1999-1019_TRAFFIC SAFETY SYSTEMS_Personal Services Agreement
*ERSONAL SERVICES AGREEMINT THIS AGREEMENT is made and entered into this /�9A day of 1999, by and between the City of San Juan Capistrano (hereinafter referred to as the "City") and Traffic Safety Systems, Inc., (hereinafter referred to as "Consultant"). RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to install a traffic signal enforcement system at certain City intersections to perform such services; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. Consultant agrees to install and maintain traffic signal camera systems (the "System"), and to administer the issuance of traffic citations to motorists in violation of the applicable state statutes, all under the direction and control of the City Manager, or his designee. The scope of services is further set forth in Exhibit "A," attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and terminate on December 31, 2004. Section 3. Compensation. Consultant shall receive as payment Fifty-nine Dollars($59.00) or Fifty Percent (50%), whichever is less, for each CVC 21453 fine successfully collected. Consultant shall coordinate with the City Manager for the establishment of a satisfactory system of accounting for those citations issued, fines collected and monies distributed. The system shall, at the sole reasonable determination of the City Manager, be in conformance with sound municipal accounting practices. Fines collected by the City between the 1st through 31st of any month, the City shall make payment to Consultant on the 15th day of the following month. -t- �1 It is understood by the parties hereto that there shall be no charge or fee whatsoever to the City for the installation and maintenance of the System of for the performance of the Services itemized in Exhibit "A," and that Consultant's compensation for the installation, maintenance and the operation of the System and for the performance of the Services shall be the retention of those portions of fines successfully collected as set forth herein. Video Fee -- The City agrees that a $2.00 surcharge shall be included over and above the $59.00 fee for the first 2,500 fines collected to offset consultants costs for video work. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed installations, including the -2- 0 location of all utilities, and is aware of all conditions; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Consultant agrees to commence red signal camera equipment installation within 30 days of approval of determination of viability based on the results of the video survey. Consultant will begin video survey within 15 days of approval of agreement by City. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. All services to be rendered hereunder shall be subject to the direction and approval of the City. -3- Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the amount of not less than One Million Dollars ($1,000,000) combined single limit. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non - owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; -4- 1 $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.5 Proof of Insurance Requirements. Consultant shall submit the endorsement and insurance certificate, including the deductible or self -retention amount, to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied prior to beginning any work under this Agreement. 14.6 Timing of Compensation and Insurance Requirements. Consultant shall not receive any compensation until all insurance provisions have been satisfied. Section 15. Termination for Cause and Without Cause. This Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. Failure to meet one or more of the following may be reasonable cause to terminate this agreement, however, City reserves the right to terminate for cause relative to other factors not specifically identified below: 1. Consultants costs and City's costs exceed available citation revenue needed to -5- 0 support program. 2. Consultant services on maintenance and operation of system is not performed in a timely and efficient manner. 3. Equipment does not function as presented by consultant and as herein described. 4. State legislation or litigation limits effectiveness or terminates program. 5. City Council determines that program does not meet the public need. 6. Program negatively impacts safety. In addition, this Agreement may be terminated without cause by either party by serving ninety (90) days' written notice of termination on the other party. Section 16. Notice. All notices shall be personally delivered or mailed to the below listed addresses, or to such other addresses as may be designated by written notice. If any action at law or in equity is necessary to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to reasonable attorneys' fees, costs and necessary disbursements in addition to any other relief to which he may be entitled. Section 18. Prevailing Law. The laws of the State of California govern any disputes arising under this Agreement. Section 19. Dispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). Section 20. Force Majeure. In case by reason of force majeure Consultant shall be rendered unable wholly or in part to carry out Consultant's obligations under the Agreement, then except as otherwise expressly provided in the Agreement, if Consultant shall give notice and full particulars of such force majeure in writing to the City within a reasonable time after occurrence of the event or cause relied on, the obligations of Consultant giving such notice, so far as they are affected by such force majeure, shall be suspended during the continuance of the inability then claimed which shall include a reasonable time period for the removal of the effect thereof, but for no longer period, and Consultant shall endeavor to remove or overcome such inability with all reasonable dispatch. The term "force majeure," as employed herein, shall mean acts of God, strikes, lockouts or other industrial disturbances, acts of the public enemy, orders of any kind of the Government of the United States or of the State or any civil or military authority, insurrections, riots, epidemics, landslides, lightening, earthquakes, fires, hurricanes, storms, floods, washouts, droughts, arrest, restraining of government and people, civil disturbances, explosions, partial or entire failure of utilities, shortages of labor, material or supplies or transportation, or any other similar or different cause not reasonably within the control of the party claiming such inability. It is understood and agreed that the settlement of existing or impending strikes, lockouts or other industrial disturbances shall be entirely within the discretion of Consultant and that the above requirements that any force majeure shall be reasonable dispatch shall be deemed to be fulfilled even though such existing or impending strikes, lockouts, or other industrial disturbances may not be settled but could have been settled to acceding to the demands of the opposing person or persons. Section 21. Assistance from Sheriffs Department. U City contracts with the Orange County Sheriffs Department for City police services. To the extent feasible and with the consent of the Sheriffs Department, City will work with Consultant to provide police manpower in assisting Consultant of its contractural obligations in support of this traffic signal enforcement program. Consultant agrees and understands that City makes no guarantee or pledges with regard to any minimal level of assistance to be provided to Consultant however. Section 22. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. Will provide the following: n L-A 1. The technology required to administer the Red light Camera program to include the cameras, radar, flash, computers, and hardware required to operate systems at the intersection. 2. The financing of all costs to deliver the technology described in item one of the Scope of Services. 3. A test and warning period. Warnings will be mailed to violators for a period of 30 days. That warning period may commence prior to signing a binding contract. The warning period includes deployment of the technology at an intersection, film and digital images of violators, accessing registration information and a written notice mailed to the violator. One warning period will be completed at the beginning of the program with the first unit to call attention to the fact that the program is using automated technology to detect red light violators. 4. Selection and engineering of a minimum number of intersection approaches as agreed upon by the City and Traffic Safety Systems, Inc.. The City will provide current engineering diagrams for proposed intersections and a list of intersection approaches for potential deployment of the technology. The initial intersection list is as follows: Del Obispo at Ortega Highway Del Obispo at Camino Capistrano Ortega Highway at Rancho Viejo Road (Requires Caltrans Approval) Stonehill at Camino Capistrano Camino Capistrano at San Juan Creek Road Del Obispo at Del Avion 5. The City Manager may, in cooperation with Traffic Safety Systems, Inc., add to the above list or remove intersections as traffic issues may so demand. 