INDEPENDENT CONTRACTOR AGREEMENT
FOR HUMAN RELATIONS SERVICES
THIS AGREEMENT is made and entered into this 17th day of
November, 1992 , by and between the CITY OF SAN JUAN CAPISTRANO,
hereinafter referred to as "City, " and NIBARDO GOMEZ, JR. ,
hereinafter referred to as "Consultant. "
W I T N E S S E T H
WHEREAS, City requires professional consulting services
relating to the continuance of human relations services and
activities as a part of the City' s Community Services Department;
and,
WHEREAS, Consultant is prepared to render said professional
services,
NOW, THEREFORE, City and Consultant agree as follows:
SECTION 1. SCOPE OF WORK
Consultant will perform services or tasks to coordinate and
carry out a comprehensive human relations program for the targeted
population as described in Exhibit A, Scope of Work.
SECTION 2. BEGINNING OF WORK
Consultant shall begin providing human relations services
effective November 17, 1992 .
SECTION 3. COMPENSATION
Consultant shall be paid a flat amount of $3 , 200. 00 per month
for said professional services with no reimbursable expenses.
Consultant shall submit a monthly billing to the City for services
performed. The billing shall be submitted to 32400 Paseo Adelanto,
San Juan Capistrano, CA 92675.
Total cost to the City for Consultant' s fee shall not exceed
$24, 000.00.
SECTION 4, INDEPENDENT CONTRACTOR
At all times during the term of this Agreement, Consultant
shall be an independent contractor and shall not be an employee of
the City. City shall have the right to control Consultant only
insofar as the results of Consultant' s services rendered pursuant

to this Agreement; however, City shall not have the right to
control the means by which Consultant accomplishes services
rendered pursuant to this Agreement. Consultant shall meet with
the Director of Community Services on a schedule to be mutually
determined regarding services provided and the results of such
services, and shall provide periodic progress reports as described
in the Scope of Work.
SECTION 5. OFFICE HOURS
The Consultant shall maintain office hours on a weekly basis,
to be mutually determined by Consultant and City.
SECTION 6. TERM AND TERMINATION
The services provided for under this Agreement shall be
completed on or before June 30, 1993 . City or Consultant may
terminate this Agreement without cause at any time by giving the
other party a 15-day advance written notice of termination which
shall be deemed effective 15 days from date said notice is
deposited by first class mail in the United States mails. Notice

SECTION 7 . LIABILITY INSURANCE PROTECTION
Consultant shall maintain his own automobile and general
liability insurance protection in the amount of at least
$300, 000. 00, combined single limit.
Consultant shall present proof of insurance to City in the
form of an endorsement or certificate acceptable to the City
Attorney prior to beginning work.
SECTION S. INDEMNITY
Notwithstanding any other provision contained in this
Agreement, City shall be responsible for all injuries to persons
and/or all damages to real or personal property of Consultant or
others, caused by or resulting from activities or operation of
Consultant during the progress of, or connected with, the rendition

of services hereunder. City shall defend and hold harmless and
indemnify Consultant from all costs and claims for damages to real
or personal property, or personal injury to any third party
resulting from the activity of Consultant.

Exhibit A
Scope of Work
Consultant will perform services or tasks to accomplish the
following for the target client population:
A. Information and Referral
Provide information and referral regarding a variety of
social, health, educational, and legal services available to
target population, such as:
how to apply for a social security card
how to apply to the Department of Motor Vehicles for an
identification card
availability of health or medical services
preventative health care information, such as smoking
cessation, prenatal care, AIDS awareness, etc.
tenants and landlords rights
employee and employer rights
civil rights information
employment and housing anti-discrimination laws
how to apply for U.S. Citizenship
educational opportunities: how to improve English
language skills, how to apply for jobs, availability of
programs to improve job skills, etc.
Information services may be provided during consultant's office
hours at City Hall, in the field, or during specially organized
educational sessions.
B. Educational Assistance
Organize periodic educational programs or sessions to provide
more detailed information about one of the topical areas identified
in Section A, above. Consultant may conduct programs personally,
or he may arrange for quest speakers or presenters qualified and
knowledgeable about the topic. Educational programs will be
conducted, for the most part, at facilities provided at Serra
Continuation High School. Consultant may organize and/or conduct

