This contract is made and entered into by and between the

Reed Thomas Company hereinafter
referred to as CONTRACTOR.
i IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS:
r FIRST. CONTRACT DOCUMENTS. The contract documents shall be
a considered to include the Notice Inviting Bids, the Instructicns
to Bidders, the Proposal, the Bid Bond, the Non -Collusion Affi-
davit, the Designation of Sub -Contractors, the Contract which is
prepared for execution by the City and the Contractor, plans,

specifications and special provisions, contract bonds, resolu-
tions adopted by the City Council pertaining to the work, in-
surance policies and certificates, and any supplemental written
agreements amending or extending the scope of the work originally
S= contemplated that may be required to complete the work in a
�- substantial and acceptable manner.
SECOND. THE WORK. CONTRACTOR agrees to furnish all tools,
labor, material, equipment, transportation, and supplies neces-
sary to perform and complete in good and workmanlike manner the
construction of regrading and landscaping of a portion of the
Calle Miramar Right -of -Way at Avenida Pescador in strict confor-
mity with the Plans, Specifications and all other contract docu-
ments, which documents are on file at the Office of the City
' Clerk, City Hall, 32400 Paseo Adelanto, San Juan Capistrano,
California.
THIRD. PAYMENT. City agrees to pay, and CONTRACTOR. agrees to
accept, the lump sum adjusted for variations of quantities, at
the prices designated in bid proposal at the time and in the
manner set forth in the Specifications.

FOURTH. COMMENCE'?ENT AND COMPLETION OF THE WORK. CONTRaCTOR

agrees to begin and complete the work within the time specified
in the Notice Invitina Bids. It is agreed that it would be im-
practicable and extremely difficult to fix the actual amount of
damages, and loss sustained by City, should CONTRACTOR fail to
complete the work in the specified time; therefore, CONTRACTOR
shall pay City, as liquidated damages, not in the nature of a
penalty, one hundred dollars ($100) a day for each day delayed;
provided that extensions of time with waiver of liquidated
s damages, may be granted as provided in the Specifications.

FIFTH. PERFORMANCE BOND AND LABOR, AND MATERIAL BOND. Contractor

i agrees to furnish bonds guaranteeing the performance of this con-
tract and guaranteeing payment of all labor and material used
under this contract, as required by the laws of the State of Cali-
fornia, on forms approved by City. The Performance Bond shall
^ be for an amount of one hundred percent (100%) of the amount of
this contract and shall be conditioned on full and complete per-
formance of the contract, guaranteeing the work against faulty
workmanship and materials for a period of one (1) year after com-
pletion and acceptance. The Labor and Material Bond shall be for
an amount of one hundred percent (1000 of the amount of this
contract and shall be conditioned upon full payment of all Labor
and Material entering into or incidential to the work covered by
this contract. CONTRACTOR acrees to furnish the bonds on the
forms found within the Specifications.
SIXTH. GENERAL PREVAILING RATE OF PER DIEM WAGES. Pursuant
to the Labor Code of the State of California, copies of the pre-
vailing rate of per diem wages, as determined by the Director
of the State Department of Industrial Relations, are on file
in the office of the City Clerk, 32400 Paseo Adelanto, San Juan
Capistrano, California, and are hereby incorporated and made a

EIGHTH. COMPLIANCE WITH OTHER PROVISIONS OF LAW RELATIVE TO

PUBLIC CONTRACTS. City is subject to the provisions of the
Government Code and the Labor Code of the State of California.
It is stipulated and agreed that all provisions of law applicable
' to public contracts are a part of this contract to the same ex-
tent as though set forth herein and shall be complied with by
CONTRACTOR. These include, but are not limited to, the stipula-
tion that eight (8) hours labor constitute a legal day's work
+• and CONTRACTOR shall, as a penalty to City, forfeit twenty-five
IF dollars ($25) for each workman employed in the execution of the
., Contract by CONTRACTOR, or by any SUB -CONTRACTOR, for each calen-
dar day during which such workman is required or permitted to
work more than eight (8) hours in violation of the provisions
of Article Three, Chapter One, Part Seven, Division 2, of the
California Labor Code, except as permitted by law.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN JUAN CAPISTRANO, CALIFORNIA, DECLARING
WORK TO BE COMPLETED AS TO PLANS AND
SPECIFICATIONS FOR THE CALLE MIRAMAR
REHABILITATION (REED THOMAS COMPANY)
WHEREAS, on the 16th day of August, 1983, the City of
San Juan Capistrano entered into a contract with the Reed Thomas
Company, for the rehabilitation and landscaping of Calle Miramar
right-of-way; and,
WHEREAS, the Director of Public Works has evaluated the
final quantities and cost figures and recommends approval.
NOW, THEREFORE, the City Council of the City of San
Juan Capistrano does resolve as follows:
SECTION 1. That the work required to be performed by
said contractor has been completed.
SECTION 2. That the total cost of said work is in the
amount of $20,030.
SECTION 3. That the work is hereby accepted and
approved.
SECTION 4. The City Clerk is directed to forthwith
forward a "Notice of Completion" to the County Recorder of the

FINANCIAL CONSIDERATIONS:
The original contract price was $17,380. Change Order No. 1
and 2 were for an extension of time, and Change Order No. 3
was for an increase of $2,650 for landscaping.

SITUATION
San Diego Gas & Electric and Pacific Telephone Companies recently
completed the rerouting of utilities through the subject project
site at Calle Miramar and Avenida Pescador. The City's contractor
for the project,the Reed Thomas Company, is now prepared to begin
work on the slope reconstruction. However, since the rainy season
is upon us, Staff, with the contractor's concurrence, is recom-
mending postponement of the grading work until April 15, 1984 to
avoid possible drainage and erosion problems with the residential
slopes. To accommodate this postponement and provide the contractor
sufficient time to complete the project, Staff is recommending a
time extension to June 15, 1984.

project site the contractor has been unable to begin work. As a

the utility companies sufficient time to complete their modifications
and permit the contractor sixty days to construct the project.

