IT IS HEREBY AGREED BETWEEN THE PARTIES AS FOLLOWS: FIRST. CONTRACT DOCUMENTS. The contract documents shall be considered to include the Notice Inviting Bids, the Instruction to Bidders, the Proposal, the Bid Bond, the Non-Collusion Affi- davit, the Designation of Sub-Contractors, the Contract which is prepared for execution by the City and the Contractor, plans, specifications and special provisions, contract bonds, resolu- tions adopted by the City Council pertaining to the work, in- surance policies and certificates, and any supplemental written agreements amending or extending the scope of the work originally contemplated that may be required to complete the work in a substantial and acceptable manner. -SECOND. THE WORK. CONTRACTOR agrees to furnish all tools, labor, material, equipment, transportation, and supplies neces- sary to perform and complete in good and workmanlike manner the construction of INSTALLATION O^ TRAFIC SICNALS DEL OBISPO STREET AND CALLE ASPERO in strict confor- mity with the Plans, Specifications and all other contract docu- ments, which documents are on file at the Office of the City Clerk, City Hall, 32400 Paseo Adelanto., San Juan Capistrano, California. THIRD. PAYMENT. City agrees to pay, and CONTRACTOR agrees to accept, the lump sum adjusted for variations of quantities, at the prices designated in bid proposal at the time and in the manner set forth in the Specifications. -1G- . FOURTH. COMMENCEMENT AND COMPLETION OF THE WORK. CONTRACTOR agrees to begin and complete the work within the time specified in the Notice Inviting Bids . It is agreed that it would be im- practicable and extremely difficult to fix the actual amount of damages , and loss sustained by City, should CONTRACTOR fail to complete the work in the specified time ; therefore, CONTRACTOR shall pay City, as liquidated damages, not in the nature of a penalty, one hundred dollars ($100) a day for each day delayed ; provided that extensions of time with waiver of liquidated damages, may be granted as provided in the Specifications . FIFTH. PERFORMANCE BOND AND LABOR AND MATERIAL BOND. Contractor agrees to furnish bonds guaranteeing the performance of this con- tract and guaranteeing payment of all labor and material used under this contract, as required by the laws of the State of Cali- fornia, on forms approved -by City. The Performance Bond shall be for an amount of one hundred percent (100%) of the amount of this contract and shall be conditioned on full and complete per- formance of the contract, guaranteeing the work against faulty workmanship and materials for a period of one (1) year after com- pletion and acceptance. The Labor and Material Bond shall be for an amount of one hundred percent (100°x) of the amount of this contract and shall be conditioned upon full payment of all Labor and Material entering into or incidental to the work covered by this contract. CONTRACTOR agrees to furnish the bonds on the forms found within the Specifications . SIXTH. GENERAL PREVAILING RATE OF PER DIEM WAGES. Pursuant to the Labor Code of the State of California, copies of the pre- vailing rate of per diem wages , as determined by the Director of the State Department of Industrial Relations, are on file in the office of the City Clerk, 32400 Paseo Adelanto, San Juan Capistrano, California, and are hereby incorporated and made a -17- part hereof . CONTRACTOR agrees that he, or any SUB-CONTRACTOR under him, shall pay not less than the foregoing specified pre- vailing rates of wages to all workmen employed in the execution of the contract . SEVENTH, INSURANCE. CONTRACTOR agrees to carry Public Liability, Property Damage, and Workmen's Compensation Insurance in amounts as required by the Specifications. EIGHTH. COMPLIANCE WITH OTHER PROVISIONS OF LAW RELATIVE TO PUBLIC CONTRACTS. City is subject to the provisions of the Government Code and the Labor Code of the State of California. It is stipulated and agreed that all provisions of law applicable to public contracts are a part of this contract to the same ex- tent as though set forth herein and shall be complied with by CONTRACTOR. These include, but are not limited to, the stipula- tion that eight (8) hours labor constitute a legal day's work and CONTRACTOR shall, as a penalty to City, forfeit twenty-five dollars ($25) for each workman employed in the execution of the Contract by CONTRACTOR, or by any SUB-CONTRACTOR, for each calen- dar day during which such workman- is required or permitted to work more than eight (8) hours in violation of the provisions of Article Three, Chapter One, Part Seven, Division 2, of the California Labor Code, except as permitted by law. The following is a breakdown of the final costs for the project: Total Construction Cost: $33, 498 . 00 Less 10% Retention: $ 3, 349 . 80 Total Due : $30 , 148 . 20 Previous Payment: $27 , 133 . 38 Balance Due: $ 3, 014 . 82 The work has been accepted as complete by the City Engineer. FINANCIAL CONSIDERATIONS The final costs are within the budgeted amount for this capital project. ALTERNATE ACTIONS 1. Accept the project as complete. 2 . Do not accept the project. 