W I T N E S S E T H: WHEREAS, CITY is the holder of certain equestrian/hiking trail easements over Tract 6305 as listed on Exhibit "A" attached and; WHEREAS, CITY desires to secure the trails for equestrian and hiking use during daylight hours only; and WHEREAS, HOMEOWNERS desire maintenance and access to the equestrian/hiking trails compatible with the Hunt Club Development. NOW, THEREFORE, in consideration of the approval by CITY of the equestrian/hiking trails in Tract 6305, HOMEOWNERS covenant and agree to maintain the equestrian/hiking trails shown in Exhibit "B" attached in accordance with the following provisions. 1. HOMEOWNERS shall supply, install, and maintain unlocked gates at equestrian/hiking trail intersections shown in Exhibit "C". 2. HOMEOWNERS shall maintain equestrian/hiking trails at a minimum in accordance with the adopted City trail maintenance standards shown in Exhibit "D". The foregoing obligations shall be a burden upon and be binding upon, and inure to the benefit of the parties hereto, their successors and assigns. Equestrian/hiking trails shall be weeded annually .n conjunction �a th the City's Weed Abatement Program. Vandalized and/or broken equestrian/hiking trail fencing shall be repaired by the City in an expeditious manner. Erosion problems within equestrian/hiking trails shall be regraded during the City's annual weeding of the trail system. Major erosion problems on General Plan equestrian/hiking trails shall be regraded as necessary to maintain a passable trail. Equestrian/hiking trails are for the exclusive use of equestrians and hikers. No vehicles, other than maintenance vehicles, shall be permitted on equestrian/hiking trails without the written authorization of the Director of Public Works. Civic groups, homeowner associations and individuals may undertake additional maintenance responsibilities over equestrian/hiking trails subject to an appropriate contract/agreement. The City shall perform additional maintenance of equestrian/hiking trails as deemed necessary and/or appropriate by the Director of Public Works. All maintenance obligations for equestrian/hiking trails in this policy shall be conditioned on the availability the City Budget or as authorized by the City Council. Approved by: WA&.I William D.
