THIRD. PAYMENT. COMMENCE'?ENT AND COMPLETION OF THE WORK. CONTRaCTOR , agrees to begin and complete the work within the time specified in the Notice Invitina Bids. It is agreed that it would be im- practicable and extremely difficult to fix the actual amount of damages, and loss sustained by City, should CONTRACTOR fail to complete the work in the specified time; therefore, CONTRACTOR shall pay City, as liquidated damages, not in the nature of a penalty, one hundred dollars ($100) a day for each day delayed; provided that extensions of time with waiver of liquidated s damages, may be granted as provided in the Specifications. S FIFTH. PERFORMANCE BOND AND LABOR, AND MATERIAL BOND. Contractor 1 i agrees to furnish bonds guaranteeing the performance of this con- tract and guaranteeing payment of all labor and material used under this contract, as required by the laws of the State of Cali- fornia, on forms approved by City. The Performance Bond shall ^ be for an amount of one hundred percent (100%) of the amount of this contract and shall be conditioned on full and complete per- formance of the contract, guaranteeing the work against faulty workmanship and materials for a period of one (1) year after com- pletion and acceptance. The Labor and Material Bond shall be for an amount of one hundred percent (1000 of the amount of this contract and shall be conditioned upon full payment of all Labor and Material entering into or incidential to the work covered by this contract. Change Order No. 1 and 2 were for an extension of time, and Change Order No. 3 was for an increase of $2,650 for landscaping. The City's contractor for the project,the Reed Thomas Company, is now prepared to begin work on the slope reconstruction. However, since the rainy season is upon us, Staff, with the contractor's concurrence, is recom- mending postponement of the grading work until April 15, 1984 to avoid possible drainage and erosion problems with the residential slopes. To accommodate this postponement and provide the contractor sufficient time to complete the project, Staff is recommending a time extension to June 15, 1984. The low bidder for the project is the Reed Thomas Company; a tabulation of the bids is shown below: Reed Thomas Company $17,380 Gillespie Construction 17,390 California Landscape, Inc. 21,880 Allied Sprinkler 25,980 Ortega Rock $28,521 The project calls for the regrading and landscaping of an unused portion of Calle Miramar right-of-way. In conjunction with the project the adjacent property owners have agreed to accept the unusued right-of-way and maintain the improvements resulting from the project. COMMISSION/BOARD REVIEW, RECOMMENDATION Not applicable. FINANCIAL CONSIDERATIONS In the 1983-84 Capital Improvements Budget $15,000 was authorized for the project. The low bid by Reed Thomas Company is $2,380 over the project budget. Staff is recommending supplemental funding from anticipated 1983-84 revenue collections. ALTERNATE ACTIONS 1. This recommendation is based on Staff's belief that bid proposals can be generated within the parameters of the project's original budget allocation. Examination of Plans, Specifications and Site of Work The bidder is required to examine the site of work, the proposal, the plans and the specifications very carefully. He shall satisfy himself as to the character, quality and quantities ' of the work to be performed, the materials to be furnished and the requirements of the Contract Documents. The plans for the ' work show conditions as they are believed to exist, but it is not to be inferred that all the conditions as shown thereon are ' actually existent, nor shall the City or any of its officers or agents be liable for any loss sustained by the Contractor as a result of any variance between conditions shown on the plans and actual conditions revealed during examination or progress of the work. The submission of a proposal shall be prima facie evidence that the bidder has made such an examination. ' Interpretation of Drawings and Documents If any bidder should find discrepancies in, or omission ' from, the drawings, specifications or other proposed contract documents, or if he should be in doubt as to the true meaning of ' any part thereof, he shall at once make a written request to the Engineer for correction, clarification or interpretation of the ' point or points in question. The person submitting such a re- quest shall be responsible for its prompt delivery. ' In the event that the Engineer receives such a request and it should be found that certain essential information is not ' clearly and fully set forth, or if the Engineer discovers errors, -10- I romissions, or points requiring clarification in the drawings or ' documents, a written addendum will be mailed to each person to whom a set of contract documents has been delivered. The City ' will not be responsible for any instructions, explanations or interpretations of the documents presented to bidders in any manner other than written addendum. r Addenda or Bulletins rThe effect of all addenda to the contract documents shall be considered in the bid and said addenda shall be made a part of the contract documents and shall be returned with them. A person, firm or cor- poration who has submitted a sub -proposal to a bidder, or who has quoted prices on materials to a bidder, is not hereby disqualified from submitting a bid in his own behalf. Proposals Bids to receive consideration shall be in accordance with the following instructions: A. Bids shall be made only upon the forms provided within these specifications; all bid items shall be properly filled out; bid prices shall be stated both in words and in figures; and the signatures of all persons signing shall be in longhand. Mistakes may be crossed out and corrections typed or written in ink adjacent thereto and must ' be initialed in ink by the person or persons signing the bid. C. Bids shall not contain any recapitulation of the work to be done. Alternate proposals will not be considered except as required hereinabove. No oral, telegraphic or telephonic proposals or modifications will be considered. D. The City may require any bidder to furnish a statement of his ' experience, financial responsibility, technical ability, equip- ment and references properly and fully filled out. E. Each bidder shall list his proposed sub -contractors on the form accompanying the proposal in accordance with the pro- , - visions of the specifications. F. Each bidder must accompany his bid with either a cashier's ' check upon some responsible bank, or a properly certified check upon such bank, or an approved corporate surety bond ' payable to the City for such a sum of not less than ten (10) percent