PERSONAL SERVICES AGREEMENT
�TH'�ISAQ��GREEMENT is made and entered into this day of
lc2004, by and between the City of San Juan Capistrano
(hereinafter referred to as the "City") and LAN Engineering
{hereinafter referred to as "Consultant").
RECITALS:
WHEREAS, City desires to retain the services of Consultant regarding the City's
proposal to provide Engineering/Building Plan Check, Engineering, and Architectural
Services; and
WHEREAS, Consultant is qualified by virtue of experience, training, education
and expertise to accomplish such services.
NOW, THEREFORE, City and Consultant mutually agree as follows:
Section 1. Scope of Work.
The scope of work to be performed by Consultant shall consist of those tasks as
set forth in Exhibit "A," attached and incorporated herein by reference.
Consultant warrants that all of its services shall be performed in a competent,
professional and satisfactory manner and in accordance with the prevalent standards of
its profession.
Section 2. Term.
This Agreement shall commence on the effective date of this Agreement by all
parties. This Agreement shall be for a three-year (3 -year) period of time with two one-
year extensions. Agreement extensions shall be based on staff review of Consultant
performance. The Agreement shall terminate December 31, 2007.

Section 3. Compensation.
3.1 Consultant contract billings may be submitted on the consultant's
forms and, at a minimum, should contain the following:
Title or project(s)
Purchase order number
Total approved purchase order amount
Amount paid to date
Amount requested
Amount remaining on purchase order
Breakdown of amounts by project type or account number
Total cost to City for Consultant's fees shall not exceed $50,000 per
project proposal for each annual period. The amount stipulated above is not a
guarantee by the City to Consultant that said amount will be received by Consultant.
Rather, it represents the maximum authorization permitted without further Council
approval. Consultant may not, dependent upon availability of projects, receive any
work. The City shall issue purchase orders equal to the anticipated Consultant fees on
a project basis, which shall constitute Consultant's authorization to proceed. Consultant
fees will be billed based on the hourly rate schedule in Exhibit B, up to the stipulated
amount agreed to either as stipulated by the plan check fee schedule in Exhibit A or as
agreed to in writing.
3.2 Method of Payment.
Consultant shall submit monthly invoices, clearly indicating the monthly
period for which the billing is made. These invoices should be submitted to: City of San
Juan Capistrano, Attention: Engineering Department (City Project Manager) 32400
Paseo Adelanto, San Juan Capistrano, CA 92675.
For extra work not part of this Agreement, a written authorization from City
is required prior to Consultant undertaking any extra work.
3.4 Records of Expenses.
Consultant shall keep complete and accurate records of all costs and
expenses incidental to services covered by this Agreement. These records will be
made available at reasonable times to City.
Section 4. Independent Contractor.
Itis agreed that Consultant shall act and be an independent contractor and not
an agent or employee of City, and shall obtain no rights to any benefits which accrue to
City's employees.
Section 5. Limitations Upon Subcontracting and Assignment.
The experience, knowledge, capability and reputation of Consultant, its principals
and employees were a substantial inducement for City to enter into this Agreement.
Consultant shall- not contract with any other entity to perform the services required
without written approval of the City. This Agreement may not be assigned, voluntarily or
by operation of law, without the prior written approval of the City. If Consultant is
permitted to subcontract any part of this Agreement by City, Consultant shall be
responsible to City for the acts and omissions of its subcontractor as it is for persons
directly employed. Nothing contained in this Agreement shall create any contractual
relationships between any subcontractor and City. All persons engaged in the work will
be considered employees of Consultant. City will deal directly with and will make all
payments to Consultant.
Section 6. Changes to Scope of Work.
In the event of a change in the Scope of Work provided for in the contract
documents as requested by the City, the Parties hereto shall execute an addendum to
this Agreement setting forth with particularity all terms of the new agreement, including
but not limited to any additional Consultant's fees.
Section 7. Familiarity with Work and Construction Site.
By executing this Agreement, Consultant warrants that: (1) it has investigated
the work to be performed; (2) it has investigated the proposed construction site,
including the location of all utilities, and is aware of all conditions there; and (3) it
understands the facilities, difficulties and restrictions of the work under this Agreement.
Should Consultant discover any latent or unknown conditions materially differing from
those inherent in the work or as represented by City, it shall immediately inform City of
this and shall not proceed with further work under this Agreement until written
instructions are received from the City.
Section 8. Time of Essence.
Time is of the essence in the performance of this Agreement.

Section 9. Compliance with Law.
Consultant shall comply with all applicable laws, ordinances, codes and
regulations of federal, state and local government.
Section 10. Conflicts of Interest.
Consultant covenants that it presently has no interest and shall not acquire any
interest, direct or indirect, which would conflict in any manner or degree with the
performance of the services contemplated by this Agreement. No person having such
interest shall be employed by or associated with Consultant.
Section 11. Copies of Work Product.
At the completion of the contract period, Consultant shall have delivered to City
at least one (1) copy of any final reports and architectural drawings containing
Consultant's findings, conclusions, and recommendations with any support
documentation. All reports submitted to the City shall be in reproducible format.
All services to be rendered hereunder shall be subject to the direction and
approval of the City.
Section 12. Ownership of Documents.
All reports, information, data and exhibits prepared or assembled by Consultant
in connection with the performance of its services pursuant to this Agreement are
confidential to the extent permitted by law, and Consultant agrees that they shall not be
made available to any individual or organization without prior written consent of the City.
All such reports, information, data, and exhibits shall be the property of the City and
shall be delivered to the City upon demand without additional costs or expense to the
City. The City acknowledges such documents are instruments of Consultant's
professional services.
Section 13. Indemnity.
Consultant agrees to protect, defend and hold harmless City, its elected and
appointed officials and employees from any and all claims, liabilities, expenses or
damages of any nature, including attorneys' fees, for injury or death of any person or
damage to property or interference with use of property and for errors and omissions
committed by Consultant arising out of or in connection with the work, operation or
activities of Consultant, its agents, employees and subcontractors in carrying out its
obligations under this Agreement.

