9 California (hereinafter referred to as "AUTHORITY"), and City of San Juan Capistrano, a municipal
10 corporation (hereinafter referred to as"AGENCY").
11 WITNESSETH:
12 WHEREAS, by Agreement No. C-95-989 dated August 18, 1995, as last changed by
13 Amendment No. 12 dated April 26, 2007, AUTHORITY and AGENCY entered into an Agreement which
14 determined that AGENCY was eligible to receive funding under the Combined Transportation Funding
15 Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian Facilities
16 Program; and
17 WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be
18 updated as required; and
19 WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A;
20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as
21 follows:
22 Amend Exhibit A. "Combined Transportation Funding Programs (CTFP) Allocations", to delete
23 the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding
24 Programs (CTFP) Active Project List", dated March 31, 2007, included in this Amendment as
25 Attachment No. 1 which is incorporated into and made a part of the Agreement.

RECOMMENDATION
By motion, approve Amendment No. 12 to Cooperative Agreement No. C-95-989
Combined Transportation Funding Programs Master Funding Agreement with Orange
County Transportation Authority (OCTA).
SITUATION
A. Summary and Recommendation
At their meeting of August 1, 1995, the City Council of San Juan Capistrano
adopted Resolution No. 95-8-1-3 approving Cooperative Agreement No. C-95-
989 with the Orange County Transportation Authority (OCTA).
Staff is now recommending approval of Amendment No. 12 to the Agreement
which revises the project allocation exhibit.
B. Background
In 1995, the Orange County Transportation Authority (OCTA) worked with the
Technical Advisory Committee (TAC) to develop a Master Funding Agreement,
The TAC is a committee comprised of Public Works Directors and City Engineers
from all the Orange County cities and County staff. The purpose of the Master
Funding Agreement is to clarify the roles and responsibilities of the Authority and
each local jurisdiction with respect to delivery of projects funded by Measure M
and the Bicycle/Pedestrian Facilities Program.
By executing the agreement, OCTA agrees to fund all approved projects. The
City agrees to complete all phases and activities of the approved projects in a
timely manner. The Agreement provides for periodic reviews and updates.

(Ortega Highway to Camino Capistrano) - $296,030 ; Project No. 05-
SJCP-AHRP-2404 Del Obispo Street Rehabilitation (Aguacate Road to
Alipaz Street) - $167,218 ; Project No. 05-SJCP-AHRP-2402 Junipero
Serra Road Rehabilitation (Camino Capistrano to 1-5 southbound ramps) -
$100,986 have been consolidated as Project No. 05-SJCP-AHRP-2403 -
$564,234 for FY 2006-07.
Project No. 05-SJCP-AHRP-2406 Del Obispo Street Rehabilitation (Paseo
De La Paz to N/O Blue Fin Drive) - $261,338, Project No. 05-SJCP-
AHRP-2405 Del Obispo Street Rehabilitation (Aguacate Road to Paseo
De La Paz) - $326,725 have been consolidated as Project No. 05-SJCP-
AHRP-2406 - $588,063 and moved from FY 2005-06 to FY 2006-07.
Project No. 03-SJCP-MPH-1202 Del Obispo Street Widening at Calle
Aspero - $212,504 has been moved from FY 2005-06 to FY 2007-08.
City Council may wish to be aware of the following:
Ortega Highway funding 97-SJCP-GMA-1131 for $250,000; 97-SJCP-
MPH-1133 for $178,448; 99-SJCP-GMA-2008 for $144,901 represent
funding for the previously constructed widening of Ortega Highway from
Rancho Viejo Road to 1-5. These funding allocations have been 90%
drawn down but remain unresolved due to right of way issues.
March 2007 requests to extend Ortega Interchange funding 00-SJCP-RIP-
3160 for $2,500,000 to FY 2008-2009; La Novia Bridge funding 05-SJCP-
MPAH-2400 for $3,279,826 to FY 2008-2009 and Ortega Highway Signal
Timing and Coordination 03-SJCP-SIP-1203 for $158,000 to FY 2007-

2008 are not confirmed at this time and should be reflected in the next
Amendment.
COMMISSIONS/BOARD REVIEW, RECOMMENDATIONS
Not applicable.
FINANCIAL CONSIDERATIONS
Approval of Amendment No. 12 will maintain City's eligibility to receive Measure M
funds and Bicycle/Pedestrian Facilities funds in a timely manner. There is no impact on
City funds.

