ASSESSMENT DISTRICT (AD83-1)
CITY OF SAN JUAN CAPISTRANO, CALIFORNIA
THIS AGREEMENT, made and entered into this 5th day of June
1984 , by and between the City of San Juan Capistrano,
a body politic of the State of California, hereinafter designated
as "CITY", and DAVID A. BOYLE ENGINEERING , hereinafter
designated as "ENGINEER."
W I T N E S S E T H:
WHEREAS: CITY is conducting a,:, assessment district for
the purposes of completing public improvements i.,, Tracts 10103,
11093, 11094, and 11095 within CITY's boundaries; and
WHEREAS, CITY desires to retain ENGINEER to perform the
services of assessment engineer for said assessment district; and
WHEREAS, ENGINEER is considered professionally competent
to provide the services desired.
NOW, THEREFORE, it is mutually agreed by and between CITY
and ENGINEER as follows:
1. ENGINEER agrees to provide the services promulgated
in "Exhibit A - Assessment Engineer, Tracts 10103, 11093, 11094,
11095" attached hereto and hereinafter referred to as Exhibit "A"
2. CITY agrees to provide the assistance and compensation
promulgated in "Exhibit"A" and "Exhibit "B"
3. ENGINEER recognizes the need to conduct above said
services in an expeditious manner and agrees to so provide said
services.

4. ENGINEER shall designate DAVID A. BOYLE as
Assessment Engineer.If DAVID A. BOYLE ceases to serve
as Assessment Engineer, CITY may at its sole discretion terminate
this agreement. Such termination shall be provided in writing,
and ENGINEER's cost incurred up to the date of receipt of said
notice shall be compensated. No other compensation shall be made.
IN WITNESS WHEREOF, this agreement has been executed on
behalf of CITY by its officers thereunto duly authorized and by
ENGINEER, the date and year first above written.

I The Assessment Engineer shall:
1. Provide a cost estimate for the improvements listed below.
Quantities are to be derived from the street improvement plans
for Tracts 10103, 11093, 11094, and 11095 which are on file in
the Engineering Division and through on-site inspection.
A. Improvements to be constructed by the Assessment District
1) Rancho Viejo Road
Street improvements (paving, curb and gutter,
sidewalks,utility undergrounding, and -
landscaping)* $
2) Imperial Drive
Paving and utility undergrounding,
landscaping $
3) Regency Court
Paving $
4) Windsor Drive and Dominion Way
Final lift of paving $
5) Buckingham Drive
Paving $
6) Tract 10103, Lot 10

2. Prepare the petition for presentation to the City Council for
consideration of the proposed assessment district.
3. Provide the following services in preparation of the "Engineer's
Report."
A.
Prepare diagram maps (scale'1" = 100') on 18" x 26" sheets.
B.
Check and approve
improvement plans
to assure all parcels
are benefiting.
C.
Check and approve
Design Engineer's
quantities and construction
costs.
D.
Check and approve
Design Engineer's
specifications.
*Landscaping shall include equestrian fencing.
E. With Design longineer, check all utility4tesigns, quantities,
cost estimates and specifications.
F. Prepare all incidental costs.
G. Prepare procedural report and preliminary assessment roll.
H. Prepare all necessary notices for mailing and posting in field.
I. Assist in the preparation of bond prospectus.
J. Attend bid openings.
K. Attend all meetings with Staff and property owners.
L. Attend public hearing and make necessary reports to Council.
M. Prepare final assessment roll after 30 -day collection period.
4. Provide 30 copies of the completed Engineer's Report to City.
II The City shall:
1. Make the Design Civil Engineer and Utility Design Engineer and the
City personnel available for consultation with ENGINEER.
2. Make City records and improvement plans available for use by
ENGINEER.
3. Provide $ 9,500.00 in total compensation to ENGINEER.
A. One payment per month shall be made.
B. The total compensation made at any time during the project
shall be commensurate with the amount of work completed at
that time.
C. At no time shall more than 90 percent of said total compensation
be paid until all work as required, has been completed.
4. If the proceedings for said assessment district terminate, prior
to completion, CITY shall compensate ENGINEER on the basis of
percentage of work completed at the date of termination.
5. Work required of ENGINEER that is beyond the scope of work required
herein shall be compensated in accordance with the attached
schedule, designated as and incorporated herein as "Exhibit B."

It is understood and agreed that the aforementioned rates and
charges include all normal clerical and stenographic services,
auto travel, equipment and materials used in connection with the
production of the required engineering services. Monthly billings
will be furnished for all services rendered. Payments shall be
due and payable upon presentation of invoices.
