A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, APPROVING CITY SKATEPARK AND
TRAIL PROJECT (C I P 21201) (RZ 21-003) (CA 21-005)
WHEREAS, the City of San Juan Capistrano is the owner of the real property
located at 32681 Alipaz Street (APN 121-190-57); and,
WHEREAS, on January 19, 2021, the City Council selected Grindline Skateparks,
Inc. to prepare design plans and construction cost estimates for a City skatepark to be
located at 32681 Alipaz Street (APN 121-190-57); and,
WHEREAS, Since that time, the City's consultant Grindline Skateparks, Inc. has
developed plans for a City Skatepark and Trail Project (CIP 21201) that would include a
42,575 square foot public skatepark on the southwest corner of the Kinoshita Farm
property and a new multi -use public trail that would connect The Farm residential
development, currently under construction adjacent to the project site, to the new
skatepark and Camino Del Avion ("City Skatepark and Trail Project"); and,
WHEREAS, the City is concurrently processing a Code Amendment pursuant to
Municipal Code Section 9-2.309 to amend the Kinoshita Farm Specific Plan (SP 85-01)
to allow a public skatepark and trail as allowed uses ("Code Amendment") and Rezone
(RZ 21-003) pursuant to Municipal Code Section 9-2.315 to change the property's current
zoning from Agriculture/Specific Plan to Specific Plan ("Rezone"); and,
WHEREAS, collectively, the City Skatepark and Trial Project, Code Amendment,
and Rezone shall be referred to as the "Project"; and,
WHEREAS, on July 19, 2021, the Parks, Equestrian and Community Services
Commission reviewed the Project development plans; and,
WHEREAS, the Planning Commission conducted a duly -noticed public hearing on
the Project on January 26, 2022, pursuant to Title 9, Land Use Code, Section 9-2.302
and City Council Policy 5, and continued the matter to the February 9, 2022, Planning
Commission meeting; and,
WHEREAS, the Planning Commission conducted a duly -noticed public hearing on
February 9, 2022, considered all relevant public comments, and recommended approval
of the Project to the City Council; and,
WHEREAS, the City prepared a Mitigated Negative Declaration and Mitigation
Monitoring Reporting Program that analyzed the Project's environmental impacts in
compliance with the provisions of the California Environmental Quality Act ("CEQA"); and,
WHEREAS, the City Council has adopted a Mitigated Negative Declaration and
Mitigation Monitoring Reporting Program for the Project. The City Council hereby

the Mitigated Negative Declaration and Mitigation Monitoring Reporting Program for the
Project; and,
-WHEREAS, uii-April--5, 022,-the-City-Council-hcld_a-duly_noticed-public hearing_
to consider the Project and, following receipt of all written and oral public comments, the
City Council closed the public hearing, considered the evidence presented, and
deliberated.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The City Council of the City of San Juan
Capistrano hereby finds the foregoing recitals are true and correct and are incorporated
herein and made an operative part of this Resolution.
SECTION 2. CEQA. The City Council of the City of San Juan Capistrano
hereby finds and determines that all potential environmental impacts of the Project have
been fully analyzed in the MND. No new or additional mitigation measures are required.
There is no substantial evidence in the administrative record to support a fair argument
that the Project may result in any significant environmental impacts beyond those
analyzed and mitigated in the adopted MND.
SECTION 3. Findings for Approval of Capital Improvement Project CIP 21201.
The City Council does hereby make the following findings pursuant to Section 9-2.337 of
Title 9, Land Use Code of the City of San Juan Capistrano with respect to Public
Improvement Plans for the Capital Improvement Project (CIP 21201):
The proposed City Skatepark and Trail Project is consistent with the goals,
policies, and objectives of the General Plan, including the Parks and Recreation
Element and Circulation Element because the goals and policies of these
Elements are substantially implemented through the Project. The Project is
consistent with the following policies and objectives:
Parks and Recreation Goal #1: Provide, develop, and maintain ample park and
recreation facilities that provide a diversity of recreational activities.
Policy 1.4: "Develop and maintain a balanced system of public and private recreational
lands, facilities, and programs to meet the needs of the community."
The proposed project conforms to the General Plan Parks and Recreation Element
because the project would deliver a new skatepark amenity which was identified as a
community priority as part of a citywide recreation needs assessment conducted in 2007.
Policy 1.7: "Provide parkland improvements and facilities that are durable and
economical to maintain. "
The proposed project conforms to the General Plan Parks and Recreation Element
because of the high-quality, durable materials proposed to be used for the project's
construction. Additionally, the City entered into a Cost Sharing and Cooperative