9 California (hereinafter referred to as "AUTHORITY"), and City of San Juan Capistrano, a municipal
10 corporation (hereinafter referred to as "AGENCY").
11 WITNESSETH:
12 WHEREAS, by Agreement No. C-95-989 dated August 18, 1995, as last changed by
13 Amendment No. 9 dated October 28, 2004, AUTHORITY and AGENCY entered into an Agreement
14 which determined that AGENCY was eligible to receive funding under the Combined Transportation
is Funding Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian
16 Facilities Program; and
17 WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be
18 updated as required; and
19 WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A;
20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as
21 follows:
22 Amend Exhibit A, "Combined Transportation Funding Programs (CTFP) Allocations", to delete
23 the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding
24 Programs (CTFP) Allocations", dated December 20, 2004, included in this Amendment as Attachment
25 No. 1 which is incorporated into and made a part of the Agreement.

7 THIS AMENDMENT NO. 5 is made and entered into thiss� y of
8 2003, by and between the Orange County Transportation Authority, a public corporation of the State of
9 California (hereinafter referred to as "AUTHORITY"), and City of San Juan Capistrano, a municipal
10 corporation (hereinafter referred to as "AGENCY").
11 WITNESSETH:
12 WHEREAS, by Agreement No. C-95-989 dated August 18, 1995, as last changed by
13 Amendment No. 4 dated November 6, 2001, AUTHORITY and AGENCY entered into an Agreement
14 which determined that AGENCY was eligible to receive funding under the Combined Transportation
15 Funding Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian
16 Facilities Program; and
17 WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be
18 updated as required; and
19 WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A;
20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as
21 follows:
22 Amend Exhibit A. "Combined Transportation Funding Programs (CTFP) Allocations", to delete
23 the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding
24 Programs (CTFP) Allocations", dated July 26, 2002, included in this Amendment as Attachment No. 1
25 which is incorporated into and made a part of the Agreement.

7 7. AUTHORITY requires written notification at the time when right of way is
8 declared excess to the transportation improvement, and prior to the disposal process.
9 Resolution of any issues regarding whether or not a right of way is excess to the transportation
10 improvement will be by the mutual agreement of AUTHORITY and AGENCY. Excess land
11 acquired with CTFP funds shall be sold by AGENCY in accordance with Government Code,
12 Article 8, Surplus Land, Section 54220-54232, et.sea., and proceeds from the sale shall be
13 returned immediately to AUTHORITY.

9 (herein after referred to as "AUTHORITY"), and City of San Juan Capistrano, 30,400 Paseo
10 Adelanto, San Juan Capistrano, California 92675 (hereinafter referred to as "AGENCY').
11 WITNESSETH:
12 WHEREAS, AUTHORITY has determined that AGENCY has met the requirements of
13 and is eligible under the Combined Transportation Funding Programs (CTFP) as specified
14 in the CTFP Manual and has approved AGENCYs project(s) specified in Exhibit A or the
15 most recent amendment thereto (hereinafter referred to as"PROJECT(s)") to receive funding
16 under the CTFP; and
17 WHEREAS, AUTHORITY has also approved AGENCY's project(s) specified in Exhibit
18 B or the most recent amendment thereto (hereinafter referred to as "PROJECT(s)") to
19 receive funding under the Bicycle and Pedestrian Facilities Program;
20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and
21 AGENCY as follows:
22 1. AGENCY shall implement and complete PROJECT(s) funded under this
23 Agreement in accordance with the CTFP Manual, Bicycle and Pedestrian Facilities Manual,
24 and the AGENCY's PROJECT(s) application submitted to AUTHORITY and in accordance
25 with Exhibit A, "CTFP Program,"Exhibit B, "Bicycle and Pedestrian Facilities Program,"which
26 are attached to and, by this reference, incorporated in and made a part of this Agreement.

