AGENDA REPORT D18
TO: Mayor and City Council
FROM: Dave Adams, City Manager
SUBJECT: Consideration of Consulting Services for State and Federal Government
Advocacy Services — FY 2008/09 (Townsend Public Affairs, Inc. and
Pattton Boggs, LLP)
RECOMMENDATION:
By motion,
1. Approve the agreement with Townsend Public Affairs, Inc. to provide state
government advocacy services for the period of July 1, 2008 through December
31, 2008 not to exceed $30,000 plus expenses during the term of the agreement,
and
2. Approve the agreement with Patton Boggs,. LLP to provide federal government
advocacy services for the period of July 1, 2008 through December 31, 2008 not
to exceed $50,000 plus expenses during the term of the agreement, and
3. Authorize the City Manager to execute the agreements, as approved by the City
Attorney, for these services.
SITUATION:
In effort to assist the City in securing state and federal funding for capital improvement
projects, highlight government funding opportunities and keep state and federal officials
briefed on the City's priority objectives, the City Council approved contracts for state
and federal advocacy services in October 2007. To date, the City has applied for the
following state and federal grants:
State
• Safe Routes to School Grant $308,400
Various Sidewalk and Crosswalk Improvements
Federal
• Water Resources Development Act of 2008 $10 million
San Juan Watershed Restoration Project
Agenda Report •
Page 2 August 5, 2008
Fiscal Year 2009 Appropriations Requests
Dept. of Interior - Los Rios Historic District Park $1 miilion
THUD - Del Obispo Street Circulation Improvements and
Bridge Widening Project (CIP #122) $5 million
THUD - San Juan Creek Road Widening, Valle Road
to Camino Capistrano (CIP #406) $4.2 million
Title XVI — Recycled Water System $3 million
The previous agreements ran from October 16, 2007 through June 30, 2008 and were
at reduced rates. The FY 2008/09 provides $80,000 is funding for lobbyist services
which is sufficient to fund services from through December 2008. Therefore the
contracts for consideration are for July 1, 2008 through December 31, 2008. Staff will
return to City Council in December 2008 for consideration of continuation of services
which would require an additional appropriation of general fund reserves of $80,000. If
the City is successful in obtaining grants that will offset existing funding of projects a
portion of that savings could be allocated to the cost of lobbying for those grant funds.
Staff recommends the City Council approve the agreements for advocacy services with
Townsend Public Affairs, Inc. and Patton Boggs, LLC. and authorize the City Manager
to execute the agreements.
Background:
Based on our research, recommendations from other municipalities and prior
experience, staff has identified the following firms to provide these services through
June 30, 2008. At the end of the contract period, staff will review and evaluate these
services and provide a recommendation to the City Council regarding further advocacy
services.
Townsend Public Affairs, Inc. (TPA) has been providing advocacy services since 1998
and is one of the top 15 intergovernmental advocacy firms in California. TPA possesses
the skills, experience and a track record of results that will assist the City in achieving
tangible outcomes.
Patton Boggs, LLP has been _providing advocacy service for more than 40 years.
Patton Boggs is one of American Lawyer's'Top 100" US law firms and is consistently
ranked as the nation's number one lobbying firm by the National Journal, Roll Call,
Influence and The Hill. The firm provides services to state and local municipalities
relying on the professional skill, integrity and vision of more than 500 lawyers and non -
lawyer specialists to provide their clients with a high level of service and assistance.
Both firms have agreed to a retainer fee of $4,500 per month plus expenses. The term
of this initial agreement would be from August 5, 2008 through June 30, 2008.
Staff recommends the City Council approve Townsend Public Affairs, Inc. (State) and
Patton Boggs, LLP (Federal) to provide state and federal government advocacy

services from October 1, 2007 through June 30, 2007 at a rate of $4,500 per month, not
to exceed $40,000 plus expenses during the term of the agreement for each firm, and
authorize the City Manager to execute the agreements, as approved by the City
Attorney, for these services.
COMMISSION/BOARD REVIEW AND RECOMMENDATIONS:
Not Applicable
FINANCIAL CONSIDERATIONS:
The City Council has approved funding for these services in the amount of $80,000 for
FY 2008/09. These two agreements total $80,000 plus expenses. Expenses can be
covered from minor administrative transfers from other budget savings.
