Section 3, Compensation 3.1 Amount, The City hereby agrees to pay the additional sum of Forty Four Thousand Nine Hundred and Fifty Dollars ($44,950.00) for a revised total not to exceed contract price of Two Hundred Seventy Seven Thousand Eight Hundred and Twenty Dollars ($277,820.00) to Consultant for those services performed as set forth in Exhibit "A". SD 3.2 Method of Payment. Subject to Section 3.1, Consultant shall submit monthly invoices based on total services which have been satisfactorily completed for such monthly period. The City will pay monthly progress payments based on approved invoices in accordance with this Section. Section 4. Entire Agreement This Amendment constitutes the entire understanding and agreement between the parties with respect to those additional services described herein and any other understandings, oral or in writing, are hereby superseded. Approve the plans and specifications for Citywide Pavement Rehabilitation project; and, 2. Authorize the City Clerk to receive bids; and, 3. Approve an Amendment to the Personal Service Agreement with George G. Boghossian & Associates, Inc. SITUATION Summary and Recommendation Plans and specifications for Citywide Pavement Rehabilitation project have been prepared. Staff is requesting City Council approval of the plans and specifications, and authorization to receive bids. A copy of the plans and specifications is available for review in the City Clerk's office. Approval of an addendum for design of additional streets by George G. Boghossian & Associates, Inc. is also requested (Exhibit A of Attachment 1). Background The Pavement Rehabilitation project consists of placing asphalt concrete overlays on several streets as well as cape seal improvements on other public roadways in the City. Cape sealing process combines the application of chip seal followed by a slurry seal. The project also includes construction of handicap ramps, cold milling pavement where necessary, speed humps, striping, resetting of surveying monuments, and removal and Agenda Report June 16, 2009 Page 2 replacement of existing potholes in areas of pavement stress/failure. A list of streets that will be rehabilitated this summer and have already been designed is provided as Attachment 2. Right-of-way acquisition is not necessary to implement the project.. In October 2007, the City retained George G. Boghossian & Associates, Inc. to prepare the design pians for the rehabilitation of 41 streets in San Juan Capistrano. City field staff have recommended addition of other streets to future workload and we have received a proposal by the consultant for design services. Exhibit A of the Amendment to the Personal Service Agreement, Attachment 1, lists additional streets to be designed for the amount of $44,950. This project includes $500,000 in Federal stimulus package funds, ear -marked for Camino Capistrano between La Zanja and San Juan Creek Road. Since CalTrans is the approving agency for Federal dollars, this project will be advertised as soon as we receive the "notice to proceed" from CalTrans. Staff has been working with CalTrans over the past two months to finalize the necessary paperwork for the project. ENVIRONMENTAL REVIEW The City's Environmental Administrator has determined this project to be Categorically Exempt. COMMISSION/ BOARD REVIEW AND RECOMMENDATIONS Not Applicable FINANCIAL CONSIDERATIONS This project has a prior approved budget for construction of $1,084,500 and for design of $25,000 in accounts 50-00000-67401-07105-000 and 50-.00000-62250-07105-000, respectively. Additional $1,071,000 in funds is included in the Capital Improvement Program for FY 2009/2010 to cover construction costs, staff time, and design. Additionally, we will receive $500,000 in federal stimulus funds for the rehabilitation of Camino Capistrano from La Zanja to San Juan Creek Road, and $86,000 of new C.A.P. funding in FY 2009/2010. The FY 2009/2010 budget also includes the following funds that will be transferred to this project: 07109 — Arterial Street Rehabilitation in the amount of $172,500 08102 — Pavement Management Program in the amount of $45,000 Overall, the project has $3,708,126 in total budget for design and construction.
