Tr� > 4 1997'_ 5 BY AND BETWEEN 6 CITY OF SAN JUAN CAPISTRANO a municipal corporation, hereinafter referred to 7 as CITY, 8 and 9 COUNTY OF ORANGE, a political subdivision of the State of California and recognized Urban 10 County under the Federal Housing and Community Development Act of 1974 & 1977, hereinafter 11 referred to as COUNTY. 12 WHEREAS, COUNTY and CITY previously entered into a Cooperation Agreement, 13 dated September 25, 1979 in which both parties agreed to cooperate in the undertaking, 14 or assist in the undertaking, of community development and housing assistance 15 activities, and 16 WHEREAS, COUNTY and CITY have previously entered into contracts dated 17 December 18, 1979 (Contract No. C26271) and February 17, 1981 (Contract No. C26445) 18 providing a total of $480,000.00 (Four Hundred Eighty Thousand Dollars and no/100) 19 for the acquisition of real property to assist in the provision of housing for low- 20 and moderate-income persons, and 21 WHEREAS, the CITY has submitted to the COUNTY an application for funding of 22 a project hereinafter described to aid in furthering the development of housing as 23 described in the Contracts of December 18, 1979 and February 17, 1981, and 24 WHEREAS, the COUNTY has entered into a separate agreement dated July 14, 1981 25 with the U. S. Department of Housing and Urban Development (hereinafter designated as 26 HUD) to fund said project under the Housing and Community Development Act of 1974 27I and 1977 (hereinafter referred to as ACT). 28I NOW, THEREFORE, IT IS AGREED by and between the parties that the following -1- uonrracr No. uzoojo provisions as well as all applicable Federal, State and County laws and regulations 1 including the attached SPECIAL PROVISIONS, identified as EXHIBIT "A", are part of 2 this Contract. 3 1. For the PURPOSES OF THIS CONTRACT the following definitions shall 4 apply: 5 a. Project Manager: The party responsible for, but whose responsibility 6 is not limited to the following: Contracting, monitoring and implementing the project. 7 b. Construction Bid Package: A package of bidding documents which 8 includes proposal, bidding instruction, contract documents, detailed estimated costs 9 and plans and specifications for a construction project all prepared in accordance 10 with applicable federal regulations. 11 c. Director: The Director of the County of Orange Environmental 12 Management Agency. 13 d. Reimbursable Basis: The CITY will provide the funds for the project 14 and submit proof of payment to the COUNTY, whereby upon approval the COUNTY will 15 forward Community Development Block Grant funds to repay the CITY. 16 2. It is understood that the CITY is solely responsible for implementation 17 of the project, described as: 18 a. Real property acquisition of an easement approximately ten feet in 19 width abutting Trabuco Creek and which will extend from Del Obispo Street to Mission 20 Street and the construction/installation of a sewer line within said easement 21 (Exhibit "B"). 22 b. This easement is for the purpose of supporting and advancing projects 23 E12.2 and F12.2 as provided for in Contract Nos. C26271 and C26445 and expenditure 24 of funds provided under this Contract for project G12.3 shall not be initiated 25 prior to completion and total expenditure of funds of said projects. 26 c. It is agreed by and between the parties that all funds for 27 project G12.3 shall be expended prior to one of the following dates, whichever 28 —2— • Contract No. C26636 1 occurs last: March 31, 1983, or ten calendar months. beyond the first day when funds 2 for both projects E12.2 and F12.2 are completely expended. 3 d. In the event that the CITY has not submitted appropriate invoices 4 for all approved project costs funded by the Block Grant under this Contract prior 5 to the date referred to previously in Section 2.c. , this Contract shall be subject 6 to termination at the discretion of the COUNTY. 7 3. CITY agrees: 8 a. Any amendment(s) to this contract shall be submitted to and approved 9 by the COUNTY, prior to commencement by CITY of such project. 10 b. To act as Project Manager for said project and to submit any and 11 all third-party contracts funded through this Contract to COUNTY for review prior 12 to award of such contracts by CITY. 13 c. To be responsibile for design and inspection, including the costs 14 related to those activities. 15 d. To submit the Construction Bid Package for this project to DIRECTOR 16 for review prior to advertising for bids on the construction contract or prior to 17 award of such a contract if sole source procurement is used. CITY shall not advertise 18 for bids until DIRECTOR has approved Construction Bid Package. CITY shall construct 19 project in accordance with the construction bid package which DIRECTOR approved 20 unless prior written approval is received from DIRECTOR for deviation therefrom. 21 e. That all work shall be in accordance with CITY's governing 22 building and safety codes. 