Resolution Number 20-04-21-01RESOLUTION NO. 20-04-21-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN JUAN CAPISTRANO, CALIFORNIA, ADOPTING THE SAN JUAN CAPISTRANO LOCAL HAZARD MITIGATION PLAN AND REPEALING RESOLUTION NO. 04-11-16-02 WHEREAS, the City of San Juan Capistrano recognizes the threat that natural hazards pose to people and property within the community; and WHEREAS, undertaking hazard mitigation actions will reduce the potential for harm to people and property from future hazard occurrences; and WHEREAS, the U.S. Congress passed the Disaster Mitigation Act of 2000 ("Disaster Mitigation Act") emphasizing the need for pre -disaster mitigation of potential hazards; WHEREAS, the Disaster Mitigation Act makes hazard mitigation grants available to state and local governments; WHEREAS, an adopted Local Hazard Mitigation Plan is a requirement for certain funding for mitigation projects under multiple Federal Emergency Management Agency (FEMA) pre- and post -disaster mitigation grant programs; and WHEREAS, the City of San Juan Capistrano used the FEMA -prescribed process under 44 CFR §201.6 to prepare this local hazard mitigation plan; and WHEREAS, under the California Disaster Assistance Act, as amended by AB 2140, certain disaster funding is available to a local jurisdiction if such jurisdiction has adopted a local hazard mitigation plan into the safety element of its general plan; and WHEREAS, the City's Local Hazard Mitigation Plan meets all the statutory requirements of AB 2140 and AB 757. Once adopted by the City Council, the Local Hazard Mitigation Plan, including evacuation routes, shall be incorporated into the City's Emergency Operations Plan. WHEREAS, the California Office of Emergency Services and FEMA Region IX have reviewed and approved the City of San Juan Capistrano Local Hazard Mitigation Plan contingent upon the City Council adopting the Local Hazard Mitigation Plan; and WHEREAS, the City of San Juan Capistrano desires to reinforce its emergency planning efforts by formally adopting the Local Hazard Mitigation Plan and to comply with the funding eligibility requirements of the Disaster Mitigation Act; and WHEREAS, adoption of the Local Hazard Mitigation Plan by the City Council demonstrates the City of San Juan Capistrano's commitment to fulfilling the mitigation goals and objectives outlined in the Local Hazard Mitigation Plan; and 4/21/2020 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Juan Capistrano, California, adopts the City of San Juan Capistrano Local Hazard Mitigation Plan as an official plan; and, BE IT RESOLVED, that the City of San Juan Capistrano adopts the City of San Juan Capistrano Local Hazard Mitigation Plan; and, BE IT RESOLVED, the City of San Juan Capistrano will submit this adoption resolution to the California Office of Emergency Services and FEMA Region IX officials to enable the plan's final approval in accordance with the requirements of the Disaster Mitigation Act of 2000 and to establish conformance with the requirements of AB 2140 and AB 747; and, BE IT FURTHER RESOLVED that Resolution No. 04-11-16-02, which adopted the City's 2004 Natural Hazard Mitigation Plan, is hereby repealed.