of the aggregate sum of the bid, which check or bond and the monies represented thereby shall be held by the City ' as a guarantee that the bidder, if awarded the contract, will in good faith enter into such contract and furnish the required bonds. The bidder agrees that, in case of his refusal or failure to ' execute said contract and give bonds within the time required by these documents, such check or bond, and the money re- presented thereby, shall remain the property of the City and, if the bidder shall fail to execute said contract, said ' surety will pay to the City the damages which the City may suffer by reason of such failure, not exceeding the sum of ' ten (10) percent of the amount of the bid. A bid received_ and not accompanied by such cashier's check, certified check ' or approved bond shall be rejected. I -12- I ' G. Bids shall be delivered to the City at the location stipulated, ' on or before the day and hour set for the opening of bids, as hereinbefore specified in the "Notice Inviting Bids". Bids shall be enclosed in a sealed envelope bearing the title of the work, the name of the bidder, bid opening date and time of bid opening. 1 Licensing of Contractor ' All persons, firms, partnerships or corporations shall be licensed in accordance with the Business and Professions Code ' of the State of California and the applicable ordinances of the City and County before doing any work of any kind. ' Withdrawl of Bids ' Any bidder may withdraw his bid in person or by written request at any time prior to the scheduled closing time for re- ceipt of bids. Opening of Bid Proposals ' The City will, in open session, publicly open, examine and declare the bids at the time set forth in the "Notice Inviting ' Bids". Bidders or their authorized representatives are invited to be present. Award of Contract or Rejection of Bids ' No bidder may withdraw his bid for a period of forty-five (45) days after the date set for the opening of bids. The con- tract for the work will either be awarded or the bids rejected within the forty-five (45) days from the date set for the opening of bids. The contract for the work will be awarded to the lowest ' responsible bidder complying with these instructions and with the "Notice Inviting Bids". The City, however, reserves the right to reject any or all bids and to waive any nonconformity ' in the bids received. 1 -13- ' The bidder to whom the award is made shall execute a written ' contract with the City and furnish the stipulated bonds, insurance and bid breakdown within fifteen (15) days after the notice of ' award of contract. The contract shall be made in the form adopted by the City. The release of the successful bidder's surety deposit, as previously stipulated (page 5), shall be made upon the City's ' acceptance of the Labor and Materials Bond and the Faithful Per- formance Bond. ' If the bidder to whom the award is made fails to enter the contract as herein provided, the award may be annulled and an ' award may be made to the next lowest responsible bidder; and such bidder shall fulfill every stipulation embraced herein, as ' if he were the party to whom the first award was made. A corpora- tion to which an award is made shall furnish evidence of its cor- porate existence and evidence that the officer signing the con- tract and bonds for the corporation is duly authorized to do so. Bonds ' The successful bidder, simultaneously with the execution of the Agreement, will be required to furnish a Labor and Material Bond in a sum not less than one hundred percent (1008) of the ' total amount payable by the terms of the contract and a Faithful Performance Bond in a sum not less than one hundred percent ' (1008) of the amount of the contract. Said bonds shall be secured from a surety company satisfactory to the City. Surety ' companies, to be acceptable to the City, must be authorized to do business in the State of California and be on the accredited ' list of the United States Treasury. ' Time of Performance The work shall be commenced within fifteen (15) calendar days from the date of execution of the contract and shall be diligently ' prosecuted until completion. A time limit of sixty 1 -14- ' Attention is has directed to all provisions of ( 60 ) calendar days from the date of execution of the contract ' been set for completion of the work. Assignment of Contract ' No assignment by the Contractor of any contract to be entered into hereunder or any part thereof, or of funds to be received thereunder by the Contractor, will be recognized by the awarding authority unless such assignment has had prior approval ' of the awarding authority and the surety has been given notice of such assignment in writing and has consented thereto in writing. Workmen and Waqes ' Building Permits It shall be the Contractor's responsibility to obtain all necessary permits, bonds and insurance, as required, for the ' completion of the project. No extra compensation shall be made therefore. 1 1 -15- Attention is specifically directed to all provisions of ' the Labor Code of the State of California with regard to workmen and wages. Wages shall not be less than prevailing wage rates ' determined by the City pursuant to said -Code and as listed in the "Notice Inviting Bids". ' Building Permits It shall be the Contractor's responsibility to obtain all necessary permits, bonds and insurance, as required, for the ' completion of the project. No extra compensation shall be made therefore. 1 1 -15- I SPECIAL PROVISIONS 1 1. Work to be Done ' The City of San Juan Capistrano is proposing the rehabilitation of the Calle Miramar Right -of -Way at Avenida Pescador. Work under this contract consists of clearing and grubbing, ' grading, installation of irrigation systems, soil preparation, landscape planting, and all other appurtenant work as shown on the plans and included in the specifications. ' 2. Standard Specifications The contractor shall perform his work in accordance with the Standard Specifications for Public Works Construction, 1982 Edition, hereinafter referred to as the Standard Specifications. The contractor shall maintain a copy of this book on the job ' site at all times. The provisions of the Standard Specifications shall be modified as indicated below: ' Change 1: "Section 2-4 - Contract Bonds" The "Payment Bond" (Material and Labor Bond) shall be in the amount of 100 percent of contract price. The "Faith- ful Performance Bond" shall be held as assurance of guaranteed performance for a period of one year after acceptance of the improvements by the City Council. 