23 f. To maintain accounting records, official files, and other evidence 24 pertaining to costs incurred as required by all applicable HUD regulations, and 25 all of these shall be accessible for the purposes of monitoring, surveys, audits and 26 examinations by duly authorized representatives of COUNTY or HUD. These records shall 27 be kept available at CITY's office during the project's contract period and thereafter 28 for three (3) years from the date of final payment of HUD Community Development Block -3- • • Contract No. C26636 1 Grant Funds. 2 g. That the project shall be retained for Community Development purposes 3 as defined by applicable HUD provisions at a level of operations and maintenance 4 adequate to insure maximum utilization of the project by low- and moderate-income 5 persons. 6 h. That the Director, shall biannually evaluate the CITY's progress in 7 complying with the terms of this contract. CITY shall cooperate fully in 8 such evaluation. The Director shall report the findings of each evaluation 9 to the CITY and Orange County Board of Supervisors. If it is determined by the 10 Board of Supervisors that performance or progress on performance is unsatisfactory, 11 the Board of Supervisors may terminate the contract or withhold further funding 12 on the project pending resolution of the unsatisfactory conditions. In addition, 13 the Board of Supervisors may require reimbursement of any funds that it determines 14 to be improperly expended or not expended on the project in a timely manner. 15 1. That if it is subsequently determined by COUNTY or HUD 16 that funds were not expended in compliance with the applicable federal laws and 17 regulations, CITY will refund to COUNTY such sums as were improperly expended. 18 J. To assume responsibility for California Environmental Quality 19 Act compliance and to provide COUNTY with necessary information to comply with 20 the National Environmental Policy Act. 21 4. Project Funding: 22 a. The estimated cost of the project covered by this agreement is: 23 Land Acquisition/Sewer Construction $175,000.00 (One Hundred 24 Seventy-Five Thousand Dollars and no/100) 25 Design and Inspection $ -0- 26 TOTAL $175,000.00 (One Hundred 27 Seventy-Five Thousand Dollars and no/100) 28 b. COUNTY shall not be responsible for any costs which exceed the ap- 9 proved estimated project(s) cost funded by Block Grant. 10 d. Payment by the COUNTY to the CITY shall be on a reimbursable basis 11 unless CITY has been authorized and issued cash advances by COUNTY under this 12 Contract. 13 e. Cash advances requested by the CITY under this Contract shall be 14 made by the COUNTY to the CITY if the following conditions are met: 15 (1) The CITY has demonstrated to the Director through certification 16 in a form prescribed by the Director and subsequently through performance, its . 17 willingness and ability to establish procedures that will minimize the time elapsing 18 between the receipt of funds and disbursement of such funds. 19 (2) The CITY certifies to the Director, that the CITY's financial 20 management system meets the standards for fund control and accountability prescribed 21 in Office of Management and Budget Circular No. A-102 as amended from time to time. 22 (3) The CITY complies with the cash advance procedures as shall be 23 required by the Financial Procedures of the Housing and Community Development Program 24 Office of County's Environmental Management Agency (hereinafter EMA). 25 If the CITY is subsequently found, by DIRECTOR, to be in noncompliance with 26 4.e.(1) through 4.e.(3) CITY shall be paid pursuant to 4.d. 27 f. Reimbursable basis payments, as referred to in section 4.d. above, 28 and/or cash advances described in 4.e. above, shall be made in accordance with the -5- • • Contract No. C26636 I 1 financial procedures of EMA. In the event of conflict between such financial 2 procedures and any applicable statutes, rules or regulations of HUD, including 3 Office of Management and Budget Circular No. A-102, the latter shall prevail. 4 5. Neither COUNTY nor any officer nor employee thereof shall be responsible 5 for any damage or liability occurring by reason of any action or omission of 6 CITY or its agents, associatesk contractors, subcontractors, materialmen, laborers, 7 or any other persons, firms, or corporations furnishing or supplying work service, 8 materials, or supplies in connection with CITY's performance of this Contract and 9 from any and all claims and losses accruing or resulting to any persons, firm or 10 corporation for personal injuries or property damage resulting from or as a 11 consequence of, CITY's performance of this Contract under or in connection with any 12 work, authority or jurisdiction delegated to CITY under this Contract. It is also 18 understood and agreed that, pursuant to California Government Code Section 895.4, 14 CITY shall fully indemnify, defend and hold COUNTY harmless from any liability 15 imposed for injury (as defined by California Government Code Section 810.8) occurring 16 by reason of any action or omission of CITY under or in connection with any work, 17 authority or jurisdiction delegated to CITY under this Contract. CITY shall act in 18 an independent capacity and not as officers, employees or- agents of COUNTY. 