Report dated August 16, 1983, from the Director of Public
Works, forwarding results of bids received for the Calle
Miramar Rehabilitation Project. The report advises that the
low bid of $17,380, is $2,380 over the 1983-84 Capital
Improvement Project budget and recommends supplemental
funding from anticipated 1983-84 revenue collections.

anticipated 1983-84 revenue collection into Project Account

SITUATION
Bid were opened for the Calle Miramar Rehabilitation project by
the City Clerk on August 1, 1983. The low bidder for the project
is the Reed Thomas Company; a tabulation of the bids is shown below:

The project calls for the regrading and landscaping of an unused
portion of Calle Miramar right-of-way. In conjunction with the

the project.
COMMISSION/BOARD REVIEW, RECOMMENDATION
Not applicable.
FINANCIAL CONSIDERATIONS
In the 1983-84 Capital Improvements Budget $15,000 was authorized
for the project. The low bid by Reed Thomas Company is $2,380
over the project budget. Staff is recommending supplemental
funding from anticipated 1983-84 revenue collections.
ALTERNATE ACTIONS
1. Award the contract to Reed Thomas Company in the amount of
$17,380 and reject all other bids.
2. Do not award the contract and cancel the project.

RECOMMENDATION

Mr. and Mrs. William E. Deacon grant to the City of San Juan
Capistrano a license to enter on to Lot 59 of Tract 8087 owned
by Mr. and Mrs. William E. Deacon for grading and landscaping
construction.
This license is granted subject to the following conditions:
1. Permission to enter the property is granted for the sole
purpose of grading and landscaping purposes as shown on the
improvement plans on file in the office of the City Engineer,
City of San Juan Capistrano, California.
2. The City of San Juan Capistrano agrees that Mr. and Mrs.
William E. Deacon are to be free from all liability or loss
by reason of injury to person or property, from whatever
cause, while exercising any right granted under this license,
including any liability for injury or death to the person or
property of the City of San Juan Capistrano, their agents
and employees. The City of San Juan Capistrano shall save
Mr. and Mrs. William E. Deacon harmless from any and all
liability, loss, costs, or obligations on account of, or
arising out of, any such injury or losses however occurring
resulting from the use of any rights granted under this license.
3. It shall be the duty of the City of San Juan Capistrano to
maintain the property in its current condition and not to
commit waste upon the property during construction.
4. This license shall run from the date of commencing construction
to the filing of a "Notice of Completion" with the County
Recorder.

Mr. and Mrs. Wayne B. Collins grant to the City of San Juan
Capistrano a license to enter on to Lot 58 of Tract 8087 owned
by Mr. and Mrs. Wayne B. Collins for grading and landscaping
construction.
This license is granted subject to the following conditions:
1. Permission to enter the property is granted for the sole
purpose of grading and landscaping purposes as shown on the
improvement plans on file in the office of the City Engineer,
City of San Juan Capistrano, California.
2. The City of San Juan Capistrano agrees that Mr. and Mrs.
Wayne B. Collins are to be free from all liability or loss
by reason of injury to person or property, from whatever
cause, while exercising any right granted under this license,
including any liability for injury or death to the person or
property of the City of San Juan Capistrano, their agents and
employees. The City of San Juan Capistrano shall save Mr, and
Mrs. Wayne B. Collins harmless from any and all liability,
loss, costs, or obligations on account of, or arising out of,
any such injury or losses however occurring resulting from the
use of any rights granted under this license.
3. It shall be the duty of the City of San Juan Capistrano to
maintain the property in its current condition and not to
commit waste upon the property during construction.
4. This license shall run from the date of commencing construction
to the filing of a "Notice of Completion" with the County
Recorder.

The undersigned, as bidder, declares that he has carefully
' examined the location of the proposed work as described, examined
the Plans and Specifications and General Conditions therefor,
' read the Instructions to Bidders, and is familiar with all pro-
posal requirements, and hereby proposes and agrees, if the pro-
posal is accepted, to complete the said construction in accordance
' with the Contract Documents, as defined in Section 1-2 of the
Standard Specifications, in the time stated herein, for the unit
' price or lump sum given on the following pages of this proposal,
amounting to a total of:
' Seventeen Thousand Three Hundred Eighty Dollars $ 17,380.00

Said amount to include and cover all taxes, the furnishing
' of all materials, the performing of all the labor requisite or
proper and the providing of all necessary machinery, tools, ap-
paratus, and other means of construction; also, the performance
and completion of all the work in the manner set forth, described

If the contract is awarded, the undersigned agrees to enter
' into a contract with the City and to commence work within fifteen
(15) calendar days from the date of execution thereof, and to
' diligently prosecute the work to completion before the expiration

All bids are to be computed on the basis of the given
Estimated Quantities of Work, as indicated in this proposal,
times the unit prices as submitted by the bidders. In case of
discrepancy between words and figures, the words shall prevail.
' In case of discrepancy between unit prices and the extension
thereof, the unit price shall prevail and bids will be computed
' as indicated above and compared on the basis of corrected totals.
The estimated quantities of work indicated in this proposal
' are approximate only, being given solely as a basis for comparison
of bids. It is understood that the City does not expressly nor
by implication agree that the actual amount of work will corres-
pond therewith, bmt reserves the right to increase or decrease
' the amount of any item or portion of the work or to omit portions
of the work as may be deemed expedient by the Engineer.
It is also understood by Bidder that the City of San Juan
Capistrano has the right to reject this proposal or to award a
contract to the undersigned at the prices stipulated. If the
proposal is rejected, then any check or cashier's check shall be
t returned to the undersigned within thirty (30) days. No bid bonds
will be returned. If the proposal is accepted and the undersigned
fails to enter into a contract within fifteen (15) days after the
agreement is delivered to him for signature, or within such further
time as may be granted by the City Council, then said check shall
be cashed or said bond declared forfeit and an amount equal to the
difference between the lowest bid and the next lowest bidder who
twill execute a contract shall be paid into the treasury of the
City of San Juan Capistrano as liquidated damages for the failure
tof the undersigned to comply with the terms of this proposal.
Accompanying this proposal is a $1,738.00 bidders bond (insert

