with the slope stabilization efforts for the Terminal Reservoir No. 3 Project, staff recommends that RBF perform these services. RBF submitted a cost proposal of $233,780. Staff has reviewed this proposal and finds it to be reasonable for the scope of work. Staff recommends that a Personal Services Agreement in the amount of $233,780 be awarded to RBF on an emergency basis to allow for timely completion of the pipeline protection plans. The Agreement has been approved as to form by the City Attorney and has been executed by RBF. The Agreement is attached for your review and final execution. FINANCIAL CONSIDERATIONS The preliminary construction estimate for all the work associated with the Avenida Placida Landslide is $3.5 Million. This work was unanticipated and is not included in the FY 05/06 Budget. Staff will seek FEMA reimbursement for the aforementioned costs. Personal Services Agreement — RBF Consulting, Inc. 3/21/200-4 AGENDA REPORT G 1 a TO: Dave Adams, City Manager FROM: Amy Amirani, Public Works Director SUBJECT: Consideration of Project Update and Additional Appropriation for Expenditures Related to the Avenida Placida Landslide (Avenida Placida) (FEMA DR -1585) RECOMMENDATION: By motion, appropriate $1.9 Million from the General Fund Reserve to cover the costs for remaining work items relating to the Avenida Placida Landslide. SITUATION: In early June 2005, an ancient landslide, known as the Avenida Placida Landslide was re -activated. According to the City's Geotechnical Engineer, Lawson and Associates Geotechnical Consulting (LGC), the re -activation of the landslide was due to the heavy rains experienced by Southern California during the declared Federal Emergency Management Agency (FEMA) DR -1585 event. This event occurred during the period of February 16 to 23, 2005. The landslide is located west of the San Juan Hills Estates residential development, just above Avenida Placida. . The landslide deposited a significant amount of debris in an existing detention basin within the San Juan Hills Estates Development. The landslide also impacted existing domestic water facilities at the Krum Reservoir site. LGC recommended that mitigation measures be taken to remove the debris from the detention basin and stabilize the existing water facilities. Landslide Debris Removal The work to remove the landslide debris from the detention basin and re -grade the impacted area has been completed by the City's contractor, Earth Construction and Mining (ECM). On February 21, 2006, the City Council adopted a resolution declaring ECM's contract work to be complete. Stabilization of Domestic Water Facilities Based on LGC's recommendations, staff proceeded under an emergency basis to prepare engineering plans, solicit bids, and award a construction contract for the stabilization of the existing domestic water facilities at the Krum Reservoir site. On 0 Agenda Report Paae 2 0 March 21, 2006 October 14, 2005, the City Manager, under delegated authority from the City Council executed a construction contract with Calex Engineering Company (Calex) for a total of $1,884,000. The stabilization work is ongoing and is expected to be completed in late June 2006. Environmental Approvals The work associated with the Avenida Placida Landslide has been previously reviewed in accordance with the California Environmental Quality Act (CEQA) of 1970. Staff has determined that the proposed mitigation measures constitute an "emergency project' under the provisions of Section 15269 of the CEQA Guidelines. Required permits from the U.S. Fish and Wildlife, California Department of Fish and Game, Army Corps of Engineers, and Regional Water Quality Control Board were obtained prior to the start of any construction work. As part of the permit provisions, the City is required to restore up to 7 acres of native habitat. Staff is working with the aforementioned resource agencies to finalize the restoration plans. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: Not applicable. FINANCIAL CONSIDERATIONS: In September 2005, the City Council appropriated $3.5 million from the General Fund Reserve for expenditures associated with the Avenida Placida Landslide. The final cost of the landslide debris removal including construction, construction management, engineering, and inspection is approximately $1.7 million. The projected cost of the stabilization of domestic water facilities as well as the environmental restoration effort is approximately $3.7 million. This equates to a total project cost of $5.4 million, which is $1.9 million over the amount appropriated by the City Council. The cost difference can be attributed to two factors. The first is that construction costs for both the landslide debris removal and the stabilization work are $1.3 million higher than initial estimates. This is due mainly to contractors being very busy, resulting in an uncompetitive bid market. In addition, the unpredictable cost of materials, including structural steel and concrete has also impacted the market. The second factor is the environmental restoration effort. Initially, it was anticipated that the mitigation would be limited to the on-site re -vegetation of 3.3 acres with no long-term maintenance and monitoring program. In issuing the environmental permits, the resource agencies have required the City to restore up to seven acres of native habitat off-site, along with a 5 - year maintenance and monitoring program. This may increase project costs by almost $600,000. Staff is continually working with the resource agencies to reduce mitigation requirements and lessen restoration costs. A spreadsheet summarizing initial and updated cost estimates for the project is attached for reference (Attachment 1). 