19 6. Neither CITY nor any officer nor employee thereof shall be responsible 20 for any damage or liability occurring by reason of any action or omission of COUNTY 21 under or in connection with any work, authority or jurisdiction not delegated to CITY 22 under the terms of this contract. It is also understood and agreed that, pursuant 2$ to California Government Code Section 895.4 COUNTY shall fully indemnify, defend 24 and hold CITY harmless from any liability imposed for injury (as defined by 25 California Government Code Section 810.8), occurring by reason of any action 26 or omission of COUNTY under or in connection with any work, authority or jurisdiction 27 not delegated by CITY under this contract. 28 7. The project will utilize Housing and Community Development Block Grant Funds and the additional sewer line can be installed within the established cost constraint of $175 ,000 . The report advises that the costs will be charged to the Redevelopment Agency. AGENDA ITEM August 16 , 1983 TO: Stephen B. Julian, City Manager FROM: Thomas G. Merrell, Director Community Planning and Development SUBJECT: Contract Amendment - 7th Year (Trabuco Sewer) SITUATION In 1982 , the Board of Supervisors and the City Council approved a contract to expend Housing and Community Development Block Grant Funds to construct the Trabuco Sewer extension. The extension will serve the Little Hollywood neighborhood in Los Rios. Due to some cost-saving measures (i.e. , intercepting the Moulton Niguel line) , it was determined that a sewer line could be extended along Ramos Street within the established cost constraint of the $175, 000 grant. However, the contract is required to be amended to reflect the additional line. The amended contract is attached. COMMISSION/BOARD REVIEW, RECOMMENDATION The Los Rios Review Committee reviewed the original contract proposal as part of the 7th year contract review. The committee was notified of the minor contract change at their August 10 meeting. FINANCIAL CONSIDERATIONS As in the past, the City has agreed to absorb administrative, engineering and planning costs. Thus, all monies received by the City through this program have been directly applied to the Los Rios neighborhood. The capital improvements monies will not exceed $175, 000--the amount provided to the City from the County. This money is credited to Account No. 06- 4706-545 and 546. Salary costs from Planning staff will come from Account No. 01-4310-111 and from Engineering Account No. 01-4420-111. The monies for this project are allocated in the current budget. All these costs will be charged to the Redevelopment Agency. ALTERNATE ACTIONS 1. Authorize the Mayor to execute the 7th year HCDBG amended contract. 2. Modify the contract and authorize the Mayor to execute. 3. Refer back to staff for further review. Julian, City Manager FROM: Raymundo Becerra, Acting Director Community Planning and Development SUBJECT: HCDA Seventh Year Operating Agreement SITUATION In early 1981, the Board of Supervisors approved funding allocations for the seventh year of the Housing and Community Development Block Grant Program (HCDBG) . This particular grant calls for the expenditure of $175, 000 . These monies will be used for the development of a sewer system in the Little Hollywood area. In order for the City to utilize these funds, an operating agreement must be entered into between the County of Orange and the City of San Juan Capis- trano. The City has entered into these agreements for the past six funding years. FINANCIAL CONSIDERATIONS As in the past, the City has agreed to absorb administrative, engineering, and planning costs. Thus, all monies received by the City through this program have been directly applied to the residents of the Los Rios neighborhood. ALTERNATE ACTIONS 1. The funding will be used to continue implementation of the Los Rios Precise Plan, providing for sewer installation, a community park and bazaar, and housing rehabilitation. Written Communicaticns: Report dated September 17, 1980, from the Director of Community Planning and Development, forwarding a Comprehensive Strategy Program for implementation of the Plan. Judy Lynch, Assistant Planner, reviewed the program and use of funds, cited meetings held by the Los Rios Review Committee and Planning Commission and the fact that public notices were mailed, published, and posted, and advised that residents are in agreement with the proposals. Public Hearing: . Notice having been given as required by law, Mayor Hausdorfer-. opened the Public Hearing and, there