1 Change 2: "Liability Insurance" ' The amounts and provisions of insurance are modified to be: ' Bodily Injury $ 500,000 each person Bodily Injury 1,000,000 each accident Bodily Injury 1,000,000 aggregate products ' Property Damage $ 500,000 each accident Property Damage 500,000 aggregate operations Property Damage 500,000 aggregate protection Property Damage 500,000 aggregate products Property Damage 500,000 aggregate contractual ' The contractor shall likewise obtain public liability and property damage insurance to cover vehicles used or main- tained by him, whether on or off the premises, with ' liability limits of not less than $500,000, for any one person, and $500,000 for any one accident, and property damage of $500,000. The insurance amounts set fort;: herein are the minimum amounts required by the City. Other agencies with which the contractor may be involved in the accomplishment of the work may require greater amounts. 1 -23- I I 1 1 1 1 I 1 The City will not recognize any claim for additional compensation because of the requirement for greater amounts of insurance, as an element to be considered by the contractor in determining his bid. Change 3: "Section 8 - Facilities for Agency Personnel" Delete this section. 3. Terms Defined Whenever in the said Standard Specifications the following terms are used, it is hereby provided that the following City department or persons shall be intended: AGENCY shall mean City of San Juan Capistrano wherever appropriate. BOARD shall mean the City Council of the City of San Juan Capistrano. ENGINEER shall mean City Engineer or other person(s) designated by same. LANDSCAPE ARCHITECT shall mean City Engineer or other person(s) designated by same. 4. Special Provisions of Items of Work, Materials and Methods of Construction A. Bid Items BID ITEM 1 - Irrigation SCOPE Furnish all materials, equipment, services, supervision, transportation and labor necessary to perform all irrigation work complete including the following: Drawings and Specifications Service Manuals Record Drawings Loose Equipment Guarantee Materials Installation 1. Drawings and Specifications 1.1 The intent of the Drawings and Specifications is to indicate and specify a complete and efficient sprinkler irrigation system ready for use in accordance with the manufacturer's recommendations and meeting with the approval of the Landscape Architect without further cost of labor and material to the Owner. -24- 1 -25- 1.2 Plot dimensions are approximate. Before proceeding ' with any work the Contractor shall carefully check and verify all dimensions and shall report any variations to the Owner. ' 1.3 Due to the scale of the Drawings, it is not possible to indicate all offsets, fittings, etc. which may be ' required. The Contractor shall carefully investigate the structural and finished conditions affecting all his work, and plan his work accordingly, furnishing such fittings, etc. as may be required to meet such conditions. Drawings are generally diagrammatic and indicative of the work to be installed. The work shall be installed in the most direct and workmanlike manner, so that conflicts between sprinkler systems, planting and architectural features will be avoided. 2. Service Manuals Contractor shall furnish two (2) service manuals to the Owner. Manuals may be loose leaf and shall contain complete exploded drawings of all equipment installed showing components and catalog numbers together with the manufacturer's name and address. Additional sheets shall cover operation ' instructions simple enough to be understood without specialized knowledge. 3. Loose Equipment Loose sprinkling equipment, operating keys and spare parts will be furnished by the Contractor in quantities as shown ' on plans or in specifications. ' 4. Guarantee 4.1 The entire sprinkler system shall be unconditionally guaranteed by the Contractor as to material and ' workmanship, including settling of backfilled areas below grade for a period of one (1) year following the date of final acceptance of the work. ' 4.2 If, within one year from the date of completion, settlement occurs, and adjustments in pipes, valves ' and sprinkler heads or paving is necessary to bring the system or paving to the proper level of the permanent grades, the Contractor, as part of the work under his Contract, shall make all adjustments without extra cost to the Owner, including the restoration ' of all damaged planting, paving or other improvements of any kind. 1 -25- I r r 1 U H 4.3 Should any operational difficulties in connection with the sprinkler system develop within the specified guarantee period which in the opinion of the Owner may be due to inferior material and/or workmanship, said difficulties shall be immediately corrected by the Contractor to the satisfaction of the Owner at no additional cost to the Owner, including any and all other damage caused by such defects. 5. Materials 5.1 Pipe and Fittings 5.1.1 Brass Brass pipe shall be IPS standard weight 85% Red Brass. Fittings shall be with standard 125 -pound cast bronze threaded fittings. 5.1.2 PVC Conduit Pipe that is used for control wires shall be PVC conduit Schedule A. Type 2110. All wires under paving shall be installed in PVC conduit. 5.1.3 PVC High Impact Pipe - Type 1220 (PVC Schedule 40 and 80) 5.1.3.1 Type II Grade I High Impact Pipe 5.1.3.2 Outside diameter of pipe shall be the same size as iron pipe 5.1.3.3 Pipe shall be marked at intervals not to exceed 5' with the following infor- mation: Manufacturer's name, nominal pipe size, PVC type and grade (i.e. 1220) schedule, NSF approval and commercial standard designation CS 207-60. 5.1.3.4 PVC Schedule 40 shall not be threaded. 5.1.3.5 Fittings shall be PVC Schedule 40, Type II, NSF approved. 5.1.4 PVC Pressure Rated Pine - ss 40 5.1.4.1 Type I Grade II Pressure Rated Pipe. 5.1.4.2 Materials shall meet the requirements set forth in ASTM D1784 -60T. 5.1.4.3 Outside diameter of pipe shall be the same size as iron pipe. -26- I I I I 5.1.4.4 Pipe shall be marked at intervals with the following information (not to exceed 5'): Manufacturer's name, nominal pipe size, PVC type and grade (i.e., PVC 1220) SDR rating class, NSF approval and commercial standard designation CS 256-63. 5.1.4.5 PVC Type I shall not be threaded. 5.1.4.6 PVC fitting shall be PVC Type II, Schedule 40 NSF approved. 5.1.4.7 Solvent shall be #175 Gray NSF approved as manufactured by Industrial Polychemical Service, Gardena, California. 