RECITALS: WHEREAS, City and Consultant have entered into a Personal Services Agreement dated November 21, 2000 for Preparation of Plans and Specifications for the Los Rios Historic District Parking Lot and Sign Program (CIP No. 125) in the amount of $34,400; and, WHEREAS, City and Consultant have previously agreed to amend the services by Amendment dated February 19, 2002 for an additional fee of $7,500 for a revised total fee of $41,900; and, WHEREAS, City and Consultant agree that additional design services outlined in Exhibit "A" are required for which extra compensation will become due. NOW, THEREFORE, BE IT RESOLVED City and Consultant mutually agree as follows: Section 1, Additional Work. In the course of providing services to City under the November 21 2000 Agreement, and February 19 2002 Amendment, City requests Consultant to perform additional services. Those extra services are set forth in Exhibit "A" attached and incorporated herein by reference. Section 2. Additional Compensation. City hereby agrees to pay the additional sum of $30,000 for a revised total contract price of $71,900 to Consultant for those services originally described in the Personal Services Agreement dated November 21, 2000; amended February 19, 2002 and amended now as set forth in Exhibit "A" attached hereto and made a part hereof. Section 3. Relationship to First Agreement. Except as to Sections 1 and 2 herein, all other terms and conditions of the first agreement shall remain unchanged. SD Section 4. Entire Agreement. This is the entire Agreement between City and Consultant with respect to those extra services described in Exhibit "A", and any other understandings, oral or in writing, are hereby superseded. Work Completed To Date Per the Original Contract 1) conceptual plans and drawings; 2) meetings with City staff and presentations of concepts; and 3) various design and phasing revisions, as directed by City staff. Supplemental and/or Additional Work 1) additional RV storage and parking lot layouts and phasing alternatives, as directed by City staff; 2) conceptual landscape design for the Teahouse Restaurant "buffer area' 3) surveying, soils report, grading plan, and architectural inspection of the Troubleman's Cottage; 4) revisions to the overall RV storage/Los Rios parking lot plan to incorporate the Troubleman's Cottage and other changes; 5) topographic survey of 1st phase parking lot site; and 6) production of various additional exhibits for presentations and meetings. Remaining Tasks Under the Original Contract 1) preparation of the final parking lot plans; 2) site specific soils report for project; 3) preparation of signage plan; 4) preparation of landscape plan; 5) preparation of storm drain, water quality management, and erosion control plans. Estimated Budgetary Augmentation to Original Contract Based on the task remaining, and without any other unexpected directives to the contrary, it is estimated that the remaining tasks will require a budget augmentation of $30,000. This amount takes into account not only the expanded scope of the work, but the fact that the original contract for work was entered into in November 2000 — nearly 3-1/2 years ago. Since then, labor costs have gone up approximately 25% due to the shortage of qualified personnel; overhead costs have gone up approximately 45% due to major increases in insurance premiums, taxes, rents, and other costs of doing business in California; reimbursable costs have gone up approximately 20% due primarily to the increased cost of fuel and the indirect consequences of fuel cost increases; and sub -consultant costs (e.g., for soils engineer) have gone up approximately 30% due to all of the above factors. 0 0 AMENDMENT TO PERSONAL SERVICES AGREEMENT THIS AMENDMENT to Agreement is made thisIT_ day of f-t�' , 200 , by and between the City of San Juan Capistrano (hereinafter "City"), and KHR Associates (Hereinafter "Consultant'). L-shaped parking lot running along the border of the Rios property and the Niccola property. 2. The original design. Consistent with earlier direction, the option of a parking lot on the CRA-Trulis property will not be considered. Within those options evaluate and provide recommendations on: ♦ Appropriate buffer between the Niccola's and Montanez property and the parking lot/RV storage. ♦ A "nature walk" connecting to Ramos Street ♦ Phased approach to allow the parking lot to be implemented as soon as possible within the City's fiscal limitations. Assumed within all options: ♦ The parking lot will be asphalt rather than gravel or other less improved surface. ♦ The RV storage lot will be gravel. ♦ The trees will be retained within the parking lot and RV storage to the maximum extent practicable. ♦ Security issues will be carefully evaluated. , I PERSONAL SERVICES AGREEMENT a - THIS AGREEMENT is made and entered into thiscis day of U�IM 2000, by and between the City of San Juan Capistrano (hereinafter referred to as the "City") and KHR Associates (hereinafter referred to as "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to Plans and Specifications Preparation for the Los Rios Historic District Parking Lot and Sign Program; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by Consultant shall consist of those tasks as set forth in Exhibit "A," attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and services required hereunder shall be completed by no later than July 31, 2001 in accordance with the time schedule set forth in "Exhibit D,"attached and incorporated herein by reference. Section 3. Compensation. 