NOTICE IS HEREBY GIVEN that the contract heretofore awarded by the
City Council of the City of San Juan Capistrano, California, to
Fred Weisz and Associates, 24001 Alicia Parkway, Suite 309, Mission Viejo,
California, 92691, who was the company thereon for doing the following
work, to wit:
CONSTRUCTION OF CAMINO CAPISTRANO SOUTH,

That said work was completed by said company according to plans and
specifications and to the satisfaction of the City Engineer of the
City of San Juan Capistrano, and that said work was accepted by
the City Council of the City of San Juan Capistrano, at a regular
meeting thereof held on the 3rd day of September, 1980 by
Resolution No. 80-9-3-2
That upon said contract the National Bonding and Accident Insurance
Company was surety for the bonds given by the said company as required
by law.

THIS AGREEMENT is made and entered into this /� n day of

(hereinafter referred to as the "Contractor") and the
CITY OF SAN JUAN CAPISTRANO
State of California, (hereinafter referred to as the "City") and
is in accordance :with and by virtue of the provisions of the
"llunicipal Improvement Act of 1913", being Division 12 of the
Streets and Highways Code of the State of California, and of all
acts supplementary thereto, incorporated by reference therein, or
amendatory thereof.

WHEREAS, the City, by Resolution approved and adopted, duly awarded
the contract to the Contractor, and for further particulars refe-
rence is hereby made to the records of the proceedings on fi.lc in
the Office of the City Clerk and open to public inspection; and,
WHERI'AS, said works of improvement for which the Contractor was
awarded the Contract are set forth herein.
NOW, THEREFORE, iT IS !.MUTUALLY AGREED BY THE PARTIES UERETO As
FOLLOWS:

SECTION 1. That all applicable provisions of the "Municipal Im-
provement Act of 1913", and of all acts supplem=ntary
thereto, incorporated by reference therein, or amen-
datory thereof, are incorporated herein by reference
and made a part hereof.
SECTION 2. That the Contractor, for the consideration hereinafter
mentioned, will do and perform in good and workmanlike
manner, all the hereinafter mentioned work or improve-
ments, under the direction and to the satisfaction of
the
SUPERINTENDENT OF STREETS
in the manner and within the limits designated in Reso-
lution of Intention !,lo. 80-1-23-8 adopted by the
City Council of said City on the 23RD day of
JANUARY, 1980 , and pursuant to and in
strict accordance with the plans and specifications
for the same contained in the "Report" prepared and
filed pursuant to Sections 10200 through 10204 and
10300 of the Streets and Highways Code, and any modi-
fications thereof, approved and adopted by said City

Council, and on file in the Office of the City
Clerk. Reference is made to said "Report", Re-
solution, and to said plans and specifications,
all as modified, which are hereby expressly in-
corporated herein and made a part hereof, for a
complete description of said work or improvements.
SECTION 3. That.the following is a general and abbreviated
description of the works of improvement:
Construction of certain public street
and utility improvements, together with
appurtenances and appurtenant work in a
special assessment district known and
designated as ASSESSMENT DISTRICT NO. 78-1
(CAMINO CAPISTRANO SOUTH].
SECTION 4. That the Contractor will, at said Contractor's own
cost and expense, furnish all'necessary materials
and labor for said work, and the materials used
therein shall comply with the specifications and be
to the satisfaction of the
SUPEP,INTENDrNT OF STREETS
and the Contractor, will, within one hundred and
( 120) twetrty days £rom the dat:ehercof,
completeethesaid work or improvements anti turn same
over to the City ready for use and free and discharged
of all liens, claims and demands whatsoever. The pro-
visions of Title 1 (commencing with Section 4200),
Chapter 3, Division 5 of the Government Code of the
State of California, and further, the provisions of
Title 15 (commencing with Section 3082), Part 4, Divi-
sion 3 of the Civil Codes of the State of California,
are expressly made appli.c:a.ble to work done under this
Agreement.
SECTION 5. That the City hereby fixes the time for the commence-
ment of said work to be within FIFTEEN (15)
days from the date of execution of this Agreement.
SECTION 6. That upon the performance of the covenants aforesaid
by the Contractor, and acceptance thereof by the City,
the City Treasurer will pay to the Contractor from the
special improvement fund, established pursuant to Sec-
tion 10424 of the Streets and highways Code, only, the
total amount of the cost and expenses of the work.
Nothing herein, however, shall prevent acceptance of
the payment for completed portions of the work by the
City, in its discretion.

