2009, by and between the City of San Juan Capistrano (hereinafter referred to as the
"CITY") and IS Architecture (hereinafter referred to as the "CONSULTANT").
WHEREAS, CITY and CONSULTANT entered into an agreement dated October 21,
2008, for historic preservation and architectural consulting services for the Blas Aguilar
Adobe Phase C and Roof Improvements Project (CIP No. 455) in an amount not to exceed
$60,870; and
WHEREAS, based on existing conditions revealed during the work under the
agreement to date, CONSULTANT has identified additional tasks necessary to complete
the scope of work; and
WHEREAS, CITY has reviewed, and concurs with the necessity of, said additional
tasks; and
WHEREAS, CITY and CONSULTANT hereby desire to amend the agreement to
incorporate the additional tasks in the scope of work.
Section 1. The scope of work to be performed by Consultant is amended to
incorporate the additional tasks totaling $4,575 as set forth in Exhibit "A," attached
and incorporated herein by reference.
Section 2. Section 3.1 (Compensation, Amount) is hereby amended to read as
follows:
"Total compensation for the services hereunder shall not exceed $72,000
consisting of: 1) the scope of work as amended totaling $65,445 and 2) a
10% contingency totaling $6,555."

Section 3. All other provisions of the Agreement not amended hereunder shall
remain in full force and effect.

Re: Blas Aguilar - South Wall
Dear Teri,
We would like to summarize the concerns and costs of the proposed exploration of the south wall at the rear
of Blas Aguilar. Per the Gilbert Sanchez report done in 1991, the south wall was noted to be pushing out
and potentially failing. In his report he suggested poor drainage and excessive moisture in the wall might be
the cause of the deterioration. The report recommended removing the concrete walkway that was against the
wall, with the assumption that the poor drainage caused by the walkway's slope towards the building•was the .
source of the moisture trapped in the wall. The walkway was removed, but the wall has continued to fail.
Evidence of the continuing deterioration of the wall can be seen in the new stress marks in the ceiling,
cracking of the interior wall finishes, and the existence of a slope / bulge on the exterior of the wall.
Both the architect and structural engineer agree that an exploratory investigation needs to be preformed to,
help uncover what the cause of the problem is and to.provide a direction for a solution. The following is
proposed for the exploration:
- Provide a trench at the face of the building, 3' wide, 3' out, and the depth of the foundation, to
uncover if the foundation is failing. IS Architecture has coordinated with their archaeologist, Steven
Van Wormer, to provide a unit. It is- expected to take the two person team two days to perform the
work. We have also coordinated to have David Blardes as the Native American monitor out at the
site during excavation.
- Open a 2 foot wide vertical opening from the bottom of the wall to the eave to reveal if there is
basal erosion, adobe degradation, and if the bond beam is connect to the top of the wall. The city
will coordinate with the contractor to open up the wall, per the direction of IS Architecture. After
the inspection the contractor will patch the wall with stucco, and backfill the trench as agreed upon
by the city and archeologist.
Our firm is very concerned that the south wall's condition needs to be explored; the wall will continue to
degrade and eventually cause failure, which could potentially be a major life -safety issue. At the time. our firm
responded to the Request for Proposal, the urgent condition of this wall was not anticipated. Our firm would
like to minimize the additional costs of a change in scope of work. We have therefore reviewed the original
budget to determine where there are funds that could be reallocated to this purpose, and where additional
funds will be needed. We have broken down the costs into four areas.
First, since it has been determined that there will be no archeological work regarding the well, the budget in
IS Architecture's contract for, the archaeologist of $3,000 will cover the estimated $1,500 excavation cost for
a team of two working for two days. The remainder of the archaeological budget will assist with the cost of
cataloging and writing a report on any found artifacts. However, depending on what is found, the costs will
vary and additional funds may be needed to complete the appropriate documentation of the artifacts.
Second, the structural engineer has requested material testing -of the existing bond beam. The estimated cost
for this service is $1,000 plus mileage costs ($75). The original budget contained'$1,000 for spectroscopic
analysis of the wood. After close inspection of the resource there are no wood members remaining that

necessitate testing. We would therefore recommend that the budget be reassigned to material testing. This
will leave a small difference between the two budgets.
At.the time of the coordination with David Blardes, he did not request a fee for his services, but if he does,
the city will need to address this item with him.
Third, reviewing and analyzing the cause of the wall's deterioration will necessitate an additional site visit.
Our firm had budgeted for two additional meetings; we would propose that the cost of our additional site
visit would be drawn from. this budget. However, the structural engineer did not anticipate an additional site
visit. He is requesting an additional $1,000 to cover the cost of the site visit.
Fourth, the south wall will need structural and architectural construction documents to repair the wall. The
architectural services are fairly minimal and are estimated at $2,000. Structural engineering is the
preponderance of the work and is estimated at $1,500 in additional costs. We were not able to identify an
existing budget that could absorb. these costs.
