Resolution Number 21-07-20-03RESOLUTION NO. 21-07-20-03 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, PROCLAIMING THE TERMINATION OF THE EXISTENCE OF A LOCAL EMERGENCY (NOVEL CORONAVIRUS "COVID- 19") DECLARED MARCH 16, 2020; AND RESCINDING RESOLUTION NO. 20-03-17-03 WHEREAS, on March 4, 2020, as part of the State of California's response to address the global COVID-19 outbreak, Governor Gavin Newsom declared a State of Emergency to make additional resources available, formalize emergency actions already underway across multiple state agencies and departments, and help the state prepare for broader spread of COVID-19; and WHEREAS, on March 16, 2020, the City Manager, in his capacity as Director of Emergency Services, proclaimed the existence of local emergency in the City of San Juan Capistrano, after determining that the spread of COVID-19 is likely to create emergency conditions of disaster or extreme peril which will be beyond the services, personnel and equipment and facilities of the City; and WHEREAS, on March 17, 2020, the City Council ratified the Proclamation of the Local Emergency by adopting Resolution No. 20-03-17-03, which identified conditions of extreme peril to the safety of persons and property within the city caused by the threat of COVID-19 that would impact significant City and community operations, including critical public infrastructure and services, and require the provision of additional public safety and emergency services, and shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of San Juan Capistrano; and WHEREAS, the original intent of the State of Emergency was to implement measures to mitigate the spread of COVID-19, and to prepare to respond to an increasing number of individuals requiring medical care and hospitalization that may exceed locally available resources; and WHEREAS, the effective actions of Californians over the past fifteen months have successfully curbed the spread of COVID-19, resulting in dramatically lower disease prevalence and death, in the State. As of June 9, 2021, 54.3% of eligible Californians have received a full course of COVID-19 vaccination, raising the level of overall immunity in the State, on June 11, 2021, Governor Gavin Newsom signed Executive Order N-07- 21 to allow for a full reopening of California while maintaining caution and vigilance as California continues to increase vaccination rates and monitor COVID-19 variants; and WHEREAS, the City Council has exercised due diligence and has determined that the conditions of extreme peril presented by the spread of COVID-19 have been abated to such a degree as to warrant the termination of the local emergency; and 7/20/2021 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Juan Capistrano does hereby proclaim that the local emergency that was declared on March 16, 2020, by the Director of Emergency Services, which was ratified by the City Council on March 17, 2020, via Resolution No. 20-03-17-03, is hereby rescinded and terminated.