Section 14. Insurance.
Insurance required herein shall be provided by Admitted Insurers in good
standing with the State of California and having a minimum Best's Guide Rating of A -
Class VII or better.
14.1 Comprehensive General Liability.
Throughout the term of this Agreement, Consultant shall maintain in full
force and effect Comprehensive General Liability coverage in the following minimum
amounts:
$500,000 property damage;
$500,000 injury to one person/any one occurrence/not limited to
contractual period;
$1,000,000 injury to more than one person/any one occurrence/not limited
to contractual period.
14.2 Comprehensive Automobile Liability.
Throughout the term of this Agreement, Consultant shall maintain in full
force and effect Comprehensive Automobile Liability coverage, including owned, hired
and non -owned vehicles in the following minimum amounts:
$500,000 property damage;
$500,000 injury to one person/any one occurrence/not limited to
contractual period;
$1,000,000 injury to more than one person/any one occurrence/not limited
to contractual period
14.3 Worker's Compensation.
If Consultant intends to employ employees to perform services under this
Agreement, Consultant shall obtain and maintain, during the term of this Agreement,
Worker's Compensation Employer's Liability Insurance in the statutory amount as
required by state law.

14.4 Proof of Insurance Requirements/Endorsement.
Prior to beginning any work under this Agreement, Consultant shall submit
the insurance certificates, including the deductible or self -retention amount, and an
additional insured endorsement to the Consultant's general liability and umbrella liability
policies using ISO form CG 20 10 11 85 (in no event with an edition date later than
1990) to the City's General Counsel for certification that the insurance requirements of
this Agreement have been satisfied.
14.5 Errors and Omissions Coverage
Thfoughout the term of this Agreement, Consultant shall maintain Errors
and Omissions Coverage (professional liability coverage) in an amount of not less than
One Million Dollars ($1,000,000). Prior to beginning any work under this Agreement,
Consultant shall submit an insurance certificate to the City's General Counsel for
certification that the insurance requirements of this Agreement have been satisfied.
14.6 Notice of Cancellation/Termination of Insurance.
The above policy/policies shall not terminate, nor shall they be cancelled,
nor the coverages reduced, until after thirty (30) days' written notice is given to City,
except that ten (10) days' notice shall be given if there is a cancellation due to failure to
pay a premium.
14.7 Terms of Compensation.
Consultant shall not receive any compensation until all insurance
provisions have been satisfied.
14.8 Notice to Proceed.
Consultant shall not proceed with any work under this Agreement until the
City has issued a written "Notice to Proceed" verifying that Consultant has complied
with all insurance requirements of this Agreement.
Section 15. Termination.
City and Consultant shall have the right to terminate this Agreement without
cause by giving thirty (30) days' advance written notice of termination to the other party
In addition, this Agreement may be terminated for cause by providing ten (10)
days' notice to the other party of a material breach of contract. If the other party does
not cure the breach of contract, then the agreement may be terminated subsequent to
the ten (10) day cure period.

Section 16. Notice.
All notices shall be personally delivered or mailed to the below listed addresses,
or to such other addresses as may be designated by written notice. These addresses
shall be used for delivery of service of process:

Section 17. Attorneys' Fees.
If any action at law or in equity is necessary to enforce or interpret the terms of
this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs
and necessary disbursements in addition to any other relief to which he may be entitled.
Section 18. Dispute Resolution.
In the event of a dispute arising between the parties regarding performance or
interpretation of this Agreement, the dispute shall be resolved by binding arbitration
under the auspices of the Judicial Arbitration and Mediation Service ("JAMS").
Section 19. Entire Agreement.
This Agreement constitutes the entire understanding and agreement between the
parties and supersedes all previous negotiations between them pertaining to the subject
matter thereof.

CHECKING, ENGINEERING AND ARCHITECTURAL SERVICES
GENERAL INFORMATION
It is the intent of the City of San Juan Capistrano, Department of Engineering & Building,
to establish a team of consultants to facilitate both building and engineering plan check,
engineering and architectural services. The services are generally described herein and
are intended to supplement staffs efforts where specific expertise is required or time
constraints necessitate consultant assistance. From the proposals, a team of consultants
will be selected who best represent expertise across the various specialty areas. The team
will become part of a four-year program in which the work load will be spread among the
team members. Work will be parceled out on an as -needed basis, and no specific
guarantee can be given as to the annual fees for consultant usage.
The consultant team will only be modified in the event consultants are dropped from the
list due to corporate changes or it is deemed by the City that additional consultants are
warranted.
INVITATION TO RESPOND
The Cityof San Juan Capistrano is soliciting proposals for professional consulting services.
In general, the tasks identified above and delineated herein are to be performed with
minimum direction and assistance from the City.

SUBMISSION OF PROPOSAL
Proposals may by submitted by mail or hand delivered. Proposals should be delivered to:

no later than 5:00 p.m., September 21, 2001. Proposals will not be accepted after this
time.
FORM OF PROPOSAL
Consultant proposals shall contain the following:
Statement of qualifications clearly indicating the services in which the firm is
interested;
2. Statement/discussion of services provided, including anticipated turnaround times and
ability of firm to handle requests on an as -needed basis;
3. Resumes of key personnel for various service areas;
4. Consultant fee schedules, including hourly rates and proposed flat fees;
5. Completed consultant self rating form included with this request for proposal.
EVALUATION OF PROPOSALS
The City of San Juan Capistrano is interested in selecting consultants who have the
experience and expertise to render plan checking, engineering and architectural services
in a comprehensive and timely manner. Accordingly, the evaluation criteria will consist
primarily of four parts:
1. Consultants' experience
2. Consultants' expertise
3. Consultants' ability to handle volume and meet time frames
4. Consultants' costs

It is important to the City that you identify the persons you will assign to various functions,
at which office they are assigned and whether they are full-time employees of your firm.
You should also address any conflict of interest that may exist and comment on solutions.
The City of San Juan Capistrano reserves the right to reject any and all proposals.
Nonacceptance of any proposal will not imply criticism , `the proposal orthat any proposed
service was deficient. All participating candidates will be notified of the decision reached.
CONSULTANT'S RESPONSIBILITY
The Consultant shall perform the tasks as set forth herein:
A. Building Services
Review construction documents in accordance with the following uniform model
codes as amended by City ordinance.

b. Uniform Plumbing Code - 1998 California Plumbing Code

2. Provide a comprehensive plan review as directed or provide only specified plan
review elements as follows:
a. Structural review and analysis of design and calculations
b. Inspection services
c. Other building services as may be defined
3. Provide geotechnical review and consultation regarding soil problems, features
or events.
B. Engineering/Architectural Services
Review construction documents and subdivision maps in conformance with the
following standards:
a. City of San Juan Capistrano Municipal Code
b. City of San Juan Capistrano and County of Orange applicable design
standards
c. Highway Design Manual standards
d. San Diego Regional Water Quality Control Permit

Render and remit a typed plan check correction/clarification list (two copies) to
the Engineering & Building Department within 10 working days from notification
by the City.
2. Engineering/Architectural Services
Complete services in a thorough and efficient manner, on time and within the
approved fee schedule.

