AMENDMENT TO PERSONAL SERVICES AGREEMENT THIS AMENDMENT to Agreement is made this 5t" day of April, 2005, by and between the City of San Juan Capistrano (hereinafter "City"), and J. L. Patterson and Associates, Inc. (hereinafter "Consultant'). WHEREAS, City and Consultant have entered into a Personal Services Agreement dated October 17, 2000, for design of the Vereda Bikeway Undercrossing of the LOSSAN Rail Corridor (CIP 124). WHEREAS, City and Consultant agree that additional design services outlined in Exhibit "A", attached hereto, are required for which extra compensation will become due. NOW, THEREFORE, BE IT RESOLVED by the City and Consultant as follows: Section 1. Additional Work In the course of providing services to City under the October 17, 2000 Agreement, City requests Consultant to perform additional design services. Those extra services are set forth in Exhibit "A" dated January 21, 2005, and is attached and incorporated herein by reference. Section 2. Additional Compensation City hereby agrees to pay the additional sum of $33,621 for a revised contact amount of $194,476. Section 3. Relationship to First Asareement and First Amendment Except as to Sections 1 and 2 herein, all other terms and conditions of the first agreement and first amendment to the agreement shall remain unchanged. Section 4. Entire Aureement This is the entire Agreement between the City and Consultant with respect to those extra services described in Exhibit "A" and any other understandings, oral or in writing, are hereby superseded. A) Further study of no -skew alternate was carried out as a result of meeting held on 2/14/01. As you recall the skew alternate was approved on December 20,2000. B) At the start of the project, there was no requirement of the second main track addition. OCTA required of us to make provision for the second main track during the meeting held on March 2,200. As a result further study was carried out to ensure that this is feasible. C) Our original design fee assumed the use of standard Metrolink design and detail bridge drawings, thereby reducing the effort of work tremendously. However since the skew was a must in this alignment, the standard set of drawings no longer can be used. A new set of drawings has to be reinvented to incorporate the skew. The skew effect is not limited to drawings but design as well. D) Access ramp from the Bikeway to Vons's Parking Area (Plaza Del Rio shopping center) E) Add pavement from the proposed limit to.the existing pedestrian bridge crossing the Creek. Work includes changing minimum two drawings, show best fit alignment using the topo. Readjust drawing to fit the detail. Two drawings are anticipated for corrections. Add to the specification to reflect the change. Work out the quantities for the bid purpose. 1) The cost occurred to perform work in task A and Task B amounted to $ 16,250 2) The estimated cost for the 4 additional drawings normally not required if standard Metrolink drawings used including design for Task C $16,000 3) Access ramp requirement from the bikeway to Plaza Del Rio shopping center for Task E $5000 4) Additional Pavement from the proposed limit..................................................$5500 Total $42,750 Currently we are moving forward to complete all phases of design and drawings. Patterson & Associates, �- Naren Patel Project Manager cc: file . . . • 0 0 PERSONAL SERVICES AGREEMENT THIS AGREEMENT is made and entered into this 17th day of October, 2000, by and between the City of San Juan Capistrano (hereinafter referred to as the "City") and J. L. Patterson and Associates (hereinafter referred to as "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to obtain design services for the Vereda Bikeway undercrossing of the LOSSAN rail corridor; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. The scope of work to be performed by Consultant shall consist of those tasks as set forth in Exhibit'A," attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and services required hereunder shall be completed by no later than April 2, 2001, Section 3. Compensation. 3.1 Amount. Total compensation for the scope of services for this Project shall not exceed one hundred and eighteen thousand , one hundred and five dollars and eighty three cents ($118,105.83), as set forth in Exhibit "B," attached and incorporated herein by reference. -1- SD 0 0 3.2 Rate Schedule. The services shall be billed to the City at the hourly rate set forth in Exhibit "B," attached and incorporated herein by reference. Included within the compensation are all the Consultant's ordinary office and overhead expenses incurred by it, its agents and employees, including meetings with the City representatives and incidental costs to perform the stipulated services. Submittals shall be in accordance with Consultant's proposal. 