Works, advising that one bid, in the amount of $22,132, was
received from Gillespie Construction Company for the
re -grading and landscaping of a portion of the Calle Miramar
right-of-way at Avenida Pescador. The amount was higher
than the Engineer's Estimate of $15,000, and rejection of
the bid was recommended.
Rejection of Bid/Readvertise:
It was moved by Councilman Schwartze, seconded by Councilman
Buchheim and unanimously carried to reject the bid from

SITUATION
On June 1, 1983, the City Clerk opened bids for the Calle Miramar
Rehabilitation Project. One bid was received from Gillespie
Construction Company in the amount of $22,132 for the re -grading
and landscaping of a portion of the Calle Miramar Right -of -Way
at Avenida Pescador. The Engineer's estimate prepared for this
project is $15,000. On May 3, 1983, when the City Council authorized
advertising for bids, a budget of $15,000 was allocated for the
project. Based on the budget allocation, Staff is recommending
rejection of the bid from Gillespie Construction Company and
authorization to re -advertise. This recommendation is based on
Staff's belief that bid proposals can be generated within the
parameters of the project's original budget allocation.
COMMISSION/BOARD REVIEW, RECOMMENDATION
Not Applicable.
FINANCIAL CONSIDERATIONS
There is no cost or compensation associated with the Staff
recommendation. Nominal printing costs will be incurred in
re -advertising this project.
ALTERNATE ACTIONS
Reject the bid from Gillespie Construction Company in the
amount of $22,132 for the Calle Miramar Rehabilitation and
authorize Staff to re -advertise the project.

As directed by the City Council, Staff has prepared plans and
specifications for the rehabilitation of Calle Miramar at the
intersection of Avenida Pescador. Included in this project
is the regrading and landscaping of the old street right-of-way

this right-of-way have agreed to accept the land after completion
of the grading and landscaping. The Engineer's Estimate for the

The project is unbudgeted and will require the transfer of contingency
funds as previously outlined to the City Council when authorization
to proceed with preparation of the plans and specifications
was directed.

Gentlemen:
Enclosed is a copy of Resolution No. 84-11-6-2, which
was adopted by the City Council at their meeting of November 6,
1984. The Resolution accepts the work completed for the Calle
Miramar Rehabilitation in the amount of $20,030.00.
The Council directed that the balance due, in the
amount of $18,027.00, be payable immediately. The 10% retention
will be payable upon 35 days from recording of the Notice of
Completion. The Notice was recorded on November 13, 1984;
therefore, the final payment in the amount of $2,003.00 may be
released on December 18, 1984.

At their meeting of January 17, 1984, the City Council
took action to approve Change Order No. 2, Time Extension Calle
Miramar Rehabilitation. The change order provides for a time
extension to June 15, 1984. This postponement is necessary since
the rainy season is upon us, and staff, with the your
concurrence, recommended the grading work not be done until April
15, 1984 to avoid possible drainage and erosion problems with the
residential slopes.

' INSTRUCTION TO BIDDERS
' Securing Documents
Plans, specifications and other contract documents will be
' available for examination without charge and copies may be secured
in accordance with the "Notice Inviting Bids".
Examination of Plans, Specifications and Site of Work
The bidder is required to examine the site of work, the
proposal, the plans and the specifications very carefully. He
shall satisfy himself as to the character, quality and quantities
' of the work to be performed, the materials to be furnished and
the requirements of the Contract Documents. The plans for the
' work show conditions as they are believed to exist, but it is
not to be inferred that all the conditions as shown thereon are
' actually existent, nor shall the City or any of its officers or
agents be liable for any loss sustained by the Contractor as a
result of any variance between conditions shown on the plans and
actual conditions revealed during examination or progress of the
work. The submission of a proposal shall be prima facie evidence
that the bidder has made such an examination.
' Interpretation of Drawings and Documents
If any bidder should find discrepancies in, or omission
' from, the drawings, specifications or other proposed contract
documents, or if he should be in doubt as to the true meaning of
' any part thereof, he shall at once make a written request to the
Engineer for correction, clarification or interpretation of the
' point or points in question. The person submitting such a re-
quest shall be responsible for its prompt delivery.
'
In the
event
that the Engineer receives such a request and
it should be
found
that certain essential information is not
'
clearly and
fully
set forth, or if the Engineer discovers errors,

romissions, or points requiring clarification in the drawings or
' documents, a written addendum will be mailed to each person to
whom a set of contract documents has been delivered. The City
' will not be responsible for any instructions, explanations or
interpretations of the documents presented to bidders in any
manner other than written addendum.