being no response, declared the Hearing closed. Councilman Friess requested information on receipt of Federal funds, as indicated on page 11 of the Application. BACKGROUND Staff is preparing an application for seventh year Housing and Community Development Block Grant funds, in accordance with City Council policy to participate in the HCDBG Program. The requested funding will be used to continue the implementation of the Los Rios Precise Plan, as outlined in the attached Comprehensive Strategy Program. The proposed Seventh Year Application consists of a grant request totaling $522,100. Components of the grant are: Housing Cost Reduction: $378,600 Housing Rehabilitation: $ 50,000 Public Improvements: $ 93,500 City Council consideration of the application provides an opportunity to receive additional public input on the HCDBG Program, the issues and needs of the community, and the appropriateness of funding levels. Projects that have been undertaken with HCDBG funds to implement the Los Rios Precise Plan include: a loan/grant program for housing rehabilitation, street improvements to Los Rios, Mission, and Ramos Streets, a connector road between Mission and Ramos Streets, restoration of the Montanez Adobe, and acquisition of the Little Hollywood Planned District for the development of low-rent housing. The following projects under the seventh year application have been proposed in order to support the City's commitment towards the implementation of the Los Rios Precise Plan and, in particular, the achievement of the housing objectives. Seventh year funds for Housing Cost Reduction will be used to construct offsite improvements to support the proposed housing in the Little Hollywood Planned Housing District. The improvements include: the installation of a sewer along the east side of the Trabuco Creek, south to Del Obispo; replacing the sewer along Mission and Los Rios Streets, to Del Obispo; the Mission Street crossing at the A.T. and S.F. tracks; the extension of Mission Street into the Little Hollywood area; and installation of a sewer on Ramos Street to connect to the proposed Trabuco Creek sewer line. Neighborhood Strategy Objective: The following objectives have been developed and approved as part of the Los Rios Precise Plan and shall be used as a guide for Housing and Community Development Funding: Housing: (a) "Fix-Up" grants of up to $500.00 per dwelling unit should be provided to allow residents to make minor repairs and imp- rovements to their dwelling units which are essential -to keep the unit habitable. Property Acquisition: The City should apply for discretionary Housing and Community Development Act funds for the purpose of adquiring the entire Planned Housing District site. 4. .Public Street Improvements: Presently Los Rios Street is not crowned resulting in poor drainage; and its shoulders are dirt, making them difficult to cross during rainy weather. The improvements to Los Rios Street are intended to improve the drainage characteristics without altering the rural character of the street. A driving surface 20' wide will be located in the existing road , in a manner that avoids existing buildings, fences or trees. A surfaced shoulder of variable width will be provided to allow space for walking and parking. The shoulder will range from approximately 2' to 8' in width. A submerged drainage tile or pipe drain will be installed within the shoulder. In keeping with the rural character of the area, there will be no sidewalk. The driving surface will have a brown-colored aggregate. The shoulder will be crushed native stone. The roadway of of Los Rios Street from Del Obispo Street extending about 220' to the north, is currently 40' wide. This improvement was made in r 1974 in anticipation of new commercial development along Los Rios Street. If continued at 40' , the extension would require the demolition of res- idential units including an adobe occupied by low and moderate income families. Therefore, said segment of Los Rios Street will be reduced in width to a roadway to 20'by modifying the easterly curb line. The petition has been approved by the State and is being reviewed by the Heritage, Conservation and Recreation Service ( former National Park Service) of the United States Department of Interior. If the district is app- roved, property owners of structures within the area will be eligible for tax deductions for improvements made to the buildings. The only requirement is that the structure be a commercial use. 3. Adoption of Historic Building Code: The City as part of its policy to preserve its historic culture has adopted Section 104-J-Historic Building, 1976 Uniform Building Code, which exempts Historic Buildings from complying with all provisions of the U.B.C. . This program shall be established in order to meet the following objectives: 1) offer homeownership to those who could not otherwise afford their own home; 2) revitalize deteriorating neighborhoods