The period of performance of the project shall commence on the jst day of October 19 76 and shall cease on the 30th day of September 19 77 2. Disbursement schedule is as follows: Payment shall be made upon the receipt of the "Report of Financial Activity and Request for Payment". Funds are to be paidto the Subgrantee for reim- bursement of accrued expenditures. "Report of Financial Activity and Re- quest for Payment" should be submitted on a regular basis, normally once a month. Additional Administrative Conditions and Provisions 1. Termination of Aid: After notice of County - review, this grant may be terminated or fund payments discontinued by the County where it finds a substantial failure to comply with the provisions.of the contract including these and any special grant conditions and subsequent action by the County. 2. Inspection and Audit: The County and/or the Department of Labor or any of its duly authorized representatives, shall have access for purpose of audit and examinations to any books, documents, papers, and records of the Subgrantee and to relevant books and records of subgrantees and subcontrac- tors. 3. Accounting: The criteria for recordkeeping detail shall be definitive enough to identify expense by CETA Ti,tle, program activity, cost category, -I- I 6 7 8 WO 10 11 12' 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 and budget line items as defined in the CETA Audit Guide, April 19-7s. 4. Maintenance of Records: All required records shall be maintained until three (3) years after termination or expiration of grant. 5. Utilization oi Funds: Funds awarded are to be expended for purposes and activities covered by SUBGRANTEE's approved grant. Adjustments will be made to correct previous overpayments or underpayments and any disallowanm resulting from audit. ;6. Allowable Costs: The allowability of costs incurred u nder any grant shall be determined in accordance with the general principles of allbwability and standards for selected cost items set forth in Bureau of the Budget Circu- lar No. A87 "Principles for Determining,Costs Applicable to Grants and Con- tracts with State and Local Governments" except where superceded by CETA Regulations. 7. Expenses Not Allovrable: Grant funds may not be expended for any item not identified as allowable under Section 98.12 of the 'Play 23, 1975 Federal Register. Prior approval should be sought from County on :--any question- able expenditures. Any expenditure of funds involving (1) an excess of the approved total allocation; (2) a new program activity; or, (3) any program activity or cost category involving a cumulative increase of more than five percent (5%) of the total budget shall necessitate an amendment of the grani requiring prior grantor concurrence. 8. Unexpended Fu nds: All unexpended balances of grant funds will revert to County. 9. Grant Interest: SUBGRANTEE shall not be accountable for interest earned oil grant funds pending their disbursement or actual application for project purposes. 10. Income from Other Sources: All income from other sources, such as contri- butions, donations or funds from other grant programs, must be accounted -2- 24 14. Insurance: The SUBGRANTEE must provide evidence of adequatepersonal 25 liability and property damage insurance prior to funds being disbursed. The 26 11 County may at its sole discretion waive the above requirement. 27 ii 15. General The administration of grants shall be subject to such further 28 rules, regulations and policies concerning account and records, payments of -3- .1 for separately id not co -mingled with CETA fu. the SUBGRANTEE certifies 2 that nolother federal funds will be received or used for the portions of the 3 . project funded by the County. 4 11. Title to ProDerty: Title to property acquired in whole or in part with 5 - grant funds in accordance with approved budgets shall vest in the County. 6 subject to divestment at the option of the County. SUBGRANTEE shall 7 exercise due care in the use, maintenance, protection and preservation 8 of such property during the period of project use. SUBGRANTEE will submit 9 to the County within thirty (30) days of purchase a list of all equip - :L0 ment items purchased with grant funds. .11 12. Obligation of Grant Funds: Grant funds.shall not, without advance written 3.2 approval by the County be obligated prior to -the effective date or 13 subsequent to the termination date of the grant period. Obligations out - 14 standing as of the termination date shall be liquidated within ninety (90) 15 days. Such obligations, must be related to goods or services provided and 16 utilized within the grant period. 