Addenda or Bulletins
rThe effect of all addenda to the contract documents shall
be considered in the bid and said addenda shall be made a part
of the contract documents and shall be returned with them. Be-
fore submitting his bid, each bidder shall inform himself as to
r whether or not any such addenda have been issued, and failure to
cover in his bid any such addenda issued may render his bid invalid
and result in its rejection.
Proposals
Bids to receive consideration shall be in accordance with

bid prices shall be stated both in words and in figures; and

' B. All prices and notations must be in ink or typewritten. No
' erasures will be permitted. Mistakes may be crossed out and
corrections typed or written in ink adjacent thereto and must
' be initialed in ink by the person or persons signing the bid.
C. Bids shall not contain any recapitulation of the work to be
done. Alternate proposals will not be considered except as
required hereinabove. No oral, telegraphic or telephonic
proposals or modifications will be considered.
D. The City may require any bidder to furnish a statement of his
' experience, financial responsibility, technical ability, equip-
ment and references properly and fully filled out.
E. Each bidder shall list his proposed sub -contractors on the
form accompanying the proposal in accordance with the pro-
, - visions of the specifications.
F. Each bidder must accompany his bid with either a cashier's
' check upon some responsible bank, or a properly certified
check upon such bank, or an approved corporate surety bond
' payable to the City for such a sum of not less than ten (10)
percent of the aggregate sum of the bid, which check or bond
and the monies represented thereby shall be held by the City
' as a guarantee that the bidder, if awarded the contract, will
in good faith enter into such contract and furnish the required
bonds.
The bidder agrees that, in case of his refusal or failure to
' execute said contract and give bonds within the time required
by these documents, such check or bond, and the money re-
presented thereby, shall remain the property of the City and,
if the bidder shall fail to execute said contract, said
' surety will pay to the City the damages which the City may
suffer by reason of such failure, not exceeding the sum of
' ten (10) percent of the amount of the bid. A bid received_
and not accompanied by such cashier's check, certified check
' or approved bond shall be rejected.

' G. Bids shall be delivered to the City at the location stipulated,
' on or before the day and hour set for the opening of bids, as
hereinbefore specified in the "Notice Inviting Bids". Bids
shall be enclosed in a sealed envelope bearing the title of
the work, the name of the bidder, bid opening date and time
of bid opening.

Licensing of Contractor
' All persons, firms, partnerships or corporations shall be
licensed in accordance with the Business and Professions Code
' of the State of California and the applicable ordinances of the
City and County before doing any work of any kind.
' Withdrawl of Bids
' Any bidder may withdraw his bid in person or by written
request at any time prior to the scheduled closing time for re-
ceipt of bids.
Opening of Bid Proposals
' The City will, in open session, publicly open, examine and
declare the bids at the time set forth in the "Notice Inviting
' Bids". Bidders or their authorized representatives are invited
to be present.
Award of Contract or Rejection of Bids
' No bidder may withdraw his bid for a period of forty-five
(45) days after the date set for the opening of bids. The con-
tract for the work will either be awarded or the bids rejected
within the forty-five (45) days from the date set for the opening
of bids.
The contract for the work will be awarded to the lowest
' responsible bidder complying with these instructions and with
the "Notice Inviting Bids". The City, however, reserves the
right to reject any or all bids and to waive any nonconformity
' in the bids received.

' The bidder to whom the award is made shall execute a written
' contract with the City and furnish the stipulated bonds, insurance
and bid breakdown within fifteen (15) days after the notice of
' award of contract. The contract shall be made in the form adopted
by the City. The release of the successful bidder's surety deposit,
as previously stipulated (page 5), shall be made upon the City's
' acceptance of the Labor and Materials Bond and the Faithful Per-
formance Bond.
' If the bidder to whom the award is made fails to enter the
contract as herein provided, the award may be annulled and an
' award may be made to the next lowest responsible bidder; and
such bidder shall fulfill every stipulation embraced herein, as
' if he were the party to whom the first award was made. A corpora-
tion to which an award is made shall furnish evidence of its cor-
porate existence and evidence that the officer signing the con-
tract and bonds for the corporation is duly authorized to do so.
Bonds
' The successful bidder, simultaneously with the execution of
the Agreement, will be required to furnish a Labor and Material
Bond in a sum not less than one hundred percent (1008) of the
' total amount payable by the terms of the contract and a Faithful
Performance Bond in a sum not less than one hundred percent
' (1008) of the amount of the contract. Said bonds shall be
secured from a surety company satisfactory to the City. Surety
' companies, to be acceptable to the City, must be authorized to
do business in the State of California and be on the accredited
' list of the United States Treasury.
' Time of Performance
The work shall be commenced within fifteen (15) calendar days
from the date of execution of the contract and shall be diligently
' prosecuted until completion. A time limit of sixty

SPECIAL PROVISIONS
1 1. Work to be Done
' The City of San Juan Capistrano is proposing the rehabilitation
of the Calle Miramar Right -of -Way at Avenida Pescador.
Work under this contract consists of clearing and grubbing,
' grading, installation of irrigation systems, soil preparation,
landscape planting, and all other appurtenant work as shown
on the plans and included in the specifications.
' 2. Standard Specifications
The contractor shall perform his work in accordance with the
Standard Specifications for Public Works Construction, 1982
Edition, hereinafter referred to as the Standard Specifications.
The contractor shall maintain a copy of this book on the job
' site at all times. The provisions of the Standard Specifications
shall be modified as indicated below:
' Change 1: "Section 2-4 - Contract Bonds"
The "Payment Bond" (Material and Labor Bond) shall be in
the amount of 100 percent of contract price. The "Faith-
ful Performance Bond" shall be held as assurance of
guaranteed performance for a period of one year after
acceptance of the improvements by the City Council.
1 Change 2: "Liability Insurance"
' The amounts and provisions of insurance are modified to
be:
' Bodily Injury $ 500,000 each person

Bodily Injury 1,000,000 aggregate products
' Property Damage $ 500,000 each accident

' The contractor shall likewise obtain public liability and
property damage insurance to cover vehicles used or main-
tained by him, whether on or off the premises, with
' liability limits of not less than $500,000, for any one
person, and $500,000 for any one accident, and property
damage of $500,000. The insurance amounts set fort;:
herein are the minimum amounts required by the City. Other
agencies with which the contractor may be involved in the
accomplishment of the work may require greater amounts.

