AGREEMENT FOR REHABILITATION OF
PASEO DE LA PAZ
THIS AGREEMENT, made and entered into this 2nd day of
November, 1982, by and between the City of San Juan Capistrano,
hereinafter designated as "CITY" and the Paseo de La Paz
property owners, hereinafter designated as "OWNERS."
W I T N E S S E T H:
WHEREAS OWNERS desire to rehabilitate and repave Paseo de
La Paz from Del Obispo Street northwesterly to its terminus; and
WHEREAS, CITY desires to assist OWNERS in rehabilitating
and repaving Paseo de La Paz as part of the CITY'S storm drain
project for Paseo de La Paz.
NOW, THEREFORE, it is mutually agreed by and between CITY
and OWNERS as follows:
1. CITY shall provide 50% of the funds necessary to finance
the removal and replacement of damaged and/or deteriorated asphalt
within Paseo de La Paz up to a maximum CITY expenditure of $6,300.00.
2. CITY shall provide inspection services to insure
compliance with applicable CITY requirements.
3. OWNERS shall provide CITY with itemized copies of all
executed contract documents, billings and invoices prior to the
expenditure of CITY funds.
IN WITNESS WHEREOF, this agreement has been executed by CITY
and legally responsible representatives of OWNERS, the date and
year first above written.

SUBJECT: Agreement for Street Repairs, Paseo de la Paz

In April, 1982, the City in cooperation with the property
owners on Paseo de la Paz entered into an agreement to
construct storm drain facilities was completed in August, 1982.
Construction of the facilities caused some damage and deterioration
to Paseo de la Paz requiring removal and replacement work to
correct the construction damage. The property owners on Paseo
de la Paz have approached the City with a request that the City's
obligation for repairs to the streets be contributed towards the
homeowners' plans to rehabilitate the entire street.
On behalf of the homeowners, Staff has solicited bids for the
repair and repaving of the street. Based on the bids received,
the City's repair obligation should not exceed $6,300. An
agreement providing for City inspection services and obligating
a City contribution in an amount not to exceed $6,300 is enclosed
for City Council consideration and approval.
The homeowners anticipate proceeding with the project within
the next two weeks. Total cost of the project to be borne by
the property owners is approximately $16,000.
FINANCIAL CONSIDERATIONS
A budget amendment of $6,300 from the General Fund to the Master
Plan Drainage Facility Area L01 Account is necessary. Drainage
fees in the amount of $72,000 were collected for Tract 10593 (Bear
Brand Ranch) in anticipation of this drainage facility.
ALTERNATE ACTIONS
1. Approve the agreement for participation in the rehabilitation
of Paseo de la Paz and authorize an expenditure up to
$6,300 for the rehabilitation.
2. Do not approve the agreement for participation in the
rehabilitation of Paseo de la Paz and authorize an expenditure
up to $6,300 for the rehabilitation.
3. Request further information from Staff.

RECOMMENDATION
By motion, approve the agreement for participation in the
rehabilitation of Paseo de la Paz and authorize a loan of
up to $6,300 from the General Fund to the Drainage Fund.
Authorize the Mayor and City Clerk to execute the agreement.

took unanimous action in approving the agreement between the City
and the Paseo de la Paz property owners for participation in the
rehabilitation of Paseo de la Paz. In further action, Council
authorized a loan of up to $6,300 from the General Fund to the
Drainage Fund.