3.1 Amount. Total compensation for the scope of services for this Project shall not exceed Thirty Four Thousand Four Hundred Dollars ($34,400.00), as set forth in Exhibit "B," attached and incorporated herein by reference. c:\myfiles\agree\personalsvcs.wpd 01/25/00 p:\City Manager\cmgr shared\personalsvcs.wpd -t- SD 3.2 Rate Schedule. The services shall be billed to the City at the hourly rate set forth in Exhibit "C;" attached and incorporated herein by reference. Included within the compensation are all the Consultant's ordinary office and overhead expenses incurred by it, its agents and employees, including meetings with the City representatives and incidental costs to perform the stipulated services. Submittals shall be in accordance with Consultant's proposal. 3.3 Method of Payment. Consultant shall submit monthly invoices based on total services which have been satisfactorily completed and specifying a percentage of projected completion for approval by the City. The City will pay monthly progress payments based on approved invoices in accordance with this Section. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. 3.4 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to City. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between c:\myfiles\agree\personalsvcs.wpd 01/25/00 p:\City Manager\cmgr shared\personalsvcs.wpd -2- any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed construction site, including the location of all utilities, and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All services to be rendered hereunder shall be subject to the direction and approval of the City. Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one personlany one occurrence/not limited to cAmyfiles\agree\personalsvcs.wpd 01/25/00 pXity Manager\=gr shared\personalsvcs.wpd -4- 9 0 contractual period. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non -owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit the insurance certificates, including the deductible or self -retention amount, and an additional insured endorsement to the Consultant's general liability and umbrella liability policies using ISO form CG 20 10 1185 (in no event with an edition date later than 1990) to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.5 Errors and Omissions Coverage Throughout the term of this Agreement, Consultant shall maintain Errors and Omissions Coverage (professional liability coverage) in an amount of not less than One Million Dollars ($1,000,000). Prior to beginning any work under this Agreement, Consultant shall submit an insurance certificate to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.6 Notice of Cancellation/Termination of Insurance. c:\myfiles\agree\personalsvcs.wpd 01/25/00 p:\City Manager\cmgr shared\personalsvcs.wpd -5- 0 0 The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions have been satisfied. 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City and Consultant shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to the other party In addition, this Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. Attorneys' Fees. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other relief to which he may be entitled. Section 18. Dispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). Section 19. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. c:\myriles�zgree\personalsvcs.wpd 01/25/00 p:\City Manager\cmgr shared\personalsvcs.wpd -7- \�\ KHR ASSOCIATES Consulting Engineers - Architects - Planners Exhibit A Scope of Work for Los Rios Historic District Parking Design & Sign Program The section (submitted herein as Exhibit A) describes, in detail, KHR Associates' work tasks and proposed methodology to meet the City's criteria for the project. KHR Associates' scope of work includes the labor and materials believed necessary to complete the project in a timely and cost efficient manner. The scope of work will be undertaken in three phases - the first phase aimed at developing alternative parking lot engineering, landscaping, and lighting concept plans; the second phase refining a preferred conceptual design and producing a preliminary sign program design; and the final phase producing final design plans for both the parking lot and