SECTION 7. That the cost of said work or improvements shall be
at the prices as set forth in the bid of the Con-
tractor on file in the Office of the City Clerk.
SECTION B. That it is stipulated that eight (8) hours of labor
shall constitute a legal day's work and that neither
the Contractor, nor any subcontractor hereunder, shall
require or permit any workman employed to perform any
of the work included in this Agreement to labor more
than eight (8) hours during any one calendar day, ex-
cept as provided by Sections 1812 or 1817 of the
Labor Code of the State of California; and, it is
further stipulated that the Contractor shall forfeit,
as a penalty, to the City, the sum of Twenty -Five
Dollars ($25.00) for each workman employed in the
execution of this Agreement by the Contractor or by
any subcontractor hereunder, for each calendar day
during which such workman is required or permitted
to labor more than eight (8) hours in violation of
the provisions of Sections 1810 to 1817, inclusive,
of said Labor Code.
SECTION 9. That pursuant to the provisions of Section 1775 of
said Labor Code, the Contractor shall, as a penalty
to the City, forfeit the sum of Twenty -Five Dollars
($25.00) for each calendar day, or portion thereof,
for each workman paid less than the prevailing wage
rates for any work clone under this Agreement by him,
or by any subcontractor under him. A sehedule has
been obtained from the Director of the Department of
Industrial Relations, pursuant to the provisions of
Section 1773 of the Labor. Code of the State of Cali-
fornia, and reference is hereby made to copies tliereof
on file in the Office of the City Clerk,, -which said
copies are available to any interested party upon re-
quest. Purt-her, a copy shall be posted at each job
site during the course of construction.
SECTION 10. That in no case, except where it is othcneise pro-
vided by or pursuant to law, and except as otherwise
hereinbefore provided, will the City, or any officer
thereof, be liable for any portion of the expense of
the work aforesaid, nor for any delinquency of persons
or property assessed.
SECTION 11. The award of contract and the execution of this Agree-
ment are subject to the following:
"RECEIPT OF MONIES FRO.f SALE OF SECURITIF,S".
SECTION 12. That in the event the work is not completed within the
time limit specified in the Agreement, or within such
further time as may be extended, the City will deduct
from the amount to be paid to the Contractor, liquidated
damages in the amount of $ 100.00 for each -
working day of delay until the delayed work is completed.

City and Contractor are in agreement that at the
time of signing this Contract, it is impractical
and extremely difficult to fix the actual damages
which will be incurred by City if the works of im-
provement are not completed within the time period
as specified herein. Accordingly, City and Con-
tractor do agree that the above referenced sum is
a reasonablesumto assess as damages by reason of
the failure of Contractor to complete the works of
improvement within the time as specified.
SECTION 13. That further incorporated herein are all the pro-
visions of the "Report" as previously approved by
the City and the Resolution of Intention as pre-
viously adopted and referenced.
SECTION 14. That the Contractor agrees to indemnify, defend,
and hold harmless the City, its officers, agents
and employees, from any and all claims and losses
accruing or resulting to any and all contractors,
subcontractors, materialmen, laborers, and any
other person, firm or corporation furnishing or
supplying work, services, materials or supplies
in connection with the performance of this Agreement.
SECTION 15. It is hereby stipulated and agreed to between the
parties hereto, and notice is hereby expressly
given to the Contractor, that in no cast., except
where it is otherwise provided by law, will said
City, or any officer or employee thereof, be liable
for any portion of the expense of the work aforesaid.
SECTION 16. Should any litigation or arbitration be commenced
between the parties concerning the wor}cs o_.,improve-
ment as referenced herein, the prevailing party in
any such litigation, being the City or the Contractor,
should be entitled to a reasonable sum for attorney's
fees incurred in any such litigation relating to this
Contract.
SECTION 17. This Agreement shall be binding upon all parties
hereto and their respective heirs, executors, ad-
ministrators, successors, and assigns.
IN WITNESS WHEREOF, the parties hereto have set their hands on the
day and year first hereinabove written.

