This Agreement, made and entered into this 22nd day of
January, 1985, by and between the City of San Juan Capistrano, a
body politic of the State of California, hereinafter designated as
"City," and Jim and Pete Tyson, owners of the Capistrano Depot,
hereinafter designated as "Depot."
WITNESSETH:
WHEREAS, the City of San Juan Capistrano has constructed
improvements east of the Depot, consisting of a paved parking lot,
landscaping, lighting, sidewalks, and a passenger waiting area; and,
WHEREAS, the Depot has improved an area north of its facility
for parking purposes; and,
WHEREAS, on January 17, 1984 the City and the Depot entered
into an agreement covering the exchange of time-limited parking spaces
between the two lots, improved maintenance and the posting of speed
limits; and,
WHEREAS, the terms of the original agreement were carried out
and the City and the Depot wish to enter into a new agreement.
NOW, THEREFORE, it is mutually agreed by and between the City
and the Depot as follows:
I. The City shall designate thirty-eight (38) additional

MULTIMODAL TERMINAL
This Agreement, made and entered into this 17th
day of January , 1984, by and between the City of San Juan
Capistrano, a body politic of the State of California, here-
inafter designated as "City," and Jim and Pete Tyson, owners
of the Capistrano Depot, hereinafter designated as "Depot."
WITNESSETH:
WHEREAS, the City of San Juan Capistrano has
constructed improvements adjacent to the Depot, consisting
of a paved parking lot, landscaping, lighting_, sidewalks,
and a passenger waiting area; and,
WHEREAS, the City has designated thirteen parking
spaces in this area for two-hour use which are available to
customers of the Depot; and,
WHEREAS, the City wishes to provide a like number
of unrestricted spaces in the Depot's north lot to compensate
for the loss of the use of these spaces by commuters; and,
WHEREAS, the Depot agrees to remove same signs
limiting parking in their north lot in exchange for the
two-hour spaces posted in the MultiModal Terminal as long
as parking regulations are diligently enforced.
NOW, THEREFORE, it is mutually agreed by and between
the City and the Depot as follows:
1. The City shall designate and post thirteen
parking spaces limited to two-hour parking
in the MultiModal Terminal, adding additional
spaces to a maximum of twenty as needed.
2. The Depot shall remove time limitation signs
from thirteen parking spaces on the east
side of their lot, removing an additional
seven signs in the same area to a maximum
of twenty as needed.
3. The City will provide sweepincr and cleaning
of both the Depot's parking lot and the

Written Communications:
Report dated January 22, 1985, from the Senior
Administrative Assistant, advising that on January 17, 1984,
the City and the Depot entered into an agreement covering
parking, maintenance, and posting of speed limits in the
Depot and Multi -Modal Terminal parking lots. The report
forwarded a new agreement incorporating additional
improvements in the two lots: i.e., 38 additional spaces in
the Multi -Modal Terminal to be designated 2 -hour parking;
removal of time limits in the Depot parking lot; continued
sweeping and cleaning of the lots; construction of speed
bumps in the Multi -Modal Terminal lot; and, new signs
prohibiting overnight parking and designating tow -away
zones. The agreement will be effective for a one-year
period of time and repeals the previous agreement dated
January 17, 1984. Costs for the proposed improvements were
estimated at $2,000.
Approval of Agreement:
It was moved by Councilman Buchheim, seconded by Councilman
Friess, and unanimously carried to approve the agreement
between the City and the Depot for improvements in the
Multi -Modal Terminal; and, to authorize a transfer of funds
from the General Fund to Account No. 01-4440-213 (Public
Works Maintenance Specialized Services) in the amount of
$20000 to cover the cost of the improvements. The Mayor and
City Clerk were authorized to execute the agreement on
behalf of the City.