17 13. Bond: All SUBGRANTEES who will receive or disburse grant funds, are re - 18 quired to furnish a bond in a form satisfactory to the County in an 19 amount of at least fifty percent (50') of the total grant award, and con - 20 ditioned upon the faithful performance of their duties as required by law 21 1 and this agreement of all of the officers, employees, or agents of the grantee. The County may at its sole discretion waive the above require- 23 1 ment. 24 14. Insurance: The SUBGRANTEE must provide evidence of adequatepersonal 25 liability and property damage insurance prior to funds being disbursed. C. Cancellai.ions or Modifications 1. All parties to this grant agree that program funds are contingent upon 'funds received, or obligated from the Department of Labor under CETA of 1973. if such funds are not forthcoming, or otherWise, limited the County will notify the SUBGRANTEE of any such notice or provision and order them t�, cease, limit, or otherwise curtail their operations in accordance with the following provisions: In the event the Department of Labor terminates in whole or in part its contract with the prime contractor before the expiration date, and by so doing makes necessary the termination by the prime contractor of this subcontract, the Program Agent -will provide prompt notice of termination to the subcontractor. Upon receipt of such notice, the subcontractor agrees to cease such operations as are necessary to conform ---------with the Department of Labor termination of the prime contract within 20 days, and to negotiate necessary .fair and reasonable final settlement and close-out costs. (Sec. 108(b)(2), 110(b), and 602(b) CETA of 1973) -2. If the SUBGRANTEE should fail to meet the commitment of this grant either because of failure to perform; changes in the program operating environment; or other factors that are a product of program operations or changes in circumstances or s,ituations, then the County.- may at its discretion withold further funds, and unilaterally terminate the grant. There may be a mutually agreed upon reallocation of the balance of funds with a change in goals, objectives and program design. 3. All changes or modifications to the grant shall be jointly negotiated between the SUBGRANTEE and the County. In all cases changes and modifications shall be made in compliance with rules, regulations, policies and procedures presently in existance or provided in the future by the County. -4- 0 Reports 1. The SUBGRANTEE shall submit, at such times and in such form as may be pre- scribed, such reports as the County may reasonably require. The .Count y shall notify the SUBGRANTEE from time to time as necessary of any chahges in the SUBGRANTEE's reporting requirements. Monitoring and Evaluation 1. Monitoring and/or evaluation will be scheduled in accordance with the over- all County Management requirements and will require access -on the part of the County -to all records, data, and other.documentation, as well as access to observe in a reasonable manner relevant program activities. F. Authority to Bind Subgrantee 1. SUBGRANTEE shall furnish to the -County, in writing, a list of persons authorized to execute, in behalf of the SUBGRANITEE, grants, modifications ,to the grants, Report of Financial Activity and Request for Payment, or other documents as may be required by the County, - In the event auth- ority is delegated to a position (e.g., City Manager, Personnel Director) rather than to an individual the list of positions so authorized shall be furnished. G. Fair Employment Practices 1. The percentage of minority and female participants and staff personnel at - all levels within the SUBGRANTEE's organization, funded under this grant and their u pward mobility or lateral movement over a period of time. 3.' Periodic interviews will be conducted with a representative sample of par- ticipants and staf f personnel funded under this grant. 4. In-service training and career counseling which will enhance the future em- ployability of the participants. If Operational Compliance review indicates that the SUBGRANTEE is out of.com- pliance, the SUBGRANTEE will be given 60 days notice of this fact, and required to show sufficient progress in meeting compliance standards. Should insuffi- cient evidence of attempting to comply be shown, the 'program may be recommended for deobligation, as per the -County of Orange deobligation 'clause contained in this agreement, under Special Provisions and Conditions, subparagraph B. (1), Termination of Aid and subparagraph C. (2), Cancellation or Modification. -7- 6 7 E-1 a 10 11 12 13 14 16 17 ASSURANCES AND CERTIFICATIr"'S A. General Assurances 1. The applicant assures and certifie:; that: a. It will comply with the requirements of the Comprehensive Employment and. Training Act (CETA) of 