Said Project generally provided for surface repair, sealing, painting and striping of the courts surfaces and installation of new nets for the new Pickleball courts at Camino Capistrano / Acjachema Street Courts and Cook -La Novia Park. On February 19, 2019, by Resolution No. 19-02-19-02, the City of San Juan Capistrano City Council delegated authority to the City Manager, or his or her designee, to accept public works as complete on behalf of the City, and authorized the City Clerk to file a Notice of Completion on behalf of the City. On May 2, 2022, the Public Works Director, Thomas Toman determined that the Conversion of the Tennis, Volleyball and Basketball Courts into Pickleball Courts, CIP 22201 was completed on April 28, 2022, by said company according to plans and specifications, and accepted the work on behalf of the City of San Juan Capistrano, the owner of said Project, and completed a Certificate of Acceptance attached hereto as Exhibit "A". And, that upon said contract, Ohio Casualty Insurance Company was the surety for the bonds given by the said company as required by law. Dated at San Juan Capistrano this 3rd day of May 2022. WHEREAS, the Public Works Director has evaluated the work and deemed that the Project has been completed in accordance with the plans and specifications and recommends approval and acceptance of the work, and has evaluated the final quantities and cost figures for the Project and recommends approval of the costs; and WHEREAS, on February 19, 2019, by Resolution No. 19-02-19-02, the City Council of San Juan Capistrano delegated authority to the City Manager, or his or her designee, to accept public works as complete, and authorized the City Clerk to file the Notice of Completion on behalf of the City. NOW, THEREFORE, it is determined and directed as follows: 1. The work required to be performed by said contractor has been completed, and is hereby accepted and approved; and, 2. The total cost of said construction work was in the amount of $45,000; and, 3. The Public Works Director shall forward a Notice of Completion to the City Clerk for recording with the Orange County Clerk -Recorder.