6. Consultant agrees to begin the video survey within 15 days of the approval of the agreement by the City Council and commence red signal camera equipment installation within 15 days of approval of determination of viability based on the results of the video survey, TSS agrees to complete the installations in a timely manner. Where possible, Traffic Safety Systems, Inc. will utilize existing City power connections and poles. in 7. All film to be used to capture images of violators. 8. Film and deployment data will be retrieved a minimum of every 48 hours for initiation of the processing and examination for recorded violations. 9. Film will be developed to maximize the images for examination and processing through Verification One (V1) and Verification Two (V2). Verification One and Verification Two are quality control checks to ensure that the violations are clearly visible in the images prior to processing for citations. 10. The film will be scanned and digitized with the film archived for retrieval when necessary for any Court hearings. 11. Motor Vehicle Division ownership information will be retrieved once a violation has been established at the V1 state. That information will be recorded into the computer software program and archived with the images. 12. The images and data will again be examined and compared with MVD results as an additional quality control measure to again verify the violation (V2). 13. After verification that the violation exists, the images will be reviewed by the involved law enforcement agency as a third verification. Once confirmation occurs, the citation will be issued. Confirmation consists of: red light signal is illuminated image of vehicle prior to the stop line vehicle entered the intersection against a red signal at least half of operator's face is visible and recognition/identification is possible. 14. The citations will then be printed and mailed to the violators. 15. The data will then be electronically transferred to the Police and Court. 16. The citation will then be mailed to violator through US Mail. 17. Court packages will be prepared for prosecution and will include the images to document the violation, the TSS, Inc. Certificate of Mailing, the maintenance and calibration records. Traffic Safety Systems, Inc., will be notified a minimum of two weeks in advance of a court appearance to prepare the evidence package. 18. Testimony for Court hearings that result from the use of this technology will be -10- 50 provided in conjunction with the Police Department. 19. The Intersection Collision Warning System (ICWS) will be provided at no additional cost to the City. Installation and activation of (ICWS) will occur after deployment of the new generation detection system is in full production and operating at 24 Gigahertz. The new generation of detector will replace all existing detectors in the US. RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to install a traffic signal enforcement system at certain City intersections to perform such services; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. Consultant agrees to install and maintain traffic signal camera systems (the "System"), and to administer the issuance of traffic citations to motorists in violation of the applicable state statutes, all under the direction and control of the City Manager, or his designee. The scope of services is further set forth in Exhibit "A," attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and terminate on December 31, 2004. Section 3. Compensation. Consultant shall receive as payment Fifty-nine Dollars($59.00) or Fifty Percent (50%), whichever is less, for each CVC 21453 fine successfully collected. Consultant shall coordinate with the City Manager for the establishment of a satisfactory system of accounting for those citations issued, fines collected and monies distributed. The system shall, at the sole reasonable determination of the City Manager, be in conformance with sound municipal accounting practices. Fines collected by the City between the 1 st through 31 st of any month, the City shall make payment to Consultant on the 15th day of the following month. It is understood by the parties hereto that there shall be no charge or fee whatsoever to the City for the installation and maintenance of the System of for the performance of the Services itemized in Exhibit "A," and that Consultant's compensation for the installation, maintenance and the operation of the System and for the performance of the Services shall be the retention of those portions of fines successfully collected as set forth herein. Video Fee -- The City agrees that a $2.00 surcharge shall be included over and above the $59.00 fee for the first 2,500 fines collected to offset consultants costs for video work. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed installations, including the -2- location of all utilities, and is aware of all conditions; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Consultant agrees to commence red signal camera equipment installation within 30 days of approval of determination of viability based on the results of the video survey. Consultant will begin video survey within 15 days of approval of agreement by City. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. All services to be rendered hereunder shall be subject to the direction and approval of the City. -3- Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the amount of not less than One Million Dollars ($1,000,000) combined single limit. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired and non - owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; ME $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Workers Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.5 Proof of Insurance Requirements. Consultant shall submit the endorsement and insurance certificate, including the deductible or self -retention amount, to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied prior to beginning any work under this Agreement. 14.6 Timing of Compensation and Insurance Requirements. Consultant shall not receive any compensation until all insurance provisions have been satisfied. Section 15. Termination for Cause and Without Cause. This Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. Applicant: City of San Juan Capistrano Written Communications: (1) Report dated October 19, 1999, from the Engineering and Building Director, addressing the City Council's concerns regarding staffing to monitor the cameras; the collision avoidance system; and, deferral of implementation. William Huber, Director of Engineering and Building, made an oral presentation, advising revenue generated from the system would pay for officers to monitor the cameras. He indicated that the agreement required installation of the collision avoidance system as soon as it became available, which was anticipated in January or February of 2000. He advised that the experience of cities that had implemented red light cameras had been positive and recommended approval of the installation. City Council Minutes S.3' 10/19/99 Public Hearing: Notice having been given as required by law, Mayor Greiner opened the public hearing, and the following persons responded: (1) Red Rawlings, 31192 Via Sonora, spoke in support of the proposal. (2) Angela Duzich-Rohde, 31372 Don Juan Avenue, spoke in support of the proposal. (3) Lon Uso, 31302 Via Las Palmas, stated that he was against this system and felt it would be a hidden tax on residents and visitors to the City. Mr. Uso felt the cost of the system might be excessive compared to its benefit, and encouraged researching and using more traditional solutions to the running of red lights. (4) Bill Hardy, 26523 Calle Lorenzo, spoke in support of the proposal. Council Comments: Council Member Campbell stated that she would support the program, noting that her questions and concerns had been answered and that the system could free time for officers to respond to other types of calls. Council Member Hart stated that his concerns had been adequately addressed. He asked that a status report regarding viability of the intersections and staffing levels be generated every two months during implementation, and a formal report with recommendations be prepared within 6 months of implementation. Council Member Jones expressed concern that the collision avoidance device was not yet ready but he stated that he would support the program. He noted that a number of citizens had requested his support of this program. Council Member Swerdlin stated that he also received a lot of constituent feedback in favor of this program. Huber, Director of Engineering & Building SUBJECT: Consideration of Red Signal Camera Enforcement Program and Agreement for Installation and Operation of Enforcement Cameras (Traffic Safety Systems) RECOMMENDATION It is recommended that the City Council 1) Approval installation of automated red signal cameras and 2) Approve the agreement withTraffic Safety Systems, Inc. for installation and operation of red signal enforcement cameras. SITUATION A. Summary and Recommendation Staff has reviewed issues raised by Council at its September 21, 1999 meeting. The September 21, 1999 Agenda Item is provided in Attachment 2 as background information. Staff believes the current Sheriffs staffing levels will be adequate to service the red signal program during the implementation phase. The program will provide a significant deterrent to violators even without the collision avoidance system. Also, there are a number of successful programs in use in Southern California. Therefore, Staff recommends implementation of the red signal camera enforcement program. B. Background 1. History At City Council's September 21, 1999 meeting, a Public Hearing was held to consider implementation of a red signal camera enforcement program. Council continued the Public Hearing to give staff additional time to respond to a variety of issues raised by Council. 