3.3 Method of Payment. Consultant shall submit monthly invoices based on total services which have been satisfactorily completed and specifying a percentage of projected completion for approval by the City. The City will pay monthly progress payments based on approved invoices in accordance with this Section. For extra work not part of this Agreement, a written authorization from City is required prior to Consultant undertaking any extra work. 3.4 Records of Expenses. Consultant shall keep complete and accurate records of all costs and expenses incidental to services covered by this Agreement. These records will be made available at reasonable times to City. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Other than those subcontractors mentioned in Exhibit "B", Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. -2- 0 0 Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed construction site, including the location of all utilities, and is aware of all conditions there; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. All services to be rendered hereunder shall be subject to the direction and approval of the City. -3- , Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California and having a minimum Best's Guide Rating of A- Class VII or better. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period. -4- 0 0 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non -owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Proof of Insurance Requirements/Endorsement. Prior to beginning any work under this Agreement, Consultant shall submit the insurance certificates, including the deductible or self -retention amount, and an additional insured endorsement to the Consultant's general liability and umbrella liability policies using ISO form CG 20 10 1185 (in no event with an edition date later than 1990) to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.5 Errors and Omissions Coverage Throughout the term of this Agreement, Consultant shall maintain Errors and Omissions Coverage (professional liability coverage) in an amount of not less than One Million Dollars ($1,000,000). Prior to beginning any work under this Agreement, Consultant shall submit an insurance certificate to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied. 14.6 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be canceled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. I&I 0 0 14.7 Terms of Compensation. Consultant shall not receive any compensation until all insurance provisions have been satisfied. 14.8 Notice to Proceed. Consultant shall not proceed with any work under this Agreement until the City has issued a written "Notice to Proceed" verifying that Consultant has complied with all insurance requirements of this Agreement. Section 15. Termination. City and Consultant shall have the right to terminate this Agreement without cause by giving thirty (30) days' advance written notice of termination to the other party In addition, this Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other relief to which he may be entitled. Section 18. _ ispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). rol Section 19. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. Patterson -7- PROJECT UNDERSTANDING 0 EXHIBIT "A" The existing Vereda Bikeway is discontinuous in the vicinity of the Los Angeles - San Diego Rail Corridor. The construction of an underpass at this location will close the gap for the bikeway/trail while adding safety and security to fun loving bike riders and hikers. The increase in rail traffic especially with the growth of freight, Amtrak, and Metrolink trains make the decision of separating the trail from the railroad an appropriate and prudent solution. It is our understanding that in recognizing the importance of public safety and concerns, the City has proposed to construct a Railroad Underpass with an improved Bikeway in the vicinity of the crossing. We also understand that the federal government has approved funds for the construction of this project. J.L. Patterson & Associates, Inc. (JLP) is submitting this response to your request for proposal to provide you with our highly qualified team to perform the necessary engineering to complete the underpass to your full satisfaction. After reviewing your RFP, we have determined that in addition to the construction of the new Underpass and Retaining Walls along the revised Bikeway alignment the following services will be required: • Paved Bikeway • Relocation of 18" Sewer Line • Modification of existing drainage system within project limits. • Utility relocation • Survey • Geotechnical Investigation • Archeological Survey Our Team is fully prepared to address every issue of the project! The selected bridge alternate and construction method shall be chosen so as to minimize cost and construction time during a 12 -hour work window on weekends. We are further in agreement that using Metrolink's construction crews who are the most experienced, and well equipped to construct small span bridges during the specified work window is the preferred alternative. In tum, it makes sense to use Metrolink Standards for Abutment, Bent and Girder design. We propose to study the following alternates and compare each method in terms of constructability, economy, and simplicity. 