E. Fee Schedules
Engineering Fees
a. Plan Check
Engineering fees will be determined for plan check services based on the
attached fee schedule. The consultant shall bill on an hourly basis, not to
exceed 75% of the total fee, and fees may be negotiated lower if, in the
determination of the City, a lower tee is warranted.
b. Design/Architectural
Services will be negotiated on a project -by -project basis based on a pre -
agreed scope of work. Payment will be as determined by the City project
manager.
2. Building Fees
a. Plan Check
Total plan check at 80% of base plan check fee paid by applicant not
including any surcharges (base plan check fee). Base plan check fee will be
65% of building permit fee, not including surcharges.
Structural plan check is not to exceed 60% of base plan check fee, not
including any surcharges.
b. Other Services
Services will be negotiated on a project -by -project basis based on a pre -
agreed scope of work. Payment will be as determined by the City project
manager.
F. Maintenance of Records
The consultant will maintain all books, documents, papers, employee time sheets,
accounting records/ledgers and other evidence pertaining to costs incurred and shall
make such materials available at their respective offices at all reasonable times
during the contract period and for three years from the date of final payment for
inspection by the City. The consultant shall furnish copies, if requested.

CITY'S RESPONSIBILITY
The City shall perform the tasks as set forth herein:
A. Establishment of Valuation (Plan Check Services Only)
Assign a valuation to the proposed work in accordance with the appropriate
Engineering or Building Division standards. The City shall collect all fees from the
applicant in connection with the services.
B. Project submittals
City will supply all necessary documentation/specifications, reports, studies,
calculations, etc., to Consultant as is readily available at the City.
C. Coordination
City will serve as project coordinator. On plan checking, the City will be responsible
for notifying the applicant when plans with corrections are available to pick up. The
City will route plans (preliminary/revised) to and from the Consultant.
SELECTION PROCESS
The Selection Committee, comprised of the Engineering & Building Director, Development
Services Manager and two Senior Engineers, will review the proposals submitted.
Candidates will be selected based on the proposals submitted, including qualifications of
staff, proposed fee schedules and ability to handle work load in a timely manner.

Consultants are asked to rate their expertise in the various fields listed below. The
information will be used by Staff in selecting consultants on specific types of work.
Consultants may rate themselves high on more than one category, but should not rate the
same in more than three categories. Building plan check and Engineering plan check are
considered separate services and should be rated independent of one another.
On a scale of 1 to 10, rate yourself with "1" being yoor strongest area of expertise and "10"
being a competent area of expertise. "N" or no rating will indicate no interest or company

SUBJECT: Consideration of Design Concept for Del Obispo Street Widening at Calle
Aspero (CIP No. 102)
RECOMMENDATION
By motion, approve the design concept for Capital Improvement Project No 102, Del
Obispo Street Widening at Calle Aspero and authorize Staff to complete the design.
SITUATION:
Summary and Recommendation:
This project consists of proposed widening along the west side of Del Obispo Street in
the vicinity of Calle Aspero in accordance with the City's General Plan Circulation
Element and Parks and Recreation Element. The improvements have been modified in
accordance with City Council direction September 6, 2005. Staff is recommending that
City Council approve the design concept, and authorize staff to complete the project
design. A copy of the plans is available for review in the City Clerk's Office. A copy has
also been placed in the City Council office.
Background
At the September 16, 2003 meeting, City Council adopted the Traffic Congestion Relief
Capital Improvement Program from the Traffic Congestion Relief Ad -Hoc Committee.
This project is ranked number 3 in priority in the City's Traffic Congestion Relief
Program. Future widening of Del Obispo Street to four lanes is a City of San Juan
Capistrano proposed project of the Measure M Investment Plan. The Measure M
Investment Plan will form the basis of the future ballot measure to extend Measure M
funding for circulation projects.
The proposed project consists of widening improvements to Del Obispo Street from 300
feet south of Calle Aspero to 400 feet north of Calle Aspero consistent with the General
Plan Circulation Element and Parks and Recreation Element. The project right of way
fronts the Cobblestone Development to the south of Calle Aspero and Logan property
(Assessor Parcel No. 649-082-23) to the north. The proposed widening is located
wholly within the City's existing public right of way area and does not require any private
property acquisitions. The widening of Del Obispo Street will provide for four travel
lanes and Class 2 bicycle lane. The proposed project will require modification to the
existing traffic signal to align the signal in conjunction with street improvements and will
provide a separate left turn phase. The project also includes landscaping,_