The City will not recognize any claim for additional
compensation because of the requirement for greater
amounts of insurance, as an element to be considered by
the contractor in determining his bid.
Change 3: "Section 8 - Facilities for Agency Personnel"
Delete this section.
3. Terms Defined
Whenever in the said Standard Specifications the following
terms are used, it is hereby provided that the following City
department or persons shall be intended:
AGENCY shall mean City of San Juan Capistrano
wherever appropriate.
BOARD shall mean the City Council of the
City of San Juan Capistrano.
ENGINEER shall mean City Engineer or other person(s)
designated by same.
LANDSCAPE ARCHITECT shall mean City Engineer or other
person(s) designated by same.
4. Special Provisions of Items of Work, Materials and Methods
of Construction

SCOPE
Furnish all materials, equipment, services, supervision,
transportation and labor necessary to perform all irrigation
work complete including the following:

1. Drawings and Specifications
1.1 The intent of the Drawings and Specifications is to
indicate and specify a complete and efficient
sprinkler irrigation system ready for use in

1.2 Plot dimensions are approximate. Before proceeding

with any work the Contractor shall carefully check
and verify all dimensions and shall report any
variations to the Owner.

1.3 Due to the scale of the Drawings, it is not possible
to indicate all offsets, fittings, etc. which may be

required. The Contractor shall carefully investigate
the structural and finished conditions affecting
all his work, and plan his work accordingly, furnishing
such fittings, etc. as may be required to meet such
conditions. Drawings are generally diagrammatic and
indicative of the work to be installed. The work
shall be installed in the most direct and workmanlike
manner, so that conflicts between sprinkler systems,
planting and architectural features will be avoided.
2. Service Manuals
Contractor shall furnish two (2) service manuals to the
Owner. Manuals may be loose leaf and shall contain complete
exploded drawings of all equipment installed showing
components and catalog numbers together with the manufacturer's
name and address. Additional sheets shall cover operation
'
instructions simple enough to be understood without specialized
knowledge.
3. Loose Equipment
Loose sprinkling equipment, operating keys and spare parts
will be furnished by the Contractor in quantities as shown
'
on plans or in specifications.
'
4. Guarantee
4.1 The entire sprinkler system shall be unconditionally
guaranteed by the Contractor as to material and
'
workmanship, including settling of backfilled areas
below grade for a period of one (1) year following
the date of final acceptance of the work.
'
4.2 If, within one year from the date of completion,
settlement occurs, and adjustments in pipes, valves
'
and sprinkler heads or paving is necessary to bring
the system or paving to the proper level of the
permanent grades, the Contractor, as part of the work
under his Contract, shall make all adjustments without
extra cost to the Owner, including the restoration
'
of all damaged planting, paving or other improvements
of any kind.

4.3 Should any operational difficulties in connection
with the sprinkler system develop within the
specified guarantee period which in the opinion of
the Owner may be due to inferior material and/or
workmanship, said difficulties shall be immediately
corrected by the Contractor to the satisfaction of
the Owner at no additional cost to the Owner, including
any and all other damage caused by such defects.
5. Materials
5.1 Pipe and Fittings
5.1.1 Brass
Brass pipe shall be IPS standard weight 85%
Red Brass. Fittings shall be with standard
125 -pound cast bronze threaded fittings.
5.1.2 PVC Conduit
Pipe that is used for control wires shall be
PVC conduit Schedule A. Type 2110. All wires
under paving shall be installed in PVC conduit.
5.1.3 PVC High Impact Pipe - Type 1220 (PVC Schedule
40 and 80)
5.1.3.1 Type II Grade I High Impact Pipe

plastic male adaptors.
6.3.3 The joints shall be allowed to set at least
twenty-four (24) hours before pressure is applied
to the system on PVC pipe

6.3.5 Sprinkler lines shall be tested in place before
backfilling for a period of not less than one (1)
hour, and shall show no leakage or loss of
pressure. During the test period, minimum test
pressure at the highest point of the section being
tested, shall be 100 pounds per square inch.
6.3.6 At the conclusion of the pressure test, the
head shall be installed and tested for operation
in accordance with design requirements under
normal operating pressure. Contractor shall
verify head pressures with pitot tube and adjust
valve to correspond with design pressure.
6.4 Installation of Rina-Tite PVC Pi
6.4.1 Except as may be noted in other parts of the
Specifications, or on the drawings, installation
of Ring -rite pipe and connecting fittings shall
be outlined in manual as furnished by pipe
manufacturer, or as set forth by the Johns -Manville
Company Manual #772-62A. This shall include,
but not be limited to, the installation of the pipe
at the proper depth and the correct location of
concrete thrust blocks of adequate sizes. Contractor
shall make available the services of the manu-
facturer's representative at the start of the
installation and may be required from time to
time during construction.
6.4.2 Each line shall be tested at a pressure 50 psi
greater than the manufacturer's recommended
working pressure for a period of two (2) hours
with the couplings and connections exposed
and with the center of the pipe section
sufficiently to hold pipe in place.
6.5 Sprinklers
6.5.1 All nozzles on stationary pop-up sprinklers
shall be tightened after installation. All
sprinklers having an adjustment stem shall be
adjusted on a lateral line for the proper radius,
diameter and/or gallonage.

interpreting the drawings and these specifications. The work

1. Approvals
1.1 All sprinkler work shall be inspected and approved prior
to the start of any work in this section.
1.2 Prior to excavation for planting or placing of stakes,
locate all utilities, electric cables, conduits,
sprinkler lines, heads, valves and valve control wires,
and all utility lines so that proper precautions may be
taken not to damage such improvements. In the event
of a conflict between such lines and plant locations,
promptly notify the Landscape Architect who shall
arrange for relocation for one or the other. Failure
to follow this procedure places upon the Contractor the
responsibility for, at his own expense, making any and all
repairs for damages resulting from work hereunder.