1973, as amended (P.L. 93-203, 87 Stat. 839 i and P.L. 93-50, 88 Stat. 1845), hereinafter referred to as' the Act, r and, with the regulations and policies promulgated thereunder; and b. It will comply with OMB Circular number A-95 and Federal Management Circulars (FMC) 74-4 and 74-7, as those circulars relate to functions such as the utilization of funds, the operations of programs, and maintenance of records, books, accounts, and other documents under the Act. 2. The applicant further �ssures and certifies *that if the regulations promulgated pursuant to the Act are amended or revised, it shall comply with them or notify the ' County within 30 days after promulgation of the amendments or revisi6n that it cannot so conform, so that the :L8 county may take appropriate action including termination, if necessary. 3.9 3. In addition to t*he requirements of I and 2 above and consistent with the 20 regulations issued pursuant to the Act, the applicant makes the following 23. further assurances and certifications: 22 a. It possesses legal authority to apply for the orant; that a resolution, 23 motion, or similar action has been duly adopted or passed as an offici� 24 act of the applicant's governing body, authorizing the filing of the 25 application, including all understandings and assurances contained 26 therein, and directing and authorizing the person identified as the 27 official representative of the applicant to act in connection with the ,28 application and to provide such additional information as may be 22 91-646) which provides for fair and equitable treatment of persons 23 displaced as a result of Federal and federally -assisted programs. 24 f. It will comply with the provisions of the Hatch Act which limit the 25 political activity of'employees. 26 g. it will comply with the requirement that no program under the Act shall 27 involve political activities (section 710). 28 it h. It will comply with Title VI of the Civil Rights Act of 1964, (42 USC 11 2000d) prohibiting employment discrimination where (1) the primary 12 purpose of grant is to provide employment or (2) discriminatory employment practices will result in unequal treatment of persons who 14 are or should be benefiting from the grant -aided activity. 3.5 d. No person with responsibilities in the operation of any.program under 26 the Act will discriminate with respect to any program participant.or 3.7 any applicant for participation in such program because of race, creed, 18 color, national origin, sex, age, political affiliation or beliefs 29 (section 703(l) and 712). 20 e* It will comply with the requirements of the provisions of the Iniform Relocation Assistance and Real Property Acquisition Act of 1970 (P.L. 22 91-646) which provides for fair and equitable treatment of persons 23 displaced as a result of Federal and federally -assisted programs. 24 f. CETA funds will, to the extent practicable, be used to supplement, 3.6 rather than supplant, the level of funds that would otherwise be 17 available for the planning and administration of programs under' the 18 eligible applicant's grant (section 703(11)). _19 s. It will submit reports as required by the County ,iand will maintain 20 records and provide access to them as necessary for the Secretary s 21 review to assure that funds are being expended in accordance with tile 22 purposes and provisions of'the Act, including the maintenance of 23 records to assist the Countv* in determining the extent to which 24 the program meets the special needs of disadvantaged, chronically 25 Unemployed, and low income persons for meaningful employment opportuni- 26 ties (sections 703(12) and 311(c)). 27 i t. Conditions of employment or training will be appropriate and reasonable;, 15 with regard to the type of work, the geographical region and the 16 proficiency of the applicant (section 703(4)). 17-1 m. It will comply with the labor standards requirements set out i.n section 706 of the Act. x. Services and activities provided under this Act will be adininistered by or under the supervision of the applicant (sections 105(a)(1)(B) and 205(c)(1)). y. No funds made available under the Act shall be used for lobbying activities in volation of 18 USCA 1913. B. Additional Assurances for Title I Proqrams In carrying out programs Linder Title I of the Act, the applicant assures and certifies that: 1. Manpower services', including job developirlent, w ill be provided to those most in need of them including low income persons and persons of"limited English-speaking ability, and that the need for continued funding of programs of demonstrated effectiveness is considered in serving such persons (section 105(a)(1)(0). 