Resolution Number 22-05-03-02.j 'I RESOLUTION NO. 22-05-03-02 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AUTHORIZING DECLARING DESIGNATED FLEET INVENTORY AS SURPLUS PROPERTY AND AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS REQUIRED TO FACILITATE THE FINAL SALE OF THE VEHICLES AND EQUIPMENT SENT TO SURPLUS. WHEREAS, the City owns and maintains a fleet of vehicles and equipment for the purpose of providing field services and transportation; and WHEREAS, the City's water and sewer utility systems were annexed to Santa Margarita Water District on November 15, 2021; and WHEREAS, as a result of the transfer of water and sewer operations, there is an excess of vehicles and equipment that will no longer be required for City operations; and WHEREAS, the City has determined that the vehicles and equipment identified in Exhibit "A" should be declared as surplus property as they have been removed from service; and WHEREAS, Section 3-4.401(e) of the San Juan Capistrano Municipal Code states that City Council must declare any asset in excess of $1,000 as surplus prior to that asset being disposed; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, HEREBY RESOLVES, FINDS AND DETERMINES AS FOLLOWS: That the foregoing recitals are true and correct and incorporated herein by this reference. 2. That the City Council of the City of San Juan Capistrano does hereby declare said vehicles and equipment as "surplus" property pursuant to Section 3-4.401(e) of the Municipal Code and directs staff to proceed to dispose of the property in accordance with its rules and regulations. 3. That the City Manager is hereby authorized to execute all necessary agreements required to facilitate the final sale of the vehicles and equipment listed on Exhibit A of this resolution. 5/3/2022 PASSED, APPROVED, -and ADOPTED is 3rd day of n-;2. 022.