5.1.4.8 Caution shall be utilized in handling Type I pipe due to the possibility of cracking or of splitting when dropped or handled carelessly. ' 5.1.4.9 When connection is plastic to metal, male adaptors shall be used. The male ' adaptor shall be hand tightened, plus one turn with a strap wrench. Joint compound shall be permatex Type II. ' 5.1.5 Ring-tite PVC Pipe All pipe indicated on the working drawings, shall be Class 160 psi Johns -Manville PVC pipe with ring-tite joints. All ring-tite joints shall be sealed with rubber rings as provided by the manufacturer. All pipe joints shall provide for expansion and contraction. I I 11 1 I Thrust blocks shall be provided as required for proper anchorage and durability of the ring-tite pipe. 5.2 Sprinkler Heads 5.2.1 Sprinkler heads shall be as shown on plan or approved equal. 5.3 Valves 5.3.1 Remote Control Valves Electric remote control valves shall be installed. -27- ' 5.3.2 Gate Valves Approved gate valves shall be Kennedy #427 or ' Crane #438 or approved equal. 5.3.3 Check Valves ' Swing check valves shall be of bronze construction with 125 psi working pressure and shall conform ' to federal specification WW -V -SI, Class A, Type IV. Check valves shall be model #440 as manufactured by Kennedy Valve Manufacturing Company or approved equal. ' "Stopamatic" valves shall be normally closed and shall allow water to pass through when pressure rises above 20 psi. Valves shall be as manufactured ' for Rainbird, Glendora, California, or approved. 5.3.4 Quick Coupling Valves ' Quick coupling valves shall be as indicated on Plan and shall have a locking cover. Alternate ' material may be submitted for approval. Each quick coupling valve shall have a molded vinyl cover, yellow in color. All quick coupling valve keys and hose swivels shall be of same ' manufacturer as the quick couplers. 5.4 Automatic Controllers ' Automatic controllers shall be installed. 1 Control 5.5 Wire for RCV's All wiring to be used for connecting the automatic ' controller to the electrical solenoid actuated by remote control valve shall be Type OF -600V, 7 -strand ' or solid copper, PVC insulation, single conductor, UL approved underground feeder cable. Each pilot or "hot" wire shall be color -coded with the common wire being either black or white. 5.6 Valve Boxes All remote control valves, gate valves, and pressure ' relief valves shall be installed in suitable valve boxes complete with locking ' covers. All shall be Ametek, or approved equal, and shall be marked "G.V." or "RCV" with station numbers for control valves painted in 1-1/2" high white letters on valve cover by Contractor. -28- 1 I ' 5.7 Backflow Prevention Units The backflow prevention units shall be installed. t6. Installation ' 6.1 Trenching 6.1.1 Excavation shall be open vertical construction ' sufficiently wide to provide free working space around the work installed and to provide ample space for backfilling and compacting. C� C 1 1 1 I F 6.1.2 Trenches for pipe shall be cut to required grade lines, and trench bottom shall be compacted to provide an accurate grade and uniform bearing for the full length of the line. 6.1.3 When two (2) pipes are to be placed in the same trench, a 6" space shall be maintained between pipes. 6.2 Backfilling 6.2.1 Backfill material shall be approved soil. Unsuitable material including clods and rocks over 1" in size shall be removed from the premises and disposed of legally at no cost to the Owner. 6.2.2 All backfilling shall be done carefully and shall be properly compacted. 6.2.3 Depth of trenches shall be sufficient to provide a minimum cover above the top of the pipe as follows: 12" over PVC non -pressure lateral lines 18" over PVC non -pressure lateral lines for rotor system 18" over PVC ring-tite main under pressure 6.3 PVC Pipe 6.3.1 PVC pipe shall be installed in a manner which will provide for expansion and contraction as recommended by the pipe manufacturer. 6.3.2 All plastic to metal joints shall be made with plastic male adaptors. 6.3.3 The joints shall be allowed to set at least twenty-four (24) hours before pressure is applied to the system on PVC pipe -29- I ' 6.3.4 After all new sprinkler piping and risers are in place and connected, all necessary work has been completed and prior to the installation of ' sprinkler heads, control valves shall be opened and a full head of water used to flush out the system. After the system is thoroughly flushed, riser shall be capped off and the system pressure ' tested. 1 1 1 CI 1 1 6.3.5 Sprinkler lines shall be tested in place before backfilling for a period of not less than one (1) hour, and shall show no leakage or loss of pressure. During the test period, minimum test pressure at the highest point of the section being tested, shall be 100 pounds per square inch. 6.3.6 At the conclusion of the pressure test, the head shall be installed and tested for operation in accordance with design requirements under normal operating pressure. Contractor shall verify head pressures with pitot tube and adjust valve to correspond with design pressure. 6.4 Installation of Rina-Tite PVC Pi 6.4.1 Except as may be noted in other parts of the Specifications, or on the drawings, installation of Ring -rite pipe and connecting fittings shall be outlined in manual as furnished by pipe manufacturer, or as set forth by the Johns -Manville Company Manual #772-62A. This shall include, but not be limited to, the installation of the pipe at the proper depth and the correct location of concrete thrust blocks of adequate sizes. Contractor shall make available the services of the manu- facturer's representative at the start of the installation and may be required from time to time during construction. 6.4.2 Each line shall be tested at a pressure 50 psi greater than the manufacturer's recommended working pressure for a period of two (2) hours with the couplings and connections exposed and with the center of the pipe section sufficiently to hold pipe in place. 6.5 Sprinklers 6.5.1 All nozzles on stationary pop-up sprinklers shall be tightened after installation. All sprinklers having an adjustment stem shall be adjusted on a lateral line for the proper radius, diameter and/or gallonage. -30- I6.5.2 Sprinkler heads and risers shall be installed according to details. ' 6.8.3 All local and other applicable codes shall take precedence in connecting the 110 volt electrical service to the controller. Owner shall provide power to controller. Contractor shall complete hook-up to controller. -31- 6.6 Valves 6.6.1 Piping systems shall be supplied with valves at all points shown on the drawings or specified ' herein, arranged to give complete regulating control throughout. 6.6.2 Valves shall be the full size of the line in which they are installed unless otherwise indicated. ' 6.6.3 Remote control valves shall be adjusted so that the most remote sprinkler heads operate at the pressure recommended by the head manufacturer. Remote control valves shall be adjusted so a uniform distribution of water is applied by the sprinkler heads to the planting areas for each ' individual valve system. 