County Rowrda WHEREAS, OWNER has submitted to the City a proposed form of Comprehensive Development Plan for approximately 330 (three hundred and thirty) acres located within this City, a copy of which Comprehensive Development Plan (CDP) is attached hereto as Exhibit I; and, WHEREAS, approval of said Comprehensive Development Plan was conditioned upon Owner entering into an Agreement whereby Owner would dedicate and transfer to the City development rights for, on and to CDP Area 16 (General Agricultural District) prior to the issuance of -the first residential building permit for Parcels 1 through 13, A and B, as designated in said Comprehensive Development Plan. X '(1, 1,1111 (71 NOW, THEREFORE, the parties hereto in consideration of mutual convenants and conditions set forth herein and substantial public benefits to be derived hereby agree as follows: -1- * a BK 13456 Po 1427 1. Owner and City hereby agree that prior to the issuance of the first residential building permit for the residential development of Parcels Ithrough 13, A and B, under the Comprehensive Development Plan approved by the City Council of the City of San Juan Capistrano on August 15, 1979, Owner shall dedicate and transfer to City the development rights for, on and to CDP Area 16 to maintain the open space and/or agricultural nature of the area. Consideration for such dedication shall be the City's approval of the aforesaid CDP and waiver of agricultural development fees assessed pursuant to Ordinance 316. Such instrument of dedication and transfer shall be subject to the approval of the City Attorney. 2. Owner and City agree that Exhibit A shall be substantially the configuration shown as Parcel 16 of said Comprehensive Development Plan, but it is understood that the boundaries of the area to be subject to said Agreement may be adjusted to conform to precise boundaries of the parcel or tract maps.
