1994-0315_VAQUERO WEST MERCANTILE_Lease Agreement Amd #2AMENDMENT#2 TO LEASE AGREEMENT WITH VAQUERO WEST MERCANTILE AT 26755 VERDUGO STREET AMENDMENT made this 15t day of Marc J994 by and between the SAN JUAN CAPISTRANO COMMUNITY REDEVELOPMENT AGENCY (the "Landlord") and VAQUERO WEST MERCANTILE (the "Tenant"). RECITALS A. Landlord and Tenant are parties to a lease agreement dated April 7, 1992 (referred to herein as the "Lease"). B. The Tenant has projected lease revenue from the second floor of the Premises. C. The Tenant has requested consideration by the Agency of amended lease terms in an effort to successfully lease the second floor of the Premises. D. The Landlord wishes to adjust the terms of the lease to recognize that the revenue projected from the sublease of the second floor of the Premises is necessary to ensure the successful operation of the Tenant. NOW THEREFORE, in consideration of the mutual covenant herein, the parties agree that the lease is amended as provided herein. The above Recitals are incorporated into and made part of the Amendment. 2. All references to section numbers herein shall mean sections of the lease unless otherwise indicated. 3. All reference to terms herein shall mean the terms of the Lease unless otherwise indicated. 4. Paragraph G of the basic provisions of the Lease is amended as follows: The second floor of the Premises shall be used for professional office space for attorneys, accountants, architects, insurance offices and other similar uses provided that such office space shall not be used for any medical, dental or veterinary use. The Premises may also be used for overnight accommodations. Such accommodations shall not exceed ten (10) consecutive days in length, shall be leased for a minimum of $50.00 per night, shall be subject to Title 3 Chapter 3, Article 6 Section 1 (3-3.601) of the San Juan Capistrano Municipal Code "Transient Occupancy Tax"; and the Tenant shall arrange for parking for any overnight guests, only in those areas designated as overnight parking. The Premises shall be used for the foregoing purposes and no other use or purpose (see Paragraph 14 of Lease). EXECUTED as of the date first written above.