3 2. For AGENCY's full and complete performance in delivering PROJECT(s) under
4 this Agreement, AUTHORITY shall pay AGENCY in accordance with the project budget,
5 specified in Exhibit A or B of this Agreement, and the policies and procedures contained
6 in the CTFP and Bicycle and Pedestrian Facilities Manuals.
7 3. CTFP or Bicycle and Pedestrian Facilities funds expended by AGENCY on
8 activities other than those approved by the Authority's Board of Directors, which are
9 specified in Exhibit A and B, shall be returned to AUTHORITY within 30 days of
10 AUTHORITY's written order.
11 4. If AGENCY fails to implement and/or complete any PROJECT(s) in accordance
12 with article 1. of this Agreement and specifically in accordance with the approved project
13 description (i.e., all PROJECT(s) phases and activities must be completed by PROJECT(s)
14 close-out), unless otherwise agreed in writing by both AUTHORITY and AGENCY, the full
15 amount of funding programmed by AUTHORITY for such projects shall be returned to
16 AUTHORITY within 30 days of AUTHORITY's written order. AUTHORITY shall have sole
17 discretion in determining whether PROJECT(s) has been completed satisfactorily.
18 5. Upon close-out of each PROJECT(s) under this Agreement and before final
19 payment is processed, AUTHORITY, or other agents of AUTHORITY, may perform an audit
20 to ensure that CTFP policies and procedures were followed. Such audit shall be performed
21 within 90 days of AUTHORITY receiving the final report for each PROJECT(s). If the audit
22 determines that any of the activities performed are ineligible for CTFP funding, AGENCY
23 shall return the amount of funding used to perform ineligible activity to AUTHORITY.
24 This Agreement shall be made effective upon execution by both parties and shall
25 remain in effect until both parties agree to amend or terminate it. Amendments to Exhibit
26 A and Exhibit B will be made on a periodic basis and attached hereto by reference.

By motion, approve Amendment No. 13 to Cooperative Agreement No. C-95-989
Combined Transportation Funding Programs Master Funding Agreement with Orange
County Transportation Authority (OCTA).
SITUATION
A. Summary and Recommendation
At the August 1, 1995 meeting, the City Council adopted Resolution No. 95-8-1-3
approving Cooperative Agreement No. C-95-989 with the Orange County
Transportation Authority (OCTA).
Staff is now recommending approval of Amendment No. 13 to the Agreement,
which revises the project allocation exhibit.
B. Backaround
In 1995, the Orange County Transportation Authority (OCTA) worked with the
Technical Advisory Committee (TAC) to develop a Master Funding Agreement.
The TAC is a committee comprised of Public Works Directors and City Engineers
from all the Orange County Cities and County staff. The purpose of the Master
Funding Agreement is to clarify the roles and responsibilities of the Authority and
each local jurisdiction with respect to delivery of projects funded by Measure M
and the Bicycle/Pedestrian Facilities Program.
By executing the Agreement, OCTA agrees to fund all approved projects. The
City of San Juan Capistrano agrees to complete all phases and activities of the
approved projects in a timely manner. The Agreement provides for periodic
reviews and updates.