WHEREAS, on the 19th day of March, 1980, the City of San
Juan Capistrano entered into a contract with Fred Weisz and
Associates for the construction of Camino Capistrano South,
Assessment District 78-1; and,
WHEREAS, the Director of Public Works has evaluated the
final quantities and cost figures and recommends approval.
NOW, THEREFORE, the City Council of the City of San Juan
Capistrano does resolve as follows:
SECTION 1. That the work required to be performed by
said contractor has been completed.
SECTION 2. That the total cost of said work is in the
amount of $204,617.79.
SECTION 3. That the work is hereby accepted and
approved.
SECTION 4. It is further ordered that a "Notice of
Completion b' -girded, on behalf of the City, in the office of
the County Recorder of the County of Orange within ten (10) days
of the date of this Resolution.

SITUATION
Staff is requesting approval of a Change Order for a unit price
increase for reinforced concrete pipe in Assessment District 78-1
Camino Capistrano South. The original plans, during the bidding,
indicated a larger quantity of concrete pipe. During this period
the Caltrans Maintenance Station project installed concrete pipe
such that there was a decrease in quantity for Assessment District
78-1. The original quantity for concrete pipe was 1013 linear
feet. The actual amount installed was 744 linear feet. Under the
provisions of the standard specifications, this contract is sub-
ject to a change in unit price since there is more than a 25%
decrease in quantity.
FINANCIAL CONSIDERATION
The contractor is requesting an increase of $4.00 per linear foot.
Since there is a decrease in quantity, the District would be saving
$5600.72 for this bid item with the increase in unit cost.
ALTERNATE ACTIONS
1. Approve the unit price increase in reinforced concrete pipe
at $4.00 per linear foot.
2. Do not approve the unit price increase.
3. Request further information.
RECOMMENDATION

considered and approved on the 23rd day of January, 1980
and other contract documents duly adopted and approved, to which
"Report" and documents reference is hereby made for a description
of said work and improvement.

PROPOSALS
Proposals must be submitted on the blank forms prepared and fur-
nished for the purpose and which may be obtained at the Office of
the City Clerk and City Engineer. At said Office, bidders may
obtain copies of the plans, profiles and specifications for the
contemplated improvement.
BONDS
The Contractor will be required to furnish with the contract.a
Faithful Performance Bond in the amount of 100 % of the aggre-
gate amount of the bid, and a Labor and Material Bond in the
amount of 100 %. The Contractor will also furnish certificates
of insurance evidencing that all insurance coverage has been
secured, as required by the specifications.
PREVAILING WAGES
Notice is further given that the legislative body has obtained
the general prevailing rate of per diem wages in accordance with
law to be paid for the construction of the above entitled improve-
ments. The schedule has been obtained from the Director of the
Department of Industrial Relations, pursuant to the provisions
of Section 1773 of the Labor Code of the State of California,
and reference is hereby made to copies thereof on file in the
Office of the City Clerk, and which said copies are available
to any interested party upon request. Further, a copy shall be
posted at each job site during the course of construction.
PAYMENT
Payments will be made in cash to the contractor in accordance
with the provisions of the specifications and on itemized esti-
mates duly certified and approved by the Superintendent of
Streets submitted in accordance therewith, based on labor and
materials incorporated into said work during the preceding
month by the contractor. The first progress payment will not
be made until after delivery of bonds and receipt of monies
therefor.
BID SECURITY
All proposals or bids shall be accompanied by a cashier's or
certified check payable to the order of the City amounting to
ten percent (10%) of the bid, or by a bond in said amount and
payable to said City, signed by the bidder and a corporate
surety, or by the bidder and two sureties who shall justify
before any officer competent to administer oaths, in double said
amount over and above all statutory exemption. Said check shall
be forfeited or said bond shall become payable in case the
bidder depositing same does not, within fifteen (15) days
after written notice, sign the contract.