3. Request further information from staff. RECOMMENDATION By motion, determine that the work, as accepted by the City Engineer, on the Del Obispo and Calle Aspero Traffic Signal has been completed; and direct that a Notice of Completion be filed with the Orange County Recorder within ten (10) days from the date of acceptance. Due to a temporary shortage of concrete , the con- tractor will not be able to complete the project for at least 35 days , therefore, he is requesting a time extension for the completion date. FINANCIAL CONSIDERATIONS The City can require the contractor to pay $100 per day to the City in liquidated damages. ALTERNATE ACTIONS 1. Approve the request for time extension. 2 . Do not approve the request for time extension. 3 . Request further information from staff. It is staff ' s feeling that they are a reputable contractor and will perform the work diligently. This intersection is a problem for traffic entering Del Obispo from Calle Aspero and the instal- lation of a traffic signal will alleviate this problem. Plans and specifications may be reviewed at the City Engineer' s office. FINANCIAL CONSIDERATIONS The estimated construction cost for this traffic signal is $40 , 000 . This project has been budgeted for in the Gas Tax Fund. ALTERNATE ACTIONS 1. Authorize staff to advertise for bids for the construction of a traffic signal at Del Obispo and Calle Aspero. 2. Do not authorize staff to advertise for bids. 3. Request further information from staff. He shall satisfy himself as to the character, quality and quantities of the work to be performed, the materials to be furnished and the requirements of the Contract Documents . The plans for the work show conditions as they are believed to exist, but it is not to be inferred that all the conditions as shown thereon are actually existent, nor shall the City or any of its officers or agents be liable for any loss sustained by the Contractor' as a result of any variance between conditions shown on the plans and actual conditions revealed during examination or progress of the work. The submission of a proposal shall be prima facie evidence that the bidder has made such an .examination. Interpretation of Drawings and Documents If any bidder should find discrepancies in, or omission from, the drawings, specifications or other proposed contract documents, or if he should be in doubt as to the true meaning of any part thereof, he shall at once make a written request to the Engineer for correction, clarification or interpretation of the point or points in question. The person submitting such a re- quest shall be responsible for its prompt delivery. In the event that the Engineer receives such a request and it should be found that certain essential information is not clearly and fully set forth, or if the Engineer discovers errors, -10- 0 omissions, or points requiring clarification in the drawings or documents, a written addendum will be mailed to each person to whom a set of contract documents has been delivered. The City will not be responsible for any instructions, explanations or interpretations of the documents presented to bidders in any manner other than written addendum. Addenda or Bulletins The effect of all addenda to the contract documents shall be considered in the bid and said addenda shall be made a part of the contract documents and shall be returned with them. Be- fore submitting his bid, each bidder shall inform himself as to whether or not any such addenda have been issued, and failure to cover in his bid any such addenda issued may render his bid invalid and result in its rejection. Disqualification of Bidders No person, firm or corporation shall be allowed to make , file or be interested in more than one bid for the same work unless alternate bids are called for. A person, firm or cor- poration who has submitted a sub-proposal to a bidder, or who has quoted prices on materials to a bidder, is not hereby disqualified from submitting a bid in his own behalf. Proposals Bids to receive consideration shall be in accordance with the following instructions; A. Bids shall be made only upon the forms provided within these specifications ; all bid items shall be properly filled out; bid prices shall be stated both in words and in figures; and the signatures of all persons signing shall be in longhand . Where there is a conflict in the words and the figures, the words shall govern. -11- B. All prices and notations must be in ink or typewritten. No erasures will be permitted . Mistakes may be crossed out and corrections typed or written in ink adjacent thereto and must be initialed in' ink by the person or persons signing the bid. C. Bids shall not contain any recapitulation of the work to be done. Alternate proposals will not be considered except as required hereinabove. No oral, telegraphic or telephonic proposals or modifications will be considered . D. The City may require any bidder to furnish a statement of his experience, financial responsiblit.y, technical ability, equip- ment and references properly and fully filled out. E. Each bidder shall list his proposed sub-contractors on the form accompanying the proposal in accordance with the pro- visions of the specifications . F. Each bidder must accompany his bid with either a cashier' s check upon some responsible bank, or a properly certified check upon such bank, or an approved corporate surety• bond payable to the City for such a sum of not less than ten (10) percent of the aggregate sum of the bid, which check or bond and the monies represented thereby shall be held by the City as a guarantee that the bidder, if awarded the contract, will in good faith enter into such contract and furnish the required bonds . The bidder agrees that, in case of his refusal or failure to execute said contract