2.. Programs of institutional skill training shall be designed for occupations in which skill shortages exist (section 105(a)(6)). 3. The plan meets all the requirements of section 105(a) and the applicant will comply with all provisio.ns of the Act (section.105(b)). 4. It will make such arrangements as are prescribed by regulation to assist the Commission in carrying out his responsibilities under sections 105 and 108 of the Act (section 105(a)(7)). 5. Special consideration will be given to the needs of eligible disabled veterans, special veterans, and veterans who served in the Armed Forces and who received other than a dishonorable discharge within four years before the date of their application. Each applicant in selecting t (section 70'1(13)). 2 u. 'The.'program makes appropriate prawisica-for the manpower needs of I youth in the area served (section 703(15 ), and will assure.that: (1) Individuals receiving training on the job shall be compensated by the employer at such rates, including periodic increases, as may be deemed reasonable under regulations prescribed by the Secretary, but in no event at a rate less than that specified in Section 6(a)(1) of the Faie Labor Standards Act of 1938 or, if higher, under the applicable State or local minimum wage law. Wages in the Commonwealth of Puerto Rico, the Virgin Islands, American Samoa, and the Trust Territory of the Pacific Islands shall be consistent with the Federal , State, or local law other- wise applicable (section 111(b)). (2) Persons employed in public service jobs under this Act shall be paid wages which shall not be lowerthan whichever is the highest of (a) the minimum wage which would be applicable to the employee under the Fair Labor Standards Act of 1938, if Section 22 6(a)(1) of such title applies to the participant and if he were onwealth 23 not exempt under section 13 thereof. Wages in the Comm can Samoa, and the �f Puerto Rico, the Virgin Islands, Ameri 24 wi th ,25 Trust Territory of the Pacific Isla nds shall be consistent 26 the Federal, State, or local law otherwise applicable; (b) the '27 State or local minimum viage for the most nearly comparable 28 covered employment, or (c) the prevailing rates of pay for persons -5- participants for programs funded undar Title 1, of the Act, shall take into 2 consideration the extent that such veterans are available in the area. 3 Specific effort should be made to develop appropriate full or part7time 4 .5 6 T 10 n 12 131 opportunities for such veterans. The applicant should utilize the assistance o.-' the State and local veterans employmeat service representative in formulating its program objectives. On a continuing and time.ly basis, information on job vacancies and training opportunities funded under Title I of the Act shall be provided to the State and local veterans employment service representative for the purpose of disseminating information to eligible veterans (section 104(b) of Emergency Jobs and Unemployment Assistance Act of 1974). 3.4 I'C. Additional Assurances Pelatin2 to Public -Service E-mployment Pro2rams 3.5 , ' 16 17 3.8 19 20 21 22 23 24 25 27 23 For public service employment activity, the applicant further assures and certifies that: 1. Special consideration will be given to the filling of jobs which provide sufficient prospects for advancement or suitable continued employment by providing..complementary training and manpower services designed to (1) promote the advancement of participants to employment or training opportunities suitable to the individuals involved, whether in the public or private sector of the economy, (2) provide participants with skills for which there is an anticipated high demand, or (3) provide participants with self -development skills; except where exempt under the provisions of section 604 of the Act, provided, however,that nothing contained in this paragraph shall be construed to preclude persons or programs for whom the fore going goals are not feasible or appropriate (sections 205(c)(4) and 604).. -7- 24 1 revisions of qualification requirements at all levels of employment, 2.5 including civil service requirements and practices relating thereto, 26 in accordance with regulations prescribed by the Secretary, with a 27 vi ew toward removing artificial barriers to public employment of those .28 whom it is the purpose of the Act to assist (section 205(c)(18)). 2. To the -xtent feasible, public servic -jobs shall be provided �M'I 1, 2 occupational fields which are most likely to expand within the publi.-E 3 or private sector as the unemployment rate recedes except where exempt 4 under section 604 of the Act (sections 205(c)(6) and 604). 