SUBJECT: Agreement for Parking and Maintenance (Capistrano Depot)
SITUATION:
Last year the City and the owners of the Capistrano Depot entered into an
agreement for improvements to the Multi Modal Terminal. Thirteen unrestricted
parking spaces in the City's lot were posted 2 -hour parking in exchange for
removal of a like number of restricted spaces in the private lot. The City
agreed to post both lots as a 15 mph zone and to extend litter control to the
private lot. On December 19th the agreement was reviewed by staff and Jim
and Pete Tyson for suggested improvements. The following items were discussed
for possible inclusion in a new agreement:
1. The City will initially install two speed bumps in the public
section of the main two-way driveway to further slow down vehicles
in the heaviest pedestrian areas, but beyond the bus turn -around
so as not to impede bus traffic.
The 27 spaces currently restricted in the private lot will become
unlimited parking areas. The 38 unrestricted spaces in the City's
lot will be posted as 2 -hour parking.
Both lots will be posted for no overnight parking. In addition,
new signage in the 2 -hour lot will include the words "tow -away zone".
In addition, the City will investigate the possible use of a portion of the
Dunivin property for overnight or weekend parking and for long-term parking;
the Tysons will explore the idea of a long-term sublease of the private lot
to the City so that further improvements can be made; and the City will
re-evaluate circulation between the various adjacent lots and the MultiModal
Terminal.
The use of speed bumps in public parking lots is increasing. Locally, the
County of Orange, the Capistrano Unified School District, and Saddleback
College have all successfully used this device to slow down motorists where
pedestrians are present. The signage poses no problem, although we have
never before posted areas for immediate tow -away. The Sheriff's Department
did issue 127 tickets in the Terminal during the months of October and
November. Enforcement appears to be the key to making a 2 -hour zone work.
The attached agreement covers items that can be readily implemented while
we are looking at the others. At such time the other items become feasible,
the agreement will be brought back for amendment.

FINANCIAL CONSIDERATIONS:
The cost of two speed bumps, the signage, labor costs in removing old signs,
and City overhead would be approximately $2,000. A budget amendment would
be required.
ALTERNATE ACTIONS:
Approve the agreement and authorize a budget amendment in the amount
of $2,000 to cover the cost of the improvements.
2. Request further information.
RECOMMENDATION:
By motion, approve the agreement and authorize a transfer of funds from the
General Fund to Account Number 01-4440-213 (Public Works Maintenance
Specialized Services) in the amount of $2,000 to cover the cost of the
improvements.

(1) Direct staff to prepare a resolution directing that the
Vehicle Code be enforced in the Depot parking lot;
(2) Approve the agreement between the City and Jim and Pete
Tyson of the Capistrano Depot, authorizing the exchange
of time-limited spaces in the Depot parking lot to
allow the City to designate and post up to a maximum of
20 spaces limited to two-hour parking;
(3) Authorize staff to develop a sign program for the
Multi -Modal area which will be presented for funding in
the 1984-85 budget; and,
(4) Direct staff to continue working with the railroad,
property owners, and regulatory agencies to determine

SUBJECT: MultiModal Terminal Parking and Access
SITUATION:
Last June the City opened the new MultiModal Terminal with paved parking
spaces for fifty cars and four buses. It included a public waiting area
in a park -like setting with a passenger loading and unloading area in front
and other improvements such as functional lighting, expanded driveways,
and considerable landscaping. The result was the creation of a safer, more
attractive place to park a car or wait for a bus or train. Since then,
several situations have been identified which require improvement. These
can be grouped into three major categories: parking conflicts, pedestrian
access, and traffic control.
Parking Conflicts
Prior to the time that the City acquired the property for the MultiModal
Terminal, a portion of it was used in an unimproved condition by the
Capistrano Plaza as a parking lot for its patrons. Plaza tenants and
their employees also parked there and a sign identified its restricted
use. There are no statistics available on whether or not the signs were
obeyed.
When the City acquired the property, it became a public parking lot along
with a section which had previously been used as a storage area. The lot
could no longer be restricted, but the trade-offs seemed fair. It was
anticipated that there would be high commuter use during weekdays, but
spaces would be free for commercial use on weekends when tourist influx
was heaviest. This turned out to be true, but merchants complained that
there was nowhere for their customers to park during the week, and they
appealed to the City for assistance.

