Resolution Number 21-04-06-03RESOLUTION NO. 21-04-06-03 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, INITIATING A GENERAL PLAN AMENDMENT STUDY (GPA 21-002) INVOLVING A 7.3 -ACRE AREA LOCATED BETWEEN 26874 ORTEGA HIGHWAY AND 31882 CAMINO CAPISTRANO FOR THE PROPOSED "EL CAMINO SPECIFIC PLAN" COMPRISED OF THREE PRIVATE PARCELS AND NINE CITY -OWNED PARCELS, INCLUDING THE BLAS AGUILAR ADOBE, HISTORIC TOWN CENTER PARK, AND THE FORMER CALTRANS PARCEL (ASSESSOR PARCEL NUMBERS 124-160-37, 124-160- 52, & 124-160-51, 124-160-63, 124-160-57, 124-160-55, 124-160-27, 124-160-08, 124-160-10, 124-160-09, 124-160-11, & 124-160-12) AND MAKING A DETERMINATION PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT IN CONNECTION THEREWITH WHEREAS, Municipal Code Section 9-2.307 requires that the City Council initiate consideration of all General Plan Amendments by the approval of a resolution to initiate a General Plan Amendment study; and, WHEREAS, Camino Capistrano OZ, LLC, as applicant (the "Applicant') for the proposed "EI Camino Specific Plan" (the 'Project'), requests a General Plan Amendment; and, ' WHEREAS, the proposed Project includes the proposed Playhouse commercial project, the proposed Forster & EI Camino residential/commercial project, and the Blas Aguilar Adobe, Historic Town Center Park, and the former Caltrans parcel on approximately 7.3 acres; and, WHEREAS, Staff recommends further study of the Project to assess and determine its compatibility with the San Juan Capistrano General Plan, pursuant to City policy and municipal code regulations; and, WHEREAS, the proposed initiation of a General Plan Amendment study is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262 because this is a planning study and not the approval of any General Plan Amendment or land use entitlement. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The City Council finds and determines that the proposed initiation of a General Plan Amendment Study for the project, is statutorily exempt ' from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15262 and municipal code Section 9- 2.307(a), because this is a planning study and not the approval of any General Plan Amendment or land use entitlement. 1 4/6/2021 Section 2. The City Council hereby initiates a General Plan Amendment study for the proposed "EI Camino Specific Plan," generally located on t approximately 7.3 acres between 26874 Ortega Highway and 31882 Camino Capistrano and refers the matter to staff for analysis and to the Planning Commission for a recommendation. Section 3. The City Council hereby directs staff to prepare, execute and file a Notice of Exemption with the Orange County Clerk within five working days after the passage and adoption of this Resolution. Section 4. The record of proceedings relating to this Resolution are located at City Hall 32400 Paseo Adelanto, San Juan Capistrano, CA 92675.
