1982-0629_ORANGE, COUNTY OF_AgreementAGREEMENT FOR LAW ENFORCEMENT SERVICES 2 3 THIS AGREEMENT, made and entered into by and between the COUNTY OF ORANGE, a 4 body -politic and corporate, hereinafter designated as "COUNTY", and the CITY OF SAN 5 JUAN CAPISTRANO, a municipal corporation, located in the County of Orange, herein - 6 after designated as "CITY". 7 WITNESSETH: 8 In consideration of the terms, covenants, conditions, and promises to be kept, 9 performed and observed by the parties hereto, it is agreed as follows: 10 1. COUNTY, throuqh its Sheriff and the deputies, officers and employees of 11 his Department, shall render to CITY police protection and law enforcement services 12 as hereinafter in this Agreement provided. 13 2. Such services shall include the enforcement of State statutes and such 14 municipal ordinances of CITY as are similar to ordinances of COUNTY enforced by 15 the Sheriff within unincorporated territory of COUNTY. 16 3. The level of such services shall be as follows: Two (2) day car units, 17 three (3) evening car units, two (2) night car units; two (2) investigative units. 18 A day car unit is a one-man patrol car unit used on the day shift 56 hours 19 per week. 20 An evening car unit is a one-man patrol car unit used on the evening shift 21 for 56 hours per week. 22 A night car unit is a one-man patrol car unit used on the night shift for 23 56 hours per week. 24 An investigative unit is one detective for 40 hours per week and includes 25 all necessary related services. 26 4. For the purpose of performing said functions, COUNTY shall provide all 27 manpower, supervision, communications, equipment, and supplies necessary to maintain 28 the service to be rendered hereunder. 1 5. The final authority for rendition of service, standards of performance, 2 discipline of officers, and other matters incident to the performance of such service 3 and the control of COUNTY personnel shall remain in COUNTY. 4 .6. CITY shall not be called upon to assume any liability for the direct nayment 5 of any salaries, wages, or other compensation to any COUNTY personnel performing 6 services hereunder or any liability other than that provided for bv this Agreement. 7 Except as herein otherwise specified, CITY shall not be liable for compensation or 8 indemnity to any COUNTY employee or any injury or sickness arising out of his 9 employment. 10 7. COUNTY, its officers, agents, and employees shall not be deemed to have 11 assumed any liability for the negligence of CITY or any of its officers or employees, 12 or for any dangerous or defective condition of any public street or work or property 13 of CITY, and CITY shall hold COUNTY, its officers and employees harmless from any 14 and all claims for damages resulting therefrom. 15 8. Both CITY and COUNTY shall hold each other harmless from liability for 16 acts or omissions of the other. 17 9. CITY agrees to pay COUNTY the costs of performing all services covered 18 by this Agreement. Such costs shall be determined by the County Auditor -Controller 19 as follows: 20 Costs of patrol service units shall include the direct operating expense of 21 the Sheriff's Patrol Bureau, including salaries, wages, benefits, services, Supplies, 22 and Department overhead to include approDriate percentages of administration, 23 depreciation, Personnel -Fiscal Bureau and training costs prorated to each service 24 unit or portion thereof, plus qeneral County overhead applicable to the Patrol 25 Bureau. 26 Costs of investigative service units not normally supplied to all County law 27 enforcement shall include the direct operating expense of the Sheriff's Detective 28 and Youth Services Bureaus, including salaries, wages, benefits, services, 0 supplies and Department overhead to include appropriate percentages of administration, 2 depreciation, Personnel -Fiscal Bureau and training costs prorated to each service 3 unit or portion thereof, plus general County overhead applicable to the Detective 4 and Youth Services Bureaus. 5 The COUNTY shall render to CITY at the close of each calendar quarter a 6 statement of one-fourth the annual costs, as determined pursuant to the preceding 7 paragraphs, of performing all services covered by that Agreement, as determined 8 by the COUNTY Auditor -Controller at the beqinning of each fiscal year, and said 9 CITY shall pay COUNTY therefore within twenty (20) days after receipt Of Such 10 statement. If such payment is not received by the COUNTY within thirty (30) 11 days after rendition of billing, COUNTY may satisfy such indebtedness from any 12 funds of CITY on deposit with COUNTY without giving further notice to CITY of 13 COUNTY's intention to do so. 14 10.