and give bonds within the time required by these documents, such check or bond, and the money re- presented thereby, shall remain the property of the City and, if the bidder shall fail to execute said contract, said surety will pay to the City the damages which the City may suffer by reason of such failure, not exceeding the sum of ten (10) percent of the amount of the bid . A bid received and not accompanied by such cashier's check, certified check or approved bond shall be rejected. -12- G. Bids shall be delivered to the City at the location stipulated , on or before the day and hour set for the opening of bids, as hereinbefore specified in the "Notice Inviting Bids . " Bids shall be enclosed in a sealed envelope bearing the title of the work and the name of the bidder. Licensing of Contractor All persons, firms, partnerships or corporations shall be licensed in accordance with the Business and Professions Code of the State of California and the applicable ordinances of the City and County before doing any work of any kind . Withdrawl of Bids Any bidder may withdraw his bid in person or by written request at any time prior to the scheduled closing time for re- ceipt of bids. Opening of Bid Proposals The City will, in open session, publicly open, examine, and declare the bids at the time set forth in the "Notice Inviting Bids . " Bidders or their authorized representatives are invited to be present. Award of Contract or Rejection of Bids No bidder may withdraw his bid for a period of forty-five (45) days after the date set for the opening of bids. The con- tract for the work will either be awarded or the bids rejected within the forty-five (45) days from the date set for the opening of bids. The contract for the work will be awarded to the lowest responsible bidder complying with these instructions and with the "Notice Inviting Bids. " The City, however, reserves the right to reject any or all bids and to waive any nonconformity in the bids received . -13- The bidder to whom the award is made shall execute a written contract with the City and furnish the stipulated bonds and bid breakdown within fifteen (15) days after the notice of award of contract . The contract shall be made in the form adopted by the City. The release of the successful bidder 's surety deposit, as previously stipulated , shall be made upon the City's acceptance of the Labor and Materials Bond and the Faithful Performance Bond. If the bidder to whom the award is made fails to enter the contract as herein provided, the award may be annulled and an award may be made to the next lowest responsible bidder; and such bidder shall fulfill every stipulation embraced herein, as if he were the party to whom the first award was made . A corpora- tion to which an award is made shall furnish evidence of its corporate existence and evidence that the officer signing the contract and bonds for the corporation is duly authorized to do SO. Bonds t The successful bidder, simultaneously with the execution of the Agreement, will be required to furnish a Labor and Material Bond in a sum not less than one hundred percent (100%) of the total amount payable by the terms of the contract and a Faithful ,Performance Bond in a sum not less than one hundred percent (100%) of the amount of the contract. Said bonds shall be secured from a surety company satisfactory to the City. Surety companies, to be acceptable to the City, must be authorized to do business in the State of California and be on the accredited list of the United States Treasury. Time of Performance The work shall be commenced within fifteen (15) calendar days from the date of execution of the contract and shall be diligently prosecuted until completion. A time limit of one-hundred-twenty -14- • (120) calendar days from the date of execution of the contract has been set for completion of the work. The Bidder's attention is directed to the specifications as to provisions for extension of time of completion and/or assessment of liquidated damages . Assignment of Contract No assignment by the Contractor of any contract to be entered into hereunder or any part thereof, or of funds to be received thereunder by the Contractor, will be recognized by the awarding authority unless such assignment has had prior approval of the awarding authority and the surety has been given notice of such assignment in writing and has consented thereto in writing. Workmen and Wages Attention is specifically directed to all provisions of the Labor Code of the State of California with regard to workmen and wages . Wages shall not be less than prevailing wage rates determined by the City pursuant to said Code and as listed in the "Notice Inviting Bids . " Building Permits It shall be the Contractor's responsibility to obtain all necessary permits, bonds and insurance, as required, for the completion of the project. Work To Be Done The work to be done under this contract, in general , consists of installing traffic signals, coordination equipment, street light- ing and other items as shown on the plans , and other miscellaneous items and appurtenant work. 2. Standard Specifications The contractor shall perform his work in accordance with the Standard Specifications for Public Works Construction, 1976 Edition, hereinafter referred to as the Standard Specifications, City of San Juan Capistrano, and the Standard Specifications , 1978 Edition, of the State of California, hereinafter referred to as the Standard