Resolution Number 22-02-01-02' RESOLUTION NO. 22-02-01-02 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, INITIATING A GENERAL PLAN AMENDMENT STUDY FOR A CHANGE TO THE LAND USE DESIGNATION, A REZONE STUDY FOR A CHANGE TO THE ZONING DESIGNATION, AND A CODE AMENDMENT STUDY TO ESTABLISH A SPECIFIC PLAN FOR 32221, 32241, 32261, AND 32281 CAMINO CAPISTRANO (APN 668-091-03) TO ALLOW FOR VERY HIGH DENSITY RESIDENTIAL DEVELOPMENT, AND MAKING A DETERMINATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH WHEREAS, Municipal Code Section 9-2.307 requires that the City Council initiate consideration of all General Plan Amendments by the approval of a resolution to initiate a General Plan Amendment study; and, WHEREAS, Municipal Code Section 9-2.315 requires that the City Council initiate consideration of all zone changes and amendments to the official zoning map; and, WHEREAS, Municipal Code Section 9-2.309 requires that the City Council initiate consideration of all Land Use Code text amendments, including establishing a new specific plan; and, WHEREAS, in accordance with state law, the City must update the General Plan Housing Element, which identifies sites which can accommodate the State Allocated Regional Housing Needs Assessment, and staff requests a General Plan Amendment to comply with state requirements; and, WHEREAS, the proposed Project envisions comprehensive updates to the Housing Element and changes to the land use designations of approximately 3.5 acres of land to accommodate Very High Density residential developments; and, WHEREAS, Staff recommends further study of the Project to assess and determine its compatibility with the San Juan Capistrano General Plan, pursuant to City policy and municipal code regulations; and, WHEREAS, the proposed initiation of a General Plan Amendment, Rezone, and Code Amendment study is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262, because this is a planning study and not the approval of any General Plan Amendment or land use entitlement. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY RESOLVE AS FOLLOWS: 1 2/1/2022 Section 1. The City Council finds and determines that the proposed initiation of a General Plan Amendment, Rezone, and Code Amendment Study for , the project, is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262 and municipal code Section 9-2.307(a), because this is a planning study and not the approval of any General Plan Amendment or land use entitlement. Section 2. The City Council hereby initiates a General Plan Amendment, Rezone, and Code Amendment study for a Specific Plan at 32221, 32241, 32261, and 32281 Camino Capistrano associated to the "2021 General Plan Element Update" and refers the matter to staff for analysis and to the Planning Commission for a recommendation. Section 3. The City Council hereby directs staff to prepare, execute and file a Notice of Exemption with the Orange County Clerk within five working days after the passage and adoption of this Resolution. Section 4. The record of proceedings relating to this Resolution are located at City Hall 32400 Paseo Adelanto, San Juan Capistrano, CA 92675. The custodian of records is the Community Development Director. NOW THEREFORE BE IT FURTHER RESOLVED, that the City Council of the City of San Juan Capistrano hereby directs staff to prepare, execute, and file ' a Notice of Exemption with the County Clerk and with the Office of Planning and Research within five (5) working days of the City Council's adoption of this Resolution.