AWARD AND EXECUTION
Any award of contract will be made subject to the receipt of
monies and proceeds from issuance and sale of bonds.
The Contractor shall execute the contract within fifteen
(15) days after he has been notified in writing to proceed, and
shall commence construction within fifteen (15) days after
contract execution, and shall complete all the work and improve-
ments within one hundred and twenty (120) days
after e-ecution.
The City Council hereby reserves the right to reject any and all
proposals, to waive any irregularity, and to award the contract
to other than the lowest bidder. No bidder may withdraw his bid
for a period of forty-five (45) days after the bid opening.

Gentlemen:
Enclosed is a copy of Resolution No. 80-9-3-2, which
was adopted by the City Council at their meeting of September 3,
1980. The Resolution accepts the work completed for the construction
of Assessment District No. 78-1, Camino Capistrano South, in the
amount of -$204,617.79.
The Council directed that the balance due in the amount

BID SECURITY
All proposals or bids shall be accompanied by a cashier's or
certified check payable to the order of the City amounting to
ten percent (10%) of the bid, or by 'a bond in said amount and
payable to said City, signed by the bidder and a corporate
surety, or by the bidder and two sureties who shall justify
before any officer competent to administer oaths, in double said
amount over and above all statutory exemption. Said check shall
' be forfeited or said bond shall become payable in case the
bidder depositing same does not, within fifteen (15) days
after written notice, sign the contract.

PROPOSALS
Proposals must be submitted on the blank forms prepared and fur-
nished for the purpose and which may be obtained at the Office of
the City Clerk and City Engineer. At said Office, bidders may
obtain copies of the plans, profiles and• specifications for the
contemplated improvement.
BONDS
'
The Contractor will be required to furnish with the contract a
Faithful Performance Bond in the amount of 100 % of the aggre-
gate amount of the bid, and a Labor and Material Bond in the
amount of 100 %. The Contractor will also furnish certificates
of insurance evidencing that all insurance coverage has been
secured, as required by the specifications.

PREVAILING WAGES
Notice is further given that the legislative body has obtained
'
the general prevailing rate of per diem wages in accordance with
law to be paid for the construction of the above entitled improve-
ments. The schedule has been obtained from the Director of the
Department of Industrial Relations, pursuant to the provisions
'
of Section 1773 of the Labor Code of the State of California,
and reference is hereby made to copies thereof on,file in the
Office of the City Clerk, and which said copies are available
to any interested party upon request. Further, a copy shall be
'
posted at each job site during the course of construction.
PAYMENT
Payments will be made in cash to the contractor in accordance
with the provisions of the specifications and on itemized esti-
mates duly certified and approved by the Superintendent of
Streets submitted in accordance therewith, based on labor and
materials incorporated into said work during the preceding
month by the contractor. The first progress payment will not
be made until after delivery of bonds and receipt of monies
therefor.

Plans, specifications and other contract documents will be
' available for examination without charge and copies may be secured
in accordance with the "Notice Inviting Bids." A.
' Examination of Plans, Specifications and Site of Pork
The bidder is required to examine the site of work, the
proposal, the plans and the specifications very carefully. Fie
' shall satisfy himself as to the character, quality and quantities
of the work to be performed, the materials to be furnished and
the requirements of the Contract Documents. The plans for the
' work show conditions as they are believed to exist, but it is
not to be inferred that all the conditions as shown thereon are
actually existent, nor shall the City or any of its officers or
agents be liable for any loss sustained by the Contractor as a
result of any variance between conditions shown on the plans and
' actual conditions revealed during examination or progress of t?:_
' work. The submission of a proposal shall be prima facie ev,,;ence
that the bidder has made such an examination.
' Interpretation of Drawings and Documents
If any bidder should find discrepancies in, or omission
from, the drawings, specifications or other proposed contract
documents, or if he should be in doubt as to the true meaning of
any part thereof, he shall at once make a written request to the
Engineer for correction, clarification or interpretation of the
' point or points in question. The person submitting such a re-
quest shall be responsible for its prompt delivery.
In the event that the Engineer receives such a request and
it should be found that certain essential information is not
clearly and fully set forth, or if the En;ineer discovers errors,