7= Alternate 1: 3 -span structure as proposed. PRTfERSON 8 RSSOCi m, INC. ONt-iPq(N 9fNG RING �J Y Alternate 2: Use of Reinforced Box -culvert cast near the site. Y Alternate 3: Use of Prefabricated steel liner, somewhat similar to alternate 2 except that the excavation is carried out progressively depending upon the width of the liner. The readily available steel liner comes in 2 or more feet wide segments and can be constructed with minimal track disruptions. First, the excavation is made to make room for the first segment. The first segment is lowered into place. The excavation continues for the second segment placement. The two segments are then connected to each other. The method is continued until the whole tunnel is completed and connected. See Figure 1. Advantages using Steel Liner: • The steel liner is readily available and capable of resisting the applied E-80 Cooper Loading. • The sections are lighter as opposed to reinforced box - culvert and thus easy to handle. • The steel liner saves both design and construction time. • No temporary falsework required resulting in cost savings. Disadvantages: • Maintenance of Steel Liner • Specialized construction technique • "Tunnel" effect while riding under lining. Work Plan: Figure I - Structural Plate Steel Underpass Our team provides a common sense approach to this project through professional staff experienced in rail geometric, rail grade separations, railroad coordination and railroad construction projects. Our Work Plan includes: ■ Effective communication with the City, SCCRA, OCTA, METROLINK, AMTRAK and BNSF by regular status meetings on a regular basis. By doing so, the biggest hurdle of understanding and approval of the project is overcome. Railroad coordination and the ability to produce plan submittals that will gain railroad acceptance the first time through is an important factor in keeping the Vereda Bikeway Underpass Project on schedule. JLP's recent experience with SCCRA (Metrolink) and BNSF such as Redondo Junction Grade Separation and also Metrolink Double Track Project is substantial. The relationship established between the JLP PRTTERSON & 2 i RSSOCIRTES, INC. - - -: aHi-mnawonx erw�wx� 0 team and key SCCRA/AMTRAK personnel is a tremendous asset to — the City of San Juan Capistrano in the execution of this project. • Safety Training and Site Access: Design and construction activities that will require access to the Metrolink ROW will be governed by SCCRA (Metrolink) rules for On -track Safety. Design team and construction personnel other than Metrolink forces will need to be trained and activities coordinated with SCCRA. The JLP Team has gone through several hours of training and all our design staff has met the requirements to hold current Roadway Worker Certifications ... a significant schedule saving tool! Construction Staging Plan: Thorough, well -considered construction staging plans will be developed to ensure that all phases of construction will interface with the specified 12 -hour weekend window. Submittal of progress reports at the end of each month accompanying our invoices with charges for the period detailing our work progress as well as identifying any elements that can affect both schedule and cost of the project. Early mutual agreement of specific design standards to be used for the project elements. Since this is a Federally Funded Project, we will conduct a required meeting with Caltrans to assure Federal and State Compliance. JLP has participated in numerous federally funded projects and therefore we are very familiar with those requirements. Development of a work schedule that will include specific deadlines, updated to reflect time of completion. These project activities can be broken down to the following activities and submittals beginning with a kick-off meeting. Kick-off meeting: Immediately subsequent to notice -to -proceed, the City Project Manager and the JLP Project Manager shall meet at the schedule date for a kick-off meeting. This meeting should be attended by agencies and organizations with which coordination is required. City of San Juan Capistrano, SCCRA, AMTRAK, OCTA, OCFCD, Engineering staff, affec'_d Utilities, City Department and others should be invited. Available mapping will be mounted in a manner suitable for discussion of issues and concerns. Minutes of the meeting will be prepared and distributed. The sign - in sheet and telephone/email address log will be added to the project management plan. We will initiate a field review with involved agencies to ensure that all the concerns of the involved agencies are recorded and dealt with during preparation of the PS&E documents. Phase 1 (I" Submittal - 35% Submittal - Conceptual Plans) After the kick-off meeting, we will waste no time in collecting all necessary data, and give immediate authorization to perform a survey, while our Subconsultant Group Delta (Geotechnical Engineers) will begin searching existing boring data. Depending upon availability and the usage of existing geotechnical data, the scope may be reduced to minimize the design cost. From this preliminary information, we will study and develop bridge -type selection and construction methods. All these concepts developed shall be