6.6.4 Quick coupling valves shall be set approximately ' 12" from walks, curbs, headerboards, or paved areas where applicable. Vertical positioning of quick coupling valves shall be such that t sleeve top will be flush with the settled finish grade as determined after the turf is established and 3" above grade in ground cover areas. ' 6.7 Valve Boxes 6.7.1 Valve boxes shall be set one-half ('") inch above the designated finish grade in lawn areas and two (2) inches above finish grade in ground cover areas. 6.7.2 Valve boxes installed near walks, curbs, header - boards, and paving shall abut those items. The top surfaces shall be flush with items ' listed above. ' 6.8 Automatic Controller Location and Installation 6.8.1 The automatic controller shall be installed at approximate location shown on the plan. 6.8.2 Existing controllers are shown at approximate locations. ' 6.8.3 All local and other applicable codes shall take precedence in connecting the 110 volt electrical service to the controller. Owner shall provide power to controller. Contractor shall complete hook-up to controller. -31- F 11 H l� I 0 1 0 I 6.8.4 There shall be adequate coverage of earth (18" minimum) over the 24 volt control wire. Install wire in trench and tape to main lines on side of pipe at 10 -foot intervals. 6.9 Control Wire 6.9.1 All electrical equipment and wiring shall comply with local and state codes and be installed by those skilled and licensed in the trade. 6.9.2 Connecting and splicing of low voltage wire at the valves or in the field shall be made using a Rainbird Pen-Tite connector. 6.10 Backflow Prevention Units The backflow prevention units shall be installed as shown on Plans and Details. BID ITEM 2 - I. Landscape Construction YOIi3031 The work of this section includes all labor, materials and equipment required to complete work indicated on the drawings. The work shall be performed in accordance with the best standards of practice relating to the various trades and under the continuous supervision of a competent foreman, capable of interpreting the drawings and these specifications. The work included in this section is as follows: Finish Grading for Planting Soil Preparation Fertilization Planting, Including Lawn Maintenance Inspection and Certifications Guarantees Clean -Up Miscellaneous Allowances 1. Approvals 1.1 All sprinkler work shall be inspected and approved prior to the start of any work in this section. 1.2 Prior to excavation for planting or placing of stakes, locate all utilities, electric cables, conduits, sprinkler lines, heads, valves and valve control wires, and all utility lines so that proper precautions may be taken not to damage such improvements. In the event of a conflict between such lines and plant locations, promptly notify the Landscape Architect who shall arrange for relocation for one or the other. Failure to follow this procedure places upon the Contractor the responsibility for, at his own expense, making any and all repairs for damages resulting from work hereunder. -32- 1, 2. Quantities and Types Plant materials shall be furnished in the quantities and/or ' spacing as shown or noted for each location, and shall be of the species, kinds, sizes, etc., as symbolized and/or described in the "Plant Material Legend", as indicated on the ' drawings. The Landscape Architect has prepared this list only as a convenience to the Contractor and assumes no responsibility for its accuracy. The Landscape Contractor is to verify all sizes and quantities. 1 3. Verification of Dimensions and Quantities ' 4.2.6 All landscape construction items, prior to the start of the 120 -calendar day maintenance period (Final Observation). ' 4.2.7 At completion of 120 -calendar day maintenance period (Final Maintenance Observation). Observation reports shall be made for each observation by the Landscape Architect and one copy shall be submitted to the Owner and the ' Contractor. -33- 1 All scaled dimensions are approximate. Before proceeding with any work, the Contractor shall carefully check and verify all dimensions and quantities and shall immediately ' inform the Landscape Architect and Owner of any discrepancy between the drawings and/or specifications and actual conditions. No work shall be done in any area where there is such a discrepancy until approval for same has been ' given by the Landscape Architect and Owner. 4. Observation ' 4.1 All observation herein specified shall be made by the Landscape Architect and the Owner. The Contractor ' shall request observation at least two (2) days in advance of the time observation is required. 4.2 Observation will be required for the following parts ' of the work: 4.2.1 During finish grading and soil preparation. ' 4.2.2 Plants, after delivery to site prior to planting. ' 4.2.3 When vines, shrubs, and trees are spotted for but holes planting, planting are not excavated. 4.2.4 Lawn areas prior to planting. 4.2.5 Planting areas prior to planting. ' 4.2.6 All landscape construction items, prior to the start of the 120 -calendar day maintenance period (Final Observation). ' 4.2.7 At completion of 120 -calendar day maintenance period (Final Maintenance Observation). Observation reports shall be made for each observation by the Landscape Architect and one copy shall be submitted to the Owner and the ' Contractor. -33- 1 1 C 1 Certification Prior to job acceptance written certifications shall be submitted to the Landscape Architect, for the following: 5.1 Quantitiy and Quality of Commercial Fertilizer and Organic Fertilizer. 5.2 Quantity and Quality of all Soil Amendments called for by Plans and Specifications. Materials Plant Materials indicated on the drawings and herein specificed, shall conform to the following: 6.1 Nomenclature: Plant names indicated or listed in the "List of Plant Materials" on the drawings, conform to "Standard Plant Materials" on the drawings, conform to "Standard Plant Names" established by the American Joint Committee on Horticulture. Except for names covered therein, the established custom of the nursery is followed. 6.2 Condition: Plants shall be symmetrical, typical for variety and species, healthy, vigorous, free from plant disease, insect pests, or their eggs, and shall have healthy, normal root systems, well filling their containers, but not to the point of being root bound. Plants shall not be pruned prior to delivery, except as authorized by the Landscape Architect, or his representa- tive. In no case shall trees be topped before delivery. 