Specifications . The contractor shall maintain a copy of this book on the job site at all times . The provisions of the Standard Speci- fications , City of San Juan Capistrano, shall be modified as indicated below: Change 1 : "Section 2-4 - Contract Bonds" The "Payment Bond" (Material and Labor Bond) shall be in the amount of 100 percent of the contract price . The "Faith- ful Performance Bond" shall be held as assurance of guaranteed performance for a period of one year after acceptance of the improvements by the City Council . Change 2: "Liability Insurance,, The amounts and provisions of insurance are modified to be : Bodily Injury $ 500,000 each person Bodily Injury $1,000, 000 each accident Bodily Injury $1, 000,000 aggregate products Property Damage $ 500, 000 each accident Property Damage $ 500,000 aggregate operations Property Damage $ 500,000 aggregate protection Property Damage $ 500,000 aggregate products Property Damage $ 500,000 aggregate contractual The contractor shall likewise obtain public liability and property damage insurance to cover vehicles used or maintained by him whether on or off the premises , with liability limits of not less than $500 ,000 for any one person and $500 ,000 for any one accident, and property damage of $500,000 . The insurance amounts set forth herein are the minimum amounts required by the City. Other agencies with which the contractor may be in- volved in the accomplishment of the work may require greater amounts . The City will not recognize any claim for additional compensation because of the requirement for greater amounts of insurance , as an element to be considered by the contractor in determining his bid . -24- s Change 3 : "Section 8 - facilities for Agency Personnel" Delete this section. 3 . Terms Defined Whenever in the said Standard Specifications, City of San Juan Capistrano, the following terms are used, it is hereby provided that the following City departments or persons shall be intended : AGENCY shall mean City of San Juan Capistrano wherever appropriate . BOARD shall mean the City Council of the City of San Juan Capistrano . ENGINEER shall mean City Engineer or other person(s) designated by same . 4. Construction Area Contractor shall protect property and facilities adjacent to the construction area, and all property and facilities within the construction area which are shown on the„plans tb be protected . After completion of project, construction area shall be clean and in a presentable condition. All public or privately owned improve- ments and facilities shall be restored to their original condition and location. In the event improvements or facilities are<damaged , they shall be replaced with new materials equal to the original . Nothing herein shall be construed to entitle the contractor to the exclusive use of any public. street , way, or parking area during performance of the contract work, and contractor shall con- duct its operations so as not to interfere with the authorized work of utility companies or other agencies in such streets , ways or parking areas . The contractor shall be responsible for investigating conditions of available public and private roads and of clearances , restrictions and other limitations affecting transportation and ingress and egress to the site of the work. 5. Measurement and Compensation Compensation for items of work not specifically identified in the Special Provisions shall include all labor, materials , tools , equipment , safety measures and supervision required to complete the work to grades and dimensions shown on the plans or staked in the .field . There shall be no compensation except for the bid items specified in the Proposal . The cost of all work shown in the plans and specificai:ions but not specifically identified as a bid item or described within a bid item shall be included in related bid items , and no additional compensation shall become due the contractor by nature of compliance with the plans and specifications except as provided in Section 3 , "Changes in Work. ” -25- 6. Obstructions Attention is directed to . Section 5, "Utilities , " and Subsection 7-9, "Protection and Restoration of Existing Improvements , " of the Standard Specificatigns for Public Yorks Construction, and these Special Provisions . If the contractor wishes to have any utility located, he should contact the responsible agency at least 48 hours prior to construction in the immediate vicinity of the utility. The contractor 's attention is directed to the utility notification service provided by UNDERGROUND SERVICE ALERT (USA) . USA member utilities will provide the contractor with the locations of their substructures in the construction area when the contractor gives at least 48 hours notice to the USA by calling 17800-422-4133 . The contractor shall be responsible for contacting the utility companies directly to determine the locations of their substructures . Full compensation for conforming to the requirements of this article shall be considered as included in the contract bid prices paid for the various items of work, and no additional compensation will be allowed therefor. 7. Watering Full compensation for developing a water supply and for furnishing and placing all water required for work done in the 'contract, including extra work, shall be included in the prices paid for the various items of work requiring water; and no additional compensation will be allowed therefor . 