RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, AUTHORIZING THE CITY MANAGER OR
HIS DESIGNEE TO WAIVE THE FORMAL RFP/RFQ BID PROCESS AS A
NON COST-EFFECTIVE APPROACH, AND AUTHORIZING STAFF TO
PROCEED WITH AWARDING AN AGREEMENT FOR STREET
SWEEPING AND CLEANING SERVICES PURSUANT TO A PIGGYBACK
CONTRACT IN ACCORDANCE WITH A COMPETITIVE PROCUREMENT
CONDUCTED BY THE CITY OF REDLANDS
WHEREAS, the City has contracted with Cannon Pacific Services, Inc., dba Pacific
Sweeping for street sweeping services since 2007; and
WHEREAS, the contract with Pacific Sweeping expires on June 30, 2020; and
WHEREAS, street sweeping helps ensure a clean and aesthetically pleasing travel
corridor for citizens and visitors alike; and
WHEREAS, the City of Redlands, CA recently bid and awarded a contract for
street sweeping services to Pacific Sweeping; and
WHEREAS, the City desires to piggyback on the competitive procurement
performed by the City of Redlands; and
WHEREAS, the City of Redlands RFP, Page 7, Terms and Conditions, Paragraph
1 -- Additional Services/Purchases by other Public Agencies, expressly includes an
authorization for other government entities to piggyback on the contract award made by
the City of Redlands under that RFP; and
WHEREAS, Section 3-4.304 of the San Juan Capistrano Municipal Code provides
that services contracts over $25,000 are subject to a formal RFP/RFQ bid process; and
WHEREAS, Section 3-4.306(e)(3) of the San Juan Capistrano Municipal Code
provides an exception to the formal RFP/RFQ process where the process is deemed not
to be the most cost-effective approach; and
WHEREAS, undergoing a formal RFP/RFQ process for street sweeping services
would not be the most cost-effective approach given the City's need to receive expedited
street sweeping services coupled with the ability to rely on a competitive procurement
recently performed by a neighboring city at a highly competitive and reasonable price;
and
WHEREAS, Pacific Sweeping is one of the largest street sweeping contractors in
California and is sufficiently qualified and experience to perform the street sweeping
services required by the City and has indicated that it will provide the same or better
pricing to the City as it provided to the City of Redlands for said services.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN JUAN
CAPISTRANO, CALIFORNIA, HEREBY RESOLVES, FINDS AND DETERMINES AS
FOLLOWS:
1. That the foregoing recitals are true and correct and incorporated herein by this
reference.
2. That the undergoing a formal RFP/RFQ process at this time for street sweeping
services would not be the most cost-effective approach and is therefore waived for
this procurement.
3. That the City Manager or his designee is hereby authorized to directly contract with
Pacific Sweeping, on behalf of the City, for street sweeping services.