0 Agenda Report Pape 3 0 March 21, 2006 Staff recommends that an additional $1.9 million be appropriated from the General Fund Reserve to cover the cost of the remaining work items associated with the Avenida Placida Landslide. Staff is seeking FEMA reimbursement for expenditures associated with the Avenida Placida Landslide on the basis that the landslide is considered an emergency and a threat to public property and infrastructure. Please see Attachment 2 for the FEMA Project Worksheet submittal and most recent correspondence. Should FEMA reimbursement be denied, the City's Water Capital Improvement or Water Replacement funds will reimburse the General Fund for the cost of the stabilization of domestic water facilities. All other costs shall be bome by the General Fund. NOTIFICATION: Not applicable RECOMMENDATION: By motion, appropriate $1.9 Million from the General Reserve Fund to cover the costs for remaining work items relating to the Avenida Placida Landslide. The purpose of the letter was to advise OES and the city of San Juan Capistrano (city) that FEMA concluded that the Avenida Placida landslide in June 2005 is attributable to the cumulative rains, and will be attributed to the FEMA -1585 -DR event. Under that declaration, the city may request Public Assistance for debris removal and emergency protective measures. However, the documentation provided by the city's consultant, Lawson and Associates Geotechnical Consulting (LGC) indicates that Avenida Placida is an ancient slide; therefore, the city would be responsible for stabilizing the site before they would be eligible for permanent restoration of damaged facilities, in accordance with FEMA's Response and Recovery Policy 9524.2. "° F FEMA ixo scar` DEC 0 8 '005 Mr. Paul Jacks Governor's Authorized Representative Governor's Office of Emergency Services Response and Recovery Division 3650 Schriever Avenue Mather, California 95655 Dear Mr. Jacks: EC 2 3 X12 GS This is in response to your September 23, 2005, Ietter to Mr. David Fukutomi, forwarding and supporting a request from the City of San Juan Capistrano that the Avenida Placida landslide be attributed to the rains that fell during the incident period for FEMA -1585 -DR. Along with the letter, you transmitted technical data from the City's consultant, Lawson and Associates Geotechnical Consulting (LGC), regarding the geology of the site and the timing of the landslide. I apologize for the delay in our response. Mr. Fukutomi's April 28, 2005, letter to you identified specific technical information that would be necessary to determine whether landslides occurring after the incident periods for the recently declared disasters (FEMA -1577 -DR and FEMA -1585 -DR) could be attributed to those disasters. I have reviewed the data submitted by LGC in light of the outlined criteria, and I also requested our Landslide Response Task Force to conduct additional calculations to confirm LGC's conclusions. Based on this evaluation, I have concluded that the landslide can be attributed to the cumulative rains of 2005. In its report, LGC suggested that the depth of the slide and the geologic materials are consistent with the time delay between the rainfall that penetrated the slope and the eventual slope failure. LGC reported that "it is our opinion that landslide occurred as a result of the intense regional rainfall that occurred during February and March of 2005." The Landslide Response Task Force reviewed the report and confirmed that the geologic conditions and the rainfall during the incident period support the conclusions reached by LGC. Consequently, I have concluded that, absent evidence of any other triggering factor, the Avenida Placida landslide in June 2005 is attributable to the cumulative rains, and will be attributed to the FEMA -1585 -DR event. Under that declaration, the City of San Juan Capistrano may request Public Assistance for debris removal and emergency protective measures. However, the available documentation indicates that Avenida Placida is an ancient slide; therefore, the City would be responsible for stabilizing the site before they would be eligible for permanent restoration of damaged facilities, in accordance with Response and Recovery Policy 9524.2. www.fenia.gov Mr. Paul Jacks Request from the City of San Juan Capistrano Avenida Placida landslide, FEMA -1585 -DR Page 2 I appreciate the efforts on the part of the City of San Juan Capistrano and your staff to provide the information necessary to make this determination.