RECOMMENDATION
By motion, approve Amendment No. 10 to Cooperative Agreement No. C-95-989
Combined Transportation Funding Programs Master Funding Agreement with Orange
County Transportation Authority (OCTA).
SITUATION
A. Summary and Recommendation
At their meeting of August 1, 1995, the City Council of San Juan Capistrano
adopted Resolution No. 95-8-1-3 approving Cooperative Agreement No. C-95-
989 with the Orange County Transportation Authority (OCTA).
Staff is now recommending approval of Amendment No. 10 to the Agreement
which revises the project allocation exhibit.
B. Background
In 1995, the Orange County Transportation Authority (OCTA) worked with the
Technical Advisory Committee (TAC) to develop a Master Funding Agreement.
The TAC is a committee comprised of Public Works Directors and City Engineers
from all the Orange County cities and County staff. The purpose of the Master
Funding Agreement is to clarify the roles and responsibilities of the Authority and
each local jurisdiction with respect to delivery of projects funded by Measure M
and the Bicycle/Pedestrian Facilities Program.
By executing the agreement, OCTA agrees to fund all approved projects. The
City agrees to complete all phases and activities of the approved projects in a
timely manner. The Agreement provides for periodic reviews and updates.

Project No. 99-SJCP-AHP-1089 Ortega Highway Resurfacing (Del Obispo Street
to 1-5), project complete, and removed from schedule.
Project No. 99-SJCP-TDM-3161 Vereda Bikeway Undercrossing - $100,000
funding moved from Fiscal Year 03-04 to Fiscal Year 04-05.
COMMISSIONS/BOARD REVIEW, RECOMMENDATIONS
Not applicable.
FINANCIAL CONSIDERATIONS
Approval of Amendment No. 10 will maintain City's eligibility to receive Measure M
funds and Bicycle/Pedestrian Facilities funds in a timely manner. There is no impact on
City funds.

7 THIS AMENDMENT NO. 10 is made and entered into this__day of ,
8 2005, by and between the Orange County Transportation Authority, a public corporation of the State of
9 California (hereinafter referred to as "AUTHORITY"), and City of San Juan Capistrano, a municipal
10 corporation (hereinafter referred to as "AGENCY").
11 WITNESSETH:
12 WHEREAS, by Agreement No. C-95-989 dated August 18, 1995, as last changed by
13 Amendment No. 9 dated October 28, 2004, AUTHORITY and AGENCY entered into an Agreement
14 which determined that AGENCY was eligible to receive funding under the Combined Transportation
15 . Funding Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian
16 Facilities Program; and
17 WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be
18 updated as required; and
19 WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A;
20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as
21 follows:
22 Amend Exhibit A. "Combined Transportation Funding Programs (CTFP) Allocations", to delete
23 the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding
24 Programs (CTFP) Allocations", dated December 20, 2004, included in this Amendment as Attachment
25 No. 1 which is incorporated into and made a part of the Agreement.

9 California (hereinafter referred to as "AUTHORITY"), and City of San Juan Capistrano, a municipal
10 corporation (hereinafter referred to as "AGENCY").

13 Amendment No. 10 dated March 23, 2005, AUTHORITY and AGENCY entered into an Agreement
14 which determined that AGENCY was eligible to receive funding under the Combined Transportation

SITUATION
A. Summary and Recommendation
At their meeting of August 1, 1995, the City Council of San Juan Capistrano
adopted Resolution No. 95-8-1-3 approving Cooperative Agreement No. C-95-
989 with the Orange County Transportation Authority (OCTA).
Staff is now recommending approval of Amendment No. 9 to the Agreement
which revises the project allocation exhibit.
B. Background
In 1995, the Orange County Transportation Authority (OCTA) worked with the
Technical Advisory Committee (TAC) to develop a Master Funding Agreement,
The TAC is a committee comprised of Public Works Directors and City Engineers
from all the Orange County cities and County staff. The purpose of the Master
Funding Agreement is to clarify the roles and responsibilities of the Authority and
each local jurisdiction with respect to delivery of projects funded by Measure M
and the Bicycle/Pedestrian Facilities Program. By executing the agreement,
OCTA agrees to fund all approved projects. The City agrees to complete all
phases and activities of the approved projects in a timely manner. The
Agreement provides for periodic reviews and updates.

