AGREEMENT FOR THE RELOCATION OF
SAN JUAN DANCE HALL
THIS AGREEMENT is entered into by and between the CITY OF
SAN JUAN CAPISTRANO, hereinafter called "CITY" and M. L. SCHMIDT,
representing Mission Hacienda, hereinafter called "DEVELOPER."
W I T N E S S E T H:
WHEREAS, the San Juan Dance Hall has been designated by the
CITY as an historically significant structure; and
WHEREAS, DEVELOPER desires to utilize the premises upon which
the aforesaid building is located for uses which require the removal
of the aforesaid structure; and
WHEREAS, CITY desires to have the aforesaid structure located
upon a portion of the municipal premises.
NOW, THEREFORE, in consideration of the foregoing premises and
the promises hereinafter set forth, CITY agrees to permit DEVELOPER
to remove the San Juan Dance Hall from the inventory of historically
significant buildings, provided that:
1. DEVELOPER shall not, in any way, alter, mar, relocate or
destroy the San Juan Dance Hall or any part thereof without the prior
consent of the CITY.
2. DEVELOPER shall donate and give said building to the CITY,
and shall be responsible for the movement of said building to a site
designated by CITY.
3. DEVELOPER shall prepare site to the satisfaction of the
City Engineer.
4. CITY shall perform two inspections of the building prior
to the move and after building is placed on the site.
5. Any discrepancy between these two reports will be rectified
by DEVELOPER until said discrepancy is resolved to the satisfaction
of the City Engineer.
6. If CITY shall violate any portion of this agreement, it
shall forfeit any right of ownership to said building, thereby re-
leasing DEVELOPER from this agreement and he may dispose of the
Dance Hall proceeding with the use of the site AP 121-141-02 in
accordance with the appropriate permits secured therefor.
7. If DEVELOPER shall violate any portion of this agreement
he shall forfeit any permit or other entitlement, including grading
and building permits, that he may have for the utilization of the
site (AP 121-141-02.)

8. DEVELOPER shall provide CITY with detailed cost report
of all items amounting to the final contract cost not to exceed
the sum of $5,052.00; said report shall be to the satisfaction
of the Director of Public Works.
9. In consideration of the foregoing promises, CITY agrees
that within (30) thirty days after receipt of the Dance Hall
DEVELOPER shall receive the final contract sum at which time
ownership of Dance Hall shall pass from DEVELOPER to CITY in
accordance with the aforesaid provisions of this agreement.
IN WITNESS WHEREOF, this Agreement was executed on this
15th day of December, 1976, in the City of San Juan Capistrano,
California.

SUBJECT: Agreement for the Relocation of San Juan Dance Hall
At the City Council meeting of December 15, Council amended costs
to a previous agreement for movement of the San Juan Dance Hall.
The amendments to that agreement have been incorporated in a
revised contract for the Mayor's signature.