nature of the parking situation in the MultiModal Terminal, I began a
four-week study to examine parking patterns in the MultiModal Terminal's
two-hour zone. I also examined the unlimited areas in the MultiModal
Terminal, the Depot lot, and the new downtown two-hour areas which Council
had just authorized. The study consisted of a spot check, two or three
times a day, of the aforementioned parking areas, and the actual listing
of license numbers of cars in the MultiModal two-hour zones.
I found that most commuters are in place by 8:00 a.m. The Multi Modal's
unlimited area is full by this time, and the Depot's unlimited area is
nearing capacity. While there were all -day parkers early in the study
in the MultiModal two-hour areas, this had tapered off with stepped-up
law enforcement activity by the end. Enforcement seems to be the key to
the functionality of the two-hour areas.
The downtown two-hour zones appear to be working quite well. At no time
during the study did I observe fewer than three vacant spaces, even during
peak Christmas shopping hours, and the average vacancy was about seven
spaces. There seems to be continuous turn -over in these spaces and two
merchants have called to say this situation is helping their business.
The results of the study indicate that there is no need for further two-hour
spaces; however, four more are slated for posting along the edge of the Terminal's
landscaped area north of the trash enclosure. These are not legal spaces
as yet, but are functioning well and will be striped and posted for addi-
tional two-hour use. There is, however, a growing need for more unlimited
spaces. Both commuters and downtown employees currently share the unlimited
spaces available in the area. The owners of the Capistrano Depot have agreed
to convert up to twenty of their time -restricted spaces for unrestricted use
if enforcement of the two-hour zones continues to be diligent. This will
provide additional parking for commuters and should ease their situation.
Pedestrian Access
The popularity of the MultiModal Terminal for commuters is its proximity to
the station platform. Persons parking in the Depot's unrestricted area must
walk the length of the parking lot to Verdugo Street to get on the train.
The main solution to this problem is providing access to the platform from
the north end of the Depot. There appears to be adequate space to provide
a fenced walkway between the tracks and the Depot's banquet room and bar.
Staff has the support of the Depot owners and is continuing to explore the
feasibility of this proposal with Santa Fe Land and Improvement Company
and railroad officials.
A specific proposal for this will appear in next year's budget. An alternative
would be to provide access through the Depot itself (which is done from
11:30 a.m. until 2:00 a.m.). The owners currently close the building prior
to 11:30 a.m. because of vandalism and theft, but would be willing to open
early if the City would provide a monitor or would reimburse them for the
cost of a monitor. Staff is also exploring this idea.

Traffic Control
The third area of concern is the traffic within the MultiModal and Depot
parking lots. It is well-known that people use these areas as an unofficial
Camino Capistrano by-pass. While it would be difficult to control this
situation without jeopardizing legitimate use of these facilities, there
needs to be posting and enforcement of a speed limit. Pedestrians walking
to the platform or to businesses are continuously jeopardized by speeding
cars. After consulting the Traffic Engineer, it is suggested that we post
the driveways at each entrance with 15 mph speed limits. To facilitate
enforcement in the Depot's lot, a resolution is attached authorizing enforce-
ment of the Vehicle Code on private property.
A new sign program should be developed for the entire Terminal -Depot area.
Current signs should authorize tow -away for flagrant violators and there
should be uniformity in design of signs that are posted. A specific sign
program will be recommended for funding in the Redevelopment Agency's budget.
Through cooperation and patience, the problems in and around the MultiModal
Terminal can be solved in an attractive and functional manner. Staff will
continue to keep you informed on developments in this area.
