Qualified Bidders List for Professional Consultant Services for
Engineering, Building, Architectural, Plan Check, Archeological,
and Environmental Services
SUBJECT
RECOMMENDATION
1. Approve the proposed Qualified Bidders List for professional consultant services
for engineering, building, architectural, plan check, archeological, and
environmental services; and,
2. Authorize the City Manager to execute professional services agreements, on an
as-needed basis, with the firms included on the Qualified Bidders List, for
amounts not to exceed $45,000 per project.
EXECUT IVE SUMMARY
The City contracts with professional consultants to augment staff resources in the Public
Works, Utilities, and Development Services Departments. Support from specialized
consultants is often needed for development-related and/or capital improvement project
plan check, preparation of environmental documents, building plan check, capital
improvement project design, and other professional services on an as-needed basis.
Section Vll.B of the City's Purchasing Policy No. 126 (Attachment 1) provides for the
development of a pre-qualified list of bidders (i.e. professional consultants) to be
approved by the City Council at least every three years. The approved list is then
utilized by staff to efficiently solicit proposals from pre-qualified consultants to expedite
procurement of services.

The current Qualified Bidders List expires in December 2019. Consequently, staff
recently solicited statements of qualifications (SOQs) from professional firms and
received responses from 54 interested consultants. Staff reviewed all 54 SOQs
received and determined that all are qualified to be included in the City's new, proposed
Qualified Bidders List. Therefore, staff is recommending that the City Council approve
the proposed Qualified Bidders List, included as Attachment 2 to this report, for
professional consultant services for engineering, building, architectural, plan check,
archeological, and environmental services; and, authorize the City Manager to execute
professional services agreements, on an as-needed basis, with the firms included on
the Qualified Bidders List, for amounts not to exceed $45,000 per project.
DISCUSSION/ANALYSIS:
The City's use of a Qualified Bidders List began in 1992 and has proven to be a
successful tool in streamlining the procurement of services to supplement staff
resources. Every three years staff updates the Qualified Bidders List by soliciting SOQs
for professional services from a host of consultants. Respondents are then evaluated
by staff to determine qualifications, and a new list of qualified consultants are compiled
and brought to the City Councilfor approval.
This past October, staff issued a Request for Qualifications to 86 professional
consultants for engineering, building, architectural, plan check, archeological, and
environmental services. The Request for Qualifications is included as Attachment 3. Of
the 86 consultants, 54 provided SOQs, which were reviewed by staff using the following
criteria:

FISCAL IMPACT:
There is no fiscal impact associated with approving the proposed Qualified Bidders List
ENVIRONMENTAL IMPACT:
ln accordance with the California Environmental Quality Act (CEQA) the recommended
action is exempt from CEQA per Section 15061(bX3), the general rule that the CEQA
applies only to projects which have the potential for causing a significant effect on the
environment. Where it can be seen with certainty that there is no possibility that the
activity in question may have a significant effect on the environment, the activity is not

City Manager to execute professional services agreements on an as-needed basis
would not be activities with potential to cause significant effect on the environment, and
therefore are exempt from CEQA.

945 A. lntroduction to Bidding Procedures
Overview
This policy requires that certain bidding procedures be followed when purchasing goods,
supplies, equipment and materials; contracting for professional and maintenance
services; and contracting for non-public works and Public Works projects. The competitive
bidding process ensures that the City will obtain the best combination of pricing, quality,
service, and availability of products and services. Splitting a purchase to circumvent the
bidding limits is specifically prohibited by the City's Municipal Code and by State law.
The total dollar value of the goods, services, or projects determines whether formal or
informal bidding procedures must be followed, as shown below. ln certain instances,
bidding procedures may not be required.

The Contract Transmittal Form (See Appendix B) requires the identification of the project,
funding sources, contract type, insurance and bond requirements, and sets forth the
type(s) of publications required, including whether the City Clerk needs to publish a Notice
lnviting Formal Bids. ln some instances, the City Manager may require City Council
approval prior to advertising.
Documenting the Bid Process
Bidding procedures must always be documented. The originating department is
responsible for completing a Bid Recap form for all purchases and contracts of $3,000 or
more. The Bid Recap form identifies the vendors who have been contacted, the name of
the successful bidder, the amount of the contract, and the reason(s) for the successful
bidder's selection.