compared in terms of construction cost and time, material availability, time constraint (12 -hour work window during weekends) shall be duly evaluated. A very quick value engineering study (VE Study) will be prepared to come up with the right concept. Along with the bridge structure, the retaining wall concept will be laid out and type -selection for the proposed retaining wall will be made. Most likely, we will be able to use Caltrans' Standard Retaining Walls, if all the design parameters from our Geotechnical Engineers are in favor. The typical section of the Bikeway will also be provided, clearly showing the pavement thickness and drainage system. We will also fumish the City and other agencies with our conceptual layout of the Drainage System and relocation of 18" Sewer Line. The close proximity of the existing railroad bridge over San Juan Creek will be closely examined when designing or modifying the drainage system in the area. During this phase, we will confirm all existing utility precise locations and we will develop our plan to relocate them. These utilities will include fiber optic cables like MCI and Sprint, if required. This is the stage when most of the hurdles are cleared and the project runs smoothly hereon. Therefore, it is of great importance for the project and the City to bring all the parties involved to the table. Our previous experience and familiarity with most of the agencies and agency staff give us an extra edge to get fast approval and finish the project in a timely fashion. The RFP does not require this submittal, however, we think it is important to submit a General Plan Sheet and Construction Staging Plan covering basic elements upon which the entire project design will be based. We plan to submit the following Preliminary Plans together with a Preliminary Cost Estimate: 1) Bike Pathway Layout and Profile 2) General Plan- Showing Plan, Elevation and Typical Section of the Underpass. 3) Stage Construction Plan 4) Retaining Wall Layout and Profile 5) Drainage Improvements 6) Miscellaneous Details Phase 2 (2"d Submittal - 70% Complete Plans. Specifications and Estimate) Using an approved bridge concept as a base, we will proceed full swing with final design. All structural analysis and components design will be completed at this stage. All work will be conducted according to AREMA/SCCRA standards. PAGE 05 I talked to Tony Foster at the City of SIC about the archaeo portion of the RFP. The RFP itself was put together by a consultant, so he is unsure of exactly what is intended. He said we should make a statement in the proposal regarding what we think should be done. I think a scope of work would cover this. The 20 foot deep excavations mentioned in the archaeo portion are apparently some sort of soils testing that will have to be done, since the City apparently does not know what lies below the visible rip rap and fill. We should monitor such work, probably, but that is beyond the survey work. Patterson and Associates for additional design services for the Vereda Bikeway Undercrossing of the LOSSAN Rail Corridor in the amount of $33,621. A. Summary and Recommendation In October of 2000, J. L. Patterson and Associates were authorized to provide design services for the Vereda Bikeway Undercrossing. As noted in the Financial Considerations section below, there has been one additional increase in the design agreement. This project was in environmental review for two years. During that time Metrolink/Southern California Regional Rail Authority (SCRRA) has revised its design requirements, which affect the Patterson plans. As these changes are revisions rather than corrections, Patterson has requested an additional $33,621 to provide modifications to the plans (Attachment 2). B. Backaround For several years, the City has been negotiating with the Orange County Transportation Authority (OCTA), SCRRA and the California Public Utility Commission (CPUC) to improve the Vereda Bikeway crossing of the LOSSAN rail corridor. Funding has been obtained for design and construction of an undercrossing. The crossing consists of a new rail bridge to be installed sixty feet north of the existing rail bridge at San Juan Creek. The bikeway will cross under the new bridge. Ramps and retaining walls will be installed to the west in Descanso Park and in Plaza Del Rio (Vons) to the east. Staff hopes to bid this project in May with construction beginning in July and completion in November. C. Revised Scope of Work Exhibit "A" of Attachment 2 is a request for additional funds submitted by Patterson. Outside agency review took over two years after completion of the project plans. During that time Metrolink/SCRRA revised their standards and now require additional ballast (the rock under the tracks), which has caused recalculation of the bridge structure and several modifications as noted in Exhibit "A" of Attachment 2. Funding has been obtained for design and construction of the crossing (see Financial Considerations, below). After extensive review involving several outside agencies, a crossing design has been determined. Per Attachment 3, the crossing