Agreement with the City of Dana Point which states that Dana Point will contribute
$25,000 annually to the maintenance costs of the future skatepark, once operational.
Parks and Recreation Goal #2: Develop and expand the existing bicycle, hiking,
and equestrian trail system and facilities.
Policy 2.1: "Develop and expand the existing trails network that supports bicycles,
pedestrians, and horses, and coordinate linkages with those networks of adjacent
jurisdictions. "
The proposed project conforms to the General Plan Parks and Recreation Element
because the proposed project includes a multiuse trail that would connect The Farm
residential development trail currently under construction adjacent to the project site to
the skatepark project trail providing trail connection from Del Obispo Street to Camino Del
Avion and further connect the City's trail system south to the City of Dana Point.
Circulation Element Goal #3: Provide an extensive public bicycle, pedestrian, and
equestrian trails network.
Policy 3.1: "Provide and maintain an extensive trails network that supports
bicycles, pedestrians, and horses and is coordinated with those networks of
adjacent jurisdictions."
The proposed project conforms to the General Plan Circulation Element because, as
previously stated, the proposed project includes a multiuse trail that would connect The
Farm residential development trail currently under construction adjacent to the project site
to the skatepark project trail providing trail connection from Del Obispo Street to Camino
Del Avion and further connect the City's trail system south to the City of Dana Point.
2. The City Skatepark and Trail Project plans are consistent with the Land Use Code,
surrounding community and Design Guidelines, and other applicable City
requirements as follows:
General Design Issue/Principal 6: Richness of Details and Materials, which
provides, "Building materials, surfaces, finishes, lighting and landscaping should
be high quality. They should be designed and executed with a high degree of
craftsmanship. Design features should be subtle, not ostentatious. High quality
design standards should apply to all private as well as public projects..."
The proposed Project includes an agrarian themed color palette, seating areas, citrus
trees and landscaping, durable concrete skatepark elements, and playground structure
that convey a sense of richness in materials and craftsmanship.
General Design Issue/Principal 8: Linkages and Connections, which provides,
"Site planning should maximize linkages and connections to surrounding public
uses, activities, and pedestrian networks. Consideration should be given to
creation of a hierarchy of pedestrian pathways and public spaces."

The proposed Project includes a new multiuse public trail which will enhance the
pedestrian access to the proposed skatepark, City's Community Center and sports fields,
as well as The Ecology Center property.
The proposed Project complies with all applicable provisions of Title 9 of the San Juan
Capistrano Municipal Code and any applicable specific plan or comprehensive
development plan because the proposed Project is a major capital improvement project
as defined in Section 9-2.337 of the Municipal Code.
The proposed Project complies with Section 9-2.337 because the Project has undergone
required environmental review, the Project has been noticed in accordance with the Code,
and the Parks, Recreation and Community Services Commission has reviewed the
Project, and the Planning Commission has reviewed the Project.
SECTION 4. Approval of Capital Improvement Project CIP 21201. The City
Council does hereby approve the Public Improvement Plans for the Capital Improvement
Project (CIP 21201), which are on file with the Office of the City Clerk located at City Hall
32400 Paseo Adelanto, San Juan Capistrano, CA.
SECTION 5. Custodian of Documents. The custodian of documents
constituting the record of proceedings for this matter is the City Clerk of the City of San
Juan Capistrano. The documents constituting the record of proceedings for this matter
are located at City Hall at 32400 Paseo Adelanto, San Juan Capistrano, CA 92675.
SECTION 6. Severability. If any provision of this Resolution is held invalid, the
remainder of this Resolution shall not be affected by such invalidity, and the provisions of
this Resolution are severable.
SECTION 7. Effective Date. This Resolution shall only become effective once
the Ordinance No. 1098 is effective.
SECTION 8. Certification. The City Clerk of the City of San Juan Capistrano
shall certify as to the adoption of this Resolution.