B. Qualified Bidder List
ln some instances it is in the best interest of the City to have current ongoing contracts
with multiple consultants for the same or very similar services (i.e. services that can be
defined as to scope of work but not as to required events such as contract planning
services, soils testing, contract building maintenance services, etc.). These services
would best be handled by establishing a qualified bidders list and by entering into an
ongoing professional services contract when the service is required.
There are generally three categories of contractors that are placed on the Qualified
Bidders List. The first is maintenance contractors that provide services with recurring
and usual work for the preservation or protection of any publicly owned or publicly
operated facility for its intended purposes. The second is professional service
contractors that are educated or licensed specialists who provide services of an advisory
nature and provide recommendations for a course of action, an end product, or the
transmittal of information. The third is qualified construction contractors who are
called upon through an informal bidding process to perform Public Works projects
pursuant to subdivision (b) of Section 22032 of the Public Contract Code (See Section Vl.
Paragraph E below for procedural guidance on the informal bidding process).
There shall be one Qualified Bidders List (vendor, consultant and/or contractor) for
ongoing service requirements related to professional services, maintenance services,
and Public Works projects, categorized by the type of product sold or work performed for
use in soliciting bids. A "qualified" bidder is a bidder that demonstrates the following
characteristics:
. Can provide product quality, fitness, and capacity for the required usage.o Has the ability, capacity and skill to perform the contract or provide the service
required.. Has demonstrated character, integrity, reputation, judgment, experience, and
efficiency, particularly with reference to past purchases by the Ci$ or other
public agencies.. Has the ability to perform within the time required.. Has shown quality of performance and/or of products provided in previous
contracts or services with the City or other public agencies.. Can meet all insurance requirements.
The process for selecting qualified bidders shall begin with an lnformal Solicitation
of Qualifications (SOO). Criteria required for the development of an SOQ can be
found in Section Vl, Paragraph C below. The City shall endeavor to obtain a
minimum of three SOQ's for the services required and qualified bidders shall be
added to the Qualified Bidders List based on acceptable qualifications.
Evaluating Bids: The DepartmenUDivision Head or designee(s) shall select the
consultants which, in their evaluation process, is the most qualified to perform the work.
The evaluation and selection process shall be based upon the following considerations:
1. General quality and responsiveness to the request, including but not limited to:. Responsiveness to the terms, conditions, and items of performance.
. Grasp of the problem, work to be performed, and approach to be used.

2. Organization and personnel making the proposal must provide:
. Evidence of good organizational and management practices.
¡ Qualification of the personnel.
o Specialized experience of the firm and its personnel relative to the required
services.o References who can be contacted to verify past record of performance (i.e.,
completion of a quality product in a timely manner and within budget constraints).. Previous consultant experience.o The financial condition of the firm.. Capacity of the firm to perform the subject project within a required timeframe.
3. lf appropriate, the price, in any of the following formats, may be consideredo Total price and price breakdown.o Price range.. Cost schedule.
The Qualified Bidders List shall be approved by the City Council at feast every three years.
All vendors on the Qualified Bidders List shall be reviewed and approved by the City
Manager on an annual basis. Professional Services Agreements (PSA) for qualified
bidders will not be executed until selected to perform a service. At that time, and through
the term of the contract, the terms of the PSA for the selected vendor will be controlling
for any subsequent projects undertaken by the same or different departments. PSA's can
be amended at any time and are subject to the signature authority limits indicated in this
policy. All contracts shall have a defined end date.
Fee recovery vendors on the Qualified Bidders list are for development projects paid by
developers (examples: outside ElR, plan check review). A specific fee recovery service
provider may be retained to perform services on other projects, provided that the
combined fees do not exceed $250,000 per project per fiscal year. The City Council
approves contracts with fee recovery vendors; however, within the scope of each
contract, Department Heads may approve services for up to $50,000 per project.
Non-fee recovery vendors on the list have no offsetting revenue from developers. A
specific non-fee service provider may be retained to perform services on other projects,
provided that the combined fees do not exceed $150,000 per department per fiscal year.
C. lnformal Solicitation of Qualifications (SOQ)
An SOQ refers to the process that establishes criteria for evaluating firms that request
placement on the City's Qualified Bidders List. Such firms must submit an SOQ setting
forth the qualifications of members of the firm and providing any other information
required by the announcement of the project or desired service. The DepartmenUDivision
shall strive to, whenever possible, solicit at least three qualifications/proposals in writing.
When it is not practical, nor cost effective, to receive three qualifications/proposals in
writing, the Department Head at his/her discretion, may choose the vendor best suited for
the needs of the particular project or service category.
A public notice shall be advertised on the City's website and in applicable publications to