2. Quantities and Types
Plant materials shall be furnished in the quantities and/or
' spacing as shown or noted for each location, and shall be of
the species, kinds, sizes, etc., as symbolized and/or
described in the "Plant Material Legend", as indicated on the

Certification
Prior to job acceptance written certifications shall be
submitted to the Landscape Architect, for the
following:
5.1 Quantitiy and Quality of Commercial Fertilizer and
Organic Fertilizer.
5.2 Quantity and Quality of all Soil Amendments called for
by Plans and Specifications.
Materials
Plant Materials indicated on the drawings and herein
specificed, shall conform to the following:
6.1 Nomenclature: Plant names indicated or listed in the
"List of Plant Materials" on the drawings, conform to
"Standard Plant Materials" on the drawings, conform
to "Standard Plant Names" established by the American
Joint Committee on Horticulture. Except for names covered
therein, the established custom of the nursery is
followed.
6.2 Condition: Plants shall be symmetrical, typical for
variety and species, healthy, vigorous, free from plant
disease, insect pests, or their eggs, and shall have
healthy, normal root systems, well filling their
containers, but not to the point of being root bound.
Plants shall not be pruned prior to delivery, except as
authorized by the Landscape Architect, or his representa-
tive. In no case shall trees be topped before delivery.
6.3 Dimensions: The height and spread of all plant material
shall be measured with branches in their normal position,
and shall be as indicated on the drawings. The caliper
of all trees shall be measured 4'0" above the surface
of the ground. Where caliper or other dimensions of
any plant materials are omitted from the "Plant
Legend", it shall be understood that these plant
materials shall be normal stock for type listed.
6.4 Inspection: All plant materials must have been previously
inspected at the nursery by the Orange County Horti-
cultural Department, and shall be subject to the
inspection and approval of the Landscape Architect
before planting.
6.5 Plant List: Is indicated on drawings.
6.6 Sizes of Plants: Shall be as stated on the Plan.
Container stock (1 -gallon , 5 -gallon, and 15 -gallon),
shall have been grown in containers for at least one(1)
year, but not over two years.

6.7 Substitutions: Substitutions for the indicated plant
materials will be permitted provided the substitute
materials are approved in advance by the Landscape
Architect and the substitutions are made at no
additional cost to the owner. Except for the
variations so authorized, all substitute plant
materials shall conform to the requirements of these
specifications. If the accepted substitute materials
are of less value than those indicated or specified
the Contract price will be adjusted in accordance with
the provisions of the Contract.
6.8 Plants Not Approved: Plants not approved are to be
removed from site immediately and replaced with
suitable plants. The Landscape Architect and/or
Owner reserves the right to reject entire lots of
plants represented by defective samples.
7. Fertilizers and Soil Conditioners
' Samples of all soil amendments, sod and plants shall be
submitted for inspection and stored on the site until
furnishing of materials is completed. Delivery may begin
upon approval of samples or as directed by the Landscape
Architect and the Owner.
7.1
Organic fertilizer shall be processed sewage sludge
with a minimum content of 18 Nitrogen and 2% Phosphoric
Acid similar to "Nitro -humus". Method of processing
shall not destroy normal bacterial content.
7.2
Nitrogen stabilized sawdust shall be bulk, with the
following nitrogen content based on dry weight:
'
0.5% for Redwood Sawdust
0.7% for Fir Sawdust
'
1.0% for Bark or Pine Bark or Mixture
7.2.1 Salinity: the saturation extract conductivity
shall not exceed 3.5 millimhos/cm at 250 C.
'
7.3
Commercial fertilizer shall be delivered in sacks with
manufacturer's label showing weight and analysis attached
to each sack.
8. Grading and Soil Preparation
'
8.1
Contractor is to finish grade to within 1/10th of 1
foot or 1" below paving where paving exists.
'
8.2
Moisture Content: The soil shall not be worked when
the moisture content is so great that excessive compaction
will occur, not when it is so dry that dust will form
in the air or that clods will not break readily. Water
'
shall be applied if necessary to provide ideal moisture
content for tilling and for planting herein specified.

8.3 Preliminary Grading: Preliminary Grading shall be done
in such a manner as to anticipate the finish grading.
Excess soil shall be removed or redistributed before
application of fertilizer and mulch. Where soil is
to be replaced by plants and mulch, allowance shall be
made so that when finish grading has begun, there shall
be no deficiency in the specified depth of mulched
planting beds.
8.4 Weeding: Before and during preliminary and finish
grading, all weeds and grasses shall be dug out by
the roots and disposed of off the site (except those
weeds and grasses not of the perennial type, less than
2'Y" high and not bearing seeds, which may be turned
under). Oats more than 2'h" high and not bearing seeds
may be turned under. Perennial weeds and grasses to
be removed include, but are not limited to, the
following:

8.5 All Planting Areas shall be scarfied to a depth of
12 inches below grade with the spacing of the ripper
teeth no greater than 12 inches on center prior to placing
conditioners and fertilizers. All rock and debris
more than 2" in diameter shall be removed from the site.
8.6 Trenches: If sprinkler system is installed after
grading and fertilizing is completed, the upper portion
of the backfill shall be retilled and fertilized to
the depth specified for the area required to conform
to the specifications.
Soil Conditioners
9.1 *In All Planting Areas the following application shall
be made per 1,000 square feet of area and shall be
thoroughly cultivated in two directions into the
top 6" of soil, and the area watered down:
6 cu. yards nit -stabilized sawdust
100 lbs. agricultural gypsum