2. Issues -- Staff has identified the following issues: Staffing Concerns FOR CITY COUNCIL ..6;. ,-- f I 0 0 ■ Collision Avoidance System ■ Deferral of Implementation Staffing Concerns -- Initial Program The way the Agreement is structured, Traffic Safety Systems (TSS) will initially video camera each of the six (6) intersections. The videos will determine which intersections and which directions at the intersections warrant use of the red signal camera system. Installation will be done sequentially to allow adjustment of the equipment to the particular intersection dimensions and traffic. Exactly how long the process will take depends on the number of intersections and intersection legs fitted with the camera systems. Staffing needs will also vary as the number of camera systems come on line. Currently, the Sheriffs Department spends about 15 hours per week enforcing signalized intersection violations (including red signal violations) throughout the City. The majority of this is at key intersections and is primarily focused on red light violations. It is proposed that this time be dedicated to administer the red signal enforcement program during the initial period. The red signal camera system utilizes film to capture violators. The film is changed by TSS on a regular basis, depending upon the rate at which violations occur at a particular intersection. Violations would initially be screened by TSS and then transmitted to the Sheriffs Department for concurrence. This process lends itself to batching the citations so that the Sheriffs personnel can review a whole days citations at one time. This eliminates the need to have an officer in the office at all times to receive citations. Since the intersections are expected to be implemented sequentially over a period of time, it is believed the existing Sheriffs staffing levels will be sufficient to address the red signal violations. Also, we will only be utilizing Sheriffs staff as available to review citations and assure existing priorities are met. This probably will result in Sheriffs staff not being able to review 100% of the daily citations resulting in non - issuance of some citations. The agreement with TSS provides for the City to utilize its resources to the extent possible to review the citations, therefore, the staff proposal is consistent with the agreement. Staffing Concerns -- Permanent Program The initial period is expected to take about six months and tie into the time period for the City's mid -year budget review. Once the initial period is complete, Staff will assess the revenue and staffing needs based on actual experience. Staffing projections based on experiences in other communities with red signal cameras indicate the revenue generated will more than offset the additional Sheriffs staffing needs and program costs. During mid -year budget review, staff will provide proposed staffing levels for the permanent program. It should be understood that if the program does not generate the revenue as projected, the staffing needs would not be increased. Excess Revenue Based on Staffs previous evaluation, a substantial amount of revenue in excess of expenses is anticipated. This excess revenue can be used to pay for enhancement of public safety programs such as crime intervention programs, Community Services Officer Program, etc.. Collision Avoidance System The Collision Avoidance System, the unique feature of TSS that will change the signals to all red until a violator clears the intersection, is not currently available. The system, according to the consultant, is being tested and will be available in January or February of 2000. The agreement commits TSS to install the Collision Avoidance System when it becomes available at no cost to the City. A suggestion was made to delay implementation of the program until the Collision Avoidance System was available. The red signal cameras by themselves are a significant deterrent to running a red light, thus reducing possible accidents. As stated in the previous report, the cities we spoke to experienced a 27% - 40% reduction in red signal violation accidents. None of these systems are currently equipped with a Collision Avoidance System. Deferral of Implementation Due to lack of experience with red signal camera systems in Orange County, it was suggested that implementation be delayed. While it is true that there are no active systems in Orange County, both Garden Grove and Irvine have approved systems. There are, however, a number of systems in place throughout Southern California in Los Angeles and San Diego Counties including the following agencies: San Diego, CA EI Cajon, CA Poway, CA Beverly Hills, CA Los Angeles, CA San Jose, CA San Francisco, CA Oxnard, CA Fairfax, VA MTA Los Angeles All of the agencies we have talked to indicate favorable experiences with the camera systems. C. Conclusion Given the above information, staff recommends approval of implementation of the red signal camera system at the indicated intersections. SITUATION A. Summary and Recommendation To reduce red signal violations and related accidents. Staff is proposing the installation of red signal cameras at six major intersections. The installation is proposed to be performed by SENSYS Traffic, a company specializing in red signal camera systems. SENSYS will derive income from the collected citations. There are no up -front installation costs to the City. Prior to installation, SENSYS will video each intersection to determine its financial viability for use of the camera system. To support the red light cameras, additional equipment and staffing will be required from the Sheriffs Department. Staff supports the red signal camera program and recommends Council approve the agreement in Attachment 2. B. History Red light running is a significant problem in the United States. About 40 percent of motor vehicle crashes occur at intersections or are deemed "intersection related" (US DOT, 1997). Between 1992 and 1996, the number of fatal crashes at traffic signals increased 19% (from 1,888 to 2,242) according to the Insurance Institute for Highway Safety. During the same time period, other crashes increased by six percent. Injury collisions at signalized intersections increased by approximately 14% (US DOT, 1993, 1997). Collisions involving red light running were more likely to result in injuries when compared to other collisions (45% compared to 30%.) City-wide, in the 5 Yz year period from January 1994 through June 1999, there have 0 a been 118 accidents at signalized intersections directly attributed to red light violations. In Attachment 1, Staff provides a history of intersection accidents due to red light violations. The tables do show that in the past three years (1996, 1997, 1998), the number of accidents have risen. Over the five year period, however, the accidents have not shown an increasing trend. We are a small city and have only 22 signals shown on the table. This makes it difficult to establish a trend, given the small numbers. The Sheriffs department further indicates that they issued approximately 333 red light violations in the first eight months of this year. However, this does not deter violators once the officer is away from the intersection. The red light cameras would provide a 24 hour deterrent that would help reduce the number of violators and result in lowering or eliminating the red light accidents at many intersections. C. Analysis In considering red light signal cameras, the following issues were analyzed by the City Staff and Sheriffs Department: ■ Use by other agencies ■ Vehicle Code requirements ■ Court Prosecution ■ Red Light Detection System and Vendor Selection ■ Video Analysis ■ Intersection Selection ■ Sheriffs Staffing Requirements ■ SENSYS Traffic Agreement ■ Cost Analysis Use by Other Agencies Staff has researched automated red light enforcement programs and the following cities and agencies have had at least one year experience: San Diego, CA EI Cajon, CA Poway, CA Beverly Hills, CA Los Angeles, CA San Jose, CA San Francisco, CA Oxnard, CA Fairfax, VA MTA Los Angeles The cities listed above have experienced a 27% to 40% reduction in accident rates at the intersections as a result of the red light signal enforcement program. The Sheriffs Department contacted the cities of San Diego, EI Cajon, Oxnard, and Beverly Hills. They were able to get information on their programs and staffing requirements which are discussed later in this report. 