omissions, or points requiring r_lari.fication in the drawings or
' documents, a written addoncium v. ill be mailed to each person to
whom a set of contract documents has been cl.olivered. The City
' will not be responsible for any instructions, explanations or
interpretations of the documents presented to bi.ddcrs in any
manner other than written addendum.
Addenda or Bulletins
The effect of all addenda to the contract documents shall
be considered in the bid and said addenda shall be made a part
' of the contract documents and shall be returned with them. Be-
fore submitting his bid, each bidder shall inform himself as to
' whether or not any such addenda have been issued, and failure to
cover in his bid any such addenda issued may render his bid invalid
and 'result in its rejection.
' Disqualification of Bidders
No person, firm or corporation shall be allowed to make,
' file or be interested in more than one bid for the same work
unless alternate bids are called for.. A person, firm or cor-
pora tion
or-
poration who has submitted a sub -proposal to a bidder, or who has
quoted prices on materials to a bidder, is not hereby disqualified
' from submitting a bid in his own behalf.
Proposals
' Bids to receive consideration shall be in accordance with
the following instructions:
A. Bids shall be made only upon the forms .provided within these
-- specifications; all bid items shall be properly filled out;
=- bid prices shall be stated both in words and in figures; and
the signatures of all persons signing shall be in longhand.
' Where there is a conflict in the.wor cis and the figures, the
words shall govern.

' B. All prices and notations must be in ink or typewritten. No
erasures will be permitted. Mistakes may be crossed out and
' corrections typed or written in ink adjacent thereto and must
be initialed in ink by the person or persons signing the bid.
C. Bids shall not contain any recapitulation of the work to be
done. Alternate proposals will not be considered except as
' required hereinabove. No oral, telegraphic or telephonic
proposals or modifications will be considered.

D. The City may require any bidder to furnish a statement of his
experience, financial responsibility, technical ability, equip-
ment and references properly and fully filled out.
E. Each bidder shall list his proposed sub -contractors on the
form accompanying the proposal in accordance with the pro-
visions of the specifications.
F. tsids shall be delivered to the City at the location stipulated,
on or before the day and hour set for the opening of bids, as
hereinbefore specified in the "Notice Inviting Bids". Bids
shall be enclosed in a sealed envelope bearing the title of
the work and the name of the bidder.
Licensing of Contractor
All persons, firms, partnerships or corporations shall be
licensed in accordance with the Business and Professions Code
of the State of California and the applicable ordinances of the
City and County before doing any work of any kind.
Withdrawl of Bids
Any bidder may withdraw his bid in person or by written
request at any time prior to the scheduled closing time for re-
ceipt of bids.
Opening of Bid Proposals
The City will, in open session, publicly open, examine, and
declare the bids at the time set forth in the "Notice Inviting

Public Works Department, that he has explained to you
that the bonds received from Fred Weisz & Associates
in the amount of $208,250.44 each, do not have the
Power of Attorney for James A. Schaller, National
Bonding and Accident Insurance Company registered
with Probate.
He has advised me that you have looked at the bonds
and have determined that the bonds should be accepted
by the City as being in proper form and order for the
above-mentioned project, in regard to the Power of
Attorney.