8. Unclassified Excavation Unclassified Excavation shall conform to the provisions in Subsection 300-2, "Unclassified Excavation, " of the Standard Speci- fications for Public {Yorks Construction and these Special Provisions . Operations shall be conducted in such a manner that existing highway facilities , utilities , and other non-highway facilities which are to remain in place will not be damaged . Supplement and amend Subsection 300-2. 2. 1, "General, "' as follows : • All edges to be joined shall be saw cut. Supplement and amend Subsection 300-2.6, "Surplus Material, " as follows : It is estimated that there will be surplus excavation, which shall become the property of the contractor and shall be disposed of outside of the highway right-of-way. -26- Supplement an4wend Subsection 300,2.8,1�feasurement, " to include the following: 8) Removal of aggregate base and asphalt concrete surfacing 9) Excavating trenches Supplement and amend Subsection 300-2. 9, "Payment, " as follows : Full compensation for conforming to the requirements of this article including required saw cutting and all other Earthwork requirements shall be considered as included in the contract price paid for the various items of work in- volved, and no additional compensation will be allowed therefor. 9. Miscellaneous Concrete Miscellaneous Concrete shall conform to Orange County Standard Plan 803 , Subsection 303-5, "Concrete Curb,. walk, Gutters, Driveways and Alley Intersections, " of the Standard Specifications for Public Works Construction and these Special Provisions . The concrete for Miscellaneous Concrete shall be Class 520-C-2500 per Subsection 201-1. 1 .2, Concrete Specified by Class, " of the Standard Specifications . Full compensation for furnishing all labor, materials,' tools and equipment and for doing all work necessary, as shown on the plans, shall be considered as included in the contract unit price per cubic yard for Miscellaneous Concrete ; and no additional compensation will be allowed therefor . 10. Drawings The drawings show location, character of work, details of construction and are attached hereto as a part of the specifications . They are entitled "Traffic Signals, Del Obispo - Alipaz to Adelanto . 11 11. As-Built Print The contractor is required to submit to the Engineer "As-Built" prints prior to the City accepting the installations. The prints shall indicate , in red, all deviations from the contract plans, such as location of poles , pull boxes and runs, number of conductors and other appurtenant work, for future reference . -27- 12. Pre-Construction Adination Meeting ry Prior to the commencement of construction, arrangements will be made for a meeting between the Contractor, the Engineer and involved utilities . The purpose of this meeting is to coordinate the. acti_vi- ties of' the Contractor within the limits of this contract, review scheduling, discuss bonstruction methods and clarify inspection pro- cedures . The Contractor will be required to submit a complete schedule showing the number of working days required to complete the project . 13 . Traffic Signal and Highway Lighting The furnishing and installation of traffic signals shall conform to the provisions of Section 86, "Signals and Lighting, " of the Standard Spec ifications of the State of California, Department of Transportation, January, 1978, and these Special Provisions . 14. Standard Plans Standard Plans referred to in the signal plans and these Special Provisions for signal work shall be the Standard Plans of the State of California, Business and Transportation Agency, Department of Transportation, dated 1977. 15. Equipment List and Drawings Equipment list and drawings of electrical equipment and material shall conform to the provisions in Section 86-1 . 03 , "Equipment List and Drawings , " of the Standard Specifications, and these Special Provisions . The controller cabinet schematic wiring diagram and intersection sketch shall be combined into one drawing, so that the drawing is oriented with the intersections . The contractor shall furnish a maintenance manual for all auxiliary equipment and vehicle detector sensor units , control units and amplifiers . The maintenance manual and . operation manual may be combined into one manual . The maintenance manual or combined main- tenance and operation manual shall be submitted at the time the equip- ment is delivered for installation, or, if ordered by the Engineer , previous to purchase . The maintenance manual shall include, but need not be limited to, the following items : a. Specifications b. Design Characteristics c. General operation theory d. Function of all controls e: Detailed circuit analysis f . Troubleshooting procedure (Diagnostic routine) g. Voltage charts with wave forms Ii. Block circuit diagram i. Geographical layout of components J . Schematic diagrams k. List of replaceable component parts with stock numbers -28- The contractoVis required to submit to -lie Engineer "as-built" prints , prior to the City's accepting the installations . The prints shall indicate in red all deviations from the contract plans , such as pull boxes and runs, depths of conduit, number of conductors and other appurtenant work for future reference . 