for
PROFESSIONAL CONSULTING SERVICES
to
PERFORM ENGINEERING, BUILDING, ARCHITECTURAL SERVICES INCLUDING
PLAN CHECK, ARCHEOLOGICAL, AND ENVIRONMENTAL SERVICES
GENERAL INFORMATION
It is the intent of the City of San Juan Capistrano to establish a Qualified Bidders List of
professional consultants to facilitate efficient procurement of engineering, building, and
architectural services, including plan check, archaeological and environmental services,
for undefined small projects, up to $45,000 per project. The services are generally
described herein and are intended to supplement staffs efforts where specific expertise
is required, or time constraints necessitate consultant assistance. From the Statement
of Qualifications (SOQ), consultants will be selected which best represent expertise
within the various specialty areas. The list will become part of a three-year program.
Work will be contracted out on an as-needed basis, and no specific guarantee can be
given as to the anticipated annual fees or consultant usage. The services may also
include other temporary, in-house or field consulting work that might be required by
other City Departments.
The projects contemplated include, but will not be limited to, performance of engineering
and architectural design (along with the preparation of evaluation reports); including
architecture, plans, sketches and specifications for small scale new facilities or the
maintenance, repair, replacement of existing facilities, inspection, and miscellaneous
other archaeological services. Facilities contemplated include, but are not limited to,
structures, grading, streets, miscellaneous right-of-way, drainage facilities, domestic
and reclaimed water facilities, sewer lines and appurtenances, park and trail facilities,
as well as other engineering and building services as further defined in this document.
Also included are other related engineering services such as preliminary design reports,
traffic analysis, water treatment analysis, surveying, geotechnical evaluation,

groundwater modeling, completion of CEQA checklisildocuments, materials testing,
grant writing, grant compliance, plan checking and demolition and disposal plans.
The purpose of this Request for Qualifications (RFQ) is to develop a Qualified Bidders
List of professional consultants capable of performing as-needed work while facilitating
efficient procurement of their services. The consultants selected will be expected to
execute a sample professional services agreement (Attachment 1) and comply with the
terms of insurance; but not to perform any project-specific work unless authorized to do
so by staff.
INVITATION TO RESPOND
The City of San Juan Capistrano is soliciting SOQ's for professional consulting services.
ln general, the tasks identified above and described herein are to be performed with
minimum direction and assistance from the City.

Statements clearly indicating the services in which the firm is interested;
StatemenVdiscussion of services provided, including anticipated turnaround times
and ability of the firm to handle requests on an as-needed basis;

4. Consultant fee schedules to include hourly rates and flat fees (if any); and,

below (Consultant's Responsibility Section).
EVALUATION OF SOQ'S
The City of San Juan Capistrano is interested in selecting consultants who have the
experience and expertise to render design, inspection, and review services in a
comprehensive and timely manner. Accordingly, the evaluation criteria will consist
primarily of two parts:
1. Expertise2. Experience
It is important to the City that you identify the personnel that would be assigned to
various functions, from which office they are assigned, and whether they are full-time
employees of your firm. You should also address any potential conflicts of interest that
may exist.
CONSULTANT'S PONSIBILITY
The Consultant shall demonstrate the ability to perform professional services related to
the tasks as set forth in the three main categories below:
A. Buildinq Services
Review construction documents in accordance with the following uniform
model codes as amended by City ordinance:
a. Uniform Building Code - Latest adopted California Building Code
b. Uniform Plumbing Code - Latest adopted California Plumbing Code
c. Uniform Mechanical Code - Latest adopted California Mechanical Code
d. National Electrical Code - Latest adopted Edition
e. California Code of Regulations - Title 24
f. California Electrical Code - Latest Adopted Edition
Provide a comprehensive plan review as directed or provide only specified
plan review elements as follows:
a. Structural review and analysis of design and calculations
b. Structural design (bridges)
b. lnspection services
c. Other building services as may be defined
Provide geotechnical review and consultation regarding soils reports,
geotechnical issues, features and remediation.