sign program. The proposed scope of work for the parking lot design will include the following: a. Prior to the start of work, existing records, maps, reports, and other documentation relating to the project site will be assembled. b. A site survey will be conducted of the area shown on Attachment "B" of the RFP. This will serve as the basis for the RV concept parking layout. C. The civil engineering design will include Los Rios Street drainage, parking lot drainage, parking lot, and the access drive. d. A geotechnical report will be prepared for grading and to determine the appropriate pavement structural section. e. An arborculturist review will be conducted to identify significant existing trees and suitable methods to maximize tree preservation. f. Landscape and irrigation design will be prepared, including large-scale colored renderings for City Council and City Commission meetings. g. Lighting plan, photometric plan and illumination scheme will be prepared to the extent requested by the City. At minimum, the plans will include conduit and pull boxes for future lighting implementation. h. A concept parking layout for a RV parking on Lots 52 and 53 and Parcel 5 of PM 92-123 will be prepared (for possible separate implementation at a later date). i. Bid packages inclusive of plans and general and specific provisions for bidding and construction will be prepared in accordance with the City's format. All plans will be prepared using AutoCAD 2000, unless otherwise requested by the City. Project specifications shall be provided as one hard copy and a diskette or CD in WordPerfect 6.1 format for Windows. j. Support for construction and coordination with all utility companies will be provided. k. Coordination of work with sub -consultants will be provided. The proposed scope of work for the sign program will include the following: a. A topographic survey of the CRA — Oyharzabal parcel (i.e., AP#649-201-2), on the comer of Del Obispo Street and Paseo Adelanto. b. A field survey of existing signage in the Los Rios Historic District area and along Del Obispo Street. c. Grading, signage, landscape and irrigation design for Los Rios Historic District entry sign on the CRA — Oyharzabal parcel. d. Street signage plan showing signs to be removed and new signs directing visitors to Los Rios Historic District Parking Lot, particularly along Del Obispo Street and Paseo Adelanto. It is understood that the City will provide: a. A Project Manager/Administrator b. A City street base map for the sign program. c. Existing plans and information. PHASE I — CONCEPTUAL PARKING LOT & LIGHTING DESIGN In this initial phase of work, conceptual engineering, landscaping, and lighting designs for the new Los Rios Historic District parking lot will be developed for formal presentation to the City. It is envisioned that, a minimum two alternative concepts will be developed. Task 1.1 — Kick -Off Meeting & Field Review In this initial task, a "kick-off' meeting will be held with the City to review the proposed scope of work and to share insights into the project and gather existing records, maps, reports, and other documentation relating to the project. On the same day, a site survey will be conducted of the project area. The purpose of this field review will be to familiarize the project team with the project site and the area in general. KHR Associates' Scope of Work for Los Rios Historic District Parking Design & Sign Program Page 3 It is assumed that full access will that access will be unobstructed. any field work. 0 be provided to all unenclosed areas of the site and Arrangements for access will be made in advance of Task 1.2 — Supplemental Topographic Survey In this task, supplemental pick-up topographic data will be collected as deemed necessary for the design of the subject parking lot. The topographic surrey will verify vertical control for the entire site, as well as identify missing topographic features that are not shown on the City's surreys. The limits of the topographic data will extend along the perimeter of the parking lot and the public streets contiguous to the site. It is anticipated that various other pick-up surveys will be needed during the course of the civil engineering effort. Task 1.3 — Geotechnical Investigation & Observations In this task, a geotechnical investigation of the project site will be performed. The geotechnical investigation will be limited to assessing the suitability of the near -surface soils for the proposed parking lot, as well as providing geotechnical observations and testing services during grading and construction. In consideration of the size and location of the parking lot site, 3 to 4 shallow hand - auger borings, to a minimum of 5 feet, will be performed. Laboratory testing will be conducted to evaluate R -values, as well as maximum density and water content. A subsequent geotechnical report will be prepared