City Council reviewed the project at the September 6, 2005 City Council meeting and
directed Staff to provide for four vehicular lanes, a striped bike lane, as originally
proposed and to return with a revised design, eliminating a proposed sidewalk; and
reducing the height of the proposed retaining wall by bringing it closer to the street.
Additionally analysis of incorporating signalized, protected left turns from Del Obispo
Street to Calle Aspero was requested and is included in this report.
Design Modifications
• The proposed sidewalk has been retained on Del Obispo Street south of Calle
Aspero only to access the existing OCTA bus stop.
• Additional landscaping is proposed on Del Obispo Street south of the bus stop
consisting of ground cover and three California Sycamores.
• The proposed sidewalk has been eliminated on Del Obispo Street north of Calle
Aspero.
• The proposed retaining wall has been brought forward, closer to Del Obispo
Street which has reduced the visible height from approximately nine (9) feet
maximum to approximately six (6) feet.
Signal Analysis
A separate left turn phase is a requested improvement by residents of the Calle Aspero
neighborhood and is recommended by Staff to be included with this construction project
as signal modifications are necessary due to the street work and are funded in the
MPAH grant. A Collision History January 2002 through June 2005 is provided as
Attachment 2. This shows a total of 5 injury collisions with 7 individual casualties and 13
non -injury collisions.
The potential for bringing the signal improvements forward as a separate project was
reviewed. The construction relationship between street work, signal and signal
controller and existing trees make it impractical to separate the signal work out of the
project. Staff recommends that traffic signal alterations to provide a separate left turn
phase should be retained as part of this project.
COMMISSIONS/BOARD REVIEW, RECOMMENDATIONS
The City's Environmental Administrator has determined this project to be Categorically
Exempt.
The project was reviewed by the Parks Recreation and Equestrian Commission
February 28, 2005. The Commission reaffirmed the public desirability of Class 2 bike
lanes in this location.
The Design Review Committee reviewed the project March 3, 2005. The Committee's
recommendations regarding the retaining wall and landscaping have been incorporated

into the project plans. These design concepts were acceptable to the Planning
Commission at its review of July 26, 2005.
The Planning Commission reviewed the project July 26, 2005 and deferred any
recommendation on the project.
City Council reviewed the project at the September 6, 2005 City Council meeting and
directed Staff to return with a revised design to provide for four vehicular lanes, a
striped bike lane, and eliminating a proposed sidewalk; and to provide analysis of
incorporating signalized, protected left turns from Del Obispo Street to Calle Aspero.
FINANCIAL CONSIDERATIONS
The construction cost for the project as presented in September is estimated at
$493,000. A Master Plan of Arterial Highways (MPAH) Grant in the amount of $202,000
is available. The sunset date for this grant is June 30, 2006 for award of construction.
Staff has requested an extension up to two year to June 30, 2008 to accommodate
additional review. Other funding is from the City's Capistrano Circulation Fee Program
(CCFP) fund.

By motion, approve the design concept for Capital Improvement Project No. 102, Del
Obispo Street Widening and authorize Staff to complete the design.
This recommendation differs from that of the Planning Commission which did not
endorse the project but recommended that City Council authorize staff to work
with the Planning Commission in evaluating design treatments for street
widening projects city-wide and develop alternative designs more in keeping with
the community's rural character, reporting back to City Council before final
decision on this CIP within the time frame for the grant.
SITUATION:
Summary and Recommendation:
This project consists of proposed widening along the west side of Del Obispo Street in
the vicinity of Calle Aspero in accordance with the City's General Plan Circulation
Element and Parks and Recreation Element. The improvements include pavement
widening, Class 2 bicycle lane (5' wide on street), curb and gutter, sidewalk, and
accessory improvements. Staff is recommending that City Council approve the design
concept, and authorize staff to complete the project design. A copy of the plans is
available for review in the City Clerk's Office. A copy has also been placed in the City
Council office.
Background
At the September 16, 2003 meeting, City Council adopted the Traffic Congestion Relief
Capital Improvement Program from the Traffic Congestion Relief Ad -Hoc Committee.
This project is ranked number 3 in priority in the City's Traffic Congestion Relief
Program. Future widening of Del Obispo Street to four lanes is a City of San Juan
Capistrano proposed project of the Measure M Investment Plan. The Measure M
Investment Plan will form the basis of the future ballot measure to extend Measure M
funding for circulation projects.

The proposed project consists of widening improvements to Del Obispo Street from 300
feet south of Calle Aspero to 400 feet north of Calle Aspero consistent with the General
Plan Circulation Element and Parks and Recreation Element. The project right of way
fronts the Cobblestone Development to the south of Calle Aspero and Logan property
(Assessor Parcel No. 649-082-23) to the north. The proposed widening is located
wholly within the City's existing public right of way area and does not require any private
property acquisitions. The widening of Del Obispo Street will provide for a new
pedestrian sidewalk, wheelchair ramp access at the intersection corners, curbs and
gutter and Class 2 bicycle lane. The proposed project will require modification to the
existing traffic signal to align the signal in conjunction with street improvements and will
provide a separate left turn phase. A separate left turn phase is a requested
improvement by residents of the Calle Aspero neighborhood. The project also includes
landscaping.
Issues
General Plan Circulation Element
Del Obispo Street is designated a Secondary Arterial Highway as shown in
Attachment 2, Figure C-2 'Arterial Highway System' of the City's General Plan
which is consistent with the County's Master Plan of Arterial Highways (MPAH).
Existing curb to curb width of Del Obispo Street at Calle Aspero is 64 feet, the
standard width of a Secondary Arterial Highway.
Recreation Issues
Figure PR -1 'Parks and Recreational Facilities' of the City's General Plan
(Attachment 3) requires a Bike Lane Class 2 on this part of Del Obispo Street.
A Class 2 Bike Lane along Del Obispo Street is an important regional facility. This
facility already exists from Alipaz Street to the South City limit and beyond into
Dana Point and Pacific Coast Highway. Ultimately with the widening of the Del
Obispo Street Bridge over Trabuco Creek and the construction of the Vereda
Bikeway undercrossing of the railroad, the Del Obispo Street Class 2 Bike Lane
will continue across the Trabuco Creek Bridge and connect to the County Master
Plan Bike Trail along Trabuco Creek and San Juan Creek.
This will require additional curb to curb width to accommodate this facility
additional to the Secondary Arterial Highway requirement. Preliminary project
plans considered providing a Bike Path Class 1. This would have left the existing
curb returns intact.

