09-0707_SECURTEC DISTRICT PATROL, INC._Personal Services Agreement 1st AmdFIRST AMENDMENT TO PERSONAL SERVICES AGREEMENT THIS FIRST AMENDMENT TO THE PERSONAL SERVICES AGREEMENT between the CITY OF SAN JUAN CAPISTRANO ("City") and Securtec District Patrol, Inc., ("Consultant") is made and entered into, to be effective the 12Th day of November 2009, as follows: RECITALS WHEREAS, the City and Consultant have entered into that Personal Services Agreement dated July 7, 2009 for Supplemental Parking Enforcement Services (the "Agreement"); and WHEREAS, the City and Consultant desire to amend the terms of the Agreement to expand the hours of enforcement coverage for the remainder of Agreement. NOW, THEREFORE, in consideration of the promises and mutual covenants contained therein, City and Consultant agree to amend Section 1, Exhibit A of the Agreement, commencing on November 12, 2009, as follows: Section 1. Scope of Work. The scope of work to be performed by Consultant shall consist of those tasks as set forth in Exhibit 'A" attached and incorporated herein by reference. To the extent that there are any conflicts between the provisions described in Exhibit "A" and those provisions contained within this Agreement, the provisions in this Agreement shall control. Exhibit "A" is amended to reflect that the hours to be patrolled shall be from 11:00 p.m. to 6:00 a.m. On any given night of enforcement, the security officers shall only be assigned to a maximum of three -hours of patrol coverage. The three-hour time shift to be covered shall be coordinated by the City Manager or his designee. -11- All other provisions of the Agreement not amended hereunder shall remain in full force and effect. Securtec District Patrol, Inc. will provide two (2) uniformed contract security officers to patrol the public streets in all neighborhoods in the City that have overnight parking permit programs. 2. Security officers will patrol three -hours per night, six -days a week to identify vehicles which are not displaying approved parking permits. 3. The one night each week that shall not have enforcement coverage shall be rotated between Tuesday, Wednesday and Thursday. 4. The Capistrano Villas 1, 11 & III will be patrolled between the hours of 11:00 p.m. and 6:00 a.m. 5. The west side of Camino Capistrano between La Zanja Street and Oso Road will be patrolled between the hours of 2:00 a.m. and 6:00 a.m. 6. All other streets in the City that are posted for overnight parking will be patrolled between the hours of 3:00 a.m. and 6:00 a.m. 7. One (1) security officer will be assigned to patrol the Capistrano Villas I, II & III from 11:00 p.m. to 6:00 a.m. This security officer shall only patrol three - hours on any given enforcement night. The three-hour time shift to be covered shall be rotated each week and or each month. The three-hour time shift to be covered shall be coordinated by the City Manager or his designee. 8. One (1) additional security officer neighborhoods/streets in the City programs from 3:00 a.m. to 6:00 a.m. will be assigned to patrol all other that have overnight parking permit 9. The security officer(s) are expected to issue citations for vehicles parked in violation of the parking permit program only. 10. Citation books will be issued to security officer(s) by the City of San Juan Capistrano. 11. Securtec District Patrol, Inc. will provide proper training to those contract security officer(s) in advance of their assignment(s). 12. Contract security personnel will submit all citations and citation log to the San Juan Capistrano Police Services (Orange County Sheriff's Department) at the end of each shift. 13. Contract security personnel will drive Securtec District Patrol, Inc. vehicles. November 12, 2009