for the project site. During the grading and construction of the project, geotechnical observations will be provided, as well as laboratory testing of materials. A report of field observations will be provided during and/or upon completion of construction. Task 1.4 — Conceptual Parking Lot Design Based on the results of the topographic survey and the geotechnical investigation, civil engineering design options will be developed for the proposed parking lot. The civil engineering design will take into consideration Los Rios Street drainage, parking lot drainage, ADA accessibility, landscaping and lighting, parking signage and pavement delineation, as well as required pavement sections. Also, as part of this task, a concept parking layout for a modified RV parking on Lots 52 and 53 and Parcel 5 of PM 92-123 will be prepared. It is understood that this concept layout may be implemented at a later date, but will not be included in the initial construction of the subject parking lot. KHR Associates' Scope of Work for Los Rios Historic District Parking Design & Sign Program Page 4 Task 1.5 — Conceptual Landscape Architectural Design In this task, an arborculturist review will be initially conducted to identify significant existing trees and suitable methods to maximize tree preservation. Subsequently, a conceptual landscape design will be prepared that accommodates the arborculturist's recommendations while enhancing the landscaping of the area. Natural, native species of planting material will be utilized to the extent possible. High consideration will be given to "blending in" the new landscaping with existing vegetation. Task 1.6 — Discussion on Lighting Options In this task, parking lot lighting options will be explored. The use of low level lighting in strategic areas of the parking lot will be emphasized. The objective will be to minimize nighttime lighting intrusions into the existing residential areas, while at the same time maintaining visibility for safety and security purposes. Examples of lighting options will be assembled for presentation and discussion. Task 1.7 — Presentation of Conceptual Design In this concluding task to Phase I, a formal presentation will be made to the City of the conceptual designs developed for engineering, landscaping, and lighting. The presentation will include large-scale color exhibits as well as a computer-based presentation. A 3-dimensional model of the parking lot will developed as a presentation tool. This 3-dimensional model will be used to produce full-color renderings, as well as the more traditional plans and elevations. Based on input and direction from the City, the second phase of work will commence. PHASE II — PRELIMINARY PARKING LOT DESIGN & SIGN PROGRAM In this second phase of work, preliminary engineering, landscaping, and lighting plans will be developed for a second formal presentation to the City. In addition, a preliminary design for the sign program will be developed. Task 11.1 — Preliminary Parking Lot Plan In this task, the parking lot design will be refined based on comments and directives from the City. A horizontal control plan will be developed to precisely locate all key elements, including parking lot striping, signage, landscaping, and lighting. A preliminary parking lot plan will be produced in this task. KHR Associates' Scope of Work for Los Rios Historic District Parking Design & Sign Program Page 5 Task 11.2 — Preliminary Landscape Plan Based on comments received regarding the conceptual landscape design, a preliminary landscape plan will be produced. This preliminary landscape plan will be sufficient detail to specify the location, size, and type of planting that will accompany the parking lot design. Task 11.3 — Preliminary Lighting Plan Based on comments received regarding lighting, a preliminary lighting plan will be produced. This preliminary lighting plan will be sufficient detail to specify the location, size, and type of lighting that will accompany the parking lot design. As needed, a photometric plan and illumination scheme will be prepared. Task 11.4 — Preliminary Sign Program In this task a preliminary sign program will be developed. This program will specify not only signage for the parking lot, but the strategic placement of guide signs along Paseo Adelanto and Del Obispo Street that will direct visitors to the Los Rios Historic District and parking lot. A field survey will be conducted of existing signage in the Los Rios Historic District area and along Del Obispo Street. Digital photographs of key signs will be taken for use in subsequent presentations. An emphasis will be placed on the view that motorists will have when entering the Los Rios Historic District. Consideration will also be given to the grading, landscaping and irrigation design for the Los Rios Historic District entry sign on the CRA — Oyharzabal parcel. Task 11.5 — Preliminary Design