Ordinance Number 1099ORDINANCE NO. 1099 AN ORDINANCE OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, AMENDING SECTION 4-6.501 OF THE SAN JUAN CAPISTRANO MUNICIPAL CODE TO UPDATE SPEED LIMITS OF VARIOUS CITY ROADWAYS AND MAKE TECHNICAL EDITS THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: WHEREAS, California Vehicle Code Sections 22357 and 22358 authorizes a local authority to determine by ordinance an increase or decrease in local speed limits based on an Engineering and Traffic Survey. WHEREAS, California Vehicle Code Section 627 defines an Engineering and Traffic Survey and requires the survey to consider all of the following: 1) Prevailing speeds as determined by traffic engineering measurements; 2) Accident records; and 3) Highway, traffic, and roadside conditions not readily apparent to the driver. WHEREAS, the City of San Juan Capistrano has completed an Engineering and Traffic Survey in accordance with California Vehicle Code Section 627, dated February 2, 2022. WHEREAS, as part of the Engineering and Traffic Survey, speed zone measurements were taken during the off-peak hours on weekdays of 71 roadway segments on 34 roadways within the City. Furthermore, none of the exceptions to the exemptions in State CEQA Guidelines, section 15300.2 would be triggered by the proposed speed limit changes. WHEREAS, the City Council has carefully reviewed and considered all of the evidence presented in connection with the Ordinance, including, but not limited to, the Engineering and Traffic Survey, the staff report, and all written and oral testimony presented, and concluded that the proposed speed limit changes facilitate the orderly and safe movement of traffic. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano, California, does hereby ordain as follows: SECTION 1. Establishment of Prima Facie Speed Limits. Section 4-6.501 of Article 5 (Speed Limits) of Chapter 6 (Traffic) of Title 4 (Public Safety) of the San Juan Capistrano Municipal Code is hereby replaced in its entirety to read as follows: "Sec. 4-6.501. Established. Pursuant to the provisions of Section 22357, 22358 and 22358.3 of the California Vehicle Code, prima facie speed limits in the City of San Juan Capistrano are hereby determined and declared as follows: (a) Fifteen (15) miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be fifteen (15) miles per hour: (1) Los Rios Street from Del Obispo Street to Mission Street. (b) Twenty-five (25) miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be twenty-five (25) miles per hour: (1) Avenida de la Vista from Oso Road to La Zanja Street; 2 01099 (2) Avenida de la Vista from La Zanja to its southerly end; (3) Calle Arroyo from La Novia Avenue to Calle Del Campo; (4) Calle Arroyo from Calle Del Campo to Avenida Siega; (5) Camino Capistrano from Del Obispo Street to Acjachema Street; (6) EI Camino Real from Forster Street to La Zanja Street; (7) La Zanja Street from Avenida de la Vista to Camino Capistrano; (8) Ortega Highway from Camino Capistrano to Del Obispo Street; (9) Paseo Adelanto from Del Obispo Street to its southerly end; (10) Paseo Adelanto from Del Obispo Street to Ramos Street; (11) Via California from Camino Las Ramblas to Calle Bienvenido; (12) Via de Agua from Camino Las Ramblas to its northerly end; (13) Via Positiva from Alipaz Street to Camino Del Avion; and (14) Village Road from Rancho Viejo Road to Trabuco Creek Road. (c) Thirty (30) miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty (30) miles per hour: (1) Aguacate Road from Del Obispo Street to its northerly end; (2) Alipaz Street from its southerly end to Camino Del Avion; (3) Alipaz Street from Del Obispo Street to its northerly end; (4) Avenida Aeropuerto from Camino Capistrano to its westerly end; (5) Calle Arroyo from its westerly end to Rancho Viejo Road; (6) Camino La Ronda from La Novia Avenue to its easterly end; 3 01099 (7) Mission Hills Drive from Rancho Viejo Road to its easterly end; (8) Rancho Viejo Road from Calle Arroyo to Ortega Highway; and (9) Via Entrada from La Novia Avenue to the private gate. (d) Thirty-five (35) miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be thirty-five (35) miles per hour: (1) Avenida California from Vista Marina to Camino Las Ramblas, effective as of the date its dedication from Pacifica San Juan Development is accepted by the City of San Juan Capistrano; (2) Calle Arroyo from Rancho Viejo Road to La Novia Avenue; (3) Calle Aspero from Del Obispo Street to Peppertree Bend; (4) Camino Capistrano from San Juan Creek Road to Del Obispo Street; (5) Camino Capistrano from Acjachema Street to La Zanja Street; (6) Del Obispo Street from Calle Aspero to Alipaz Street; (7) Del Obispo Street from Alipaz Street to Camino Capistrano; (8) Del Obispo Street from Camino Capistrano to Ortega Highway; (9) Doheny Park Road from Camino Capistrano to southerly City Limits; (10) Junipero Serra Road from Rancho Viejo Road to Camino Capistrano; (11) La Novia Avenue from Ortega Highway to San Juan Creek Road; (12) San Juan Creek Road from La Novia Avenue to Avenida La Mancha; (13) Valle Road from its southerly end to 1-5/La Novia Avenue; (14) Valle Road from 1-5/La Novia Avenue to San Juan Creek Road; 4 01099 (15) Stallion Ridge from Avenida La Pata to its westerly end; (16) Trabuco Creek Road from Rancho Viejo Road to its easterly end; and (17) Vista Marina from Avenida California to Valle Road, effective