Review of other recent projects by the City's Parks, Recreation and Equestrian
Commission has reaffirmed the general public preference for Class 2 bike lanes,
5-0" wide, on -street, consistent with the City's General Plan.
A set of the proposed project plans were provided to the adjacent property owner,
Mr. Garfield Logan. Mr. Logan expressed several concerns related to the widening
of Del Obispo Street, with the Class 2 bike lane as the basis for many of Mr.
Logan's concerns (see Attachment 4, September 1, 2004 Logan Comment Letter).
The City responded to Mr. Logan's issues by letter dated September 13, 2004 and
explained the history of efforts to widen Del Obispo Street; the need to comply with
the General Plan in implementing street improvements, and the currently available
grant funding (see Attachment 5). Mr. Logan commented again September 16,
2004, (Attachment 6) particularly requesting the procedure for making a formal
objection. Mr. Logan has been informed by staff that this meeting will provide such
an opportunity.
Pedestrian Issues
The project proposes full parkway improvements including sidewalk. Mr. Logan's
September 1, 2004 letter questions the missing sidewalk linkage to the north of his
property (Attachment 4). Staff is aware of this missing segment and could pursue
that improvement as a separate project. Because the missing sidewalk will require
acquisition of right of way and construction of a retaining wall, this improvement
requires a lengthier timeline than provided by the current grant funding for this
project. The construction grant of $202,000 for the widening in front of Mr. Logan's
property and the Cobblestone development requires award of construction
contract prior to June 30, 2006. Staff has, therefore, pursued project approval for
the original project to ensure the grant is not lost. On completion of the sidewalk
proposed in this project north of Calle Aspero only 100 feet of the sidewalk
between Aguacate Road and Calle Aspero will be required to complete this
pedestrian linkage.
Sidewalk proposed south of Calle Aspero will access the existing OCTA bus stop.
Utility Conversion
At the July 6, 2004 meeting, City Council adopted a Revised Priority List of Public
Utilities Commission (PUC) Rule 20A Underground Utility District Conversions.
Priority No. 2 was on Del Obispo Street from North of Calle Aspero to Aguacate
Road. The priority revisions were made so this undergrounding could be included
in the construction project. Staff will seek separate approval for this work.
Design of the utility conversion project started with the formation of the district on
August 16, 2005 by Resolution No. 05-08-16-01.

Trees
Four mature jacaranda trees exist, two on each corner of the Calle Aspero/ Del
Obispo Street intersection. One of these is impacted by the need to reconstruct
the intersection curb returns to accommodate the project widening for the Class
2 bike trail. An arborist's report has been prepared (Attachment 7) which
indicates that this tree can be boxed and moved the five feet or so necessary for
its preservation.
COMMISSIONS/BOARD REVIEW, RECOMMENDATIONS
The City's Environmental Administrator has determined this project to be Categorically
Exempt.
The project was reviewed by the Parks Recreation and Equestrian Commission
February 28, 2005. The Commission reaffirmed the public desirability of Class 2 bike
lanes in this location.
The Design Review Committee reviewed the project March 3, 2005. The Committee's
recommendations regarding the retaining wall and landscaping have been incorporated
into the project plans. These design concepts were acceptable to the Planning
Commission at its review of July 26, 2005.
The Planning Commission was concerned at the potential impacts of continuing the
implementation of the City's General Plan Circulation Element and Parks and
Recreation Element further north to Aguacate Road. The Commission did not endorse
the project but recommended that City Council authorize staff to work with the Planning
Commission in evaluating design treatments for street widening projects city-wide and
develop alternative designs more in keeping with the community's rural character,
reporting back to City Council before final decision on this CIP within the time frame for
the grant.
Staff does not agree that a design issue in keeping with the community's rural character
exists. Staff has already addressed those design issues regarding the retaining wall and
landscaping as recommended by the Design Review Committee. The Planning
Commission and Mr. Logan are satisfied with those issues. The remaining issue is the
location of the street curb.
Staff believes that a city-wide review of design treatments for street widening projects
and development of alternative designs more in keeping with the community's rural
character will be an extensive project. Other priorities and Staff commitments will likely
take precedence and it will not be possible to report back to City Council for a final
decision on this CIP within a short time frame. Such design standards are already

established in Chapter 5 of Title 7 of the Municipal Code. The City Engineer is
authorized to grant deviations from these standards, where strict adherence to them
would be impractical or unreasonable.
This issue is a General Plan Circulation Element and Parks and Recreation Element
issue regarding the location of the Del Obispo Street curb. A General Plan amendment
would be necessary to change these elements. No recommendation has been made for
a General Plan amendment.
No specific objection has been made to the provision of the Bike Lane Class 2 on this
part of Del Obispo Street as shown in Figure PR -1 'Parks and Recreational Facilities' of
the City's General Plan (Attachment 3). This element has been endorsed by the Parks
Recreation and Equestrian Commission February 28, 2005.
No specific objection has been made to widening Del Obispo Street to a Secondary
Arterial Highway, Figure C-2 'Arterial Highway System' of the City's General Plan
(Attachment 2). Future widening of Del Obispo Street to four lanes is a City Proposed
Project of the Measure M Investment Plan.
The option to do interim widening with the curb set at 32 feet is available to City
Council. The signals could be set for ultimate (37 feet) widening whether or not such
widening is performed. There is a potential issue with the grant funding with this
approach, as full improvements are not being constructed. The continuity of the bike
lane would still be retained at this time with this approach. This avoids any existing tree
conflicts. The location of the proposed wall remains unchanged.
ALTERNATE ACTIONS
1. Approve the design concept for Capital Improvement Project No 102, Del Obispo
Street Widening as submitted and authorize Staff to complete the design.
2. Modify the design concept for Capital Improvement Project No 102, Del Obispo
Street Widening to interim improvements at City Council discretion and authorize
Staff to complete the design. This may negatively impact the project grant.
FINANCIAL CONSIDERATIONS
The construction cost is estimated at $493,000 and scheduled for 2006. A Master Plan
of Arterial Highways (MPAH) Grant in the amount of $202,000 is available. The sunset
date for this grant is June 30, 2006 for award of construction. Staff has requested a two
year extension to June 30, 2008 in light of the Planning Commission recommendation.
Other funding is from the City's Capistrano Circulation Fee Program (CCFP) fund.