Submittals & Presentations In this task, the preliminary design for the parking lot, landscaping and lighting, as well as the sign program, will be submitted in large-scale illustrative form to the City for final consideration. Presentations will be made to the Planning Commission, City Council, and others. Upon feedback from the City, the final design phase will be initiated to produce plans and specifications for actual construction of the parking lot. PHASE III — FINAL PARKING LOT & SIGN PROGRAM DESIGN In this final phase of work, the selected design for the parking lot will be advanced to the construction document stage, and the sign program will be finalized. Task 111.1— Parking Lot Construction Documents In this task, construction documents (also known as plans, specifications, estimates) will be prepared in accordance with the City's format. Task 111.2 — Hydrology Report & Storm Drain Plan In this task, as necessary, a hydrology map, hydraulic calculations, and drainage report will be prepared. The drainage report will be based on the preliminary drainage study and will indicate final on-site drainage calculations. The storm drain plan will be based on the City of San Juan Capistrano's standards and criteria, and will indicate the location, type, and method of construction of mainline storm drains, gutters, drainage structures, and other sub -surface and surface drains servicing the project site. Applicable profiles with elevations and locations where the storm drain crosses other utilities, as well as, construction notes and details will be placed on all plans. Task 111.3 — NPDES & BMP Plan In this task, as necessary, a water quality management plan will be prepared based on the County of Orange adopted Best Management Practices (BMP) guidelines for development. These guidelines implement the National Pollution Discharge Elimination System (NPDES) permit processing requirements. As proposed, a public parking lot project may be subject to the BMP and NPDES permit requirements. A Water Quality Management Plan (WQMP) will be submitted to the County specifying BMPs for the subject project and will include a Site Map and other exhibits in response to the requirements of the General Permit. The plan will include a narrative description of the project and an outline of which BMPs apply to the project. Furthermore, structural and non-structural BMPs may be required and implemented by the City. If applicable, KHR Associates will submit applications for necessary permits from the State Water Resources Control Board, and other agencies, as necessary. Task 111.4 — Erosion Control Plan In this task, as necessary, an erosion control plan will be prepared in accordance with City criteria. The plan will indicate the location, type, and method of placement of sandbags, diverters, silt fencing, temporary drainage facilities, and other erosion controls for use during construction, as well as appropriate notes and details. (KHR Associates) (CIP No. 125) RECOMMENDATION: By motion, approve Amendment No. 2 to the Personal Services Agreement with KHR Associates to complete Plans and Specifications for the Los Rios Historic District Parking Lot in the amount of $30,000. SUMMARY: The environmental documentation and concept plan for the Los Rios Parking Lot project has been approved by the Cultural Heritage Commission (CHC), Planning Commission (PC), and City Council. Numerous reviews of different design concepts and revisions have superseded the original scope of work and have exhausted the contracted amount for completing the project through plans and specifications. Amendment No. 2 to the agreement is necessary to complete the final review and prepare construction documents for bidding purposes. Final review as determined by City Council at its review on January 6, 2004, will consist of taking the approved concept plan back to the Design Review Committee and Planning Commission to flesh out greater detail to the approved concept plan for final City Council approval. From there the plans and specifications will return to City Council for approval and authorization to seek bids for construction. Construction of the Los Rios Parking Lot is anticipated in late spring 2005 barring sweeping changes to the concept plan and unforeseen delays in the closure of the RV storage lot. At this time, staff is recommending approval of Amendment No. 2 to the Personal Services Agreement with KHR Associates for the additional design services necessary to complete plans and specifications for the Los Rios Parking Lot in the amount of $30,000. BACKGROUND: In November 1999, by Resolution No. 99-11-16-4, City Council adopted an updated Specific Plan for the Los Rios Historic District. The Plan reaffirmed the 1978 plan, which Agenda Report • June 15, 2004 Page 2 called for construction of a public parking lot on Community Redevelopment Agency owned property. The City