educational programs at other suitable sites and locations, at his
discretion. Additionally, consultant may from time to time provide
educational assistance regarding issues of cultural diversity.
C. Inspection Referral Assistance
Consultant will assist clients who believe that deficient or
improper housing, health, sanitation codes or standards are present
in their rental units. The nature of the assistance the consultant
will provide is to refer the matter to the appropriate city or
county inspection staffs so that inspection and any needed
correction or compliance can be achieved. Consultant may serve as
a liaison, providing information between the client and the
inspectors, when his assistance will improve communication due to
language barriers or cultural differences. It is not expected that
consultant will participate in field inspections to determine
existence of housing, health or sanitation violations. However,
at his discretion, Consultant may choose to participate in field
inspections.
D. Liaison with Homeowners Associations
Consultant shall maintain a relationship with Homeowners
Association Boards of Directors in San Juan Capistrano or their
designated management companies for the purpose of :
providing information about the services provided under this
contract,
discussing problems of the Associations which result from
poorly maintained units or cultural differences;
suggesting ways for Associations to address other problems
which may relate to or assist target clients groups which
reside within these Association areas;
contacting owners or managers of rental housing units who may
be renting units in violation of health, housing or sanitation
codes or standards, or who may be engaged in improper landlord
actions against clients which are illegal or discriminatory;
providing referral information about the assistance other
governmental agencies may be able to provide within their
scope of responsibility;
encouraging Associations to enforce provisions of their Codes,
Covenants and Restrictions, where needed and appropriate,
consistent with the overall goals of the Neighborhood
Preservation Program.

E. Housing Mediation
Provide landlord/tenant and neighbor/neighbor mediation
services for the client population in San Juan Capistrano. Assist
in developing communication and discussion between disputing
tenants and landlords in an attempt to resolve issues related to
housing.
F. Employment Opportunity Program
Develop and implement a program to match available jobs in the
San Juan Capistrano business community with willing workers among
the client population. Develop plans to expand the implementation
of this program in the future.
G. Labor Defense
Consultant will establish and conduct a program to assist
immigrants with issues of labor defense. Consultant may assist
immigrants with problems concerning non-payment by wages by
employers. Consultant may advise clients of the type of information
needed to support the filing of claims with the appropriate
governmental agencies. The consultant may directly contact
employers to discuss allegations of clients. Consultant will
provide information to clients on workers and employers rights and
responsibilities.
H. Citizenship Assistance
Provide information to immigrants among the client population
about the application process and background information needed for
U.S, citizenship. Consultant may provide assistance in completing
necessary application forms.
I. Advocacy Assistance
Consultant may provide advocacy assistance to clients who
encounter difficulties dealing with employers, potential employers,
governmental or social services agencies, educational institutions,
landlords, or community organizations. The intent of such advocacy
is to assist clients in receiving fair and equitable treatment.
J. Christmas Program Coordination
Consultant shall provide overall coordination of the Santa
Claus program for target youth clients at San Juan Capistrano
Elementary School. Consultant shall work with representatives of
the School District, Orange County Fire and Sheriff's Department,
the San Juan Task Force, and toy suppliers for this annual event.

K. Community Organizational Liaison
Consultant shall serve as an informational liaison with Community
groups, organizations or service agencies to provide information
about the services of the Human Relations Program of the City of
San Juan Capistrano. This may on occasion require the Consultant
to attend meetings with representatives of these organizations.
L. Governmental Liaison
Consultant shall communicate with and provide information to law
enforcement agencies, health, welfare and social service and other
governmental agencies, as appropriate, regarding the needs of the
client group and ways to improve service delivery.
M. Changes in Scope of Work
From time to time, it may be necessary to adjust the scope of work
to better respond to new priorities. Changes in the Scope of Work
must be determined by mutual concurrence of the Consultant and the
Director of Community Services prior to any reallocation of the
Consultant's time or resources towards new priorities.
M. Reporting Reguirements
Consultant shall provide progress reports of all activities,
programs conducted and categories of contacts made under the terms
of this agreement. These reports will be provided on a bi-monthly
basis to the Director of Community Services. Consultant shall also
provide to the Director of Community Services for administrative
purposes a weekly written summary of hours spent in various
categories of service or program areas.