9.4 The prepared soil shall be uniformly blended in an
area adjacent to the planting work and shall be
accurately proportioned using a suitable measuring
container. Unused excavated soil shall be removed
from site. Protect the mix from water until it
has been placed in backfill around plants.
Finish Grading
When preliminary grading,including weeding and fertilizing,
has been completed and the soil has dried sufficiently to be
readily worked, all lawn and planting areas shall be
graded to the elevations indicated on the drawings. Grades
not otherwise indicated shall be uniform levels or slopes
between points where elevations are given. Minor adjustments
of finish grades shall be made at the direction of the
Landscape Architect, if required.
Finish grade shall be a smooth, even, and uniform plane
without abrupt change of surface. Soil areas adjacent
to buildings to allow a natural run-off of water, and
surface drainage shall be directed as indicated on the
drawings by remodeling surfaces to facilitate the natural
"run-off" of water. Low spots and pockets shall be one
(1) inch below grade of adjacent pavement of any kind.
Grading shall be done when soil is at optimum moisture
content for working.
Method of Planting and Work Procedure
11.1 No planting shall be done until all operations in
in conjunction with the installation of the sprinkler
system have been completed, final grades have been
established, the planting areas have been properly
graded and prepared as herein specified, and the work
approved by the Landscape Architect.

The relative position of all trees and plants is
subject to approval by the Landscape Architect and
Owner, and they shall, if necessary, be relocated as
directed as part of the Contract.
11.3
All plants shall be removed from their container and

set so that, when settled, they bear the same relation

grade before being transplanted. Each plant shall
be planted in the center of the pit and backfilled

unless otherwise specified, with the prepared soil.

filled with "Prepared Soil" to the bottom of the ball.
When the plant has been properly set, the pit shall
be filled to the required grade with "Prepared Soil"

vines shall be removed from stakes, untied, and
securely fastened in an approved manner to the wall,
fence or other surface next to which they are planted.

Prepare a depressed water basin as wide as plant balls
at each plant. Water thoroughly, backfilling any voids
with additional prepared planting mix.
12.3
Ground Covers
12.3.1 Pits for flat sized plants to be at least

13. Care of Plants Before and During Planting
Plants shall not be allowed to dry out before or while
'
being planted. Keep exposed roots moist by means of wet
sawdust, peat moss, or burlap at all time during planting
operations. Do not expose roots to the air except while
being placed in the ground. Wilted plants, whether in
'
place or not, will not be accepted and shall be replaced
at the Contractor's expense.
'
14. Sodded Lawn
14.1 Cultivate all lawn areas to a depth of 8". Rocks and
'
debris larger than one (1) inch in diameter which are
brought to the surface by cultivation shall be removed
from the site. If cultivation does not break lumps,
a spike tooth harrow shall be pulled behind a
'
mechanical seeder or tractor.
'
14.2 Areas to be planted in lawn shall be finished smooth
to present a neat and uniform grade prior to
installation of sod. The lawn bed shall be
inspected by the Landscape Architect to determine
'
suitability for planting prior to sodding. The
Contractor shall obtain such approval before sodding.
14.3 All sodden areas shall be thoroughly watered. Lawns
'
are to be kept continuously moist by watering as
often as required.
'
14.4 Re -sodding: Any lawn areas that do not show a prompt
catch of grass shall be re -sodded at ten day intervals
until an acceptable stand of grass is assured.

Watering
15.1 Immediately after planting, water shall be applied to
each tree by means of a hose. The water shall be
applied in a moderate stream in the planting holes until
'
the material about the roots is completely saturated
from the bottom of the hole to the top the
of ground.
15.2 Plants which cannot be watered efficiently with the
'
existing water system shall be watered by means of a
hose.

Certificates

In addition to any other certificates specified, the
Contractor shall furnish a certificate with each delivery
of bulk material, stating the source, quantity, any type
pf material and that the material conforms to the
specification requirements. For bulk delivered organic
fertilizer, the certificate shall also state the volume,
net weight, percent of Nitrogen, percent of Phosphoric
Acid. For each fertilizer and soil conditioner, in
containers, a similar certificate or invoice shall be
furnished stating total quantities by weight and volume
for each material. These certificates shall be submitted
to the Landscape Architect and Owner prior to the
start of the maintenance period.
Protection
The Contractor shall carefully and continuously protect all
areas included in the contract, including plant materials,
fences, supports. etc., until final acceptance of the work
by the Landscape Architect and Owner.
Maintenance
18.1 The Contractor shall maintain a sufficient number of
men and adequate equipment to perform the work herein
specified. Plant maintenance work shall consist of
applying water, weeding, caring for plants, including
groundcovers, shrubs and trees, edging,aerating, and
mowing of lawns, fertilizing and control of pests
and diseases.
18.2 Damage to any planted area shall be repaired immediately.
Depressions caused by vehicles or foot traffic shall
be filled with topsoil, leveled and replanted.
Exterminate gophers and moles, and repair damage.
18.3 The entire project shall be maintained for a period
of 120 days, commencing from the time all items of work
have been completed to the satisfaction of the
Landscape Architect and the Owner.
18.4 The project shall be so cared for that a neat and clean
condition will be presented at all times to the
satisfaction of the Owner and the Landscape Architect.