The work to be done consists of the construction of a storm drain,
widening on the west side with concrete curb, gutter and sidewalks, and
undergrounding of 311 utilities on Camino Capistrano.
' 2. STANDAPD SPECIFICATIONS
' The contractor shall perform his work in accordance with the
Standard Specifications for Public Works Construction, 1976 Edition,
hereinafter referred to as the Standard Specifications. The contractc.,
shall maintain a copy of this book on the job site at all times. The
provisions of the Standard Specifications shall be modified as indicated
below:

Change 1: "Section 2-4 - Contract Bonds"
The "Payment Bond" (Material and Labor Bond) shall be in the
amount of 100 percent of the contract price. The "Faithful Performance
Bond" shall be held as assurance of guaranteed performance for a
period of one year after acceptance of the improvements by the City
Council.
Change 2: "Liability Insurance"
The amounts and provisions of insurance are modified.to be:

minimum amounts required by the City. Other agencies with which �h_
contractor may be involved in the accomplishment of the work may re-
quire greater amounts. The City will not recognize any claim for
additional compensation because of the requirement for greater amounts
of insurance, as an element to be considered by the contractor in
determining his bid.

4. Special Provisions of Items of Work and Method of Payment
A. Bid Items
BID ITEMS 1,5,11&18 - Furnish a:-. Install P.C.C. Curb and Gutter,
Cross Gutter., Sidewalk and Drive Approach
Portland cement concrete shall meet the requirements of
' Section 400 and these special provisions. For 2500 class concrete,
a prequalified mix design may be used in accordance with the pro-
visions of ACI 318-71, Section 4.2.2.1, in which•f6 = 2500 psi.
The sodium sulphate loss requirement and the gradation X -value sub-
mittal required of Section 400-1.3.1 may be waived by the Engineer.
The cement type requirement, Section 201-1.2.1, shah be Type II
or Type V as determined by the Engineer. Type II or Type V
' cement shall conform to ASTM C 150 and the low alkali requirements
of Table lA therein. The Cleanness Value requirement of Section
200-1.4 shall be replaced with the following:

a minimum 65 Individual Test Result and a minimum 70 Moving

greater.. The testing and acceptance determination will be
made by the EMA Materials Laboratory.
Evaluation of Sand Equivalent and Cleanness Value results shall
conform to the provisions of Subsection 400-1.4.

' The unit: price bid per lineal fcot shall include all labor,
mater�.als, tool and equipment for the installation of the curb and
gutter, c_-oss autter, sidewalk and drive aparoach as specified, and
no additional compo ro;a--ton shall be made.
BID ITEM 2 - Furnish and Inst.,". A.C. Pavement
' Asphalt concrete shall meet the requirements of Section 400 and
these special provisions. Coa_-sa aggregate shall consist of material
of which at least 75 percent by weight shall be crushed particles
' in lieu of the requirements of Subsection 400-4.2.3. The viscosity
grade of paving asphalt shall L.e AR -4000 or AR -8000 as determined
by the Engineer. The exact proportions of agr.re�ate and the amount
of asphalt binder for each type of mixture shall be regulated as
' directed by the Engineer. Normally the, asphalt ccntent shall be
between 5.8 and 6.0 percent by dry weiaht of aggregate. Grading
shall be III -B2, 111-B3, III -C2, or III -Ci as determined by the
Engineer. The final or surface layer of asphalt concrete shall not
be placed until all on-site improvements have been completed, in-
cluding all grading, and until all unacceptable concrete work has
' been removed and replaced unless approved otherwise by the Engineer.
The sand equivalent and S -Value requirements of Subsection 400-4.3
shall be the moving average requirements.. Individual test require-
ments for sand equivalent and S -Value shall be as determined by the
EMA Materials Lab.
Payment
' The unit price bid per ton shall include all labor, materials,
tools, and equipment for the placing of A.C. Pavement as specified,
and no additional compensation shall be made.
BID ITEM 3 - Furnish and Install Aggregate Base
' Untreated base materials shall meet the requirements of
Section 400 and these special provisions. In lieu of the second
sentence of Section 200-2.4.1 at least 65 percent, by weight, of the
material retained on the No. 4 sieve shall be a crushed particle
' as determined by Test Method No. California 205. Evaluation of
gradation and sand equivalent test results shall conform to the pro-
visions of Subsection 400-1.4. The gradation and sand equivalent
requirements of Subsections 200-2.2, 200-2.3, 200-2.4, 200-2.5
and 200-2.6 shall be the moving average requirements. Individual
test requirements for gradation and sand equivalent shall be as
determined by the EMA Materials Lab.
Payment
' The unit price bid per ton shall include all labor, materials,
tools and equipment for the grading of earth and placement of
' aggregate base as specified, and no additional compensation shall
be made.