40 Vehicle Code Requirements Recent State legislation provides for use of camera surveillance and citation enforcement to catch drivers violating red lights at intersections. The California Vehicle Code (CVC) governs the requirements for implementation and enforcement. The CVC provides that a public hearing be held prior to entering into a contract for use of the red light camera system. The CVC also requires a thirty day warning notice period to motorists, a public announcement be made prior to commencement of the enforcement program and signs be placed at every intersection indicating the presence of the system. Court Prosecution Lieutenant Rick Stahr met with South County Court Commissioner Swartz to review any concerns of the Court. The Commissioner was concerned with the potential for increased staffing impacts to the courts' already hectic schedule. The Commissioner wanted to make sure the system clearly identified the driver, to help reduce the number of violators that would actually contest the tickets. The current fine is $271, of which $141.80 is passed to the City. We asked our recommended vendor what their experience has been with contested citations in Culver City. To date, they have issued 502 citations, ten have been contested and three have actually gone before a judge. This represents less than 1 % of the citations. Red Light Detection System/Vendor Selection Staff consisting of the City Manager, the Chief of Police, and Director of Engineering and Building Services reviewed several providers of the red signal enforcement equipment, including Tellis Traffic Systems, U.S. Public Technologies, and SENSYS Traffic, Inc.. After review, it was determined that SENSYS would provide the best service in terms of enforcement and safety objectives. SENSYS Traffic, Inc. provides the following: a. No up -front installation costs to the City. b. A $59.00 or 50% of the city's portion of the citation, whichever is less, per paid citation is collected by SENSYS to offset the installation and continued operation costs. C. An initial surcharge on the per citation fee to cover up front video expenses. d. SENSYS will provide all on-going maintenance and film changing. e. SENSYS will defend in court its camera system on all contested 0 0 citations. SENSYS provides cameras both for front and rear of vehicles and will produce high quality readable images. SENSYS' system is able to read all lanes of traffic individually. SENSYS will install, when it becomes available, a system to anticipate a vehicle running a red light, and will hold the red light on all intersection legs to allow the vehicle to clear. This system is anticipated to be available in January/February 2000. SENSYS' system requires no installation of sensors in the pavement, since it is a microwave system which is fully contained in the camera unit. What sets the SENSYS system apart is its microwave based system which, in the future, will be able to anticipate a vehicle running the red light and hold the other intersection legs red to allow the violator to clear the intersection. As stated above, this system is anticipated to be available in January/February 2000. As safety is a primary concern, this feature can greatly help to reduce traffic collisions. The SENSYS system will provide front and rear of vehicle cameras to catch those vehicles without front license plates. They also provide staff to defend their system if challenged in court. SENSYS does not require installation of traffic detection sensors in the pavement as do other systems which reduces traffic disruption during installation. The SENSYS system produces high quality photos that can be viewed via a computer and enhanced to clearly identify the vehicle driver. The other vendors provide similar services for installation and maintenance. Costs for the service will be offset by anticipated revenue. Staff believes, based on its evaluation that SENSYS Traffic, Inc. provides the best overall service. Video Analysis As part of the agreement with SENSYS, each intersection will be analyzed first using video to determine the potential number of violators and whether it is financially feasible to install the red signal cameras. This work is expected to take three weeks. Installation would be complete within thirty days of completion of the video work. Once this is done, determination of cost impacts and revenue can be assessed with a higher degree of reliability. 0 0 Intersection Selection Attachment 1 contains two (2) tables; the first provides the accident history caused by red light violations, at all signalized intersections for the period of January 1994 through June 1999. The table also provides a ranking of the highest to lowest in accidents. The second table provides the daily traffic volumes and number of accidents. With this information and knowledge of where we have received input regarding red light violations, the following six (6) intersections have been selected: • Del Obispo at Ortega Highway • Del Obispo at Camino Capistrano • Ortega Highway at Rancho Viejo Road (requires Caltrans approval) • Stonehill Drive at Camino Capistrano • Camino Capistrano at San Juan Creek Road • Del Obispo at Del Avion If the program is successful, other intersections may be added at a later date. Sheriffs Staffing Requirements Red signal enforcement requires support from the local sheriffs office. Based upon the cities contacted by the Sheriff Department, one full time officer per three intersections could be required to support the program. Sheriffs support involves review and verification of violations including detailed review of the photographic evidence. Sheriffs office must prepare any court documents and testify in court if necessary. In addition, some new computer equipment and programs will be needed to support the program. The cost per traffic officer, including benefits, is $126,828 per year. The new equipment is estimated at $25,000. It is proposed that initially this work will be done by existing sheriffs staff. The equipment needs will be assessed once the program is fully operational at mid -year when the program is expected to be in full gear. The Sheriffs budget will be reviewed at that time for additional staffing and equipment needs. The costs for Sheriff support should be offset by the fines collected through the program. SENSYS Traffic Agreement The proposed agreement with SENSYS Traffic, Inc. provides the following: A. Installation of red signal cameras to be installed at the six 0 0 intersections previously identified. B. Delegation to the City Manager authorization to add or remove intersections. C. The term of the agreement is from September 1999 to June 30, 2004 with two, one year, extensions. D. The agreement may be terminated at any time without cause or for failure to meet performance standards. E. SENSYS will be paid $59.00 per paid citation or 50% of the City portion of the Citation, whichever is less. SENSYS will be paid an initial fee per citation to help recover its cost for the video evaluation. F. SENSYS will analyze, using video cameras, the intersections within three weeks of approval of agreement to determine the financial viability of red signal camera enforcement. G. Installation will commence within 30 days of determination of viability as discussed in "F" above. The City Attorney has reviewed and concurs with the proposed agreement. Cost Analysis Based on the information we have collected, and assuming we will have six (6) viable intersections, a projected revenue/expense analysis has been prepared. It utilizes the following assumption: Two traffic officers will be required (2 x $126,828) for a total of $253,656 per year. No staffing is being requested at this time. In addition, the Sheriffs department has indicated that approximately 10-15 hours per week are now spent enforcing intersection violations including red signal, lane, right of way, failure to yield to pedestrians, and intersection speeding. The current amount of sheriffs time being spent on red signal violations at the intersections covered by SENSYS will result in some cost savings, however, it is difficult to accurately assess the amount. C. Conclusion The staff has reviewed and considered a variety of issues and concludes that red light signal enforcement and programs are effective in reducing red light violations and related accidents. The program can be done cost effectively. SENSYS Traffic provides a system of automated enforcement that meets the needs of the City. Staff is, therefore, recommending installation of red light signal cameras at selected intersections and approval of an agreement with SENSYS Traffic to provide the necessary services. The Engineering and Building Director made an oral presentation, noting that the following intersections were being considered for the red signal camera installation: Del Obispo at Ortega Highway; Del Obispo and Camino Capistrano; Ortega Highway at Rancho Viejo Road; Stonehill at Camino Capistrano; Camino Capistrano at San Juan Creek Road; and, Del Obispo at Camino del Avion. He noted that 10 cities in California were equipped with this system and had experienced reductions in accidents due to red light violations. The system required no up -front costs; the vendor derived a fee from each paid citation; the system used a microwave technology so there would be no loops in the street; because the system was microwave -based, it would have the ability to change the signals to all red and hold cross traffic until all violators had cleared the intersection. He noted that this feature was not presently available but was expected to be available after the first of the year. The Agreement provided for the vendor to receive $59 per paid citation; it required that the intersections be videoed first and a determination of viability for use to be made prior to