as of the date its dedication from Pacifica San Juan Development is accepted by the City of San Juan Capistrano. (e) Forty (40) miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty (40) miles per hour: (1) Alipaz Street from Camino Del Avion to Calle Rolando; (2) Alipaz Street from Calle Rolando to Del Obispo Street; (3) Camino Capistrano from Doheny Park Road to Stonehill Drive; (4) Camino Del Avion from Shipside Drive to Del Obispo Street; (5) Camino Del Avion from Del Obispo Street to Via Positiva; (6) Camino Del Avion from Via Positiva to Alipaz Street; (7) Camino Las Ramblas from 1-5 to Via California; (8) Del Obispo Street from Camino Del Avion to Calle Aspero; (9) Highland Drive from Rancho Viejo Road to Windsor Drive; (10) Highland Drive from Windsor Drive to Hillside Terrace; (11) La Novia Avenue from San Juan Creek Road to Via Sequoia; (12) La Novia Avenue from Via Sequoia to Via Capri (West); (13) La Novia Avenue from Via Capri (West) to Valle Road; and (14) San Jan Creek Road from Avenida La Mancha to its easterly end. (f) Forty-five (45) miles per hour. The prima facie speed limits on the following streets, or portions of streets, shall be forty-five (45) miles per hour: 5 01099 (1) Camino Capistrano from Stonehill Drive to Avenida Aerop_uerto; (2) Camino Capistrano from Avenida Aeropuerto to San Juan Creek Road; (3) Camino Capistrano from La Zanja Street to Oso Road; (4) Camino Capistrano from Oso Road to Junipero Serra Road; (5) Camino Capistrano from Junipero Serra Road to the northerly City Limits; (6) Camino Las Ramblas from Via California to Avenida Pescador; (7) Camino Las Ramblas from Avenida Pescador to its easterly end; (8) Del Obispo Street from the southerly City Limits to Camino Del Avion; (9) Rancho Viejo Road from Ortega Highway to Golf Club Drive; (10) Rancho Viejo Road from Golf Club Drive to Junipero Serra Road; (11) Rancho Viejo Road from Junipero Serra Road to Village Road; (12) Rancho Viejo Road from Village Road to the northerly City Limits; (13) San Juan Creek Road from Camino Capistrano to Calle Caballero (East); (14) San Juan Creek Road from Calle Caballero (East) to La Novia Avenue; and (15) Stonehill Drive from Camino Capistrano to westerly City Limits." 6 01099 SECTION 2. Legislative Findings in Support of Prima Facie Speed Limits. The City Council hereby makes the following findings pursuant to California Vehicle Code Section 627(b)(3) of the prima facie speed limit set forth below: The Legislative findings in support of prima facie speed limits previously set forth by the City Council in Ordinance No. 295, Ordinance No. 373, Ordinance No. 465, adopted on August 3, 1982; Ordinance No. 520, adopted on October 16, 1984; Ordinance No. 588, adopted on December 16, 1987; Ordinance No. 621, adopted on January 19, 1988; Ordinance No. 659, adopted on February 20, 1990; Ordinance No. 661, adopted on April 3, 1990; Ordinance No. 680, adopted on December 11, 1990; Ordinance No. 727, adopted on March 16, 1993; Ordinance No. 757, adopted on December 6, 1994; Ordinance No. 830, adopted on January 5, 1999; Ordinance No. 847, adopted on March 21, 2000; Ordinance No. 911, adopted on February 21, 2006; Ordinance No. 972, adopted on June 15, 2010; Ordinance 1000, adopted December 11, 2012; and Ordinance 1099, will be adopted May 3, 2022, shall continue to remain in effect unless amended herein. SECTION 3. Signs. The Public Works Department is hereby authorized and directed to install appropriate signs giving notice of speed limits contained herein in compliance with regulations promulgated by the California Department of Transportation under Vehicle Code section 21400. SECTION 4. Severability. If any section or provision of this Ordinance is for any reason held to be invalid or unconstitutional by any court of competent jurisdiction, or contravened by reason of any preemptive legislation, the remaining sections and/or provisions of this ordinance shall remain valid. The City Council hereby declares that it would have adopted this Ordinance, and each section or provision thereof, regardless of the fact that any one or more section(s) or provision(s) may be declared invalid or unconstitutional or contravened via legislation. SECTION 5. CEQA. The proposed Ordinance is exempt from further review under the California Environmental Quality Act (CEQA) per Section 15301, Existing Facilities, Class 1 (c), because it involves modifying existing speed limits and creating new speed limits within existing roadways. Furthermore, none of the exceptions to the exemptions in State CEQA Guidelines, section 15300.2 would be triggered by the proposed speed limit changes SECTION 6. Effective Date. The Ordinance shall take effect and be in force thirty (30) days after its passage 7 01099 and after appropriate signs giving notice of the new speed limits are posted upon the street -segments affected by -the -Ordinance. _ SECTION 7. City Clerk's Certification. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted at the duly designated posting places within the City and published once within fifteen (15) days after passage and adoption as required by law; or, in the alternative, the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five (5) days prior to the date of adoption of this Ordinance; and, within fifteen (15) days after adoption, the City Clerk shall cause to be published, the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