by increasing their economic viability; and 3) provide a method of maintaining neighborhood cohesiveness to to stabilize migration patterns beause of economic considerations between landlord/tenants. Said program shall be administered by the Los Rios Development Corporation. Its integration into the housing strategy is more thoroughly discussed under Section F. F. Housing Improvement Strategy: The primary objective of the Housing Improvement Strategy is the stabilization of the existing neighborhood from pressures of forced migration of current families. The strategy by the use of previously identified programs shall maintain the existing housing inventory while providing an opportunity for new low and moderate income units located and constructed in accordance with the policy objectives of the Los Rios Precise Plan. This strategy shall consist of the following elements: 1. Existing Housing: A major segment of the current housing is related to rental units -- a majority of which are located in the Little Hollywood area of Los Rios. In order to provide for a stabilized neighborhood situation, it is recommended that approximately 4. 5+ acres be acquired through the use of Housing and Community Development funds for the area referred to as the LDA ( Low Density Residential ) District. It is proposed that the existing units-be maintained and occupied by existing families during acquisition. Upon acquisiiton each unit would be deeded to the present occupants under the Urban Homesteading Program. Under this program; each family would receive title to their parcel upon fufill- ment of conditions of a Homesteading Agreement. Generally, the cond- itions would require that the participants bring the structures up to the minimum Building Code over a specific time frame. In addition, the occupants would be required to maintain their residence at the location for a minimum of five (5) years. Rehabilitation of units would be eligible for funding under the Housing Improvement Loan Program. 2. New Housing: New Housing would be constructed for that portion of the LDR District to serve as a means of providing replacement housing for those dwellings which can not be rehabilitated with a limited number of new units. The construction program would be administered by the non-profit Development Corporation. The type of units would not necessarily be restricted to new construction, but may include relocated units from other areas of the community. Generally these units would be rental units utilizing Section 8 Rental Assistance. Persons. dislocated from the area because of hazardous living conditions and rental increases would receive priority for occupancy of anv new units. G. (c) Public Improvements - Sewer replacement on Los Rios Street, and on Mission Street. H. Neighborhood Participation Program: The City has adopted a Citizen's Participation Program. This program is directed by the Los Rios Review Committee which is composed of area residents. The Citizen Participation Program format of Advisory Committee Meeting, workshops, and public hearings has been designed to actively stimulate input from; (1) low and moderate income persons; (2) minority groups, the elderly and the handicapped; (3) residents of areas designated for rehabilitation; and (4) all other persons directly affected by the Community Development Program. I. Relationship to Housing Assistance Plan: Major emphasis has been placed upon rehabilitated housing in the adopted Housing Assistance Plan. As outlined in the neighborhood profile, the Los Rios area maintains the largest proportion of low and moderate income families and dwelling units in need of rehabilitation. Associated Neighborhood Improvement Programs: The City as part of the implementation program for the Los Rios Precise Plan has funded, committed funds or applied for applicable grants for the following facilities : 1. Los Rios Park - The proposed Los Rios Park has been designed to incorporate a variety of open space activities while providing a buffer between residential and non-residential land uses. Multi-Modal Transportation Terminal - Under the provisions of SB 1879 (State) , the City has submitted an application for funding the construction of a multi-modal transportation terminal located easterly of the neighborhood strategy area. Upon implementation the multizmodal terminal will provide convenient access for neighborhood residents to a centralized transportation facility. The various modes to be served include Amtrak, Orange County Transit District buses (local, freeway express) , and para-transit services. Historic Preservation Program - Rehabilitation and restoration program for the Montanez Adobe. This structure represents possibly one of the oldest residential dwellings in Orange County. The structure restoration program calls for a tour museum atmosphere which will allow area residents and visitors to become acquainted with their cultural heritage.