will consist of a new rail bridge to be installed approximately sixty feet north of the existing rail bridge at San Juan Creek. The bikeway will cross under the new bridge. Ramps and minor retaining walls for the bikeway undercrossing will be built adjacent to Descanso Veterans Park west of the crossing and Plaza Del Rio east of the crossing. D�1 FOR CITY COUNCIL AGEN 0 0 Agenda Item -2- July 17, 2001 C. Revised Scope of Work: Exhibit "A" of Attachment 2 is the request for additional funds submitted by Patterson. Items A, B, C, 1 and 2 refer to the design of the rail bridge. After completion of the preliminary design, OCTA and the PUC requested an additional study regarding the shape and width of rail bridge. The alignment of the bike trail required use of custom designed angled (skewed) bridge sections rather than standard rectangular sections for the three -span rail bridge (see Attachment 3). OCTA and the PUC also requested review of the width of the rail bridge to accommodate future double tracking. Patterson reviewed these issues and it was determined that realignment of the bike trail to accommodate standard bridge sections would require extensive land takes from both the City maintenance yard and Plaza Del Rio. Future double tracking would cause modifications to the adjacent rail bridge spanning San Juan Creek. That bridge must be raised due to flood level concerns, which would also raise the track crossing over the bike trail. It was agreed to by all parties to leave the design as originally proposed. Review of the two issues required extensive engineered drawings and research by Patterson. The work was outside the scope of the Design Agreement and resulted in additional costs in the amount of $32,250. As this is a City initiated project, all costs for design studies are the responsibility of the City. Items D and 3 are the result of a request by Staff to provide an access ramp to Plaza Del Rio. Prior to closure of the crossing by OCTA, trail users accessed the Plaza by crossing a steep, landscaped slope. Preliminary plans for the bikeway indicated the east ramp, adjacent to Vons, would meet the existing bike trail elevation behind Pet Co. Therefore, access to Plaza Del Rio would be via the sidewalk adjacent to Camino Capistrano. However, the final plan indicated the ramp will meet the existing bike trail at the parking area behind Vons. It was felt a formal, paved ramp would be more appropriate and provide a safe access to the Plaza. As the access ramp was not part of the original contract, design of the ramp resulted in an increase of $5,000. In addition, the contract does not include the design of the bike trail paving between the undercrossing and the Trabuco Creek Recreational Bridge to the west (Items E and 4). Originally, Staff had hoped to complete the design in-house and provide funding from a separate grant. However, it was determined to include the bike trail paving with the undercrossing design and future construction contract in order to complete the bike trail in conjunction with the undercrossing. Also, inclusion will allow the bike trail to be reviewed and permitted by the various outside agencies along with the undercrossing, rather then by a separate submittal. 0 0 Agenda Item -3- July 17, 2001 In addition, Staff time has been reduced due to the unexpected time necessary in dealing with outside agencies, preparing agreements and overseeing the design consultant. Therefore, due to Staff time limitations, grant funding availability and permit requirements by outside agencies, Staff would prefer the paving of the bike trail be included in the undercrossing design. This will insure the bike trail is completed along with the undercrossing, thus completing the bikeway from Doheny State Beach to Avenida Siega, at the east City limit of San Juan Capistrano. Patterson has estimated the additional design and specification costs at $5,500. The additional paving is estimated at $17,000. The cost of the additional work is $42,750. The original contract is in the amount of $118,105. Approval of the additional work will result in a total of $160,855. The additional costs will be funded entirely from the City's share of the project and will remain within the current budgeted funds. The City's share of the design costs are funded from an OCTA grant. Construction of the undercrossing is presently estimated at $1,100,000. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: Not applicable. FINANCIAL CONSIDERATIONS: This project is budgeted in account 12-62115-4734-124-000 in the amount of $1, 300,000. $200,000 is City funds previously deposited with OCTA for the now defunct project to realign the railroad bridge spanning San Juan Creek. The City will also receive a yet to be determined amount of interest paid on the $200,000 accrued since December, 1998. In addition, the City has received approval of a Transportation Enhancement Act grant in the amount of $1,100,000 for construction of the undercrossing. Upon closure of the crossing, Staff has worked with OCTA to provide a safe crossing. Staff proposed a signalized, at -grade crossing.