installation of the cameras; the Agreement could be terminated without cause with 90 days notice. It was anticipated that the system would be self-supporting, given the annual revenue from the six intersections versus the expenses. Mr. Huber advised that expenses included two full- time officers to monitor the system, payment to the vendor, and one-time equipment costs. Staff did not recommend hiring the additional Sheriff staff support at this time, since it would take time to place the system into operation. A recommendation could be made at mid -year based on experience. Council Questions: In response to Mayor Greiner, Mr. Huber advised that there was a possibility that some of the intersection directions may not have enough violations to warrant the expense of the camera; that determination would be made following videoing of the intersection. In response to Council Member Jones, Sean Gunderson, representing Traffic Safety Systems, advised that the feature which would change all lights to red until the violator had cleared the intersection should be available in January or February. In response to Council Member Swerdlin, Mr. Huber advised that Caltrans had been agreeable to considering the installation at Rancho Viejo Road and Ortega Highway if the City applied for a permit. City Council Minutes -9- 9/21/99 Public Hearing: Notice having been given as required by law, Mayor Greiner opened the public hearing and the following person responded: (1) Lon Uso, 31302 Via Las Palmas, questioned whether the City had initiated this project or whether vendors and presented it; questioned whether it was being considered for safety reasons and whether there were betterways of increasing intersection safety; and, felt it was going too far and was unnecessary. There being no further response, the Hearing was declared closed with the right to re- open at any time. Council Comments: Mayor Greiner indicated that the project was being considered for safety concerns, which was of primary importance. He advised that the cameras could be tried and then the project terminated if the City wished. Council Member Jones noted that staff had been given direction to pursue this issue; however, he could not support it unless it contained the safety mechanism that would hold all lights on red until a violator cleared the intersection. Council Member Swerdlin stated his desire to keep government small and non-invasive and felt this project could not be justified and would not be effective. Council Member Hart indicated he was not opposed to the concept, he was concerned that the City was moving too quickly; that there should be some kind of a track record to review prior to the City initiating the program; and, that he was concerned with how the courts would handle citations issued by this program. In response to Council Member Campbell, Lt. Stahr stated that the cameras would be helpful, since his officers could only spend 10-15 hours a week enforcing red light intersections. He felt it would be warranted on a trial basis because it could save lives and would free up officers to respond to other concerns; however, it may need further Council Member Campbell indicated her desire for more concise information regarding exactly what the program would entail; and, expressed concern with taking two officers off the streets. Council Member Jones expressed the opinion that the delay mechanism should be part of the program before the City goes forward with this program. Mayor Greiner felt the red-light cameras would not be an intrusion on privacy because they would only be activated after the law was violated. He emphasized that the system was designed to be self supporting, so if additional officers were required they would be paid for out of the ticket revenue; officers on patrol would not be displaced. Since this was a no -risk operation he would prefer to move forward, noting that the agreement could be terminated with 90 days notice. He emphasized that the City would implement the program for public safety concerns and recommended that if there were revenues generated over and above program costs, they be funneled into other public safety program such as officer on campus programs or similar public safety/educational programs. Council Member Hart asked the City Attorney whether the courts had legal issues with this type of project. Mr. Shaw indicated that the North County Municipal Court judges had some technical concerns. He stated Garden Grove would start their project on a 6 -month trial basis to evaluate the issues, so a record would be developed. Council Member Jones noted additional liability concerns that should be explored prior to implementing the program. Council Member Hart requested that the City Attorney provide a record from Garden Grove within the next four weeks. The Report advised that the salary increase was consistent with that granted to the Management and Classified employees. The City Manager made an oral presentation. Council Member Swerdlin stated that he would not support this item because the current CPI was 1.7%, and noted that his action was consistent with his past voting record for Classified and Management Employee Memoranda of Understanding. Huber, Director of Engineering & Building SUBJECT: Consideration of Red Signal Camera Enforcement Program and Agreement with SENSYS Traffic It is recommended that the City Council 1) Approve installation of automated red signal cameras and 2) Approve the agreement with SENSYS Traffic for installation and operation of red signal enforcement cameras. SITUATION A. Summary and Recommendation To reduce red signal violations and related accidents. Staff is proposing the installation of red signal cameras at six major intersections. The installation is proposed to be performed by SENSYS Traffic, a company specializing in red signal camera systems. SENSYS will derive income from the collected citations. There are no up -front installation costs to the City. Prior to installation, SENSYS will video each intersection to determine its financial viability for use of the camera system. To support the red light cameras, additional equipment and staffing will be required from the Sheriffs Department. Staff supports the red signal camera program and recommends Council approve the agreement in Attachment 2. B. History Red light running is a significant problem in the United States. About 40 percent of motor vehicle crashes occur at intersections or are deemed "intersection related" (US DOT, 1997). Between 1992 and 1996, the number of fatal crashes at traffic signals increased 19% (from 1,888 to 2,242) according to the Insurance Institute for Highway Safety. During the same time period, other crashes increased by six percent. Injury collisions at signalized intersections increased by approximately 14% (US DOT, 1993, 1997). Collisions involving red light running were more likely to result in injuries when compared to other collisions (45% compared to 30%.) City-wide, in the 5 Yz year period from January 1994 through June 1999, there have FOR CIN COUNCIL AGENt 2E,5 been 118 accidents at signalized intersections directly attributed to red light violations. In Attachment 1, Staff provides a history of intersection accidents due to red light violations. The tables do show that in the past three years (1996, 1997, 1998), the number of accidents have risen. Over the five year period, however, the accidents have not shown an increasing trend. We are a small city and have only 22 signals shown on the table. This makes it difficult to establish a trend, given the small numbers. The Sheriffs department further indicates that they issued approximately 333 red light violations in the first eight months of this year. However, this does not deter violators once the officer is away from the intersection. The red light cameras would provide a 24 hour deterrent that would help reduce the number of violators and result in lowering or eliminating the red light accidents at many intersections. C. Analysis In considering red light signal cameras, the following issues were analyzed by the City Staff and Sheriffs Department: ■ Use by other agencies ■ Vehicle Code requirements ■ Court Prosecution ■ Red Light Detection System and Vendor Selection ■ Video Analysis ■ Intersection Selection ■ Sheriffs Staffing Requirements ■ SENSYS Traffic Agreement ■ Cost Analysis Use by Other Agencies Staff has researched automated red light enforcement programs and the following cities and agencies have had at least one year experience: San Diego, CA EI Cajon, CA Poway, CA Beverly Hills, CA Los Angeles, CA San Jose, CA San Francisco, CA Oxnard, CA Fairfax, VA MTA Los Angeles The cities listed above have experienced a 27% to 40% reduction in accident rates at the intersections as a result of the red light signal enforcement program. The Sheriffs Department contacted the cities of San Diego, EI Cajon, Oxnard, and Beverly Hills. They were able to get information on their programs and staffing requirements which are discussed later in this report. Vehicle Code Requirements Recent State legislation provides for use of camera surveillance and citation enforcement to catch drivers violating red lights at intersections. The California Vehicle Code (CVC) governs the requirements for implementation and enforcement. The CVC provides that a public hearing be held prior to entering