$28,880 design funding brought forward from FY 2005-06 to FY 2003-04 to
match City Capital Improvement Program.
Project No. 00-SJCP-RIP-3160, 1-5 Interchange/Ortega Highway - $2,500,000
delayed from FY 2003-04 to FY 2004-05 to match City Capital Improvement

7 THIS AMENDMENT NO. 7 is made and entered into this - day of
a 2003, by and between the Orange County Transportation Authority, a public corporation of the State of
v California (hereinafter referred to as "AUTHORITY"), and City of San Juan Capistrano, a municipal
10 corporation (hereinafter referred to as "AGENCY").
11 WITNESSETH:
12 WHEREAS, by Agreement No. C-95-989 dated August 18, 1995, as last changed by
13 Amendment No. 6 dated April 28, 2003, AUTHORITY and AGENCY entered into an Agreement which
14 determined that AGENCY was eligible to receive funding under the Combined Transportation Funding
15 Programs (CTFP) as specified in the CTFP Manual and also the Bicycle and Pedestrian Facilities
16 Program; and
17 WHEREAS, periodic scheduled reviews approved by AUTHORITY and AGENCY may be
18 updated as required; and
19 WHEREAS, both parties have agreed to amend the list of projects set forth in Exhibit A;
20 NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and AGENCY as
21 follows:
22 Amend Exhibit A, "Combined Transportation Funding Programs (CTFP) Allocations", to delete
23 the Exhibit in its entirety and in lieu thereof insert the revised "Combined Transportation Funding
24 Programs (CTFP) Allocations", dated July 25, 2003, included in this Amendment as Attachment No. 1
25 which is incorporated into and made a part of the Agreement.

SITUATION
A. Summary and Recommendation
At their meeting of August 1, 1995, the City Council of San Juan Capistrano
adopted Resolution No. 95-8-1-3 approving Cooperative Agreement No. C-95-989
with the Orange County Transportation Authority (OCTA)
Staff is now recommending approval of Amendment No. 6 to the Agreement which
revises the project allocation exhibit.
B. Background
In 1995, the Orange County Transportation Authority (OCTA) worked with the
Technical Advisory Committee(TAC)to develop a Master Funding Agreement.The
TAC is a committee comprised of Public Works Directors and City Engineers from
all the Orange County cities and County staff. The purpose of the Master Funding
Agreement is to clarify the roles and responsibilities of the Authority and each local
jurisdiction with respect to delivery of projects funded by Measure M and the
Bicycle/Pedestrian Facilities Program. By executing the agreement, OCTA agrees
to fund all approved projects. The City agrees to complete all phases and activities
of the approved projects in a timely manner. The Agreement provides for periodic
reviews and updates.

Project Description: This is consideration of an amendment (No. 4) to a
Cooperative Agreement with the OCTA.
Written Communications: Report dated October 2, 2001, prepared by William M.

Oral Presentation: William M. Huber, Director of Engineering and Building,
reported that staff had issued a written request to OCTA to have the Ortega
City Council Minutes 3 10-02-01
Widening project withdrawn from the Master Funding Agreement. OCTA was in
the process of considering this request, which will meet the Board level later this
year. The Ortega Widening project must remain in the Master Funding
Agreements until there is official action to remove the project. The City secured
$2.5 million, 50% of estimated design costs for an Ortega interchange, Measure
M funds and is seeking additional funding through other sources; a process
expected to take several years. Council's vote to approve Amendment No. 4
does not commit the City to future projects, but if Council does not support the
amendment, funding for other projects that benefit the City could not be
processed.
Council Action: Moved by Council Member Campbell, seconded by Mayor pro
tem Swerdlin and carried unanimously, 5-0, to approve Amendment No. 4 to the
Cooperative Agreement No. C-95-989 Combined Transportation Funding
Programs Master Funding Agreement between Orange County Transportation
Authority and the City of San Juan Capistrano; and, direct Staff to communicate

A. Summary and Recommendation

Staff is now recommending approval of Amendment No. 4 to the Agreement which
revises the project allocation exhibit.
B. Background