' BID ITEM 4 Furnish and Install A.C. P.a-,�ment Overlay
The workmanship and materials included in the work prescribed
for bid item 6 shall conform to Sections 204 and 305 of the Standard
Specifications. The work for this bid item shall include the in-
stallation of a 2" x 6" redwood header as specified on the improve-
ment plans.
' Payment
The unit price bid per lineal foot shall include all labor,
materials, tools and equipment for the installation of the 2" x 6"
' redwood header as specified, and no additional compensation shall
be made.
' BID ITEM 7 - Furnish and Install Guide Markers
The workmanship and materials included in the work prescribed
for bid item 7 shall conform to Orange County Standard Plan No. 402.
The.work for this bid item shall include the installation of the
guide markers as specified on the improvement plans.
' Payment
The unit price per each shall include all labor, materials,
' tools and equipment for the installation of the guide markers as
specified, and no additional compensation shall be made.
' BID ITEM 8 - Furnish and Install R.C.P. Storm Drain
The workmanship and materials included in the work prescribed
for bid item 8 shall conform to sections 207 and 306 0£ the Stan-
dard Specifications. The work for this bid item shall include
the trenching operations, the laying of pipe and backfilling of
the trench as specified.
Payment
' The unit price bid per lineal foot shall include all labor,

The workmanship and materials included in the work prescribed

Stone shall comply with Subsection 200-1.6, Stone for Rip -Rap,
except cobblestones shall not be used. All stones shall be angular,
' each piece having its greatest dimensions not greater than three
times its least dimensions. Stone shall comply with the test speci-
fied in Subsection 200-1.6 except that specific gravity shall be not
' less than 2.62.

Placement tolerances for finished surface shall be plus or minus
' six inches from indicated lines and grades. If, gradation curve is re-
quested by the Engineer, all points on individual grading curves ob-
tained from representative samples of rip -rap stone shall lie between
' limits as defined by a smooth curve drawn through tabulated grading
limits plotted on a mechanical analysis diagram. The grading curves
within these limits shall not show abrupt changes in slope denoting
skip grading, scalping of certain sizes of other irregularities which
' would be detrimental to proper functioning of rip -rap stone. Gra-
dation testing shall be performed by an approved testing laboratory
on samples selected by the Engineer, at the Contractor's expense.
' Stone shall be placed directly on prepared earth subgrade or area
unless rock filter blanket or filter fabric is specified or shown on
the plans. Each load of stone shall be reasonably well graded from
the smallest to the maximum size specified. Stones smaller than the
specified 15 percent size and spalls will not be permitted in an
amount exceeding 15 percent by weight of each load. Stone for rip -
rap shall be placed in a manner which will produce a reasonably well -
graded mass of stone with the minimum practicable percentage of voids.
The entire mass of stone shall be placed in conformance with the lines,
' grades and thicknesses shown on the plans. Rip -rap shall be placed
to its full course thickenss in one operation and in a manner to avoid
displacing the underlying material. Placing of rip -rap in layers by
' dumping into chutes or by similar methods likely to cause segregation,
will not be permitted. Self-propelled equipment shall not be used
on embankment slopes.

' The larger stones shall be well distributed, and the entire
mass of stone shall conform to the gradation specified. All material
going into rip -r. a:) r.rotecticn shall be so pleced and distributed that
there will be no large accumulations of either the larger or smaller
sizes of stone. It is the intent of theses acifieations to produce
a fairly compact rip -rap protection in which ail sizes of material
' are,placed in their proper proportions. Hand placing or rearranging
of individual stones by mecPanical equipment may be required as
necessary to secure the specified results.

The contractor must, however, take all due precautionary measures