Dear Bryan:
Thanks for sending me a copy of the revised preliminary concept plans for the planned street
improvements in front of my house. -
I am enclosing the plans you sent with my notations thereon indicating the changes t would
like to see.
1 see no purpose to widening the street an additional five (5) feet beyond the existing curb
line at the corner of Aspera and Del Obispo and the terminus of existing curb just to the north of
my property. Simply extending the existing curb and gutter will be considerably less costl}'
because it will not require relocating all the existing public improvements at the corner.
Moreover, the additional widening serves no useful purpose. It would be .financially impractical
if not physically impossible, to widen Del Obispo to two lanes southbound all the way back to
Aguacate. Consequently, the only portion of the roadway, which would be two lane, would be
for the proposed seven hundred (700) feet. Moreover, there is no need for a dedicated right hand
turn lane. I can attest there is no right turn vehicle stacking problem presently, and there is no
possibility of significant further development accessed by Aspero.
Furthermore, extending the road widening an additional five (5) feet will cause several
construction and aesthetic problems as follows:
1. It will make protecting in place the existing Jacarandas at the corner almost impossible
due to grade change.
2. It will necessitate a much higher retaining wall.
3. It will require removal of almost the entire existing dry stack stone wall.

Elimination of the •ting Jacarandas and creation of a nine (*ot high retaining wall will
be most unattractive.
In sum, the aesthetic cost and financial cost to create an unnecessary additional five (5) feet
of street surface is an exceedingly bad trade off. The modifications I have proposed will cost the
City much less in terms of dollars expended and physical appearance.
Lastly, the funds saved could be utilized to improve the public way on Del Obispo, to the
north of my property. Under the plans you sent me there appears to be no sidewalk to the north.
The existing sidewalk ends at the driveway to the north. Thus, for pedestrian traffic one must
leave the sidewalk at terminus, Walk in the street for about 250 feet, then turn right to reenter
about ten feet of sidewalk (at the north end of my property), then cross my driveway to reenter
sidewalk again. This is a ridiculous design. Under my proposal the sidewalk would connect
continuously from its current terminus all the way to the corner of Aspero.
I am very cornered about this and I hope my comments and modifications will be well
received. In the event they are not i would like to be informed at your very earliest opportunity
and advised what, if any are my rights to appeal or object prior to the project proceeding.

Thank you for your comments on the revised preliminary concept plans in your letter of
September 1, 2004. The City's project is intended to widen Del Obispo Street to its
ultimate configuration along your frontage and the Cobblestone frontage.
The City's efforts to widen the west side of Del Obispo Street date back to at least 1987
when the City retained consultant Fuscoe, Williams, Lundgren & Short to design the
widening. The consultant prepared preliminary widening plans but design efforts were
terminated in May 1991 due to a shortfall in project funding.
When construction of Stonehill Drive started in April 1991, a reduction of traffic on Del
Obispo Street was anticipated, and this was realized in February 1992 when Stonehill
Drive opened. However, traffic has steadily increased since that time.
The City obtained $1.3 million in grants for construction and right of way, and in
November 1997 design RFP's were sent out and responses reviewed but in April 1999
the City decided not to proceed as it could not match the grant funds.
In 2000 the City obtained right of way in front of your property. In 2002, Cobblestone
Development dedicated right of way on Tract Map 15701 south of Calle Aspero, but
were not required to construct frontage improvements per the June 1991 settlement
agreement with the former owner Carlos Romer.

With right of way in place, the City applied for and received design and construction
funding in 2002 to complete these frontage improvements and retained LAN
Engineering at the start of the 2003-2004 Fiscal Year once funding was in place.
The implementation of Del Obispo Street improvements can be anticipated to take
many years involving both projects by developers and by the City.
The following responses are provided specific to your letter:
1. The City's General Plan designates Del Obispo Street as a Secondary Arterial
Highway (four lanes, undivided) in its Circulation Element. The Parks and
Recreation Element also provides for a bike lane, Class 2, on Del Obispo Street.
In reviewing recent development projects, the City's Parks, Recreation and
Equestrian Commission has reaffirmed the public desirability of Class 2 bike lanes.
Particularly relevant to Del Obispo Street has been the review of the Belladonna
project to the south.
In revising the preliminary plans from a Class 1 bike path, the City is retaining
consistency of bicycle facilities along Del Obispo Street where southbound Class 2
bike lane currently exists from Alipaz Street to the south City limit.
2. The southbound right tum lane is provided as an interim condition. As you are
aware, Del Obispo Street is not fully improved to the south. In the ultimate
condition, the right turn lane at Calle Aspero will become a through lane. This is
not possible at this time.
3. Although the design is not fully developed, it appears that at least some of the
jacarandas will be impacted.
4. The height of the proposed retaining wall will not change, as stated in my
August 19, 2004 letter to you.
5. The City's Building Official has advised me that a wall such as the dry stack stone,
if less than three feet high, does not require a building permit. The wall, however,
is non -engineered, encroaches into the City right of way, was constructed without
an encroachment permit and conflicts with the City's proposed improvements.
6. My letter of May 10, 2004 included the following: "Please note particularly the
following: The retaining wall show is within Parcel B, the temporary construction
and slope easement. It is normal City practice to make such walls private property
following construction. You can see that this was the case to the south of Calle
Aspero. An alternative approach would be, rather than construct a wall, to cut back
a slope."

Dear Brian:
I am in receipt of your September 13, 2004 letter. To answer your inquiry unequivocally I
believe a stone -faced retaining wall is preferable to a cut slope.
With that issue clarified I would like to revisit some of my September 1, 2004 suggestions in
light of your comments.
1. Putting more traffic on Del Obispo is pointless.
First, the City does not have a right of way, nor does it have any realistic
prospect of obtaining a right of way on the west side of Del Obispo in order to
widen the street to four lanes. So, it will never be a continuous four -lane road.
Secondly, at high traffic periods there is no possibility of moving traffic
any faster through town. Del Obispo is four -lane from Aguacate to Ortega, yet,
the signals through that area operate at an F level during peek demand.
2. Since there is no possibility of having a four -lane roadway to the north
of my property making the currently proposed right turn lane a thorough lane
accomplishes nothing.
I do not understand why it is not obvious to you that unless the road can
be a continuous four lane there is no improvement in traffic flow. Furthermore,
since there is such a poor throughput where there currently are four lanes even
having the four lanes will not improve traffic flow.
3. The historic trees of San Juan Capistrano are an important part of our
town heritage. The four large Jacarandas that will most certainly be destroyed
would be a significant loss.

