1984-0710_ORANGE, COUNTY OF_AgreementAGREEMENT FOR LAW ENFORCEMENT SERVICES 2!1 3 THIS AGREEMENT, made and entered into by and between the COUNTY 4 Or- ORANGE, a body politic and corporate, hereinafter designated as 51 "COUNTY", and the CITY OF SAN JUAN CAPISTRANO, a municipal corporation, 6 located in the County of Orange, hereinafter designated as "CITY". 7 WITNESSETH: ,!I 1! In consideration of the terms, covenants, conditions, and promises 91� to be kept, performed and observed by the parties hereto, it is agreed '1011 as fol lows: 11 1. COUNTY, through its Sheriff and the deputies, officers and employees 12 of his Department, shall render to CITY police protection and law 13� i enforcement services as hereinafter in this Agreement provided. 14 2. Such services sha 11 include the enforcement of State statutes :15 and such municipal ordinances of CITY as are similar to ordinances 16 COUNTY by the Sheriff territory of enforced within unincorporated 17 of COUNTY. 18 3. The level of such services shall be as follows: two (2) day car units, three (3) evening car units, two (2) night car units, 20 and two (2) investigative units. 21 A day car unit is a one-man patrol car unit used on the day 22 shift 56 hours per week. 23 An evening car unit is a one-man patrol car unit used on the 24 evening shift for 56 hours per week. 25 A night car unit is a one-man patrol car unit used on the night 26 shift for 56 hours per week. 27 An investigative unit is one detective for 40 hours per week and 28 includes all necessary related services. ItJ 4. For the purpose of performing said functions, COUNTY shall provide 2 all manpower, supervision, communications, equipment, and supplies 3 necessary to maintain the service to be rendered hereunder. 4 5. The final authority for rendition of service, standards of perform - 5 ance, discipline of off icers, and other matters incident to the 6 performance of such service and the control of COUNTY personnel 7 shall remain in COUNTY. 8 6. CITY shall not be called upon to assume any liability for the direct payment of any salaries, wages, or other compensation, .LU to any COUNTY personnel performing services hereunder or any 11 liability other than that provided for by this Agreement. Except 12 as herein otherwise specified, CITY shall not be liable for compen- 13 sation or indemnity to any COU61TY employee or any injury or 14 sickness arising out of his employment. 15 7. COUNTY, its officers, agents, and employees shall not be deemed 16 to have assumed any liability for the negligence of CITY or any 17 of its officers or employees, or for any dangerous or defective 1811 condition of any public street or work or property of CITY, and 19 CITY shall hold COUNTY, its officers and employees harmless from 20 any and all claims for damages resulting therefrom. 21 8. Both CITY and COUNTY shall hold each other harmless from 22 liability for acts or omissions of the other. 23 9. CITY agrees to pay COUNTY the costs of performing all services 24 covered by this Agreement. Such costs shall be determined by the 25 County Audi tor -Control ler as follows: 26 Costs of patrol service units shall include the d i rec t operation 27 expense of the Sheriff's Patrol Bureaus, including salaries, wages, 281 benef i ts, services, supplies, depreciation, Personnel Bureau, Fiscal -2- 0 0 1 Services, and training costs prorated to each service unit or portion 2 thereof, plus general �ounty' overhead applicable to the Patrol 3 Bureaus. Costs of investigative service units not normally supplied 4'11 to all County law enforcement shall include the direct operating .51 expense of the Sheriff's Detective and Sex/Crim es Child Abuse Detail 6 including, salaries, wages, benefits services, supplies and Department 7 overhead to include appropriate percentages of Administration, 8 1 depreciation, Personnel Bureau, Fiscal Services, and training costs 9 prorated to each service unit or portion thereof, plus general 101� County overhead applicable to the Investigation Division. The COUNTY shall render to CITY at the close of each calendar 3.2 month a statement of one twelfth the . annual costs, as determined pursuant to the preceding paragraphs, of performing all services 3.4 covered by that Agreement, as determined by the COUNTY Auditor - 15 Controller at the beginning of each fiscal year, and said CITY 3.6 shall pay COUNTY therefore within twenty (20) days after receipt 17 of such statement. The annual cost for fiscal year 1984-85 to be 3.8 $878,895. If such payment is not received by the COUNTY within 19 thirty (30) days af ter rend i t i on of b i I I i n 9, COUNTY may satisfy 20 such indebtedness from any funds of CITY on deposit with COUNTY 21 without giving further notice to CITY of COUNTY'S intention to 22 do so. 23 10. WARMINGTON COMPANY -- CARBON CANYON CHANNEL (E03): On motion by Supervisor Riley, seconded by Supervisor Clark, negotiation of an agreement with the City of Placentia and The Robert P. Warmington Company for OCFCD acceptance and maintenance of fully improved Carbon Canyon Channel (E03), from Palm Drive to Alta Vista Street, with improvements being carried out by The Robert P. �iarmington Company at no cost to the District, was authorized, as recommended by EIMA. MOTION UNANIMOUSLY CARRIED BY BOARD NEMBERS PRESENT. AGREEMENT WITH MOULTON NIGUEL WATER DISTRICT -- CROWN VALLEY COMMUNITY PARK GYMNASIUM: On motion by Supervisor Riley, seconded by Supervisor Clark, the Clerk of the Board, on behalf of the Board of Supervisors, was authorized to execute Agreement No. 084-123 with Moulton Niguel Water District in the amount of $2,442 for plan check and inspection fees and $6,396.42 for connection fees, to be paid by the County for the Crown Valley Comjnunity Park Gymnasium, as recommended by EMA. Julian, City Manager FROM: Pamela Hallan Gibson, Senior Administrative Assistant SUBJECT: Contract for Law Enforcement Services �TTIIATTON: The annual contract for law enforcement services is attached for your review. The contract calls for two full-time one-person patrol units on duty during the night shift and day shift, and three full-time one-person patrol units on duty during the evening shift. It also includes two one-man investigative units, 40 hours per week. According to criteria established by law enforcement agencies, patrol units should spend 40-60% of their time on preventive patrol. Patrol units on the night and day shifts in San Juan Capistrano are currently spending 46% and 42% respectively on patrol. The evening shift is currently at 39%, which shows an increase in activity levels during this time period. While it is expected that the level of service now provided will be within acceptable limits during fiscal year 84-85, the activity on the evening shift will be closely monitored and a change may be requested in the 85-86 fiscal year. COMMISSION/BOARD REVIEW AND RECOMMENDATIONS: None FINANCIAL CONSIDERATIONS: The cost of the new contract is $878,895. This represents an approximate 5% increase over last year. ALTERNATE ACTIONS: 1. Approve the proposed agreement for law enforcement services for fiscal year 1984-85 and authorize the Mayor and City Clerk to execute the agreement. 2. Request further information. RECOMMENDATION: By motion, approve the proposed agreement for law enforcement services for fiscal year 1984-85 and authorize the Mayor to execute the agreement.
