20-0804_ORANGE, COUNTY OF_Agenda Report_E6City of San Juan Capistrano Agenda Report TO: Honorable Mayor and Members of the City Council FROM: Benjamin Siegel, City Manager SUBMITTED BY: Charlie View, Assistant City Manager PREPARED BY: Lynn Mata, Emergency Services Manager DATE: August 4, 2020 SUBJECT: Resolution Approving the Revised Operational Area Agreement Between the County of Orange and its Political Subdivisions as the Orange County Operational Area for Purposes of Emergency Management Coordination RECOMMENDATION: 1.Adopt a Resolution approving the revised Operational Area Agreement with the County of Orange and its political subdivisions; and 2.Repeal Resolution No. 95-11-21-04. DISCUSSION/ANALYSIS: The Operational Area Agreement formally organizes the County of Orange as well as cities and special districts within the county as the Orange County Operational Area for purposes of emergency management coordination, as required by the State of California’s Standardized Emergency Management System. First approved in 1995, the Operational Area Agreement provides a framework for interjurisdictional cooperation and outlines the responsibilities of each agency. In 2017, a working group was formed comprised of representatives of Operational Area agencies for the purpose of developing an updated agreement. The effort focused on new programs at the local, state and federal level, as well as lessons learned from more than twenty years of administering the existing framework. Following an extensive review and revision process in 2018 and 2019, a draft updated Operational Area Agreement was completed. The new agreement would replace the existing Orange County Operational 8/4/2020 E6 City Council Agenda Report August 4, 2020 Page 2 of 2 Area Agreement with reorganized and updated language that addresses agency relationships, jurisdictional responsibilities and legislated mandates before, during and after major emergencies. The revised Operational Area Agreement was approved by the Orange County Board of Supervisors on March 24, 2020. The Agreement is being submitted to each individual jurisdiction in the Orange County Operational Area for approval. Approval of the agreement will maintain the City’s full participation in all emergency coordination activities administered through the Operational Area. Adoption of the resolution approving the 2020 agreement includes action to repeal Resolution No. 95-11-21-04 that adopted the previous 1995 Operational Area Agreement. FISCAL IMPACT: There is no fiscal impact associated with the recommended action. ENVIRONMENTAL IMPACT: In accordance with the California Environmental Quality Act (CEQA), the recommended action is exempt from CEQA per Section 15061(b)(3), the general rule that the CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. PRIOR CITY COUNCIL REVIEW: On November 21, 1995, the City Council adopted Resolution No. 95-11-21-04 approving the Operational Area Agreement with the County of Orange and other jurisdictions within the County. NOTIFICATION: Ethan Brown, Emergency Management Division Orange County Sheriff’s Department ATTACHMENT(S): Attachment 1 – Resolution Attachment 2 – Revised Operational Area Agreement 1 RESOLUTION NO. 20-08-04-XX A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, APPROVING THE REVISED OPERATIONAL AREA AGREEMENT WITH THE COUNTY OF ORANGE AND ITS POLITICAL SUBDIVISIONS AS THE ORANGE COUNTY OPERATIONAL AREA FOR PURPOSES OF EMERGENCY MANAGEMENT COORDINATION AND REPEALING RESOLUTION NO. 95-11-21-04 WHEREAS, the City of San Juan Capistrano is a political subdivision that lies within the County of Orange; and, WHEREAS, as required by the State of California’s Standardized Emergency Management System, the Operational Area Agreement lays out a framework for interjurisdictional cooperation and the responsibilities of the County of Orange and its individual subdivisions; and, WHEREAS in 1995 the original Operational Area Agreement was reviewed and approved by the County of Orange and the 100+ political subdivisions that make up the Orange County Operational Area and has served as the foundation for nearly 25 years of regional emergency management collaboration; and, WHEREAS the Operational Area Agreement Revision Working Group was formed and met for more than a year to develop an updated document considering new programs and paradigms at the local, state and federal level, as well as lessons learned from more than twenty years of administering the existing framework; and, WHEREAS following an extensive review and revision process in 2018 and 2019, the revised Operational Area Agreement was approved by the County Board of Supervisors on March 24, 2020. The Agreement must now be approved by each individual jurisdiction in the Orange County Operational Area; and, WHEREAS, Approval of the 2020 Orange County Operational Area Agreement will replace the existing Orange County Operational Area Agreement with a reorganized and applicable agreement that addresses agency relationships, jurisdictional responsibilities; and legislated mandates before, during and after major emergencies. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano as follows: SECTION 1 That the City of San Juan Capistrano approves the Revised Operational Area Agreement of the County of Orange and Its Political Subdivisions. ATTACHMENT 1 2 SECTION 2 That the Mayor is hereby authorized to execute the Agreement on behalf of the City. BE IT FURTHER RESOLVED that that Resolution No. 95-11-21-04 is hereby repealed.