Technical Advisory Committee(TAC)to develop a Master Funding Agreement.The
TAC is a committee comprised of Public Works Directors and City Engineers from
all the Orange County cities and County staff. The purpose of the Master Funding
Agreement is to clarify the roles and responsibilities of the Authority and each local
jurisdiction with respect to delivery of projects funded by Measure M and the

to fund all approved projects by the Board. The City agrees to complete all phases
and activities of the approved projects in a timely manner. The Agreement provides

As set forth in the Report dated March 7, 2000, from the Engineering and Building
Director, the plans, specifications and call for bids were approved to install previously-
approved speed bumps on the following streets: Calle Entradero; Paseo San Gabriel;
Calle San Remo; and, Via de Agua between Calle De Bonanza and Camino Las
Ramblas.
Letters requesting the installation of speed bumps on Via de Agua be tabled until all
residents can express their opinion were received from: (1) Seabreeze Management

SITUATION
A. Summary and Recommendation
At their meeting of August 1, 1995, the City Council of the City of San Juan
Capistrano adopted Resolution No. 95-8-1-3 approving Cooperative Agreement
No. C-95-989 with the Orange County Transportation Authority (OCTA). At the
City Council meeting of October 5, 1999, City Council approved Amendment No. 1
to the Agreement to include indemnification provisions and disposal methods for
excess right-of-way acquired with Measure M funding.
Staff is now recommending approval of Amendment No. 2 to the Agreement which
revises the project allocation exhibit.
B. Background
In 1995, the Orange County Transportation Authority (OCTA)worked with the
Technical Advisory Committee (TAC) to develop a Master Funding Agreement.
The TAC is a committee comprised of Public Works Directors and City Engineers
from all the Orange County cities and County staff. The purpose of the Master
Funding Agreement is to clarify the roles and responsibilities of the Authority and
each local jurisdiction with respect to delivery of projects funded by Measure M
and the Bicycle/Pedestrian Facilities Program. By executing the Agreement,
OCTA agrees to fund all approved projects by the Board. The City agrees to
complete all phases and activities of the approved projects in a timely manner.
The Agreement provides for periodic reviews and updates.
Amendment No. 2 revises the project allocation exhibit.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING THE MASTER FUNDING
AGREEMENT WITH THE ORANGE COUNTY TRANSPORTATION
AUTHORITY
WHEREAS, it is desired by the Orange County Transportation Authority and the Citv
of San Juan Capistrano to enter into a Master Funding Agreement for Measure M and
bicycle/pedestrian facility funded projects; and,
WHEREAS, the Master Funding Agreement clarifies the roles and responsibilities
of the Authority and City with respect to funding and delivery of projects; and,
WHEREAS, it is necessary to enter into said agreement to maintain eligibility for
projects funded through said program.
NOW,THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Juan Capistrano does hereby authorize the Mayor to execute and the City Clerk to attest the Master
Funding Agreement with the Orange County Transportation Authority.

SUBJECT: Approval of Orange County Transportation Authority Master Funding Agreement
RECOMMENDATION
It is recommended that City Council adopt a resolution authorizing the Mayor to execute a Master
Funding Agreement with the Orange County Transportation Authority.
SITUATION
A. Summary and Recommendation
The Master Funding Agreement with the Orange County Transportation Authority clarifies
the roles and responsibilities of the Authority and local agency for all Measure M and
bicycle/pedestrian facilities projects. Staff recommends adoption of the resolution.
B. Background
The Orange County Transportation Authority(OCTA)has been working with the Technical
Advisory Committee (TAC) to develop a Master Funding Agreement. The TAC is a
committee comprised of Public Works Directors and City Engineers from all the Orange
County Cities and County staff. The purpose of the Master Funding Agreement is to clarify
the roles and responsibilities of the Authority and each local jurisdiction with respect to
delivery of projects funded by Measure M and the bicycle/pedestrian facilities program. By
executing the Agreement OCTA agrees to fund all approved projects by the Board. The City
agrees to complete all phases and activities of the approved projects in a timely manner.