6.3 Dimensions: The height and spread of all plant material shall be measured with branches in their normal position, and shall be as indicated on the drawings. The caliper of all trees shall be measured 4'0" above the surface of the ground. Where caliper or other dimensions of any plant materials are omitted from the "Plant Legend", it shall be understood that these plant materials shall be normal stock for type listed. 6.4 Inspection: All plant materials must have been previously inspected at the nursery by the Orange County Horti- cultural Department, and shall be subject to the inspection and approval of the Landscape Architect before planting. 6.5 Plant List: Is indicated on drawings. 6.6 Sizes of Plants: Shall be as stated on the Plan. Container stock (1 -gallon , 5 -gallon, and 15 -gallon), shall have been grown in containers for at least one(1) year, but not over two years. -34- I 1 1 r 6.7 Substitutions: Substitutions for the indicated plant materials will be permitted provided the substitute materials are approved in advance by the Landscape Architect and the substitutions are made at no additional cost to the owner. Except for the variations so authorized, all substitute plant materials shall conform to the requirements of these specifications. If the accepted substitute materials are of less value than those indicated or specified the Contract price will be adjusted in accordance with the provisions of the Contract. 6.8 Plants Not Approved: Plants not approved are to be removed from site immediately and replaced with suitable plants. The Landscape Architect and/or Owner reserves the right to reject entire lots of plants represented by defective samples. 7. Fertilizers and Soil Conditioners ' Samples of all soil amendments, sod and plants shall be submitted for inspection and stored on the site until furnishing of materials is completed. Delivery may begin upon approval of samples or as directed by the Landscape Architect and the Owner. 7.1 Organic fertilizer shall be processed sewage sludge with a minimum content of 18 Nitrogen and 2% Phosphoric Acid similar to "Nitro -humus". Method of processing shall not destroy normal bacterial content. 7.2 Nitrogen stabilized sawdust shall be bulk, with the following nitrogen content based on dry weight: ' 0.5% for Redwood Sawdust 0.7% for Fir Sawdust ' 1.0% for Bark or Pine Bark or Mixture 7.2.1 Salinity: the saturation extract conductivity shall not exceed 3.5 millimhos/cm at 250 C. ' 7.3 Commercial fertilizer shall be delivered in sacks with manufacturer's label showing weight and analysis attached to each sack. 8. Grading and Soil Preparation ' 8.1 Contractor is to finish grade to within 1/10th of 1 foot or 1" below paving where paving exists. ' 8.2 Moisture Content: The soil shall not be worked when the moisture content is so great that excessive compaction will occur, not when it is so dry that dust will form in the air or that clods will not break readily. Water ' shall be applied if necessary to provide ideal moisture content for tilling and for planting herein specified. ' -35- I 1 �I H 7 1 H I I 1 8.3 Preliminary Grading: Preliminary Grading shall be done in such a manner as to anticipate the finish grading. Excess soil shall be removed or redistributed before application of fertilizer and mulch. Where soil is to be replaced by plants and mulch, allowance shall be made so that when finish grading has begun, there shall be no deficiency in the specified depth of mulched planting beds. 8.4 Weeding: Before and during preliminary and finish grading, all weeds and grasses shall be dug out by the roots and disposed of off the site (except those weeds and grasses not of the perennial type, less than 2'Y" high and not bearing seeds, which may be turned under). Oats more than 2'h" high and not bearing seeds may be turned under. Perennial weeds and grasses to be removed include, but are not limited to, the following: Nut Grass Alfalfa St. Augustine Grass Puncture Vine Dallas Grass Mustard Plant Johnson Grass Wire Weed Morning Glory 8.5 All Planting Areas shall be scarfied to a depth of 12 inches below grade with the spacing of the ripper teeth no greater than 12 inches on center prior to placing conditioners and fertilizers. All rock and debris more than 2" in diameter shall be removed from the site. 8.6 Trenches: If sprinkler system is installed after grading and fertilizing is completed, the upper portion of the backfill shall be retilled and fertilized to the depth specified for the area required to conform to the specifications. Soil Conditioners 9.1 *In All Planting Areas the following application shall be made per 1,000 square feet of area and shall be thoroughly cultivated in two directions into the top 6" of soil, and the area watered down: 6 cu. yards nit -stabilized sawdust 100 lbs. agricultural gypsum 20 lbs. 6-20-20 300 lbs. finely ground calcium carbonate or oyster shell lime 9.2 *Prepare soil mix for backfill in pits for trees, shrubs, and vines (other than azaleas, ferns, and palms). Soil mix shall consist of the following: *Soil amendments (based on soil sample) to be determined after grading operation is complete. -36- I 10. U I 11. J Amount/cubic yard: 60% by vol on-site soil 40% by vol organic amendment 1 lb. 12-16-12/cu. yed. 2 lbs. iron sulphate/cu. yd. Planting pits shall be excavated twice the diameter and twice the depth of the rootball. Backfill shall then be added as outlined above. 9.3 Prepared soil mix for backfill in pits for azaleas, ferns, and palms shall be: Azaleas - Bandini Azalea Mix or Approved Equal. Ferns, Camellias, Palms - Bandini or Kelloggs Planter Mix or Approved Equal. Planting pits shall be excavated three times the diameter and three time the depth of the rootball. 9.4 The prepared soil shall be uniformly blended in an area adjacent to the planting work and shall be accurately proportioned using a suitable measuring container. Unused excavated soil shall be removed from site. Protect the mix from water until it has been placed in backfill around plants. Finish Grading When preliminary grading,including weeding and fertilizing, has been completed and the soil has dried sufficiently to be readily worked, all lawn and planting areas shall be graded to the elevations indicated on the drawings. Grades not otherwise indicated shall be uniform levels or slopes between points where elevations are given. Minor adjustments of finish grades shall be made at the direction of the Landscape Architect, if required. Finish grade shall be a smooth, even, and uniform plane without abrupt change of surface. Soil areas adjacent to buildings to allow a natural run-off of water, and surface drainage shall be directed as indicated on the drawings by remodeling surfaces to facilitate the natural "run-off" of water. Low spots and pockets shall be one (1) inch below grade of adjacent pavement of any kind. Grading shall be done when soil is at optimum moisture content for working. Method of Planting and Work Procedure 11.1 No planting shall be done until all operations in in conjunction with the installation of the sprinkler system have been completed, final grades have been established, the planting areas have been properly graded and prepared as herein specified, and the work approved by the Landscape Architect. -37- 1, ' 11.2 The relative position of all trees and plants is subject to approval by the Landscape Architect and Owner, and they shall, if necessary, be relocated as directed as part of the Contract. 