3 THIS AGREEMENT, made and entered into by and between the COUNTY OF
4 ORANGE, a body politic and corporate, hereinafter designated as "COUNTY",
5 and the CITY OF SAN JUAN CAPISTRANO, a municipal corporation, located in
6 the county of Orange, hereinafter designated as"CITY".
7 WITNESSETH:
In consideration of the terms, covenants, conditions, and promises to be
kept, performed and observed by the parties hereto, it is agreed as follows:
10 1. COUNTY, through its Sheriff and the deputies, officers and employees
11 of his Department, shall render to CITY police protection and law en -
12 forcement services as hereinafter in this Agreement provided.
13 2. Such services shall include the enforcement of State statutes and such
14 municipal ordinances of CITY as are similar to ordinances of COUNTY en -
15 forced by the Sheriff within unincorporated territory of COUNTY.
16 3. The level of such services shall be as follows: two (2) day car units,
17 three (3) evening car units, two (2) night car units, and two (2) inves-
18 tigative units.
19 A day car unit is a one-man patrol car unit used on the day shift 56
20 hours per, week.
21 An evening car unit is a one-man patrol car unit used on the evening
22 shift for 56 hours per week.
23 A night car unit is a one-man patrol car unit used on the night shift
24 for 56 hours per week.
25 An investigative unit is one detective for 40 hours per week and includes
26 all necessary related services.
27 4. For the purpose of performing said functions, COUNTY shall provide
28 all manpower, supervision, communications, equipment, and supplies

I necessary to maintain thG service to be rendered hereunder.
2 5. The final authority for rendition of service, standards of performance,
3 discipline of officers, and other matters incident to the performance of
4 such service and the control of COUNTY personnel shall remain inCOUNTY.
5 6. CITY shall not be called upon to assume any liability for the direct
6 payment of any salaries, wages, or other compensation to any COUNTY
7 personnel performing services hereunder or any liability other than that
8 provided for by this Agreement. Except as herein otherwise specified, CITY
9 shall not be liable for compensation or indemnity to any COUNTY employee
10 or any injury or sickness arising out of his employment.
.11 7. COUNTY, its officers, agents, and employees shall not be deemed to
12 have assumed any liability for the negligence of CITY or any of its offi-
13 cers or employees, or for any dangerous or defective condition of any
14 public street or work or property of CITY, and CITY shall hold COUNTY,
15 its officers and employees harmless from any and all claims for damages
3.6 resulting therefrom.
17 8. Both CITY and COUNTY shall hold each other harmless from liability
3.8 for acts or omissions of the other.
3.9 9. CITY agrees to pay COUNTY the costs of performing all services covered
20 by this Agreement. Such costs shall be determined by the County Auditor -
21 Controller as follows:
22 Costs of patrol service units shall include the direct operation expense
23 of the Sheriff's Patrol Bureaus, including salaries, wages, benefits, ser -
24 vices, supplies, depreciation, Personnel Bureau, Fiscal Services, and
25 training costs prorated to each service unit or portion thereof, plus gen-
26 eral County overhead applicable to the Patrol Bureaus. Costs of investi-
27 gative service units not normally supplied to all County law enforcement
28 shall include the direct operating expense of the Sheriff's Detective and

Sex Crimes/Child Abuse Detail including salaries, wages, benefits, ser-
vice$, supplies and Department overhead to include appropriate percent -
3 ages of Administration, depreciation, Personnel Bureau, Fiscal Services,
4 and training costs prorated to each service unit or portion thereof, plus
5 general County overhead applicable to the Investigation Division.
6 The COUNTY shall render to CITY at the close of each calendar month a
7 statement of one twelfth the annual costs, as determined pursuant to the
8 preceding paragraphs, of performing all services covered by that
9 Agreement, as determined by the COUNTY Audi tor -Control ler at the beginn-
3.0 ing of each fiscal year, and said CITY shall pay COUNTY therefore with -
11 in twenty (20) days after receipt of such statement. The annual cost for
12 fiscal year 1983-84 to be $833, 113. If such payment is not received by
13 the COUNTY within thirty (30) days after rendition of billing, COUNTY
14 may satisfy such indebtedness from any funds of CITY on deposit with
15 COUNTY without giving further notice to CITY of COUNTY'S intention to do
16 SO.
17 10. The Agreement shall continue in full force and effect for a term of
3.8 one (1) year, commencing July 1, 1983, prcvided that either party may
19 terminate upon thirty (30) days written notice.