16. Standards , Steel Pedestals and Posts Standards , steel pedestals and posts shall conform to the provisions in Section 86-2.04, "Standards, Steel Pedestals and Posts , " of the Standard Specifications and these Special Provisions . In addition to identifying each pole shaft as detailed on ES-6S of the State Standard Plans , the contractor shall also identify each mast arm for all signals and luminaires . The stamped metal identification tag shall be located on the mast arm near the butt end and shall contain the same information required by ES-6S. 17. Conduit Conduit shall conform to the provisions in Section 86-2. 05, "Conduit, " of the Standard Specifications, and these Special Provisions . Non-metallic type conduit shall be used only where specifically noted or in trenches and shall be schedule 80 . Rigid metal conduit to be used as a drilling or jacking rod shall be fitted with suitable drill bits for size hole required . Insulated bonding bushings will be required on metal conduit . After conductors have been installed , the ends of conduits terminating in pull boxes and controller cabinet shall be sealed with an approved type of sealing compound . Conduit runs are shown in schematic form only. Actual installation shall be done in the most direct manner. Contractor shall provide and install conduit between the meter and service point in accordance with S.D.G.&E. requirements . 18. Conductors and Wiring Conductors and wiring shall conform to the provisions in Section 86-2.08, "Conductors, " and Section 86-2. 09, "Wiring, " of the Standard Specifications, and these Special Provisions. Conductors No. 8 AWG and larger shall be stranded . -29- . s 19. " Splice Insulation Splice insulation shall conform to the provisions in Section 86-2.096, "Splice Insulation, " of the Standard Specifications , and these Special Provisions . Conductors #10 AWG or larger shall be spliced by the use of "C" shaped compression connectors . Splices shall be insulated by "Method B. " 20. Bonding and Grounding Bonding and grounding shall conform to the provisions in Section 86-2. 10, "Bonding and Grounding" of the Standard Speci- fications and these Special Provisions . Grounding jumper shall be attached by a 3/16 inch or larger brass bolt in the signal standard or controller pedestal and shall be run to the conduit, ground rod or bonding wire in adjacent pull box. Grounding juniper shall be visible after cap has been poured on foundation. 21. Service Service shall conform to the provisions in Section 86-2. 11, "Service, " of the Standard Specifications, and these Special Provisions . New service shall be modified Type II with meter and switch wir- ing as shown on the plan. The Contractor shall notify the Engineer in writing at least 15 calendar days in advance of the date on which he desires any ser- i vice connections or disconnects to be made . The Contractor shall be entitled to no extension of time or other compensation for any delay to this operation resulting from his failure to give the prescribed notification. . The fourth paragraph of Section 86-2. 11 is amended as follows : It shall be the Contractor 's responsibility to verify the location of and to make arrangements for and to pay for all costs to provide the necessary connection for the traffic signal and lighting system. 22. Testing Testing shall conform to the provisions in Section 86-2. 14, "Testing, " of the Standard Specifications and these Special Provisions . -30- Testing of tefic signal equipment, including controller units, fully wired cabinets and auxiliary equipment as specified in Section 86-3 .01, "Controllers , " of the Standard Specifications will be performed by Signal Maintenance , Inc . , Anaheim, California, at Contractor 's expense . Approximately 21 days will be required for testing and notification of the final results . Energization of the new traffic signal systems shall not be made on a Friday or the day preceding a legal holiday. The Engineer shall be notified at least 48 hours prior to the intended "turn-on. " The signal monitoring unit shall be tested in the field before energization. The insulation resistance shall not be less than 100 megohms on all circuits when the megger tests are performed . A knowledgeable representative for the manufacturer or dis- tributor of the traffic signal controller equipment and components , exclusive of standard conduit , and conductors , shall be present for the first day of the functional test . 23. Vehicle Signal Faces and Signal Heads Vehicle signal faces , signal heads and auxiliary equipment, as shown on the plans, and the installation thereof , shall conform to the provisions in Sections 86-4. 01 to 86-4. 06 , inclusive , of the Standard Specifications and these Special Provisions . All lamps for traffic signal units shall be furnished by the Contractor. In addition to Section 86-4. 06 , "Signal Mounting Assemblies , " of the Standard Specifications , these following Special Provisions shall apply whenever a terminal compartment is required : The terminal block shall be mounted vertically and to the side of the cable inlet guide . Sufficient lateral spacing shall be provided to allow pulling and connecting of incoming conductors without removal of the terminal block mounting screws . A minimum of one (1) inch clearance shall be provided between the terminal block and all inside walls of the terminal compartment . The terminal compart- ment shall be provided with a captive hinged access door . With the door open, there shall be a minimum of a ten-by- four-inch (101lx4") access "to the terminal compartment for connection and inspection of the terminal block. The door shall be equipped with a minimum of two hinged