11.3 All plants shall be removed from their container and ' set so that, when settled, they bear the same relation to the required grade that they bore to the natural grade before being transplanted. Each plant shall be planted in the center of the pit and backfilled ' unless otherwise specified, with the prepared soil. No soil in muddy condition shall be used for backfilling. No filling will be permitted around trunks or stems. All broken of frayed roots shall ' be properly cut off. ' 11.4 The Landscape Architect and/or Owner shall inspect the and of all materials. placing planting plant 11.5 In the event that underground construction work or ' obstructions are encountered in the planting operation, alternate locations for plant material will be selected by the Landscape Architect and Owner; operation will ' be done at no extra cost to the Owner. 12. Planting of Vines, Shrubs and Ground Covers ' 12.1 Vines and shrubs shall be planted in pits at least 18" greater in diameter than their ball of earth and at least 12" below the bottom of the ball. Compacted ' soil at bottom of pit shall be loosened and the pit filled with "Prepared Soil" to the bottom of the ball. When the plant has been properly set, the pit shall be filled to the required grade with "Prepared Soil" t and thoroughly settled by tamping and watering. All vines shall be removed from stakes, untied, and securely fastened in an approved manner to the wall, fence or other surface next to which they are planted. 12.2 Prepare a depressed water basin as wide as plant balls at each plant. Water thoroughly, backfilling any voids with additional prepared planting mix. 12.3 Ground Covers 12.3.1 Pits for flat sized plants to be at least V xV xV . Ground cover areas shall be moistened prior to planting. No flat plants shall be planted in dry soil. ' 12.3.2 Set plants in center of pits so that crown of plant will be level with finished grade after settling of soil, then backfill and ' water. -38- 1 I ' 15.3 Apply water in sufficient quantities, and as often as seasonal conditions require, to keep the ground wet at all times, well below the root system of grass and ' planting. Care is to be taken in watering slopes so as not to cause erosion damage. -39- 12.3.3 Flatted plants shall be well -rooted with runners at least 4: but not more than 6" in length. ' 13. Care of Plants Before and During Planting Plants shall not be allowed to dry out before or while ' being planted. Keep exposed roots moist by means of wet sawdust, peat moss, or burlap at all time during planting operations. Do not expose roots to the air except while being placed in the ground. Wilted plants, whether in ' place or not, will not be accepted and shall be replaced at the Contractor's expense. ' 14. Sodded Lawn 14.1 Cultivate all lawn areas to a depth of 8". Rocks and ' debris larger than one (1) inch in diameter which are brought to the surface by cultivation shall be removed from the site. If cultivation does not break lumps, a spike tooth harrow shall be pulled behind a ' mechanical seeder or tractor. ' 14.2 Areas to be planted in lawn shall be finished smooth to present a neat and uniform grade prior to installation of sod. The lawn bed shall be inspected by the Landscape Architect to determine ' suitability for planting prior to sodding. The Contractor shall obtain such approval before sodding. 14.3 All sodden areas shall be thoroughly watered. Lawns ' are to be kept continuously moist by watering as often as required. ' 14.4 Re -sodding: Any lawn areas that do not show a prompt catch of grass shall be re -sodded at ten day intervals until an acceptable stand of grass is assured. t15. Watering 15.1 Immediately after planting, water shall be applied to each tree by means of a hose. The water shall be applied in a moderate stream in the planting holes until ' the material about the roots is completely saturated from the bottom of the hole to the top the of ground. 15.2 Plants which cannot be watered efficiently with the ' existing water system shall be watered by means of a hose. ' 15.3 Apply water in sufficient quantities, and as often as seasonal conditions require, to keep the ground wet at all times, well below the root system of grass and ' planting. For each fertilizer and soil conditioner, in containers, a similar certificate or invoice shall be furnished stating total quantities by weight and volume for each material. These certificates shall be submitted to the Landscape Architect and Owner prior to the start of the maintenance period. Protection The Contractor shall carefully and continuously protect all areas included in the contract, including plant materials, fences, supports. etc., until final acceptance of the work by the Landscape Architect and Owner. Maintenance 18.1 The Contractor shall maintain a sufficient number of men and adequate equipment to perform the work herein specified. Plant maintenance work shall consist of applying water, weeding, caring for plants, including groundcovers, shrubs and trees, edging,aerating, and mowing of lawns, fertilizing and control of pests and diseases. 18.2 Damage to any planted area shall be repaired immediately. Depressions caused by vehicles or foot traffic shall be filled with topsoil, leveled and replanted. Exterminate gophers and moles, and repair damage. 18.3 The entire project shall be maintained for a period of 120 days, commencing from the time all items of work have been completed to the satisfaction of the Landscape Architect and the Owner. 18.4 The project shall be so cared for that a neat and clean condition will be presented at all times to the satisfaction of the Owner and the Landscape Architect. -40- ' 18.4.1 Lawns Watering: Water every day once per day for two weeks thereafter and then gradually reduce ' frequency of watering to three times per week. The Contractor shall continue to maintain the lawn until final acceptance by ' the Landscape Architect and the Owner. Fertilizing: Apply 16-6-8 at the rate of 5 pounds per 1,000 square feet three weeks after ' installation and water immediately thereafter. Diseases and Pest Control: Two weeks after installation of lawn, apply a granular mercurial fungicide of 1.8% mercurous chloride as per manufacturer's recommendation. ' Mowing: The lawn shall be mowed at a height of 1Y" with a rotary mower, equipped with rollers, before it reaches a 2" in height. Collect ' grass clippings during mowing operations and remove from the site. ' After each cutting, the edge of the grass shall be trimmed to a neat and uniform line. The lawn edges shall be maintained in a neat ' condition at all times. 