Dear Mr. Lara:
Thank you for asking me to provide arboricultural evaluation of two jacaranda trees at Calle
Espero and Del Obispo, describe their health and suitability for transplanting, other related
professional opinions, and report back to you.
Observations
The two jacarandas are very close to the comer of Calle Espero and Del Obispo. The more
northward tree is four feet from the curb and three feet from the traffic control box and concrete
base. It has a 14 inch diameter trunk and is in good health and balance. The structure is above
average, but codominant and slightly lion -tailed.
The more westward tree is five feet from the curb and one scaffold limb rests on the traffic
signal. Two of the main scaffold limbs are crossing and fused. It has a 12.5 inch diameter trunk
and is also in good health and balance, though the structure is not as good.
Analysis
The transplanting of large trees is a risky and costly procedure. Typically, the cost is
about sixty percent of a new tree. If there will be additional expenses for traffic control,
long-term storage during construction, or guarantees the cost maybe very near their
value. The value is reduced in this case due to minor structural defects, but they are still
healthy and valuable trees. The only point being that the cost to value ratio may be
getting nearly to equal.
The boxing procedure should be performed during the warm months, anytime from now
to September - the sooner the better. There should be a nearby flat area with a reliable
sources of water to setup a temporary drip system until they are replanted. The system
can be controlled with a battery operated timer fairly inexpensively, but hand watering
will probably not be reliable enough.

Expertise in boxing and handling large trees is essential. Most landscape contractors are
not capable of doing this work. There is no equivalent methods to compare with boxing.
Tree spades have much poorer results. Select a tree moving contractor from Valley Crest,
Senna Tree, or Tree Relocation Experts. I will supply contact information if requested.
These companies would also be the best to maintain the trees until they are replanted. If
they will be replanted immediately, they should be hired to provide maintenance for at
least three months after. A regular irrigation system must be installed after they are
replanted. The entire 96" square surface of the box should remain uncovered by concrete
and protected from compaction and pollution during the remainder of construction. Also
provide trunk and limb protection. A watering basin should be constructed around the
rootball edge and the soil surface inside the basin covered with a 3" deep layer of well -
composted, coarse-textured organic mulch (not bark).
These trees should be dug as 96" boxes, as a minimum This will require the removal of
the curb and traffic control box and vaults before boxing begins. Any power, water or gas
in this area will need to be located and disconnected prior to boxing. If pipes or conduit
pass through the rootballs, they must be cut and abandoned inside the rootballs. If the
surrounding paving and or curbs are installed before the trees are replanted, a minimum
of about 11 foot square open area is needed.

RECOMMENDATION
By motion, approve 38 consultant service agreements to provide Plan Check and Design
Services fora (3) year term with (2) one-year extensions, not to exceed $50,000 per project
proposal, per year.
A. Summary and Recommendation
The concept of a Plan Check Team was originally introduced in 1992 and, to date,
has worked very well. It was created as a means to improve service delivery to
resident and developer plan check. The concept has proven successful in that it
has resulted in improved efficiencies. Our current contracts expire on
December 31, 2001. Therefore, staff has solicited proposals and is requesting that
38 firms be recommended for a three-year term with two one-year extensions.
B. Background
History
On January 21, 1992, City Council approved the concept of creating a plan
check consultant team consisting of a select group of consultants. The team
concept creates a long-term contract with each consultant. The purpose of
the team concept is to have available consultants with pre -approved
contracts and insurance in place and ready to go to work. The team
concept allows staff to expeditiously process all consultant plan checking.
In addition, the plan check team agreements all required that they perform
their services at a specified percentage of the City's fees, which guarantees
costs and assures that City staff is also compensated for processing from the
remaining balance. All consultants agree to a fee not to exceed 65% and
80% depending upon the type of plan check. In many instances, the fees
are negotiated lower, especially on larger projects. Upon expiration of the
initial three year term, and having had a positive experience with this
concept, the master listing was reviewed, updated, and again brought to
Council for approval in January 1997. The updated listing included design
services in addition to plan check services.

Selection Process
A Request for Proposal was sent to 44 firms. Many of these firms were on
the existing list, with others being added at a staff member's request. Of the
44 firms, 38 responded with proposals. The proposals included general
engineering and building firms, as well as a number of specialty firms. The
specialty firms include areas such as geotechnical, traffic, building structural
and water quality services. A review team consisting of the Department
Director and an Administrative Assistant reviewed the proposals for the
following elements:
• Consistency with the scope of work
• Ability to meet schedules
• Past performance of similar work
• Individual(s) specified to work on projects
• Ability to meet fee requirements
• Qualifications of firm in handling required work
Staff believes that all 38 firms qualify based on the above criteria. As this
is a three-year contract with two one-year extensions, there is no need to
narrow the field. Staff prefers to spread projects among the teams as work
becomes available. This provides more flexibility and allows work to be
performed in a more efficient and timely manner. The following list shows

3. Process
Plan Check Services - As previously stated, plan check services are to be
performed at a not -to -exceed fee based on a fixed percentage of the City's
calculated plan check cost. This eliminates the need to negotiate fees and
allows staff to select a consultant and request they perform the work at the
agreed upon price. No time is wasted with costly proposals, reviews, and
fee negotiations.
Design Services — Services not covered by fee recovery, such as design for
a City capital improvement project, will continue to require that staff solicit
proposals from at least three members of the team. Proposals will then be
evaluated and followed by consultant selection. If the fee exceeds the
amended limit established under the master contract, then it will be
forwarded to the City Council for review and approval. However, no new
agreements will be required nor will insurance certifications cause delays, as
they will already be in place.

GRADING PLAN CHECKING, REVIEW OF GEOTECHNICAL REPORTS, MAP
CHECKING, ENGINEERING AND ARCHITECTURAL SERVICES
GENERAL INFORMATION
It is the intent of the City of San Juan Capistrano, Department of Engineering & Building,
to establish a team of consultants to facilitate both building and engineering plan check,
engineering and architectural services. The services are generally described herein and
are intended to supplement staffs efforts where specific expertise is required or time
constraints necessitate consultant assistance. From the proposals, a team of consultants
will be selected who best represent expertise across the various specialty areas. The team
will become part of a four-year program in which the work load will be spread among the
team members. Work will be parceled out on an as -needed basis, and no specific
guarantee can be given as to the annual fees for consultant usage.
The consultant team will only be modified in the event consultants are dropped from the
list due to corporate changes or it is deemed by the City that additional consultants are
warranted.
INVITATION TO RESPOND
The City of San Juan Capistrano is soliciting proposals for professional consulting services.
In general, the tasks identified above and delineated herein are to be performed with
minimum direction and assistance from the City.