points . Hinge pins or other hardware shall be stainless steel. The door shall be held closed with a single stainless steel machine screw of adequate size to secure the door to the compartment housing. The door shall be equipped with a neoprene gasket, permanently secured, to prevent water from entering the terminal compartment . The mounting bolt spacing and cable guide location shall be as dimensioned on drawing ES-3B of the Standard Plans . -31- 24: 'Pedestrian Signal* Pedestrian signals shall conform to the provisions in Section 86-4.05, "Pedestrian Signals , " of the Standard Specifications, and these Special Provisions . Pedestrian signals shall be Type C. The letters shall be a minimum of 4-1/2 inches in height . The following type screen shall be provided on Type C signals : A 1-1/2 inch-deep eggcrate-type screen, either of 0. 20- inch minimum thickness 3003 H14 aluminum alloy or of 0.030-inch nominal thickness polycarbonate . The assembly shall be mounted in a frame constructed of 0 .040-inch minimum thickness aluminum alloy or polycarbonate . The vertical spacing of the horizontal members shall be 1/2- inch, starting approximately 1/4-inch above and ending approximately 1/4-inch below the "DON' T" and "WALK" legends respectively. Addi- tional members may be employed outside the two legend areas for structural strength. The eggcrate-type screen shall be installed parallel to the face of the "DON' T WALK" message and shall be held in place by use of stainless steel screws . The visors described in Section 86-4.05C, "Visors , " of the Standard Specifications may be omitted with the eggcrate-type screen. The screen and frame shall be anodized flat black or may be finished with flat black enamel as specified in Section 91-4 .01, "Enamel ; Traffic Signal Lusterless Black, " of the Standard Speci- fications . Said enamel shall be applied in the shop at the Contractor 's expense . Alternate methods may be substituted for the above screening, providing the results are equal to or superior to those obtained with the above-specified screens as determined by the Engineer. 25. Detectors Detectors shall conform to the provisions in Section 86-5. 01 , "Vehicle Detectors, " of the Standard Specifications, and -these Special Provisions . Integral detector sensor units shall not be provided . Output relays, if used, shall be normally closed . -32- The Contractor shall test the detectors with a motor-driven cycle, as defined in the California Vehicle Code, that is licensed for street use by the Department of Motor Vehicles of the State of California . The unladen weight of the vehicle shall not exceed 220 pounds, and the engine displacement shall not exceed 100 cubic cen- timeters . Special features , components or vehicles designed to activate the detector will not be permitted . The Contractor shall provide an operator who shall drive the motor-driven cycle through the response or detection area of the detector at not less than three miles per hour nor more than seven miles per hour. The de- tector shall provide an indication in response to this test . Loop Detectors Sensor units shall be Type A or Type B. Section 86-5.OlA(2) , "Performance Characteristics , " of the Standard Specifications is amended to read as follows : Loop sensor units shall provide an output closure for each vehicle passing through the re- sponse area of the loop at speeds up to 75 miles per hour and shall also provide an output closure of at least 10 minutes duration when a vehicle, except motorbikes , is occupying the response area of the loop. An output closure of at least one minute duration shall be provided for motorbikes . Loop sensors shall be self-tuning. Advance loop detectors shall provide a timed lag capability in a range from 0 through 6 seconds , minimum, in one-second increments . Loop detectors in left turn lanes shall not detect any vehicle in adjacent lanes . Size of individual loops may vary from that shown on the plans. The number of sensor units and lead-in cable required to achieve the specified detection shall be installed. 26 . Pedestrian Push Buttons Pedestrian push buttons shall conform to the provisions in Section 86-5.02, "Pedestrian Push Buttons, " of the Standard Speci- fications, and these Special Provisions . The pedestrian push button instruction signs shall be 91, x 121, in size . On the Type B push button assembly, the sign shall attach to and be securely supported by the frame work. The sign shall not extend beyond the frame work. -33- 2`7." Luminaires All luminair wattage shall be as shown in the plan with integral constant wattage ballast, 240 volt multiple integral photo- electrical receptacle with photoelectric control and glare shields . All luminaires shall conform to the applicable provisions in Sec- tion 86-5, "Lighting, " of the Standard Specifications . 28. Photoelectric Controls Photoelectric controls shall conform to the provisions in Section 86-6 . 