18.4.2 Groundcovers and Shrub Areas ' Watering: New plantings shall be watered once per day for two (2) weeks after installation. ' Reduce watering to every other day for the next two (2) weeks. Water thereafter three (3) times per week until final acceptance. ' Fertilization: Fertilize three (3) weeks after planting with 5 pound 16-6-8 per 1,000 square feet: fertilize thereafter every 30 days. ' Disease and Pest Control: For control of slugs and snails, apply pelletized tricalcium arsinate t 5% by weight as per manufacturer's recommendations two weeks after installation. For control of cutworms and other soil insects, ' apply Metro brand soildrin as per manufacturer's recommendations two weeks after installation. This product contains Dieldrin, Lindane, and ' Phosphorothioate. Exterminate gophers and moles and repair damage. -41- I ' Pruning: All shrubs and trees shall be pinch pruned as necessary to encourage new growth and to eliminate rank sucker growth. Old flowers, ' and dead foliage and limbs shall be removed. No major pruning shall be done without the approval of the Landscape Architect. Weeding: All planting areas including lawn, groundcover, and shrub areas, shall be kept weed -free at all times. Weeds shall be dug ' out by the roots and disposed of off the site. Upon completion of the 60 day maintenance period, ' the Contractor shall fertilize per 26.4.1 and 26.4.2 of this section. ' -42- P 19. Guarantee and Replacements ' 19.1 All shrubs and groundcover shall be guaranteed by the Contractor as to growth and health for a period of ninety (90) days after completion of the specified ' maintenance period, and/or final acceptance by the Landscape Architect. All trees up to 20" box size ' shall be guaranteed by the Contractor to live and grow in an acceptable upright position for a period of six (6) months after completion of the specified maintenance period, and/or final acceptance by the ' Landscape Architect. Trees, in 20" boxes or larger, and all field grown specimens shall be guaranteed by the Contractor to live and grow in an acceptable upright position for a period of one year after completion of the specified maintenance period, and/or final acceptance by the Landscape Architect. ' 19.2 All plants that show signs of failing growth at any time during the life of the Contract, including the maintenance period or those plants so injured or ' damaged as to render them unduitable for the purpose intended, shall be immediately replaced in kind and size at the expense of the Contractor. ' 19.3 The Contractor within five (5) days of notification by the Landscape Architect, shall remove and replace all guaranteed plant materials which for any reason fail to meet the requirements of the guarantee. Replacement shall be made with plant materials as indicated or specified for the original planting, and all such ' replacement materials shall be guaranteed as specified for the original planting, and all such replacement materials shall be guaranteed as specified for the original guaranteed materials. ' -42- P I ' 20. Clean Up Upon completion of the work in this section, the Contractor shall remove all rubbish, trash and debris resulting from ' the operations; remove disused equipment and implements of service; leave entire area involved in a neat and acceptable condition such as to meet the approval of the ' Landscape Architect. 21. Maintenance 21.1 Maintenance of the project shall be for a period of 120 days. 21.2 Maintenance shall include all watering, fertilization, mowing, weeding, cultivating, spraying and pruning necessary to keep the plant materials in a healthly ' growing condition and to keep the planted areas neat and attractive throughout the maintenance period. ' 21.3 Protect all planted areas against damage, including erosion and trespassing, by providing and maintaining proper safeguards. ' 21.4 During the maintenance period, all planted areas shall be kept well watered and weed free at all times. 21.5 From the time any planting is done, until the end of the maintenance period, the Contractor shall maintain a sufficient number of men and adequate equipment to ' peform the work herein specified. 21.6 The Contractor will be relieved from maintenance work when the final plant establishment and maintenance work has been completed to the satisfaction of the Owner. 21.7 Damage to planting areas shall be replaced immediately ' at the Contractor's expense. 21.8 Depressions caused by vehicles, bicycles, or foot ' traffic, shall be filled and leveled. Replant damaged areas. 21.9 Exterminate gophers and moles, ground squirrels, and repair damage as above. ' 21.10 All paved areas will be washed and maintained in a neat and clean condition at all times, as directed by the Owner. ' 21.11 Pinch -prune all shrubs and trees to encourage new growth and to eliminate rank sucker growth. Remove all old flowers and dead foliage and limbs. Do no ' major pruning without the approval of the Owner. Remove damaged branches on trees back to point of growth. Treat cuts over 2" in diameter with an ' approved tree wound dressing. -43- 111 1 n 21.12 During the maintenance period, should the appearance of any plant indicate weakness and probability of dying, immediately replace that plant with a new and healthy plant of the same type and size without additional cost to the Owner. 21.13 At the end of the maintenance period, all plant material shall be in a healthy growing condition. 21.14 Contractor shall continue the maintenance period past the specified date at no additional cost to the Owner until all deficiencies have been corrected. Miscellaneous A. Insurance and Overhead Costs The contractor shall receive no direct compensation for insurance and overhead (move -in costs for example) costs. Accordingly, these costs should be prorated to the appropriate bid items. B. Protection of Existinq Utilities The engineer has endeavored to show all existing utilities. The contractor must, however, take all due precautionary measures to protect all of the existing utilities. C. Protection of Private Property The contractor must remain within the construction zone to the best of his ability. The contractor must protect all existing private property. -44-
