1978-0711_ORANGE, COUNTY OF_Agreement1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 • AGREEMENT FOR LAW ENFORCEMENT SERVICES THIS AGREEMENT, made and entered into by and between the COUNTY OF ORANGE, a body politic and corporate, hereinafter designated as "COUNTY", and the CITY OF SAN JUAN CAPISTRANO, a municipal corporation, located in the County of Orange, herein- after designated as "CITY". WITNESSETH: In consideration of the terms, covenants, conditions, and promises to be kept, performed and observed by the parties hereto, it is agreed as follows: 1. COUNTY, through its Sheriff and the deputies, officers, and employees of his Department, shall render to CITY police protection and law enforcement services as hereinafter in this Agreement provided. 2. Such services shall include the enforcement of State statutes and such municipal ordinances of CITY as are similar to ordinances of COUNTY enforced by the Sheriff within unin- corporated territory of COUNTY. 3. The level of such services shall be as follows: Two (2 day car units; Two (2) evening car units; One (1) night car unit; Two (2) investigative units. A day car unit is a one-man patrol car unit used on the da3 shift 56 hours per week. An evening car unit is a one-man patrol car unit used on the evening shift for 56 hours per week. A night car unit is a one-man patrol car unit used on the night shift for 56 hours per week. -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 An investigative unit is one detective for 40 hours per week and includes all necessary related services. 4. For the purpose of performing said functions, COUNTY shall provide all manpower, supervision, communications, equip- ment, and supplies necessary to maintain the service to be rendered hereunder. 5. The final authority for rendition of service, standards of performance, discipline of officers, and other matters inci- dent to the performance of such service and the control of COUNTY personnel shall remain in COUNTY. 6. CITY shall not be called upon to assume any liability for the direct payment of any salaries, wages, or other compen- sation to any COUNTY personnel performing services hereunder or any liability other than that provided for by this Agreement. Except as herein otherwise specified, CITY shall not be liable for compensation or indemnity to any COUNTY employee for any injury or sickness arising out of his employment. 7. COUNTY, its officers, agents, and employees shall not be deemed to have assumed any liability for the negligence of CITY or any of its officers or employees, or for any dangerous or defective condition of any public street or work or property of CITY, and CITY shall hold COUNTY, its officers and employees harmless from any and all claims for damages resulting therefrom. 8. Both CITY and COUNTY shall hold each other harmless from liability for acts or omissions of the other. 9. CITY agrees to pay COUNTY the costs of performing all services covered by this Agreement. Such costs shall be deter- mined by the County Auditor -Controller as follows: -2- 1 Costs of patrol service units shall include the direct 2 operating expense of the Sheriff's Patrol Bureau, including 3 salaries, wages, benefits, services, supplies, and Department 4 overhead to include appropriate percentages of administration, 5 depreciation, Personnel -Fiscal Bureau and training costs pro - 6 rated to each service unit or portion thereof, plus general 7 County overhead applicable to the Patrol Bureau. 8 Costs of investigative service units not normally supplied 9 to all County law enforcement shall include the direct operating 10 expense of the Sheriff's Detective and Youth Services Bureaus, 11 including salaries, wages, benefits, services, supplies and 12 Department overhead to include appropriate percentages of admin - 13 istration, depreciation, Personnel -Fiscal Bureau and training 14 costs prorated to each service unit or portion thereof, plus 15 general County overhead applicable to the Detective and Youth 16 Services Bureaus. 17 The COUNTY shall render to CITY at the close of each calen- 18 dar quarter a statement of one-fourth the annual costs, as 19 determined pursuant to the preceding paragraphs, of performing 20 all services covered by that Agreement, as determined by the 21 COUNTY Auditor -Controller at the beginning of each fiscal year, 22 and said CITY shall pay COUNTY therefore within twenty (20) days 23 after receipt of such statement. If such payment is not re - 24 ceived by the COUNTY within Thirty (30) days after rendition of 25 billing, COUNTY may satisfy such indebtedness from any funds of 26 CITY on deposit with COUNTY without giving further notice to 27 CITY of COUNTY'S intention to do so. 28 10. This Agreement shall continue in full force and effect -3- 1 2 3 4 5 6 7 8 9 10 for a term of one (1) year, commencing July 1, 1978, provided that either party may terminate upon thirty (30) days written notice. IN WITNESS WHEREOF, COUNTY has caused this Agreement to be executed by the Chairman of its Board of Supervisors and attested by the Clerk of said Board, and CITY has caused this Agreement to be executed by its Mayor and attested by the City Clerk on the dates set opposite their respective signatures.