07, "Photoelectric Controls , " of the Standard Specifications, and these Special Provisions . The photoelectric controls shall be Type IV. 29. Solid-State Traffic-Actuated Controllers Solid-state Traffic-actuated controller units , cabinets , and auxiliary equipment shall conform to the provisions in Section 86-3, "Controllers , " of the Standard Specifications and these Special Provisions . The controller unit shall be a two-phase, Type 90 controller. The controller unit shall be installed at the intersection in a Type M-1 cabinet . Controller unit equipped with a "guaranteed passage time feature" shall provide a method of omitting this feature without internal conduit modification. The recall switches , vehicle and pedestrian test push buttons , and the indicator lamps may be mounted on the controller unit or inside the controller cabinet. The indicator lamps shall , as a minimum, indicate red, yellow, and green vehicle indications, WALK and DON' T WALK pedestrian indications , vehicle and pedestrian calls . Section 86-3 .06I', "Indicators" is amended to include the following: The indicator lamps shall be controlled by a refrigerator type door switch. Section 86-3.07, "Controller Cabinet" is amended to include the following: Detector sensors, coordination equipment and inter- connect comnunications equipment shall be installed in the Type "M" cabinet . The cabinet shall have mounting flanges across the center from front to rear on 12-inch centers . There shall be gravity-operated door limit stops at 90 and 180 degrees . -34- There shall be a removable cabinet vent-light assembly which shall contain a fluorescent light and ball bearing fan controlled with an adjustable thermostat . The lamp shall be controlled by a refrigerator type door switch. Paints to be applied to the controller cabinet exterior and interior surfaces shall be white in color. Controller cables shall end in ring lugs or shall be either soldered to a through panel solder lug on the rear side of the terminal or soldered direct to the load switch socket pin. There shall be accessory panels on each bottom side wall when required on left side for field loop termination and on right side for AC service, ground bus, AC distribution terminal block, radio interference suppressor and other accessories . The following items shall be mounted on the inside of the door : a. A securely fastened heavy duty plastic envelope of sufficient size to hold controller cabinet wiring diagrams , intersection layout diagrams and other service information. b. Vehicle and pedestrian test buttons . C. Auxiliary panel with a convenience receptacle , duplex three-prong NEMA type 5-15R, a controller power and auto-flash stop timing switch. The convenience receptacle shall have ground-fault circuit interruption as defined by the Code . Circuit interruption shall occur on five milliamperes of ground-fault current . All control circuits available in the controller shall be brought out to terminal boards to facilitate utilizing additional functions, including interconnect operation. Section 86-307D9(4) is amended as follows : Contractor shall provide a three-position switch in lieu of the two-position switch required by this section. The three positions shall be designated "Flash Stop Time, " "Off, " and "Stop Time . " The "Flash Stop Time" and the "Off' positions shall operate as specified in this section. The "Stop Time,, position shall be capable of stop timing the controller whenever the switch is engaged in the "Stop Time,, position. -35- Section 86-3 .08, "Flasher" is amended to include the following: Flashing operation shall provide flashing red lights on all approaches . During flashing operations, pedestrian signals shall be turned off . The fourth paragraph of Section 86-3 .08L is amended as follows : Two circuit flashers shall be capable of carrying a mini- mum of 15 amperes per circuit . Single circuit flashers shall be capable of carrying a minimum of 30 amperes . 30 . Payment Payment for signals and lighting shall conform to the provisions in Section 86-8, "Payment, " of the Standard Specifications, and these Special Provisions . The contract lump sum price or prices paid for signals and lighting shall include highway lighting and internally illuminated street name signs . 31 . Maintenance and Guaranty The Contractor shall guarantee the entire work constructed by him under this contract will fully meet all requirements as to quality of workmanship and materials furnished by him. The Con- tractor shall make at his own expense any repairs or replacements made necessary by defects in workmanship or materials furnished by him that become evident within one (1) year after filing of the notice of completion of the work, and to restore to full compliance with the requirements of these Specifications any part of the work which during the one year period is found to be deficient with respect to any provision of the Plans and Specifications . The Con- tractor shall make all repairs and replacements promptly upon re- ceipt of written orders from the Engineer. If the Contractor fails to make the repairs and replacements promptly, the City may do the work and the Contractor and his surety shall be liable to the City for the cost. The guarantees and agreement set forth in the above paragraph shall be secured by a surety bond which shall be delivered by the Contractor to the City before the notice of completion is filed . The bond shall be in an approved form and executed by a surety company satisfactory to the City, in the amount of Five Thousand Dollars ($5,000.00) . Bond shall remain in force for a period of one (1) year after date of said notice of completion. Please execute both copies and return the "City Copy" to this office with all required bonds and insurance; the remaining copy is for your files . The contract documents are to be executed by your company within 15 days of this notice. I am also enclosing pages 14 and 24 of the bid document for your information.