21 IN WITNESS WHEREOF, COUNTY has caused this Agreement to be executed by
22 the Chairman of its Board of Supervisors and attested by the Clerk of said
23 Board, and CITY has caused this Agreement to be executed by its Mayor
24 and attested by the City Clerk on the dates set opposite their respective
25 signatures.

On motion of Supervisor Wieder, duly seconded and unanimously
carried, the Clerk of the Board, on behalf of the Board of Supervisors,
is authorized to execute the Agreement, dated July 12, 1983, between
the County of Orange and the City of San Juan Capistrano, for law
enforcement services.
IN RE: AHFP AGREEMENT 14ANDA ROAD CITY OF VILLA PARK
On motion of Supervisor Wieder, duly seconded and unanimously
carried, the Clerk of the Board, on behalf of the Board of Supervisors,
is authorized to execute the AHFP Project Administration Agreement,
dated July 12, 1983, between the County of Orange and the City of
Villa Park for the improvement of Wanda Road, Project # 1129.
IN RE AHFP AGREEMENT B&RRANC& ROAD CITY OF IRVINE
On motion of Supervisor Wieder, duly seconded and unanimously
carried, the Clerk of the Board, on behalf of the Board of Supervisors,
is authorized to execute the AHFP Project Administration Agreement,
dated July 12, 1983, between the County of Orange and the City of
Irvine for improvement of Barranca Road, Project #1075.

Assistant, forwarding an agreement with the County of Orange
to renew law enforcement services for the Fiscal Year
1983-84 at the present level of service.
Captain Vito Ferlauto, Orange County Sheriff's Department,
was present and noted the services available to the City
through the Sheriff's Department.
Renewal of Services:
It was moved by Counciiman Schwartze, seconded by Councilman
Hausdorfer and unanimously carried to approve the agreement
submitted by the County of Orange (Sheriff -Coroner
Department) for law enforcement services for Fiscal Year
1983-84, at a cost of $833.113; and, to authorize the Mayor
and City Clerk to execute the agreement on behalf of the
City.

SUBJECT: Renewal of Agreement for FY 1983-84 Law Enforcement Services
(County of Orange)
SITUATION:
The City's current agreement with the County of Orange (Sheriff -Coroner
Department) for the receipt of law enforcement services for FY 1982-83
is scheduled to expire on June 30, 1983. Accordingly, the County has
submitted the attached agreement as their proposal for the provision
of law enforcement services for FY 1983-84.
Our current agreement provides for the following level of service:
Day Shift - Two (2) full-time, one -officer
patrol units
Evening Shift - Three (3) full-time, one -officer
patrol units
Night Shift - Two (2) full-time, one -officer
patrol units
All Shifts - Two (2) full-time, one -officer
investigative units
Based upon an analysis of the City's crime profile, the Sheriff -Coroner
Department has projected that our present level of service should suffice
in meeting the City's needs in FY 1983-84.
FINANCIAL CONSIDERATIONS:
Within the City's Five Year Budget (Account #01-4210-213), $833,200 has
been allocated for the receipt of law enforcement services in FY 1983-84;
the actual charge as proposed is $833,113.
ALTERNATE ACTIONS:
1 Approve the agreement submitted by the County of Orange (Sheriff -
Coroner Department) for law enforcement services for FY 1983-84, and
authorize the Mayor and City Clerk to execute the agreement on behalf
of the City.
2. Determine that a different level of service than that proposed is
desired, and re -negotiate the proposed agreement accordingly.