18.4.1 Lawns
Watering: Water every day once per day for
two weeks thereafter and then gradually reduce
'
frequency of watering to three times per
week. The Contractor shall continue to
maintain the lawn until final acceptance by
'
the Landscape Architect and the Owner.
Fertilizing: Apply 16-6-8 at the rate of 5
pounds per 1,000 square feet three weeks after
'
installation and water immediately thereafter.
Diseases and Pest Control: Two weeks after
installation of lawn, apply a granular
mercurial fungicide of 1.8% mercurous
chloride as per manufacturer's recommendation.
'
Mowing: The lawn shall be mowed at a height
of 1Y" with a rotary mower, equipped with rollers,
before it reaches a 2" in height. Collect
'
grass clippings during mowing operations and
remove from the site.
'
After each cutting, the edge of the grass
shall be trimmed to a neat and uniform line.
The lawn edges shall be maintained in a neat
'
condition at all times.
18.4.2 Groundcovers and Shrub Areas
'
Watering: New plantings shall be watered once
per day for two (2) weeks after installation.
'
Reduce watering to every other day for the next
two (2) weeks. Water thereafter three (3)
times per week until final acceptance.
'
Fertilization: Fertilize three (3) weeks after
planting with 5 pound 16-6-8 per 1,000 square
feet: fertilize thereafter every 30 days.
'
Disease and Pest Control: For control of slugs
and snails, apply pelletized tricalcium arsinate
t
5% by weight as per manufacturer's recommendations
two weeks after installation.
For control of cutworms and other soil insects,
' apply Metro brand soildrin as per manufacturer's
recommendations two weeks after installation.
This product contains Dieldrin, Lindane, and
' Phosphorothioate.
Exterminate gophers and moles and repair damage.

' Pruning: All shrubs and trees shall be pinch
pruned as necessary to encourage new growth and
to eliminate rank sucker growth. Old flowers,
' and dead foliage and limbs shall be removed.
No major pruning shall be done without the
approval of the Landscape Architect.
Weeding: All planting areas including lawn,
groundcover, and shrub areas, shall be kept
weed -free at all times. Weeds shall be dug
' out by the roots and disposed of off the site.
Upon completion of the 60 day maintenance period,
' the Contractor shall fertilize per 26.4.1 and
26.4.2 of this section.

19. Guarantee and Replacements
'
19.1 All shrubs and groundcover shall be guaranteed by
the Contractor as to growth and health for a period
of ninety (90) days after completion of the specified
'
maintenance period, and/or final acceptance by the
Landscape Architect. All trees up to 20" box size
'
shall be guaranteed by the Contractor to live and grow
in an acceptable upright position for a period of
six (6) months after completion of the specified
maintenance period, and/or final acceptance by the
'
Landscape Architect. Trees, in 20" boxes or larger,
and all field grown specimens shall be guaranteed by
the Contractor to live and grow in an acceptable
upright position for a period of one year after
completion of the specified maintenance period,
and/or final acceptance by the Landscape Architect.
'
19.2 All plants that show signs of failing growth at any
time during the life of the Contract, including the
maintenance period or those plants so injured or
'
damaged as to render them unduitable for the purpose
intended, shall be immediately replaced in kind and
size at the expense of the Contractor.
'
19.3 The Contractor within five (5) days of notification
by the Landscape Architect, shall remove and replace all
guaranteed plant materials which for any reason fail
to meet the requirements of the guarantee. Replacement
shall be made with plant materials as indicated or
specified for the original planting, and all such
'
replacement materials shall be guaranteed as specified
for the original planting, and all such replacement
materials shall be guaranteed as specified for the
original guaranteed materials.

20. Clean Up
Upon completion of the work in this section, the Contractor
shall remove all rubbish, trash and debris resulting from
'
the operations; remove disused equipment and implements
of service; leave entire area involved in a neat and
acceptable condition such as to meet the approval of the
'
Landscape Architect.
21. Maintenance
21.1 Maintenance of the project shall be for a period
of 120 days.
21.2 Maintenance shall include all watering, fertilization,
mowing, weeding, cultivating, spraying and pruning
necessary to keep the plant materials in a healthly
'
growing condition and to keep the planted areas
neat and attractive throughout the maintenance period.
'
21.3 Protect all planted areas against damage, including
erosion and trespassing, by providing and maintaining
proper safeguards.
'
21.4 During the maintenance period, all planted areas
shall be kept well watered and weed free at all times.
21.5 From the time any planting is done, until the end of
the maintenance period, the Contractor shall maintain
a sufficient number of men and adequate equipment to
'
peform the work herein specified.
21.6 The Contractor will be relieved from maintenance work
when the final plant establishment and maintenance work
has been completed to the satisfaction of the Owner.
21.7 Damage to planting areas shall be replaced immediately
'
at the Contractor's expense.
21.8 Depressions caused by vehicles, bicycles, or foot
'
traffic, shall be filled and leveled. Replant
damaged areas.
21.9 Exterminate gophers and moles, ground squirrels, and
repair damage as above.
' 21.10 All paved areas will be washed and maintained in a
neat and clean condition at all times, as directed
by the Owner.
' 21.11 Pinch -prune all shrubs and trees to encourage new
growth and to eliminate rank sucker growth. Remove
all old flowers and dead foliage and limbs. Do no
' major pruning without the approval of the Owner.
Remove damaged branches on trees back to point of
growth. Treat cuts over 2" in diameter with an
' approved tree wound dressing.

21.12 During the maintenance period, should the appearance
of any plant indicate weakness and probability of dying,
immediately replace that plant with a new and healthy
plant of the same type and size without additional
cost to the Owner.
21.13 At the end of the maintenance period, all plant
material shall be in a healthy growing condition.
21.14 Contractor shall continue the maintenance period past
the specified date at no additional cost to the Owner
until all deficiencies have been corrected.
Miscellaneous
A. Insurance and Overhead Costs
The contractor shall receive no direct compensation for insurance
and overhead (move -in costs for example) costs. Accordingly,
these costs should be prorated to the appropriate bid items.
B. Protection of Existinq Utilities
The engineer has endeavored to show all existing utilities.
The contractor must, however, take all due precautionary measures
to protect all of the existing utilities.
C. Protection of Private Property
The contractor must remain within the construction zone to the
best of his ability. The contractor must protect all existing
private property.
