Resolution Number 21-09-21-01RESOLUTION NO. 21-09-21-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, INITIATING A GENERAL PLAN AMENDMENT STUDY FOR A CHANGE TO THE LAND USE DESIGNATION FOR 33953, 33955, 33959, AND 33963 DOHENY PARK ROAD (APN 121-254-25/26/46/64) AND THE PRICE CLUB SPECIFIC PLAN (SP 87-1) TO ALLOW FOR VERY HIGH DENSITY RESIDENTIAL, AND MAKING A DETERMINATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH WHEREAS, Municipal Code Section 9-2.307 requires that the City Council initiate consideration of all General Plan Amendments by the approval of a resolution to initiate a General Plan Amendment study; and, WHEREAS, in accordance with state law, the City must update the General Plan Housing Element, which identifies sites which can accommodate the State Allocated Regional Housing Needs Assessment, and staff requests a General Plan Amendment to comply with state requirements; and, WHEREAS, the proposed Project envisions comprehensive updates to the Housing Element and changes to the land use designations of approximately 5.5 acres of land to accommodate Very High Density residential developments; and, WHEREAS, Staff recommends further study of the Project to assess and determine its compatibility with the San Juan Capistrano General Plan, pursuant to City policy and municipal code regulations; and, WHEREAS, the proposed initiation of a General Plan Amendment study is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262, because this is a planning study and not the approval of any General Plan Amendment or land use entitlement. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council finds and determines that the proposed initiation of a General Plan Amendment Study for the project, is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262 and municipal code Section 9- 2.307(a), because this is a planning study and not the approval of any General Plan Amendment or land use entitlement. Section 2. The City Council hereby initiates a General Plan Amendment study for very high density residential at 33953, 33955, 33959, & 33963 Doheny Park Road associated to the "2021 General Plan Element Update" and refers the matter to staff for analysis and to the Planning Commission for a recommendation. 1 9/21/2021 Section 3. The City Council hereby directs staff to prepare, execute and file a Notice of Exemption with the Orange County Clerk within five working days after the passage and adoption of this Resolution. Section 4. The record of proceedings relating to this Resolution are located at City Hall 32400 Paseo Adelanto, San Juan Capistrano, CA 92675.