PROGRAM ASSISTANCE (NIBARDO GOMEZ. JR.) (600.30)
Written Communication:
Report dated November 17, 1992, from the Senior Management Assistant, recommending that a new
contract between the City and Nibardo Gomez, Jr. be approved for the provision of human relations
and housing inspection assistance. The new contract would not include housing and code inspection
tasks, which services will be provided by a future Housing Specialist position. The proposed term of
the contract would run from November 17,1992, through June 30, 1993,at a salary of$3,200 per month.
Larry Culbertson,32882 Avenida del Rosal,stated that the program should target San Juan Capistrano
residents and not non-citizens. He felt that programs such as the Employment Opportunity Program
promote the violation of human rights (minimum wages, hiring of illegal aliens) which results in
overcrowding. Mr.Scarborough stated the reality was people standing on street corners waiting for jobs
and the City needed to facilitate better ways to assist those people. Councilman Harris suggested that
consideration be given in the future to providing more specific job descriptions in human relations.
Approval of Contract:
It was moved by Councilman Hausdorfer,seconded by Councilman Friess,and unanimously carried that
the Independent Contractor Agreement for Human Relations Services be approved between the City
and Nibardo Gomez, Jr., for a not-to-exceed amount of$3,200 per month, for the period beginning
November 17, 1992, and ending June 30, 1993.
2. CONSIDERATION OF AMENDMENT TO TITLE 5 OF THE MUNICIPAL CODE TO
ADD CHAPTER 23 - REGULATING SKATEBOARDING (590.10)
Written Communication:
Report dated November 17,1992,from the City Manager,forwarding a draft Ordinance for introduction
to prohibit skateboarding on Council-designated properties within business districts and designated
public properties. The Ordinance would require the posting of signs notifying the public of the
prohibition prior to enforcement.

The City Clerk read the title of the Ordinance next in order. Further reading of all Ordinances had
been waived earlier in the meeting. It was moved by Councilman Friess, seconded by Councilman

SITUATION•
The City has contracted with Nibardo Gomez for the past several
years for the provision of human relations assistance and housing
inspection assistance. Mr. Gomez ' current contract expired October
31, 1992 , but has been extended through the present date by letter
agreement. In order for the City to continue the relationship that
has been established and allow it to grow to meet current needs of
the targeted population, it is necessary for a new contract to be
approved. The proposed new contract is attached for consideration
at this time.
The services provided by Mr. Gomez are in response to the Human
Relations element of the comprehensive Neighborhood Preservation
Program. This overall program was submitted for your approval
October 20, 1992 . The Scope of Work provided for in the attached
agreement differs from the scope of work previously completed by
Mr. Gomez, in that housing and code inspection tasks have been
deleted. These functions will be provided through the Housing
Specialist position which staff is in the process of creating. The
approval of this position will be brought before the City Council
in the future.
The proposed term of the attached contract has been revised. The
new contract is proposed to run until June 30, 1993 . This is a
shorter time frame than that which was previously approved. This
change in term will allow the contract and our human relations
program to be reviewed concurrently with the City' s budget process.
The proposed contract maintains the Department of Community
Services as the point of contact and liaison with Mr. Gomez. This

is consistent with the City's desire to expand overall program
emphasis on human services and services and programs for targeted
or "at risk" populations. Al King, Jr. , our Director of Community
Services will provide overall management of the contract.

FINANCIAL CONSIDERATIONS:
The contract provides for payment in the amount of $3 , 200 per
month. Funds to provide for the contract have been included in the
1992-93 Human Services Division budget of the Department of
Community Services. The contract reflects no increase in cost from
last year.