entered into a Personal Services Agreement on November 21, 2000, for preparation of plans and specifications for the Los Rios Historic District Parking Lot in the amount of $34,400. The City Council extensively reviewed the scope and location for a parking lot on the CRA -owned property at three (3) meetings of June 20, 2000; July 3, 2000; and August 15, 2000 before the start of the design services; and six (6) more times at meetings of October 2, 2001; October 30, 2001; November 20, 2001; December 4, 2001; June 4, 2002; and January 6, 2004 since design services started. The project has also been reviewed by the Cultural Heritage Commission at its meeting of October 23, 2003, and by the Planning Commission at its meeting of December 9, 2003. The Design Review Committee and Planning Commission will review the project again before a final review by the City Council. Originally, a temporary trailer was proposed for the RV Storage Lot Caretaker's residence and office. In spring 2002, the City became aware that two existing caretaker structures, known as Troubleman's Cottages, on San Diego Gas & Electric's Camino Capistrano property were slated for demolition. After consideration to provide these units for CARE and Camp Cookie or private individuals, both units have been moved to the Los Rios District, one to the Davidson property on the corner of Ramos Street and Lobo Street, and the second for use as the RV Storage Lot Caretaker's residence on this project. This substitution also created additional design work. Nevertheless, design progress has been made and the City Council approved the design concept and certified a mitigated negative declaration for the project at its January 6, 2004, meeting. The original agreement was amended administratively on February 19, 2002, for an increase of $7,500 to $41,900. This work consisted of the analysis of two options: • L-shaped parking lot running along the border of the Rios property and the Niccola property. 0 The original design. Agenda Report • • June 15, 2004 Page 3 Within those options evaluations and recommendations were provided on: • Appropriate buffer between the Niccola's and Montanez property and the parking lot/RV storage. • A "nature walk" connecting to Ramos Street. • Phased approach to allow the parking lot to be implemented as soon as possible within the City's fiscal limitations. The proposed Second Amendment of $30,000 will increase the compensation amount to $71,900. This will allow the originally intended work to be completed as follows: • Preparation of final parking lot plans; • Site specific soils report for project; • Preparation of signage plan; • Preparation of landscape plan; • Preparation of storm drain, water quality management, and erosion control plans. To date, funding originally intended for the foregoing has been allocated as follows: • Additional RV storage and parking lot layouts and phasing alternatives; • Conceptual landscape design for the Teahouse Restaurant "buffer area'; • Surveying, soils report, grading plan, and architectural inspection of the Troubleman's Cottage; • Revisions to the overall RV storage/Los Rios parking lot plan to incorporate the Troubleman's Cottage and other changes; • Topographic survey of 15t phase parking lot site; and Projection of various additional exhibits for presentations and meetings. Additionally, the original contract for work was entered into nearly 3'Y2 years ago in November 2000. Since then, labor costs have gone up approximately 25% due to the shortage of qualified personnel; overhead costs have gone up approximately 45% due to major increases in insurance premiums, taxes, rents, and other costs of doing business in California; reimbursable costs have gone up approximately 20% due primarily to the increased cost of fuel and the indirect consequences of fuel cost Agenda Report • • June 15, 2004 Page 4 increases; and sub -consultant costs (e.g., for soils engineer) have gone up approximately 30% due to all of the above factors. FINANCIAL CONSIDERATIONS: The project is budgeted in account No. 12-65300-4703-125 at $566,300 in FY 2003- 2004 and $643,120 in FY 2004-2005 for a total of $1,209,420. The funding source is the Community Redevelopment Agency. No budget amendment is required for the proposed action. Background The City Council reviewed the scope and general location for a parking lot on the CRA -owned property at the meetings of June 20, 2000, July 3, 2000, and August 15, 2000. At the August 15, 2000 meeting the City Council authorized staff to proceed with a concept phase to be brought back for further City Council review. Staff received only one response to the Request for Proposals for design services for this project from KHR Associates. Staff believes that KHR Associates is very well qualified to perform this work and is recommending award of a Personal Services Agreement to KHR Associates for this work. C.