into a contract for use of the red light camera system. The CVC also requires a thirty day warning notice period to motorists, a public announcement be made prior to commencement of the enforcement program and signs be placed at every intersection indicating the presence of the system. Court Prosecution Lieutenant Rick Stahr met with South County Court Commissioner Swartz to review any concerns of the Court. The Commissioner was concerned with the potential for increased staffing impacts to the courts' already hectic schedule. The Commissioner wanted to make sure the system clearly identified the driver, to help reduce the number of violators that would actually contest the tickets. The current fine is $271, of which $141.80 is passed to the City. We asked our recommended vendor what their experience has been with contested citations in Culver City. To date, they have issued 502 citations, ten have been contested and three have actually gone before a judge. This represents less than 1 % of the citations. Red Light Detection SystemNendor Selection Staff consisting of the City Manager, the Chief of Police, and Director of Engineering and Building Services reviewed several providers of the red signal enforcement equipment, including Tellis Traffic Systems, U.S. Public Technologies, and SENSYS Traffic, Inc.. After review, it was determined that SENSYS would provide the best service in terms of enforcement and safety objectives. SENSYS Traffic, Inc. provides the following: a. No up -front installation costs to the City. b. A $59.00 or 50% of the city's portion of the citation, whichever is less, per paid citation is collected by SENSYS to offset the installation and continued operation costs. C. An initial surcharge on the per citation fee to cover up front video expenses. d. SENSYS will provide all on-going maintenance and film changing. e. SENSYS will defend in court its camera system on all contested 0 0 citations. SENSYS provides cameras both for front and rear of vehicles and will produce high quality readable images. g. SENSYS' system is able to read all lanes of traffic individually. h. SENSYS will install, when it becomes available, a system to anticipate a vehicle running a red light, and will hold the red light on all intersection legs to allow the vehicle to clear. This system is anticipated to be available in January/February 2000. SENSYS' system requires no installation of sensors in the pavement, since it is a microwave system which is fully contained in the camera unit. What sets the SENSYS system apart is its microwave based system which, in the future, will be able to anticipate a vehicle running the red light and hold the other intersection legs red to allow the violator to clear the intersection. As stated above, this system is anticipated to be available in January/February 2000. As safety is a primary concern, this feature can greatly help to reduce traffic collisions. The SENSYS system will provide front and rear of vehicle cameras to catch those vehicles without front license plates. They also provide staff to defend their system if challenged in court. SENSYS does not require installation of traffic detection sensors in the pavement as do other systems which reduces traffic disruption during installation. The SENSYS system produces high quality photos that can be viewed via a computer and enhanced to clearly identify the vehicle driver. The other vendors provide similar services for installation and maintenance. Costs for the service will be offset by anticipated revenue. Staff believes, based on its evaluation that SENSYS Traffic, Inc. provides the best overall service. Video Analysis As part of the agreement with SENSYS, each intersection will be analyzed first using video to determine the potential number of violators and whether it is financially feasible to install the red signal cameras. This work is expected to take three weeks. Installation would be complete within thirty days of completion of the video work. Once this is done, determination of cost impacts and revenue can be assessed with a higher degree of reliability. 0 0 Intersection Selection Attachment 1 contains two (2) tables; the first provides the accident history caused by red light violations, at all signalized intersections for the period of January 1994 through June 1999. The table also provides a ranking of the highest to lowest in accidents. The second table provides the daily traffic volumes and number of accidents. With this information and knowledge of where we have received input regarding red light violations, the following six (6) intersections have been selected: • Del Obispo at Ortega Highway • Del Obispo at Camino Capistrano • Ortega Highway at Rancho Viejo Road (requires Caltrans approval) • Stonehill Drive at Camino Capistrano • Camino Capistrano at San Juan Creek Road • Del Obispo at Del Avion If the program is successful, other intersections may be added at a later date. Sheriff's Staffing Requirements Red signal enforcement requires support from the local sheriffs office. Based upon the cities contacted by the Sheriff Department, one full time officer per three intersections could be required to support the program. Sheriffs support involves review and verification of violations including detailed review of the photographic evidence. Sheriffs office must prepare any court documents and testify in court if necessary. In addition, some new computer equipment and programs will be needed to support the program. The cost per traffic officer, including benefits, is $126,828 per year. The new equipment is estimated at $25,000. It is proposed that initially this work will be done by existing sheriffs staff. The equipment needs will be assessed once the program is fully operational at mid -year when the program is expected to be in full gear. The Sheriffs budget will be reviewed at that time for additional staffing and equipment needs. The costs for Sheriff support should be offset by the fines collected through the program. SENSYS Traffic Agreement The proposed agreement with SENSYS Traffic, Inc. provides the following: A. Installation of red signal cameras to be installed at the six 0 F intersections previously identified. B. Delegation to the City Manager authorization to add or remove intersections. C. The term of the agreement is from September 1999 to June 30, 2004 with two, one year, extensions. D. The agreement may be terminated at any time without cause or for failure to meet performance standards. E. SENSYS will be paid $59.00 per paid citation or 50% of the City portion of the Citation, whichever is less. SENSYS will be paid an initial fee per citation to help recover its cost for the video evaluation. F. SENSYS will analyze, using video cameras, the intersections within three weeks of approval of agreement to determine the financial viability of red signal camera enforcement. G. Installation will commence within 30 days of determination of viability as discussed in "F" above. The City Attorney has reviewed and concurs with the proposed agreement. Cost Analysis Based on the information we have collected, and assuming we will have six (6) viable intersections, a projected revenue/expense analysis has been prepared. It utilizes the following assumption: Two traffic officers will be required (2 x $126,828) for a total of $253,656 per year. One time equipment cost = $25,000 Average number of citations issued and collected per intersection = 4/day City revenue per citation = $141.80 SENSYS costs per citation = $59.00 REVENUE 0 6 X (4X365X$141.80) _ $1,242,168 PER YEAR EXPENSES Traffic Officers (2) $ 253,656 One Time Equipment Costs $ 25,000 SENSYS Costs 6 x (4x365x$59.00) 516,840 TOTAL EXPENSES $ 795,496 REMAINING BAL. IA45,072 As previously stated, the additional staffing and equipment are proposed to be assessed at the mid -year budget review. No staffing is being requested at this time. In addition, the Sheriffs department has indicated that approximately 10-15 hours per week are now spent enforcing intersection violations including red signal, lane, right of way, failure to yield to pedestrians, and intersection speeding. The current amount of sheriffs time being spent on red signal violations at the intersections covered by SENSYS will result in some cost savings, however, it is difficult to accurately assess the amount. C. Conclusion The staff has reviewed and considered a variety of issues and concludes that red light signal enforcement and programs are effective in reducing red light violations and related accidents. The program can be done cost effectively. SENSYS Traffic provides a system of automated enforcement that meets the needs of the City. Staff is, therefore, recommending installation of red light signal cameras at selected intersections and approval of an agreement with SENSYS Traffic to provide the necessary services. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS N/A FINANCIAL CONSIDERATIONS See Section 10 above. RECITALS: WHEREAS, City desires to retain the services of Consultant regarding the City's proposal to install a traffic signal enforcement system at certain City intersections to perform such services; and WHEREAS, Consultant is qualified by virtue of experience, training, education and expertise to accomplish such services. NOW, THEREFORE, City and Consultant mutually agree as follows: Section 1. Scope of Work. Consultant agrees to install and maintain traffic signal camera systems (the "System"), and to administer the issuance of traffic citations to motorists in violation of the applicable state statutes, all under the direction and control of the City Manager, or his designee. The scope of services is further set forth in Exhibit "A," attached and incorporated herein by reference. Consultant warrants that all of its services shall be performed in a competent, professional and satisfactory manner and in accordance with the prevalent standards of its profession. Section 2. Term. This Agreement shall commence on the effective date of this Agreement and terminate on December 31, 2004. Section 3. Compensation. Consultant shall receive as payment Fifty-nine Dollars($59.00) or Fifty Percent (50%), whichever is less, for each CVC 21453 fine successfully collected. -1- 11 0 Consultant shall coordinate with the City Manager for the establishment of a satisfactory system of accounting for those citations issued, fines collected and monies distributed. The system shall, at the sole reasonable determination of the City Manager, be in conformance with sound municipal accounting practices. Payment shall be made to Consultant by the City as follows: A. Fines collected by the City between the 1st through 15th day of any month, the City shall make payment to Consultant on the 15th day of that month. B. Fines collected by the City between the 15th through 31st of any month, the City shall make payment to Consultant on the first day of the following month. It is understood by the parties hereto that there shall be no charge or fee whatsoever to the City for the installation and maintenance of the System of for the performance of the Services itemized in Exhibit "A," and that Consultant's compensation for the installation, maintenance and the operation of the System and for the performance of the Services shall be the retention of those portions of fines successfully collected as set forth herein. Section 4. Independent Contractor. It is agreed that Consultant shall act and be an independent contractor and not an agent or employee of City, and shall obtain no rights to any benefits which accrue to City's employees. Section 5. Limitations Upon Subcontracting and Assignment. The experience, knowledge, capability and reputation of Consultant, its principals and employees were a substantial inducement for City to enter into this Agreement. Consultant shall not contract with any other entity to perform the services required without written approval of the City. This Agreement may not be assigned, voluntarily or by operation of law, without the prior written approval of the City. If Consultant is permitted to subcontract any part of this Agreement by City, Consultant shall be responsible to City for the acts and omissions of its subcontractor as it is for persons directly employed. Nothing contained in this Agreement shall create any contractual relationships between any subcontractor and City. All persons engaged in the work will be considered employees of Consultant. City will deal directly with and will make all payments to Consultant. -2- Section 6. Changes to Scope of Work. In the event of a change in the Scope of Work provided for in the contract documents as requested by the City, the Parties hereto shall execute an addendum to this Agreement setting forth with particularity all terms of the new agreement, including but not limited to any additional Consultant's fees. Section 7. Familiarity with Work and Construction Site. By executing this Agreement, Consultant warrants that: (1) it has investigated the work to be performed; (2) it has investigated the proposed installations, including the location of all utilities, and is aware of all conditions; and (3) it understands the facilities, difficulties and restrictions of the work under this Agreement. Should Consultant discover any latent or unknown conditions materially differing from those inherent in the work or as represented by City, it shall immediately inform City of this and shall not proceed with further work under this Agreement until written instructions are received from the City. Section 8. Time of Essence. Time is of the essence in the performance of this Agreement. Consultant agrees to commence red signal camera equipment installation within 30 days of approval of determination of viability based on the results of the video survey. Consultant will begin video survey within 15 days of approval of agreement by City. Section 9. Compliance with Law. Consultant shall comply with all applicable laws, ordinances, codes and regulations of federal, state and local government. Section 10. Conflicts of Interest. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which would conflict in any manner or degree with the performance of the services contemplated by this Agreement. No person having such interest shall be employed by or associated with Consultant. Section 11. Copies of Work Product. At the completion of the contract period, Consultant shall have delivered to City at least one (1) copy of any final reports and architectural drawings containing Consultant's -3- 0 0 findings, conclusions, and recommendations with any support documentation. All reports submitted to the City shall be in reproducible format. All services to be rendered hereunder shall be subject to the direction and approval of the City. Section 12. Ownership of Documents. All reports, information, data and exhibits prepared or assembled by Consultant in connection with the performance of its services pursuant to this Agreement are confidential to the extent permitted by law, and Consultant agrees that they shall not be made available to any individual or organization without prior written consent of the City. All such reports, information, data, and exhibits shall be the property of the City and shall be delivered to the City upon demand without additional costs or expense to the City. The City acknowledges such documents are instruments of Consultant's professional services. Section 13. Indemnity. Consultant agrees to protect, defend and hold harmless City, its elected and appointed officials and employees from any and all claims, liabilities, expenses or damages of any nature, including attorneys' fees, for injury or death of any person or damage to property or interference with use of property and for errors and omissions committed by Consultant arising out of or in connection with the work, operation or activities of Consultant, its agents, employees and subcontractors in carrying out its obligations under this Agreement. Section 14. Insurance. Insurance required herein shall be provided by Admitted Insurers in good standing with the State of California. 14.1 Comprehensive General Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive General Liability coverage in the amount of not less than One Million Dollars ($1,000,000) combined single limit. 14.2 Comprehensive Automobile Liability. Throughout the term of this Agreement, Consultant shall maintain in full force and effect Comprehensive Automobile Liability coverage, including owned, hired ME 0 0 and non -owned vehicles in the following minimum amounts: $500,000 property damage; $500,000 injury to one person/any one occurrence/not limited to contractual period; $1,000,000 injury to more than one person/any one occurrence/not limited to contractual period 14.3 Worker's Compensation. If Consultant intends to employ employees to perform services under this Agreement, Consultant shall obtain and maintain, during the term of this Agreement, Worker's Compensation Employer's Liability Insurance in the statutory amount as required by state law. 14.4 Notice of Cancellation/Termination of Insurance. The above policy/policies shall not terminate, nor shall they be cancelled, nor the coverages reduced, until after thirty (30) days' written notice is given to City, except that ten (10) days' notice shall be given if there is a cancellation due to failure to pay a premium. 14.5 Proof of Insurance Requirements. Consultant shall submit the endorsement and insurance certificate, including the deductible or self -retention amount, to the City's General Counsel for certification that the insurance requirements of this Agreement have been satisfied prior to beginning any work under this Agreement. 14.6 Timing of Compensation and Insurance Requirements. Consultant shall not receive any compensation until all insurance provisions have been satisfied. Section 15. Termination for Cause and Without Cause. This Agreement may be terminated for cause by providing ten (10) days' notice to the other party of a material breach of contract. If the other party does not cure the breach of contract, then the agreement may be terminated subsequent to the ten (10) day cure period. -5- 0 Failure to meet one or more of the following may be reasonable cause to terminate this agreement, however, City reserves the right to terminate for cause relative to other factors not specifically identified below: 1. Consultants costs and City's costs exceed available citation revenue needed to support program. 2. Consultant services on maintenance and operation of system is not performed in a timely and efficient manner. 3. Equipment does not function as presented by consultant and as herein described. 