SUBMISSION OF PROPOSAL
Proposals may by submitted by mail or hand delivered. Proposals should be delivered to:

no later than 5:00 p.m., September 21, 2001. Proposals will not be accepted after this
time.
FORM OF PROPOSAL
Consultant proposals shall contain the following:
1. Statement of qualifications clearly indicating the services in which the firm is
interested;
2. Statement/discussion of services provided, including anticipated turnaround times and
ability of firm to handle requests on an as -needed basis;
3. Resumes of key personnel for various service areas;
4. Consultant fee schedules, including hourly rates and proposed flat fees;
5. Completed consultant self rating form included with this request for proposal.
EVALUATION OF PROPOSALS
The City of San Juan Capistrano is interested in selecting consultants who have the
experience and expertise to render plan checking, engineering and architectural services
in a comprehensive and timely manner. Accordingly, the evaluation criteria will consist
primarily of four parts:
1. Consultants' experience
2. Consultants' expertise
3. Consultants' ability to handle volume and meet time frames
4. Consultants' costs

It is important to the City that you identify the persons you will assign to various functions,
at which office they are assigned and whether they are full-time employees of your firm.
You should also address any conflict of interest that may exist and commei a on solutions.
The City of San Juan Capistrano reserves the right to reject any and all proposals.
Nonacceptance of any proposal will not imply criticism . `the proposal orthat any proposed
service was deficient. All participating candidates will be notified of the decision reached.
CONSULTANT'S RESPONSIBILITY
The Consultant shall perform the tasks as set forth herein:
A. Building Services
Review construction documents in accordance with the following uniform model
codes as amended by City ordinance:
a. Uniform Building Code -1998 California Building Code
b. Uniform Plumbing Code - 1998 California Plumbing Code
c. Uniform Mechanical Code - 1998 California Mechanical Code
d. National Electrical Code - 1996 Edition
e. California Code of Regulations - Title 24
2. Provide a comprehensive plan review as directed or provide only specified plan
review elements as follows:
a. Structural review and analysis of design and calculations
b. Inspection services
c. Other building services as may be defined
3. Provide geotechnical review and consultation regarding soil problems, features
or events.
B. Engineering/Architectural Services
Review construction documents and subdivision maps in conformance with the
following standards:
a. City of San Juan Capistrano Municipal Code
b. City of San Juan Capistrano and County of Orange applicable design
standards
c. Highway Design Manual standards
d. San Diego Regional Water Quality Control Permit

2. Provide comprehensive plan review or design services as directed for the
following elements:
a. Geotechnical review/design
b. Street improvements
c. Storm drain/hydrology reports/design
d. Traffic/striping improvements
e. Traffic studies
f. Sewer improvements
g. Landscaping improvements
h. Subdivision map checking
i. Structures (i.e., bridges)
j. Inspection services
k. Pavement analysis
1. Architectural design
m. Drafting
n. Water quality design and review
C. Document Transmittal
Pick up and resubmit plans to the City via the Building & Safety Division or
Engineering Division counter.
D. Performance Requirements
1. Plan Check Services
Render and remit a typed plan check correction/clarification list (two copies) to
the Engineering & Building Department within 10 working days from notification
by the City.
2. Engineering/Architectural Services
Complete services in a thorough and efficient manner, on time and within the
approved fee schedule.

E. Fee Schedules
1. Engineering Fees
a. Plan Check
Engineering fees will be determined for plan check services based on the
attached fee schedule. The consultam shall bill on an hourly basis, not to
exceed 75% of the total fee, and fees may be negotiated lower if, in the
determination of the City, a lower fee is warranted.
b. Design/Architectural
Services will be negotiated on a project -by -project basis based on a pre -
agreed scope of work. Payment will be as determined by the City project
manager.
2. Building Fees
a. Plan Check
Total plan check at 80% of base plan check fee paid by applicant not
including any surcharges (base plan check fee). Base plan check fee will be
65% of building permit fee, not including surcharges.
Structural plan check is not to exceed 60% of base plan check fee, not
including any surcharges.
b. Other Services
Services will be negotiated on a project -by -project basis based on a pre -
agreed scope of work. Payment will be as determined by the City project
manager.
F. Maintenance of Records
The consultant will maintain all books, documents, papers, employee time sheets,
accounting records/ledgers and other evidence pertaining to costs incurred and shall
make such materials available at their respective offices at all reasonable times
during the contract period and for three years from the date of final payment for
inspection by the City. The consultant shall furnish copies, if requested.

CITY'S RESPONSIBILITY
The City shall perform the tasks as set forth herein:
A. Establishment of Valuation (Plan Check Services Only)
Assign a valuation to the proposed work in accordance with the appropriate
Engineering or Building Division standards. The City shall collect all fees from the
applicant in connection with the services.
B. Project submittals
City will supply all necessary documentation/specifications, reports, studies,
calculations, etc., to Consultant as is readily available at the City.
C. Coordination
City will serve as project coordinator. On plan checking, the City will be responsible
for notifying the applicant when plans with corrections are available to pick up. The
City will route plans (preliminary/revised) to and from the Consultant.
SELECTION PROCESS
The Selection Committee, comprised of the Engineering & Building Director, Development
Services Manager and two Senior Engineers, will review the proposals submitted.
Candidates will be selected based on the proposals submitted, including qualifications of
staff, proposed fee schedules and ability to handle work load in a timely manner.

CONSULTANT SELF -RATING FORM
Consultants are asked to rate their expertise in the various fields listed below. The
information will be used by Staff in selecting consultants on specific types of work.
Consultants may rate themselves high on more than one category, but should not rate the
same in more than three categories. Building plan check and Engineering plan check are
considered separate services and should be rated independent of one another.
On a scale of 1 to 10, rate yourself with "l " being your strongest area of expertise and "10"
being a competent area of expertise. "N" or no rating will indicate no interest or company
expertise in that field.