4. Provide building and code enforcement inspection services.

Provide comprehensive plan review or design services as directed for the

g. Sewer improvements
h. Landscaping improvements

Provide field monitoring (including Native American Monitor) for construction
projects in compliance with City Council Policy 601.
Prepare and submit a historic resource or paleontological report as prescribed
in City Council Policy 601.

D. DocumentTransmittal
Pick up and resubmit plans to the City via the Building or Public Works and
Planning counter.
E. Performance Requirements
1. Plan Check Services
Render and remit a plan check correction/clarification list (two hard copies
and one electronic) redlined version of plans (one hard copy and one
electronic) to the Public Works and Utilities Department within 10 working
days from notification by the City.
2. Engineering/Architectural Services
Complete services in a thorough and efficient manner, on time and within the
approved fee schedule.
F. Fee Schedules
1. Consultant Fees
a. Plan Check and Design/Architectural
Services will be negotiated on a project-by-project basis based on a pre-
agreed upon scope of work. Payment will be determined by the City's
project manager.
The consultant shall bill on an hourly basis, shall not to exceed 75% of the
total fee collected for specific services, and fees may be negotiated lower
if, in the determination of the City, a lower fee is warranted.
2. Buildinq Fees
Plan Check Fee: 65% of Permit Fee
Additional plan review required by changes, additions, or revisions to
approved plans: Hourly $86.93
3. Other Services
Services will be negotiated on a project-by-project basis based on a pre-
agreed upon scope of work. Payment will be determined by the City's
project manager.

G. Maintenance of Records
The consultant will maintain all books, documents, papers, employee time sheets,
account¡ng records/ledgers and other evidence pertaining to costs incurred and shall
make such materials available at their respective offices at all reasonable times during
the contract period and for three years from the date of final payment for inspection by
the City. The consultant shall furnish copies, if requested.
CITY'S RESP
The City shall perform the tasks as set forth herein.
A. Establishment of Valuation (Plan Check Services Only)
Assign a valuation to the proposed work in accordance with the appropriate
Engineering or Building Division standards. The City shall collect all fees from the
applicant in connection with the services.
B. Project Submittals
City will supply all necessary documentation/specifications, reports, studies,
calculations, etc., to consultant as is readily available at the City.
C. Coordination
City will serve as project coordinator. On plan checking, the City will be
responsible for notifying the applicant when plans with corrections are available for
pick up. The City will route plans (preliminary/revised) to and from the Consultant.
Direct coordination with the applicant may be necessary for subsequent plan check
reviews.
SELECTION PROCESS
The City may select for contract negotiations the firm(s) that, in the City's judgment, will
best meet the City's needs, irrespective of the comparison of fee schedules presented
by the proposers. The City's consultant evaluation and selection process is based on
the following criteria.
a. Familiarity with the type and manner of work described.
b. Qualifications and experience of the Project Manager, Project Engineer, other
key individuals, and sub consultants. The City reserves the right to request a
change of Project Manager, or any member of the team, should it deem it
necessary. The consultant shall honor this request.
c. Results of reference checks.
d. Clarity of the SOQ.
e. Compliance with RFQ requirements.
f. Ability, capacity and skill to perform the contract or provide the service required.
Has demonstrated character, integrity, reputation, judgment, experience, and

efficiency, particularly with reference to past experience with the City or other
public agencies.
g. Ability to perform within the time required.
h. Has shown quality of performance and/or of products provided in previous
contracts or services with the City or other public agencies.
i. Can meet all insurance requirements
When a specific project is defined and consultant services are solicited from the City's
List of Qualified Bidders, the City will negotiate a professional services agreement with
the best-qualified firm at a compensation which City staff determines is fair and
reasonable. Should staff be unable to negotiate a satisfactory PSA with the selected
firm, negotiations with that firm will be formally suspended, and negotiations will be
undertaken with the next most qualified firm. Should City staff fail to reach an accord
with the second most qualified firm, the CITY will suspend negotiations formally and
continue the negotiation process with the next most qualified firms until an agreement is
reached.