4. State legislation or litigation limits effectiveness or terminates program. 5. City Council determines that program does not meet the public need. 6. Program negatively impacts safety. In addition, this Agreement may be terminated without cause by either party by serving ninety (90) days' written notice of termination on the other party. Section 16, Notice. Section 18. Prevailing Law. The laws of the State of California govern any disputes arising under this Agreement. Section 19. Dispute Resolution. In the event of a dispute arising between the parties regarding performance or interpretation of this Agreement, the dispute shall be resolved by binding arbitration under the auspices of the Judicial Arbitration and Mediation Service ("JAMS"). Section 20. Force Majeure. In case by reason of force majeure Consultant shall be rendered unable wholly or in part to carry out Consultant's obligations under the Agreement, then except as otherwise expressly provided in the Agreement, if Consultant shall give notice and full particulars of such force majeure in writing to the City within a reasonable time after occurrence of the event or cause relied on, the obligations of Consultant giving such notice, so far as they are affected by such force majeure, shall be suspended during the continuance of the inability then claimed which shall include a reasonable time period for the removal of the effect thereof, but for no longer period, and Consultant shall endeavor to remove or overcome such inability with all reasonable dispatch. The term "force majeure," as employed herein, shall mean acts of God, strikes, lockouts or other industrial disturbances, acts of the public enemy, orders of any kind of the Government of the United States or of the State or any civil or military authority, insurrections, riots, epidemics, landslides, lightening, earthquakes, fires, hurricanes, storms, floods, washouts, droughts, arrest, restraining of government and people, civil disturbances, explosions, partial or entire failure of utilities, shortages of labor, material or supplies or transportation, or any other similar or different cause not reasonably within the control of the party claiming such inability. It is understood and agreed that the settlement of existing or impending strikes, lockouts or other industrial disturbances shall be entirely within the discretion of Consultant and that the above requirements that any force majeure shall be reasonable dispatch shall be deemed to be fulfilled even though such existing or impending strikes, lockouts, or other industrial disturbances may not be settled but could have been settled to acceding to the demands of the opposing person or persons. -7- Section 21. Assistance from Sheriffs Department. City contracts with the Orange County Sheriffs Department for City police services. To the extent feasible and with the consent of the Sheriffs Department, City will work with Consultant to provide police manpower in assisting Consultant of its contractural obligations in support of this traffic signal enforcement program. Consultant agrees and understands that City makes no guarantee or pledges with regard to any minimal level of assistance to be provided to Consultant however. Section 22. Entire Agreement. This Agreement constitutes the entire understanding and agreement between the parties and supersedes all previous negotiations between them pertaining to the subject matter thereof. Will provide the following: The technology required to administer the Red Light Camera program to include the cameras, radar, flash, computers, and hardware required to operate systems at the intersection. 2. The financing of all costs to deliver the technology described in item one of the Scope of Services. 3. A test and warning period. Warnings will be mailed to violators for a period of 30 days. That warning period may commence prior to signing a binding contract. The warning period includes deployment of the technology at an intersection, photographs of violators, accessing registration information and a written notice mailed to the violator. One warning period will be completed at the beginning of the program with the first unit to call attention to the fact that the program is using automated technology to detect red light violators. 4. Selection and engineering of a minimum number of intersection approaches as agreed upon by the City and Traffic Safety Systems, Inc.. The City will provide current engineering diagrams for proposed intersections and a list of intersection approaches for potential deployment of the technology. The initial intersection list is as follows: Del Obispo at Ortega Highway Del Obispo at Camino Capistrano Ortega Highway at Rancho Viejo Road (Requires Caltrans Approval) Stonehill at Camino Capistrano Camino Capistrano at San Juan Creek Road Del Obispo at Del Avion 5. The City Manager may, in cooperation with Traffic Safety Systems, Inc., add to the above list or remove intersections as traffic issues may so demand. 6. Commence installation with 15 working days of execution of agreement, and complete installation within 60 days of execution of agreement of the required poles, cameras, detection device/s, flashes and required electrical connections. Where possible, Traffic Safety Systems, Inc. will utilize existing City power connections. All film to be used to capture images of violators. In 8. Film and deployment data will be retrieved a minimum of every 48 hours for initiation of the processing and examination for recorded violations. 9. Film will be developed to maximize the images for examination and processing through Verification One (V1) and Verification Two (V2). Verification One and Verification Two are quality control checks to ensure that the violations are clearly visible in the images prior to processing for citations. 10. The film will be scanned and digitized with the film archived for retrieval when necessary for any Court hearings. 11. Motor Vehicle Division ownership information will be retrieved once a violation has been established at the VI state. That information will be recorded into the computer software program and archived with the images. 12. The images and data will again be examined and compared with MVD results as an additional quality control measure to again verify the violation (V2). 13. After verification that the violation exists, the images will be reviewed by the involved law enforcement agency as a third verification. Once confirmation occurs, the citation will be issued. Confirmation consists of: • red light signal is illuminated • image of vehicle prior to the stop line • vehicle entered the intersection against a red signal • at least half of operator's face is visible and recognition/identification is possible. 14. The citations will then be printed and mailed to the violators. 15. The data will then be electronically transferred to the Police and Court. 16. The citation will then be mailed to violator through US Mail. 17. Court packages will be prepared for prosecution and will include the images to document the violation, the Certificate of Mailing, the maintenance and calibration records. Traffic Safety Systems, Inc., will be notified a minimum of two weeks in advance of a court appearance to prepare the evidence package. 18. Testimony for Court hearings that result from the use of this technology will be provided in conjunction with the Policy Department. -10- 19. The signalized intersection collision avoidance system (SICAS) will be provided at no additional cost to the City. Installation and activation of (SICAS) will occur after deployment of the new generation detection system is in full production and operating at 24 Gigahertz. The new generation of detector will replace all existing detectors in the US. The Vehicle Code requires we hold a Public Hearing on the "use" of automated enforcement systems prior to entering into a contract. Therefore, we need to conduct the Public Hearing on the use of the red light enforcement program and return at a later date with the agreement. I am suggesting the following alternative recommendation if we are unable to finalize the agreement prior to the Council meeting. J. C. residents for 15 yr. As long tern residents we have had to adjust to many changes in our city. Most have been pleasant but the traffic situation has been a trial for all of us. In recent years due to the growth and influx of business downtown the time one has to spend waiting at lights has increased. Because of this we have observed many not just pushing the law, but out right breaking it. Some of these are, failure to yield right of ways to pedestrians in cross walk's, and running red lights on left turns and turning right on red light's with total disregard for on coming traffic, and let's not leave out all those (aywalker's) that just don't give a hoot if you are making a tum on a green light or not. I called the city months ago with my concerns and was told at that time the city was looking into putting cameras at the light's. We have been waiting to see what you or the city was going to do about this problem. Now we read in today's Cap. Valley News, that it has been put on hold, because of the "big brother mentallity". What about the safety of our citizens. I agree it is unfortunate it has to come to this, but I don'tthink we are left with any choice don't wait till someone dies to make the right choice.