5 3. Special consideration in filling transitional public service jobs will 6 be given to unemployed persons who are the most -severely disadvantaged 7 in terms of the length of time.they have been unemployed without .8 assistance, but such special consideration shall not authorize the 9 hiring of any person when any other person is on lay-off from the same -3.0 or any substantially equivalent job (section 205(c)(7)). 11 4. No funds will be used to hire any person to fill a job opening created 3.2 by the action of an employer in la�ing off or terminating the ,13 employment of any other regular employee not -supported under the Act 14 in anticipation of filling the vacancy so created by hiring an employe, -15 to be supported under the Act (section -205(c)(8)). 16 5. Due consideration will -6e given to persons who have participated in 3.7 manpower training programs for whom employment opportunities would not 18 otherwise be immediately available (section 205(c)(9)). 3.9 6. Periodic review procedures established pursuant to section 207(a) of 20 the Act will be complied with (section 205(c)(17)). 21 7. Agencies and institutions to whom financial assistance is made 22 available under this title have' undertaken or will undertake, analyses 23 J! of job descriptions and reevaluations and, where shown necessary, 24 1 revisions of qualification requirements at all levels of employment, 2.5 including civil service requirements and practices relating thereto, 26 in accordance with regulations prescribed by the Secretary, with a 27 vi ew toward removing artificial barriers to public employment of those .28 whom it is the purpose of the Act to assist (section 205(c)(18)). 1 13. Jobs are in addition to those that would be funded by the sponsor i;;�.- 2 the absence of assi�tance under the Act (section 205(c)(25)). 3 D. Additional Assurances for Title II Programs. All assurances in C above apply to activities funded under Title II. In addition, the applicant will assure that: 6 (1) Only persons residing within the areas of substantial unemployment qualifying for assistance will be hired to fill jobs created under Title 11 of the Act and the public services provided by such jobs shall, to the -9 extent feasible, be designed to benefit the residents o� such areas 0 (section 205(c)(3)). 11 (2) All persons employed under any program, other than necessary technical, 22 supervisory, and administrative personnel, will -be sel ected from 1.3 unemployed and underemployed persons (section 205(c)(20)). 14 (3) Special consideration shall be given to eligible disabled veterans., 15 special veterans, and veterans who served in the Armed Forces and who re - 3.6 ceived other than a dishonorable discharge within four years before the -17 date of their application. Each eligible applicant selecting participant, .18 for programs funded under Title 11 of the Act, shall take into considera- 19 tion the extent that such veterans are available in the area. Specific .20 effort should be made to develop appropriate full or part-time 21 opportunities for such veterans. In order to insure special consideratio 22 for veterans, all public service employment vacancies under Title 11, 23 except those to whi6h former employees are being recalled, must be listed 24 with the State employment service at least 48 hours (excluding Saturdays, 25 Sundays, and holidays) before such vacancies are filled. During this 261� period, the employment service may refer those veterans specified above. 27 If sufficient numbers of veterans are not available, the employment 28 service, upon request, may also refer members of other significant LIP 8. Where app- iriate, it will maintain or pr--,ide linkages with upgrading i 2 and other manpower programs for the purpose of (1) providing those 3 persons employed in public service jobs who want to pursue work with .4 the employer, in the same or similar work, with opportunities to do so 5 and to find permanent, upwardly mobile careers in that field, and (2) 6 providing those persons so employed who do not wish to pursue 7 permanent careers in such field, with opportunities to seek, prepare 8 for, and obtain work-in other fields (sections 205(c)(19) and 604). 9. The program will, to the maximum extent feasible, contribute to the 3.0 elimination of artificial barriers to employment and occupational 33. advancement, including opportunities for the disadvantaged (section 12' 205(c)(21)). 3.3 10. The jobs in each j"ob category in no way infringe upon the promotional opportunities which would otherwise be available to persons currently employed in public service jobs not subsidized under the Act, and assure that no job will be filled in other than an entry level posi- tion in each job category until applicable personnel procedures and .collective bargaining agreements have been 'complied with (section 205(c)(24)).
